Extract of Minutes of Meeting
of City Council
City of Arden Hills
Ramsey, County, Minnesota
August 11, 1986
Pursuant to due call and notice thereof, the City Council
of the City of Arden Hills met in regular session at the City
Hall on Monday, August ll, 1986, at 7:30 o'clock p.m.
The following members of the Council were present: Mayor
Woodburn and Council members Hicks, Hansen, Peck and Sather. In
addition, Engineer Christoffersen, Planner Miller, Public Works
Supervisor Raddatz, Deputy Clerk Zehm, and Clerk-Administrator
McNiesh were also present.
Toward the end of the meeting, during the Clerk-
Administrator I s portion of the agenda, McNiesh reported that
under new statute regulations, the City must notify affected
citizens and publish notices of public hearing before placing
special assessments on taxes for delinquent utility bills,
diseased tree removal, and the Roseville water connection. After
limited discussion,

introduced the
following Resolution and moved its adoption:
RESOLUTION NO. 86-39
RESOLUTION SCHEDULING PUBLIC HEARING ON
SPECIAL ASSESSMENTS FOR DELINQUENT
UTILITY BILLS, DISEASED TREE REMOVAL,
AND ROSEVILLE WATER CONNECTION
WHEREAS, Chapter 473 of the 1986 Session Laws modifies the
statutorily mandated procedures for giving notice of special
assessments effective April 2, 1986, and

WHEREAS, failure to comply with that law could jeopardize
the validity of an assessment, and
WHEREAS, that law now requires that mailed notice be sent
to the property owner which sets forth certain required
information including the amount of the assessment against the
particular parcel of land owned by the owner, sets forth new
requirements for the published notice of such assessments, and
repeals the former requirement that the published notice contain
the entire assessment roll, and
WHEREAS, under the new law, hence, the City must notify--
by mailed and published notice--property owners who have failed
to pay water and sewer bills, have had diseased trees removed
from their properties, and/or have had their properties connected
to the Roseville water system,
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF ARDEN HILLS, MINNESOTA THAT the Council meet at
the City Hall, 1450 West Highway 96, in the City on September 8,
1986 at 8:30 o'clock p.m. for the purpose of holding a public
hearing to adopt and confirm special assessments for delinquent
utility bills, diseased tree removal, and the Roseville water
connection.
BE IT FURTHER RESOLVED THAT the Clerk-Administrator be
authorized and directed to cause notice of the time, place and
purpose of said public hearing to be published in the official
newspaper of the City, the New Brighton Bulletin, in the manner
specified in Chapter 473 of 1986 Session Laws and to be mailed to
affected property owners in the manner specified in that Law,

which notices shall be substantially in the forms attached hereto
as Exhibits "A-I" and "A-2" for delinquent water and sewer bills,
"B-I" and "B-2" for diseased tree removal, and "C-l" and "C-2"
for the Roseville water connection.
The motion for the adoption of the foregoing Resolution
was duly seconded by Council member Peck and, upon vote being
taken thereon, the following voted in favor thereof: All; and
the following voted against the same:
None; whereupon said
Resolution was declared duly passed and adopted.

full, true and complete transcript thereof insofar as the same
relates to the matter of establishing and confirming special

FOR DELINQUENT UTILITY BILLS
NOTICE IS HEREBY GIVEN that the Council of the City of Arden Hills.
Minnesota (the "City"), will meet in the Council Chambers of the City
Hall, 1450 West Highway 96, in the City of Arden Hills, on Monday,
September 8, 1986, at 8:30 o'clock p.m., to hear, consider and pass upon
any and all written or oral objections which may be offered with respect
to the proposed special assessments for delinquent utility bills. The
proposed assessment roll is now on file and open to public inspection by
all persons interested in the office of the City's Clerk-Administrator.
The special assessments proposed to be levied by the Council consist
of delinquent sewer and water bills which the property owners responsible
for them have not paid for sewer and water service provided to their
properties by the City.
The total amount of the overall proposed assessment is $40,526.48.
The area proposed to be assessed for said sewer and water service
consists of the entirety of the City (i.e. all of the parcels of land
located within its boundaries).
Oral or written objections will be considered at the hearing. No
appeal may be taken as to the amount of any assessment unless a signed,
written objection is filed with the Clerk-Administrator prior to the
hearing or presented to the presiding officer at the hearing.
An owner may appeal an assessment to district court pursuant to
Section 429.081 of Minnesota Statutes, as amended, by serving written
notice of the appeal upon the Mayor or Clerk-Administrator of the City
within thirty (30) days after the adoption of the assessment and filing
such notice with the district court within ten (10) days after said
service upon the Mayor or Clerk-Administrator.
The City has no ordinances or resolutions allowing for the deferment
of special assessment paYments.

to the proposed special assessments for diseased tree removal. The
proposed assessment roll is now on file and open to public inspection by
all persons interested in the office of the City's Clerk-Administrator.
The general nature of the improvement for which the assessments are to
be levied is the City's removal of diseased trees on the properties to be
assessed.
The total amount of the overall proposed assessment is $2,216.67.
The area proposed to be assessed for said improvement consists of the
entirety of the City (i.e. all of the parcels of land located within its
boundaries).
Oral or written objections will be considered at the hearing. No
appeal may be taken as to the amount of any assessment unless a signed,
written objection is filed with the Clerk-Administrator prior to the
hearing or presented to the presiding officer at the hearing.

NOTICE IS HEREBY GIVEN that the Council of the City of Arden Hills,
Minnesota (the "City"), will meet in the Council Chambers of the Clty
Hall, 1450 West Highway 96, in the City of Arden Hills, on Monday,
September 8, 1986, at 8:35 o'clock p.m., to hear, consider and pass upon
any and all written or oral objections which may be offered with respect
to the proposed special assessments for the Roseville water connection.
The proposed assessment roll is now on file and open to public inspection
by all persons interested in the office of the City's Clerk-Administrator.
The general nature of the improvement for which the assessments are to
be levied is the connection of the properties to be assessed to the
Roseville water system.
The total amount of the overall proposed assessment is $113.92.

prepay the whole or at least fifty percent (50%) of such assess-
ment to the City Treasurer with no interest being charged upon
such payment if timely made.
The amount specially assessed against the Parcel shall be
payable--unless prepaid as provided in the previous paragraph
hereof--in two (2) semi-annual installments, due on May 15 and
October IS, 1987, along with general taxes levied against the
Parcel in 1986 and collectible therewith during the year 1987 in
such semi-annual installments. Interest at eight percent (8%)
shall be added to the above amount when certified to the County
for collection with general taxes.
