Extract of Minutes of Meeting
of City Council
City of Arden Hills
Ramsey County, Minnesota
August 11, 1986
Pursuant to due call and notice thereof, a regular meeting
of the City Council of the City of Arden Hills, Minnesota, was
duly held at the City Hall in said City on Monday, August 11,
1986, commencing at 7:30 o'clock p.m.
The following members of the Council were present: Mayor
Woodburn and Council members Hicks, Hansen, Peck and Sather.
Also in attendance were Clerk-Administrator McNiesh,
Deputy Clerk Zehm, Public Works Supervisor Raddatz, Planner
Miller and Engineer Christoffersen.
The Council was referred to Clerk-Administrator MCNiesh's
memorandum of August 11, 1986 advising that easements have not as
yet been obtained from Naegele Outdoor Advertising Company, Inc.
and Arden Tower for Combined Improvement Nos. SS-83-6 and W-86-2.
As a consequence, Council member Hicks moved, seconded by Council
member Sather, that the Council reconsider Resolution No. 86-36,
RESOLUTION AWARDING BID FOR COMBINED IMPROVEMENT NOS. SS-83-6 AND
W-86-2 (NEW BRIGHTON INTERCEPTOR AND TRUHLER WATER). This motion
carried unanimously.
In discussion, Engineer Christoffersen noted that the
preconstruction meeting had been scheduled for the next day,
August 12, 1986, and that Northdale Construction Company, the
contractor, was counting on the work. He reported that although
it was known that some easements would be needed, the actual

layout of the improvement was not known until recently having
... been realigned at the request of Naegele when Naegele decided not
to pursue the Truhler Addition plat.
After further discussion, Council member Hansen introduced
and moved the adoption of the following Resolution:
AMENDED RESOLUTION NO. 86-36
RESOLUTION AWARDING BID FOR
COMBINED IMPROVEMENT NOS. SS-83-6 AND W-86-2
(NEW BRIGHTON INTERCEPTOR AND TRUHLER WATER)
WHEREAS, pursuant to Advertisement for Bids for Combined
Improvement Nos. SS-83-6 and W-86-2, New Brighton Interceptor and
Truhler Water (the "Improvement"), according to the plans and
specifications (the "Plans") therefor on file in the office of
the Clerk-Administrator in the City, bids were received on
May 29, 1986 at 2:00 o'clock p.m., opened and tabulated according
to law, and the bids were received in compliance with the
Advertisement, and
WHEREAS, it appears that Northdale Construction Company
("Northdale") is the lowest responsible bidder at the tabulated
price of $443,738.90, and
WHEREAS, implementation of the Improvement is contingent

upon the Metro Waste Control Commission awarding a bid for its
sanitary sewer/interceptor project, and
WHEREAS, the Council desires not to obligate the City to a
contractual arrangement with Northdale unless and until it has
obtained easements from Naegele Outdoor Advertising Company, Inc.
and Arden Tower, a limited partnership,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ARDEN HILLS, MINNESOTA THAT:
1. Northda1e Construction Company be awarded the
right to construct the Improvement subject,
however, to the Metropolitan Council's prior
authorization of a budget revision and the
subsequent award by the Metropolitan Waste
Control Commission of a contract for its
sanitary sewer/interceptor project and the
City's obtaining easements from Naegele Outdoor
Advertising Company, Inc. and Arden Tower, a
limited partnership;
2.
The City
authorized

3. Subject to fulfillment of the conditions in
Paragraph 1 hereof, the Mayor and Clerk-
Administrator of the City be authorized and
directed to enter into a contract--in the name
of the City--with Northdale Construction
Company for its performance of all of the work
embodied in the Improvement for the sum of
$443,738.90 which work shall be done in
accordance with the Plans therefor heretofore
approved by the City Council (in Resolution No.
86-22 adopted by the Council on April 28, 1986)
and on file in the office of the Clerk-
Administrator;
4. The Clerk-Administrator be authorized and
directed to return f~rthwith to all bidders the
deposits made with their bids except that the
deposits of Northdale Construction Company, the
successful bidder, and the next lowest bidder
shall be retained until contracts have been
signed; and
5. This Amended Resolution No. 86-36 supplants in
its entirety Resolution No. 86-36 which shall
be of no further force and effect.

The motion for the adoption of the foregoing Resolution
was duly seconded by Council member Hicks and, upon vote being
taken thereon, the following voted in favor thereof: All; and
the following voted against the same:
None; whereupon said
Resolution was declared duly passed and adopted.

Clerk-Administrator of the City of Arden Hills, Minnesota, do
hereby certify that I have carefully compared the attached and
foregoing extract of minutes of a regular meeting of the City
Council of said City held on the 11th day of August, 1986 with
the original thereof on file in my office, and the same is a
full, true and complete transcript thereof insofar as the same
relates to the proposed Combined Improvement Nos. SS-83-6 and
W-86-2 (New Brighton Interceptor and Truhler Water).
