Draft Landscape Plan 2. Highway 96 Taskforce Documents Overview Recently, staff had the opportunity to meet with Jim Tolaas, Ramsey County Public Works, to discuss two upcoming County road improvement projects in Arden Hills. These two projects are discussed in further detail below. Hil!hwav 96 The County would like to begin reconstruction of Highway 96 from Lexington Avenue to just before Highway 10. In 1997, the City convened a Highway 96 Taskforce to provide input into the reconstruction. The Taskforce's recommendations are attached for your review along with the Council meeting minutes approving the Taskforce's recommendations. In anticipation of the reconstruction, the County would like the Council's input on the following issues: Trails The preliminary plans indicate a trail running east/west along the entire south side of Highway 96. This is consistent with the Comprehensive Plan and the recently adopted Park, Trails and Open Space Plan. The Taskforce has recommended an alternative route, however, that does not , Page 2 November 13, 2002 . appear to be feasible at this time. In addition, if the Council concurs, the County has indicated a willingness to install a trail on the north side of Highway 96 as well. From staffs perspective this would be advantageous as it would provide trail access to the Army Reserve Center, City Hall, the potential joint public works facility, and any potential future development along Highway 96. The Taskforce indicated that this issue should be evaluated if the reuse of TCAAP was imminent. Landscaping and Design The County will bid this project as two separate bids. The first bid will be for the reconstruction of the road. The second bid would be for landscape improvements. Based on the preliminary landscape plan submitted, the Council will note the following: · The base landscaping to be financed by the County includes clusters of ornamental and overstory trees. Any additional landscaping would be the City's expense. · All concrete medians will have colored pavement. This is included as a County cost as well. Natural median areas would utilize a low maintenance prairie grass style planting. Relative to the median ground cover, the Highway 96 Taskforce recommended the use of turf grass as opposed to the low maintenance prairie grass. While this is more expensive and requires . underground irrigation, the Taskforce felt this median treatment was more aesthetically pleasing. While the County would possibly finance the installation of turf grass, it would be the City's responsibility to finance the irrigation. The City would also be responsible for the ongoing maintenance responsibility. Staff is in the process of obtaining an estimate on the potential cost for the irrigation. Aside from the median treatment, the Taskforce also evaluated the potential use of decorative lights. When the recommendation was formulated, they recommended that additional streetlights not be installed. However, the Taskforce recommended evaluating this issue further if the development of TCAAP was imminent. For reference, decorative streetlights cost approximately $5,000 to $6,000 per light. Finally, the Taskforce also addressed the issue of gateway signage. If the Council wanted to proceed with this at Lexington Avenue, this could be done in conjunction with this project or at a later date. The Taskforce's recommendations are outlined on the attached document. Other Issues It should also be noted that the County will be making minor intersection improvements including the use of a double left turn when turning from west bound Highway 96 to south bound Hamline Avenue. This is currently only a single left. There will also be a dedicated right turn lane from north bound Hamline Avenue to eastbound Highway 96. If possible, the County . would like to begin construction in 2003. As such, they would like to have a preliminary discussion with the Council at this Work Session and possibly have a neighborhood meeting sometime in January. . . . Page 3 November 13,2002 Lexilll!ton Avenue Improvements Ramsey County is also preparing to reconstruct the portion of Lexington Avenue that extends from Victoria Avenue in Shoreview to Highway 96. This is anticipated to be a 2004 project. The Council will note the following: · The road will be expanded from two lanes to four lanes in both directions. · A signal will be installed at the intersection of Victoria and Lexington. This will be coordinated with the signal at Cummings Park Drive (currently Guidant Drive North). · In the past, residents from the Karth Lake neighborhood have indicated that they would like a signal at Amble. The County has indicated that this intersections does not warrant a signal. The County has indicated that they would provide turning lanes to Ambel. If the City was interested in having a light in this area it would be entirely the City's expense. This would cost approximately $300,000. · There will be a nominal increase in the amoUnt of impervious surface in conjunction with the reconstruction. Given the previously identified concerns with the Karth Lake water level, this issue will require further attention and discussion as the project proceeds. · The trail along Lexington in this area will be reconstructed at the County's expense. Since the project has not been engineered at this point, there are no drawings attached for reference. It is anticipated that a neighborhoo!f meeting will be held in the future once preliminary engineering for the project has been completed. ARDEN HILLS CITY HALL - PUBLIC WORKS LUNCHROOM I. CALL TO ORDER The meeting was officially called to order at 7:08 p.m. by Chair Tholen. 2. ROLL CALL Present were: Chair, John Tholen, Public Safety Commission; Chuck Stoddard, Finance Committee; Dave Sand, Planning Commission, Don Messerly, Parks and Recreation Committee; Lynn Lawyer, resident; Bill Sanders, Landscape Architect for Sanders, Wacker & Bergly Inc.; Dwayne Stafford, Public Works Superintendent; and Kevin Ringwald, Community Development Director. Absent was: MickRichardson, resident and Tom Andreasen, Business Development Cornmittee. 3. APPROVAL OF OCTOBER 7.1997 MINUTES The minutes of October 7, 1997 were unanimously approved as submitted after a motion by Stoddard and a second by Messerly. 4. REVIEW OF DESIGN FOR ENTRY WAY SIGNS Mr. Sanders reviewed the design of the entry way signs and stated that the cost per sign would be approximately $30,000. Mr. Sanders also reviewed how this concept could be used for secondary entry ways and also at the City's parks. The task force concluded that the proposed style of sign could be incorporated into other signage that the City may choose to build in the future. The task force concluded that in the future that further design studies could be done with these other signs to more fully refine their designs. The task force concluded the two entry way signs should be located along Highway 96. The first at the southwest corner of Highway 96 and Lexington Avenue. The second at the southeast corner of Highway 96 and Interstate 35W. The task force reviewed samples provided Mr. Sanders of various materials and colors which could be used for the sign and the retaining walls. In regards to the sign face, the task force concluded that a monolithic cast stone (8 inches wide) in a light gray with recessed black letters would be most aesthetically pleasing. The task force also concluded that an "anti-graffiti" coating should be applied to the sign. The cost of this coating is estimated at $.10 per square foot every three years. 7fr- ) 5. ~~) c 6. The task force discussed the aesthetics of these different fonts, based on that the City Council would be discussing this topic at its upcoming worksession. To this end, the task force recommends that the City consider using Windsor font on the entry way signage. . The task force then reviewed various materials and colors for the retaining walls which would support the entry way signs. The task force concluded that cut stone pieces of granite, which is a waste product of the manufacturing process, would look like a "dry-fit" limestone wall but with more quality for approxirnately the same price. The task force concluded that the rainbow colored granite would be most aesthetically pleasing. The task force also suggested that at-grade lighting be provided behind the retaining walls to provide directional lighting at the sign face. REVIEW CONCEPT DESIGN FOR MEDIAN LANDSCAPING Mr. Sanders provided a concept design for the median landscaping along Highway 96. The concept groups the overs tory landscaping that is proposed by Ramsey County for inclusion in the median. The concept would add accent ornamental trees at the ends of these groups with low level shrubs beneath the ornamental trees. . The task force discussed the relative advantages and disadvantages of a high (turf) and a low (native grasses) maintenance ground cover in the median. The provision of a high maintenance ground cover would require underground irrigation (approximately $50,000) and weekly mowing. However, the high maintenance ground cover would provide for a very aesthetically pleasing median. The provision of a low maintenance median would be more cost effective, but would provide for an unkept look to the median. The task force recommends that the City Council include the turf with underground irrigation the preferred ground cover for the median. FORMULATE RECOMMENDA nONS FOR CITY COUNCIL CONSIDERA nON The task force then summarized various findings that they had made since April of 1997. The task force would recommend that if the redevelopment of the City Hall site does not require the use of the median cut (in front of Public Works driveway), then the median cut be relocated to Keithson Drive, which is at the top of the hill and has the potential for expansion into the Reiling property. D. Noise wall. The task force does not recommend the provision of a noise wall, but would recommend the provision of additionallandscapinglberming by Ramsey County in those residential areas (ie., Arden Manor Mobile Home Park) in which residents are directly adjacent to the roadway and do not have the proper building setback. e.((~ C) () E. Lighting. Given. that redevelopment of the TCAAP is not imminent and that directional underground boring (for the wiring) is becoming more cost effective so that underground electrical conduit does not need to be installed at this time for these potential future street lights. The task force recommends that the no additional lighting above that which is being proposed by Ramsey County be provided along the corridor. However, the task force would recommend that if development of the TCAAP is irnrninent, then this item be reviewed at that time. . . F. Regional Trail. The task force does not recommend the provision of the regional trail as proposed by Ramsey County. The task force recommends that the regional trail stay on the south side of Highway 96 until North Snelling Avenue. The trail then should proceed south onthe west side of North Snel!ing Avenue and cross over Highway 10, via abridge, in the vicinity of Royal Hills Park, then proceed west hugging Round Lake where possible and proceed over Interstate 35W utilizing the existing railroad bridge to gain access to the Long Lake Regional Park. G. Sidewalk (north. side). Given that redevelopmenLofthe TCAAP is not imminent, the task force does not recommend the inclusion of a sidewalk on the north side of Highway 96. However, the task force would recommend that if development of the TCAAP is imminent, then this item be reviewed at that time to deterrnine the appropriate location for trails/sidewalks within the TCAAP. . 7. He stated if it is determined the existing blacktop is too thin, as suggested by Mr. Linders, the project can be removed or slated for the future. '\ ! Councilmember Malone stated this is the hearing where the Council determines if the engineer should proceed with project plans which will include borings. He concurred that ifit makes no sense to overlay Glenpaul Avenue it can be removed from the Project. CouncilmemberMalone commented on the clay soil in Arden Hills which results in some problems with roadway cracking. MOTION: Malcllle moveci and Hicks seconded a motion to adopt Resolution #97-59, Authorizingthe Preparation of Detailed Plans and Specifications in the Matter of the 1998 Street Improvement Project. Highway 96 Improvement Project, Task Force Recommendations Mr. Kevin Ringwald, Community Development Director, introduced John Tholen, Chair ofthe Highway.96 Task Force, who was in attendance to present their recommendations related to Highway 96. He also introduced John Sanders, landscape architect for this project. ) DRAFT ARDEN HILLS CITY COUNCIL - DECEMBER 8. 1997 7 Mr. John Tholen, Chair of the Highway 96 Task Force, explained this Task Force was . created by the Council on April II, 1997 to provide the City with a series of recommendations on the reconstruction of Highway 96 so the recommendations could be forwarded to Ramsey County while the Arden Hills' portion of the project is still in the design phase. He reviewed the membership of the committee and advised that their first recommendation is that two entryway signs be located along Highway 96, the first at the southwest comer of Highway 96 and Lexington Avenue. The second entryway sign would be located at the southeast comer of Highway 96 and Interstate 35W. Bill Sanders of Sanders, Wacker, and Bergly, project landscape architect, reviewed a colored sketch of the proposed signs and landscape design including grading, location of evergreen trees, and flowers. He explained the need to raise the elevation to improve the visibility of the sign. Mayor Probst suggested Ramsey County be asked to do some of this grading prior to their completion of the project. He also stated he understands the County proposes to place the signal control box on this corner. Mr. Tholen stated they have requested this signal box be relocated on the Reserve Center property. Councilmember Malone asked if the estimate is $32,000 per sign. Mr. Sanders stated this is correct, is an estimated cost, and does not include landscaping. He reviewed the types of materials to be used for the sign. . Mr. Tholen reviewed his discussion with the Reserve Center and Ramsey County to provide trees, fill, and to seed the property. Mr. Sanders explained that the sign on the southeast corner ofl-35W would be of the same design but the landscaping may be different. Councilmember Malone asked what the City of Shoreview sign will look like. Mr. Tholen stated it is approximately 85 feet long and ten feet high. Mr. Tholen reviewed the Task Force recommendation for the inclusion of turf with underground irrigation and the addition of ornamental trees at the ends of these tree groups. They recommend no additional lighting be installed at this time since the redevelopment of TCAAP is not imminent. The Task Force would recommend that if development of the TCAAP property is imminent, then this item be reviewed at that time. Mayor Probst inquired regarding the lighting costs. Mr. Brown estimated $3,000 per fixture without wiring. He recommended placing conduit under the cross section streets and driveways since the County will pay for it. Mr. Tholen stated the Task Force does not recommend the provision of a regional trail as proposed by Ramsey County and recommends the regional trail stay on the south side of . Highway 96 until North Snelling Avenue. Councilmember Malone expressed concern with the cost estimate for the signs and stated he would have a difficult time voting to support it. Mr. Tholen stated this corner is currently an eyesore and it would be appropriate to have a nicely landscaped corner with a City sign. Councilmember Malone stated he believes there may be an alternate, creative way to handle this at a lower cost. He stated he supports the recommendation with regard to the median cut, berm, . trails, and sidewalk. Councilmember Malone asked how far apart Shoreview's lights are. Mr. Bro\',TI stated they are about 300 feet on center per side, or 150 feet apart (zig zag). Councilrnember Malone stated ifhe had to prioritize the issues of the sign, landscaping, and lights, he would support the lights. Mr. Tholen stated the Task Force considered lighting as more of a future improvement. Mayor Probst stated it would be nice to find a way to reduce the cost of the sign but he believes there is value in such a City sign and, perhaps, it is a matter oftiming this project. He stated he supports a sign project that looks nice, will be there for a long time, and something the City can be proud of. He expressed concern with the proposed size of the Shoreview sign. Mayor Probst stated he is grateful to the Task Force for their work and believes their recommendations are "on target." He cornmented that an irrigation system will allow proper maintenance of the sign area. Mayor Probst stated he also concurs with the Task Force recommendation to not consider a noise wall. Councilmember Aplikowski stated she supports all of the recommendations, including the sign. However, she has some apprehension about the irrigation but would support it over lighting. B. 1997 Street Improvements (Valley Paving), Pay Estimate #2 Mr. Stafford explained that the Council is asked to approve Pay Estimate #2 to Valley Paving, Inc. in the amount of $186,000 for the 1997 Street Improvements. He explained that Valley Paving, Inc. was the low bidder for this project at $383,143.75 and awarded the project. Due to less than anticipated quantity amounts in some areas, the final project cost was $370,990.08. Mr. Stafford stated that $179,558.03'has been paid, leaving a balance of $191,432.05. He noted the memorandum from Terry Mauer, Howard R. Green Company, recommending approval ofthe final payment subject to a retainage. Mr. Stafford recommended a retainage of$5,432.05 be held and paid upon completion of the punch list items and receipt of appropriate documentation. Mayor Probst asked if the proposed retainage amount will be adequate to assure completion. Mr. Stafford reviewed the types of work remaining and stated he is confident the proposed retainage will cover those costs. Mr. Fritsinger advised that Staff did review the remaining work items to assure the proposed retainage is adequate to cornplete the work. . Council member Hicks asked if there is other work remaining beyond the turf restoration. Mr. Stafford stated there is and reviewed the items, which were all low-cost corrections. MOTION: Hicks moved and Aplikowski seconded a motion to approve payment of Pay Estimate #2 to Valley Paving, Inc. in the amount of$186,000 for 1997 Street Improvements subjectto a retainage in the amount of$5,432.05 to be paid upon completion of punch list items and receipt of necessary documents. Planning Case #96-23, Extension of Approval, Pilgrim House Unitarian Church 1212 West Highway 96 Mr. Fritsinger explained that the Council is asked to approve an extension of the approval of Planning Case #96-23 until January 2, 1999. The applicant has not yet pulled the building permit for this project, but has indicated they intend to do so in the Spring of 1998. MOTION: . Overview Ramsey County is requesting that the City evaluate a proposed park master plan amendment to the Rice Creek North Regional Trail Master Plan. In particular, it is necessary for the City to make a finding that the proposed park plan amendment is consistent with the Arden Hills Comprehensive Plan. Analvsis Since the amendment was only received Wednesday November 13'\ 2002, a complete analysis of the proposed amendment cannot be provided. However, staff would make the following comments: 1. Land Use: The Future Land Use Plan identifies this area Park Preserve. This land use category includes natural and scenic areas that are to be preserved for public use. This is consistent with the proposed amendment. 2. Parks and Trails: The recently adopted Parks, Trails, and Open Space Plan calls for a slightly different configuration for the trail. Transportation: The Comprehensive Plan indicates the following relative to transportation on the TCAAP property: The TCAAP area will have a Minor Arterial road that will run through the entire developable area. It will be constructed as development occurs. The City will initiate discussions with Ramsey County on whether this road should be part of the County system, and if so. what the design standards should be. Connections to Highway 96. Highway 10, and I-35Wvia County Road 1I will be apart of the Minor Arterial system. Collector and local streets will be constructed with development as appropriate for the associated land uses. The planned amount of development in TCAAP is decreased in the updated land use plan from the 1981 plan. reducing both local and regional traffic impacts. (Arden Hills Comprehensive Plan. Page 79) This is outlined on the attached transportation map taken from the Comprehensive Plan. Ramsey County Parks has indicated that they do not want a street through the wildlife corridor area. As such, this leaves no access to the 66 acre primer tracer area effectively landlocking this piece of property. The proposed amendment indicates that access from County Road I would be preferable from Ramsey County Park's perspective. However, this requires going through property currently under license by the National Guard. At . this point, they have not indicated that they are willing to make this commitment. Additionally, we do not have the benefit of detailed traffic and planning analysis to determine whether the north/south connection contemplated in the Comprehensive Plan is necessary or not. Minimally, any approval should be conditioned on receiving some type of access from County Road I to the primer tracer area. 4. Public Safety: Expanding on the transportation and traffic issues above, it would seem logical that fire protection to the TCAAP site would be provided by the Fire Station on County Road I. Taking away the north/south connection to the balance of the TCAAP property would require fire vehicles to drive south on Lexington and then west on Highway 96, or drive east on County Road I and south on I-35W. Needless to say, neither are practical solutions. 5. Evaluation: The Council may wish to consider how this particular request is evaluated. Since it is addressing issues within the Comprehensive Plan, the Council may wish to have the Planning Commission provide comment and/or a recommendation. Since there are park issues involved, the Council may wish to solicit feedback from the Parks, Trails, and Recreation Committee. PROPOSED AMENDMENT TO THE RICE CREEK NORTH REGIONAL TRAIL MASTER PLAN The following amendment to the Rice Creek North Regional Trail Master Plan (June 1998) has been prepared and is being proposed by the Ramsey County Parks and Recreation Department. Acquisition of the land included in the proposed amendment will preserve a corridor which links the Rice Creek corridor with the 1500-acre preserve under the management of the Minnesota National Guard. The corridor will preserve a hydrological and wildlife movement functions, as well as future trail connections to the large preserve. The property is currently part of the Twin Cities Army Ammunition Plant (TCMP) and an "Excessing Process" has been initiated to dispose of the property. Amendment to Section VIII ACQUISITION DETAILS A. Parcel Information The 1998 Master Plan identified two parcels for acquisition; Parcel A, 113 acres from TCAAP and Parcel B, 11 acres from MnDOT. (See enclosed Boundary Map). 1. Amendment Action: This amendment proposes that the acquisition boundary for the regional trail corridor be expanded to include an additional 49 acres of TCAAP property. The property has been identified as Parcel C and Parcel D. Parcel C: U.S. Dept. of Defense, 42.75 acres Parcel D: U.S. Dept. of Defense, 6.25 acres 2. Amendment Justification: The proposed amendment will enable Ramsey County to acquire an important natural corridor between the existing boundary of the regional trail and the large nature preserve managed by the Minnesota National Guard. Preservation of the wildlife corridor is consistent with the 1996 "Vision for the Future" plan (a.k.a. Vento Reuse Plan) adopted by the TCMP Reutilization Committee appointed by the late Congressman Bruce Vento. The Minnesota Department of Natural Resources (DNR) has identified the wildlife corridor as an integral ecological link between Rice Creek on the west and a future regional park reserve on the east. In addition to its local ecological significance, the DNR believes that the wildlife corridor is a key link to two regionally significant ecological corridors - the Mississippi River and the St. Croix River corridors. The additional area has been identified as two separate parcels. Parcel D has contamination which must be cleaned up prior to a transfer to Ramsey County. (See map). Parcel C is free of contamination and could be transferred as soon as the excessing process is complete. 3. Restoration/Development: The area contains several small buildings, roads and a railroad spur. The buildings will be removed within five years. It is anticipated that the roads and railroad will be removed in conjunction and cooperation with . development of the properties to the north and south. The city of Arden Hills has expressed concem about future road access to the adjacent 66-acre "Primer- Tracer" site. To maintain the integrity of the wildlife corridor, road access to this site should be provided from the north off County Road I and follow the west boundary of the property licensed to the Minnesota National Guard. The area of contamination (Parcel D) will be remediated by the U.S. Department of Army in accordance with the standards agreed upon by the Army and the Environmental Protection Agency. Activities are underway to cleanup contaminants on the site. In the event that the site is not suitable for public access, fencing the site may be necessary. Fencing should be installed in a manner that allows for animal movement under the fence. Restoration of the natural drainage corridor and vegetation will be accomplished by Ramsey County. All restoration activities will utilize native plant material and be coordinated with the Minnesota National Guard to assure consistency throughout the corridor. The only recreational development anticipated will be a future trail connection between the Rice Creek corridor and the Minnesota National Guard property. This trail connection will be subject to agreements for use of the National Guard property for trail uses such as Nordic skiing. The property will be available for informal, non- consumptive outdoor recreation activities such as nature study and birding. . Scope of 2003 PMP 2003 General Fund Balance Impact: $0 The earlier adopted proposed budget only reflected the reconstruction costs associated with the Ingerson neighborhood and did not reflect the proposed mill and overlay project within the Karth Lake neighborhood ($191,275) and the HamJine/Snelling neighborhood seal coating project ($47,880). This $239,155 expenditure increase in the street maintenance department of the General Fund is entirely offset by an increased operating transfer in from the PIR Fund (from $285,000 to $524,155). Ramsey County Sheriff Contract Cost 2003 General Fund Balance Impact: ($7,468) At the time the proposed budget was being assembled, an estimate was used for the impact of the DARE program being terminated. Insurance Benefits to Regular Part-Time Employees. 2003 General Fund Balance Impact: ($509) Extending prorated health/dental insurance benefits is now estimated to have an $2,544 impact on the 2003 budget - of which $509 will be in the General Fund and $2,035 in the Enterprise Funds. . B. City Paid Life/STD/LTD Benefits Costs. 2003 General Fund Balance Impact: ($4,390) A new account number (#1310) has been created to capture City paid life, short-term disability (STD), and long-term disability (LTD) insurance benefit costs for Administrative and Operations and Maintenance (O&M) employees. Although these benefit costs have been City paid for full-time administrative employees - only base STD costs were City-paid until a 2001 labor union settlement included base life insurance and LTD for O&M employees. The estimated 2003 total cost of these benefits is $7,725 of which $4,390 will be in the General Fund and $3,335 in other funds. Recreation Fund Scope of Services 2003 General Fund Balance Impact: ($1,425) The elementary school track program has been removed. The impact is a $7,960 reduction in revenue and expenditures from $150,695 to $142,735. The impact of incorporating the changes referenced earlier in this memo would result in a ($13,171) deficit. There are several options of solving this proposed budget deficit situation. These options may include the following: A. Reduce the transfer to Public Safety Capital Fund No. 412 from the earlier $15,000 to $0. B. Reduce the operating transfer to Municipal Land and Buildings Fund No. 408 from the earlier $183,750 to $170,000. C. Based on a conversation between the Administrator and the GSA, it was indicated that the Army has formally declared portions of TCAAP as surplus. The GSA has begun the process to determine if the property is surplus of the entire federal government's needs. The McKinney screening for homeless uses has also begun. Staff will keep the Council updated via e-mail or memo regarding the status of any Federal interest. To indicate Arden Hills interest in possibly acquiring the property through an early transfer, the Development Team has suggested that we send a letter of interest to the GSA and Army. A draft letter is attached for your reference. · Staff had the regularly scheduled Development Team meeting on Tuesday November 12, 2002. The meeting focused on discussion of the Ramsey County Master Plan Amendment and the Public Works facility. Both of these items will be discussed in more detail at the Council mceting. The next Development Team meeting will take place on November 26th, 2002. · The Advisory Panel will have a kick off meeting on Tuesday November 19, 2002. The meeting will begin at 6:30 and be held at Arden Hills City Hall. Draft Letter to GSA and Army Date Army GSA RE: Twin Cities Army Ammunition Plant Dear GSNArmy: The City of Arden Hills has engaged in discussions with representatives ofthe Department of the Army and the General Services Administration concerning the future of Twin Cities Army Ammunition Plant (TCAAP), an inactive military industrial facility adjacent to the City. It is our understanding that the Army wishes to dispose of the property and that the General Services Administration is the property disposal agent. The City of Arden Hills is interested in obtaining title to TCAAP. Portions of the property are contaminated and the Army will be responsible for the remediation ofthe contamination. The normal disposal process of contaminated federal property involves the satisfaction ofthe provisions of Title 42, United States Code, section 9620(h)(3), which requires that the United States provide a covenant to the transferee warranting that all action necessary for the protection of human health and the environment has been taken prior to transfer. However, if certain assurances and protections can be provided, as specified in section 9620(h)(3)(C) of the above cited statute, the United States is allowed to defer the warranty and transfer title before remediation is completed. The deferral in this case must be approved by the Govemor of the State of Minnesota. Given the intended development ofTCAAP and the ability to incorporate remediation and site preparation for development into one process, the deferral of the statutory covenant appears to be appropriate. Further, the response action assurances required for deferral have been considered and do not present an impediment to the City's intended plans. Each group has been appointed by the City Council. The Planning Commission aUdits' members are appointed on an annual basis. The Chair position has been held by Mr. David Sand for the last three years. The members are: David Sand, Clayton Zimmerman, Ken Bezdicek, Megan Ricke, Cathy Smithknecht and Terri Duchenes. At this time, only Terri Duchenes has indicated she will not seek reappointment as a Planning Commissioner. As you know, we already have one vacancy on the PC. A notice has been placed in the paper that will advertise these two vacancies. The Website also lists the vacancies and provides for application. If the council would like to interview candidates, this could be arranged for the December 16, 2002 Council Work session. The Parks, Trails and Recreation Committee expanded from 7 members to as many as 10 members at one time. Through attrition, the PTRC is now at 8 members. Current members are: Don Messerly, Roberta Thompson, Jim Crassweller, Cindy Garretson, Bill Henry, Pat Krenn, and Louis Speggen .The Chair is Rich Straumann. He has been Chair for the last two (2) years. All members of the PTRC have indicated a desire to be reappointed. The Communications Committee consists of: Mary Nosek, Elwood Caldwell, Brenda Holden, Fran Holmes and Sue Schroeder. Sue Schroeder is the Chair and Mary Nosek is the Publisher. This Committee has been reappointed without change on an annual basis. The Ramsey County Public Works Task force is a combination of members from the Operations and Finance Committee, Planning Commission and Council and staff liaisons. The charge of this Task force is to assist the city in looking at the Joint use Public Works facility with Ramsey County. The work is very specific and the timeframe well defined. Most members have appreciated having a well defined task with a specified time frame. When the Council makes its' Memo City Council Committees & Appointments 2 . final decision on this issue, the Task Force can be eliminated. The Operations and Finance Committee suspended their meetings while this subgroup has been looking at the facility issue. Comments from this group indicate they would either like something specific to work on or not be scheduled to meet until or unless there were something for them to do. The Websile Task Force has met infrequently over the last year. However, they have provided assistance in reviewing the Technology Policy and the Technology Master Plan before presentation to the Council. Current members are: Craig Wilson, Roger Aiken, Tom McCallum and Joe Turgeon. It has been mentioned that perhaps the city should look at a combination Communications/Technology group to assist the city in its' many communications forms, newsletter, newspaper, Website and Cable TV. This group could be responsible for the preparation of information that could be displayed over all of these various media outlets. As well, perhaps the city should consider a monthly cable television program about the city. We currently take in more money in our Franchise fee that we expend in a year for cable TV progranuning. Recommendation: Staff recommends that the Council reappoint all of the members of the Planning Commission and Parks, Trails and Recreation Committee that have expressed a desire to return to those positions. Council should also direct staff to advertise for two openings on the Planning . Commission and plan for interviews of candidates at the December 16, 2002 coUncil Work sessIOn. Staff further recommends that council reappoint all of the members of the Communications Committee and Website Task Force with the direction that the two groups have a joint meeting to discuss the possibility of a Joint Committee. Planning Commission The following Planning Commissioners have indicated a desire to be reappointed in 2003: 1. Dave Sand, Chair 2. Clayton Zinunerman, Vice Chair 3. Ken Bezdicek 4. Megan Ricke 5. Cathy Smithknecht Terri Duchenes has indicated that she will not be seeking reappointment to the Commission. Taken in conjunction with the passing of Brad Lemberg, that leaves two vacancies assuming all of the current Commissioners are reappointed. A notice advertising these vacancies will appear in the upcoming edition of Arden Hills Notes. Notice will appear in the Bulletin and on the Website as well. An application deadline has been set for December 6th. If the Council was inclined to interview candidates, this could be done at the December 16th Work Session. Website Taskforce Since the website has bcen established, the role of the Website Taskforce has been somewhat limited. However, they have provided important insight into the creation of a City Technology Policy, Technology Master Plan, and miscellaneous website issues as they arise. Since the Page 2 November 13,2002 website is really just another conununication tool, a possible alternative to having a standing taskforce would be to incorporate Website Taskforce's responsibilities into the Conununications Conunittee. Further, at the staff level, we have discussed the enhancement of our cable television production and programming. This may be another facet of City communications that could be incorporated into the scope of the Communications Conunittee. In addition, this would be particularly helpful if we were to pursue a regularly scheduled "Arden Hills Conununity Update" type of program. . . . . . . ~ ~HILLS MEMORANDUM DATE: Work Session Agenda Item 4. B November 14, 2002 TO: Mayor and City Council FROM: Joe Lynch, City Administrator SUBJECT: Minnesota Army National Guar MnARNG Ouerations Facilitv The Minnesota Army National guard is planning to construct a 92,000 sq. ft. Operations and Maintenance facility on their licensed property, in close proximity to the Ramsey County Public Works facility. Based on preVious conversations with Ramsey County representatives and National Guard representative, the assertion has been that this facility would be located directly north of the Ramsey County property. When Ramsey County proceeded to hire and direct an engineering and survey company to determine boundary lines and take soil samples, they were told by National Guard representatives to survey and take soil borings of the property inunediately west of the Ramsey county property. This was a surprise to Ramsey County, the National Guard representative and to the city. Discussions Staff contacted Co!. Dennis Lord of the MnARNG to determine if this was indeed true and to understand why it seemed contrary to earlier belief. Co!. Lord indicated that Gen. Gene Andreotti had determined that the facility should go west of the Ramsey county building and it was a final decision. Co!. Lord did indicated that he was still open to talking about the location of the building but, he did not know if Gen. Andreotti was in favor of discussion about it. As you know, the city has been unable to talk directly to Gen. Andreotti about this and other concerns with regard to the division of land at TCAAP. Staff contacted the Dept. of Army to determine who had the final say in where the MnARNG could place any buildings on licensed property. The representative told me that the Dept. of Army did not tell the MnARNG where they could or could not place buildings but, they did express concern that the MnARNG discuss these types of issue with the local unit of government before doing so. As you know, the MnARNG is not subject to our Zoning Ordinance or planning process. Memo City Council MnARNG facility 2 . Issues Staff has identified several issue for the Council to consider about the potential location of the MnARNG facility west ofthe Ramsey County building. . The Vento Plan calls for this property to be redeveloped as Residential · This was property that the city might consider in asking the Guard if it is willing to swap property for the Primer Tracer area, property previously identified as needed by the Guard · Extension ofa public roadway from the extension of Hamline Ave. · Multiple access points along Highway 96- it would be easier for the Guard to get to a controlled access point at the extension ofN. Snelling Ave- in addition 0 the one at Hamline Ave for Ramsey County · Visible and visual impact on a Gateway into the City of Arden Hills ' · Extension of industrial property use along Hwy 96, further impacting existing Arden Hills property and neighborhoods Options Council needs to consider the position of the city on this issue. This clearly is a different use . than specified in the Vento Plan. Options to consider are: · Do nothing and allow the Ramsey CountylNational Guard shared use to proceed forward without comment · Contact the MnARng and request a meeting with Co!. Lord, Gen. Andreotti, and Ramsey County representatives to understand the need for the building and operation to be along Hwy 96 · Contact Rep. McCollum and ask her to set up a meeting with the MnARNG to make our concerns known and ask for her assistance with the Guard. Time is of the essence. Ramsey County wants to bring forward a plan to present at a neighborhood meeting in January, with an application to appear before the Planning Commission and Council in February. They would like to know ifthis is going to impact their plan and use. . No. Putting the garage 10 feet from the property line will cause us to lose the use of 1/2 of our back yard and make us relocate our existing driveway. This is true of all of the ndghbors on our street as well as the surrounding streets. 2. Would granted the variance be in keeping with the spirit and intent of the City's Yes. If our garage was attached we could be 5 feet from the property line. Our original garage was 3 feet from the property line which most of the garages in the neighborhood are. 3. Could the property in question be put to a reasonable use without the granting of the variance? No. We would have to rebuild the garage in the middle of our back yard which would result in making the garage out of proportion to our house. This will also cause our driveway to be at a odd angle. This could affect the resale value of our house as well as the whole look of the neighborhood. 4. Was the hardship created by the owner? No. The garage and a portion of our house was destroyed by a fire. The orginal garage was 3 feet from the property line. 5. Would granting the variance alter the essential character of the neighborhood? No. Not granting the variance would alter the character of the neighborhood as the garage would be out of proportion to the neighbors as most of the garages are 3 feet from the property line not 10 feet. Construction of the garage would leave approximately 78% ofthe lot as landscape area. Variance Criteria Building permit #2036 for a detached garage was approved by the City Building Inspector on August 22, 1950. Recently, the garage was destroyed by fire and the current property owner hired a contractor to demolish the destroyed garage and rebuild it. A demolition permit was granted by the Building Inspector on September 3, 2002. However, the applicant was unaware that a new garage would be rcquired to meet the current setbacks in the Zoning Code due to the garage being a non-conforming building and that the garage was damaged by more than 50% so it could not be repaired. The applicant is seeking a variance to locate a new garage in approximately the same location as the one that was destroyed. A. State Requirements . . . . A variance or variances may be granted from specific provisions of this ordinance because such land factors as length of a side of a lot, the shape of the lot or the unusual terrain prohibit reasonable development equivalent to that which would be permitted without variance on a similar size lot located in the same district, but which lot has no unusual configuration. Economic conditions alone shall not be grounds for a variance. In no case shall the granting of a variance impair the hcalth, safety, comfort and general welfare of the public, nor will it be contrary to the intent and purpose ofthe Comprehensive Plan, the official map or this or any other ordinance of the City." Variance Findinl!s Minnesota State Stature 462.357, subd. 6, requires that Cities consider the following five matters when hearing requests for zoning ordinance variances. 1. Are the circumstances for which the variance is requested unique to the property? No. The lot is only 75 feet wide, narrower than the minimum width of85 feet for a lot in the R-2 District. Furthermore, the house is centrally located on the lot with setbacks of 18 feet to the west and 18.5 feet to the east. Due to the location of the house on the lot, placing a garage 10 feet from the interior side property line could potentially cause accessibility problems for cars attempting to utilize the garage and would require relocation of part of the driveway. However, there are approximately ten other properties in the area which would experience the same difficulties accessing their garage if forced to build at the required side yard interior setback often feet. Therefore, the circumstances are not necessarily unique to the property but could be contained to a relatively small nurnber of properties within the city. Memo to Planning Commission Planning Case #02-31 Page 4 of6 2. Would granting the variance be in keeping with the spirit and intent ofthe City's Zoning Ordinance? . Yes. Currently the Zoning Ordinance allows principal structures to be set back as close as five feet from interior side yards. Ifthe garage were attached to the building it could be constructed five feet from the interior side property line. The interior side setback requirement appears to be a mistake in the Zoning Ordinance. Therefore it appears that granting the variance would be consistent with the spirit and intent of the Zoning Ordinance. 3. Could the property in question be put to a reasonable use without the granting of the variance? No. If the variance were not granted the applicant would have to either: build the proposed garage at the required side yard interior setback often feet, relocate a portion ofthe driveway to the east to accommodate the new location ofthe garage, and experience difficulties accessing the eastern half of the garage; or the applicant could build a garage at the far northwestern corner of the property thereby decreasing the angle necessary to access either side of the garagc. Constructing a garage at the northwest corner of the lot would require the applicant to travel 45 feet from rear of her home to enter the garage versus traveling 15 feet from the rear of the applicant's home to the proposed location. A garage in this location would also result in a larger portion ofthe yard being . covered by the driveway and thereby reducing the usable size of the applicant's rear yard. While the distance would serve as a large inconvenience to the applicant, the property could still be put to a reasonable use in that it could contain the house and garage while meeting the current setback requirements. That noted; staff recognizes that the applicant is merely attempting to replace a garage which was destroyed by fire. Locating the replacement garage at five feet to the east or in the northwest corner of the lot would require removal of a portion of the driveway and pouring of some additional driveway to accommodate either new location. Even after these changes are made and the new garage location has met the setback requirements; the applicant would suffer either difficulty in accessing the garage due to the sharp angle, or inconvenience in having to travel 45 feet from the garage to the house. In this light, the alternate locations due not seem reasonable for development of a garage on this lot. 4. Was the hardship created by the owner? No. The garage that was demolished due to fire damage was constructed by a previous owner conditional approval based on consent of the neighboring property owner to build closer to the lot line. Building Permit #2036 shows that the original garage built in 1950 was approved on condition that the neighboring property owner had to approve the reduced setback of 3 feet from the side yard interior property line. The applicant is requesting the variance to place the garage . . . . Memo to Planning Conunission Planning Case #02-31 Page 5 of6 in approximately the same location as the garage that was destroyed by a fire. The current owner was also not involved with the construction or placement of the house, which due to its location, could cause problems for vehicles attempting to access the eastern half of the garage ifthe garage were constructed at the required side yard interior setback. 5. Would granting the variance alter the essential character of the neighborhood? No. The effect of the garage should not alter the character ofthis neighborhood. Furthermore, the Zoning Ordinance allows principal buildings and attached garages to be constructed at the distance the applicant is requesting. 6. Is the variance requested the minimum variance necessary? Yes. The variance of five feet will allow the applicant to construct the garage five feet from the west property line and prevent the applicant from having to relocate a portion of their driveway. Deadline for Al!encv Actions The City of Arden Hills received the completed application for this request on October 28, 2002. Pursuant to Minnesota State Statue, the city must act on this request by December 27, 2002 (60 days), unless the City provides the petitioner with written reasons for an additional 60 day review period. The city may with the petitioner's consent extend the review period beyond the 120 days. Options I. Recommend approval as submitted. 2. Reconunend approval with conditions. 3.
