Extract of Minutes of Meeting
of City Council
City of Arden Hills
Ramsey County, Minnesota
August 25, 1986
Pursuant to due call and notice thereof, a regular meeting
of the City Council of the City of Arden Hills, Minnesota, was
duly held at the City Hall in said City on Monday, August 25,
1986, commencing at 7:34 o'clock p.m.
The following members of the Council were present: Mayor
Woodburn and Council members Hicks, Hansen and Peck.
Council
member Sather was absent.
Also in attendance were Assistant City Attorney Plunkett,
Engineer Peters, Public Works Supervisor Raddatz, Deputy Clerk
Zehm and Clerk-Administrator McNiesh.
The Council was referred to a letter from Northdale
Construction Company, Inc., dated August 18, 1986, requesting
return of its bid bond and release from its contractual
obligations with respect to Combined Improvement Nos. SS-83-6 and
W-86-2
(New Brighton Interceptor and Truhler Water), the
"Improvement". Engineer Peters pointed out that the Metropolitan
Council had authorized a budget revision and the Metropolitan
Waste Control Commission had awarded a bid on its sanitary
sewer/interceptor project.
The Council then focused on the Arden Tower (Vaughan) and
Naegele easement problems and Attorney Lynden's letters with
respect thereto, dated respectively August 14 and 21, 1986. The
Council discussed the possible deferment of the Improvement until
the required easements were obtained. Engineer Peters noted that
temporary provisions would have to be made to serve Edgewater
.
Estates with sewer, water and road access.
He noted that the
gravel access road to the apartment building would be lost when
the sewer/water project goes ahead and that these temporary
measures will add to project costs.
Supervisor Raddatz reported that the lift station would
need repairs soon. He indicated that the station does overflow
at times but would probably run for another year--hopefully
without repair.
He stated that his department had made some
control repairs at the station last year. After discussion, the
Council concurred that the City should not proceed with the
Improvement.
Accordingly, Council member Hicks introduced and
moved the adoption of the following Resolution:
RESOLUTION NO, 86-41
RESOLUTION REPEALING AWARD OF BID FOR
COMBINED IMPROVEMENT NOS. SS-83-6 AND W-86-2
(NEW BRIGHTON INTERCEPTOR AND TRUHLER WATER)
WHEREAS, the City has been unable to obtain satisfactory
easements
from Naegele Outdoor Advertising Company,
Inc.
("Naegele") and Arden Tower, a limited partnership, in order to
facilitate construction of Combined Improvement Nos. SS-83-6 and
W-86-2,
New Brighton Interceptor and Truhler Water
(the
"Improvement"), and
. WHEREAS, the City's securing such easements was a prime
~ condition precedent, set forth in Paragraph I of Amended
Resolution No. 86-36, which has not been fulfilled, and
WHEREAS, by letter dated August 18, 1986, the contractor
to whom the City had awarded a contract to perform the Improve-

ment--Northdale Construction Company, Inc. --requested return of
its bid bond and release from its contractual obligations to
~ perform the work implementing the Improvement,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ARDEN HILLS, MINNESOTA THAT Amended Resolution No. 86-36
be and it hereby is in all respects repealed and of no further
force and effect, and the City proceed no further with the
Improvement unless and until the City has obtained easements from
Naegele and Arden Tower and has rebid the Improvement.
The motion for the adoption of the foregoing Resolution
was duly seconded by Council member Peck and, upon vote being
taken thereon, the following voted in favor thereof: Al11 and
the following voted against the same~

Resolution was declared duly passed and adopted.

hereby certify that I have carefully compared the attached and
foregoing extract of minutes of a regular meeting of the City
Council of said City held on the 25th day of August, 1986 with
the original thereof on file in my office, and the same is a
full, true and complete transcript thereof insofar as the same
relates to the proposed Combined Improvement Nos. SS-83-6 and
W-86-2 (New Brighton Interceptor and Truhler Water).
