". 7tc; 6"5":- J ~A fs-- .,1" <f/~ Extract of Minutes of Meeting of City Council City of Arden Hills Ramsey County, Minnesota August 12, 1985 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Arden Hills, Minnesota, was duly held at the City Hall in said City on Monday, August 12, 1985, commencing at 7:30 o'clock p.m. The following members of the Council were present: Mayor Woodburn and Council members Sather, Peck, Hansen and Hicks; and the following were absent: None. Also in attendance were Engineer Christoffersen, Treasurer Lamb, Planner Miller, Clerk-Administrator McNiesh, Deputy Clerk Zehm, and Public Works Supervisor Raddatz. City Engineer Christoffersen referred the Council to his letter of August 9, 1985 regarding Hamline Avenue Improvement 85-1, Phase I, which covers the addition of fill surcharge to that segment of Hamline Avenue running from Floral Drive on the south to State Trunk Highway No. 96 and the tabulation of bids received by August 7, 1985. Engineer Christoffersen noted that approval of the bid award should be subject to approval of the plans by the State of Minnesota. He indicated that, to date, formal approval had not as yet been received from the State. After discussion, Council member Hansen introduced and moved the adoption of the following resolution: , ." . . RESOLUTION NO. 85-34A RESOLUTION AWARDING BID FOR HAMLINE AVENUE IMPROVEMENT 85-1, PHASE I (SURCHARGING HAMLINE AVENUE BETWEEN FLORAL DRIVE AND STATE TRUNK HIGHWAY NO. 96) WHEREAS, pursuant to advertisement for bids for Hamline A enue Improvement 85-1, Phase I (Surcharging Hamline Avenue b tween Floral Drive and State Trunk Highway No. 96), the "mprovement", according to the plans and specifications (the " lans") therefor on file in the office of the Clerk- A inistrator in the City, bids were received on August 7, 1985 a 2:00 o'clock p.m., opened and tabulated according to law, and t e bids set forth on the tabulation attached hereto and made a p rt hereof as Exhibit "A" were received in compliance with the a vertisement, and WHEREAS, it appears that C. W. Houle, Inc. is the lowest r sponsible bidder at the tabulated price of $90,279.75, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE C TY OF ARDEN HILLS, MINNESOTA THAT: 1. C. W. Houle, Inc. be awarded the right to construct the Improvement subject, however, to its executing a contract with the City and subject to approval of the Plans for the Improvement by the Minnesota Department of Transportation ("MnDOT") 1 2. After MnDOT has approved the Plans, the Mayor and Clerk-Administrator of the City be authorized and directed to enter into a contract with C. W. Houle, Inc. for $90,279.75 in the name of the City of Arden Hills for the Improvement according to the Plans therefor heretofore approved by the City Council (in Resolution No. 85-26 adopted by the Council on July 8, 1985) and on file in the office of the Clerk-Administrator 1 and - 2 - ./ ,"l . . . 3. The Clerk-Administrator be authorized and directed to return forthwith to all bidders the deposits made with their bids except that the deposits of C. W. Houle, Inc., the successful bidder, and the next lowest bidder shall be retained until contracts have been signed. The motion for the adoption of the foregoing resolution as duly seconded by Councilman Peck and, upon vote being taken thereon, the following voted in favor thereof: All; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. WHEREAS, the Clerk-Administrator has presented to the Council the proposed assessment rolls prepared by her with the assistance of the City Consul~ing Engineer, as directed by the Council on August 12, 1985, for Improvements SS WP ST 84-1, SS WP ST 84-2 and SS WP ST 84-3 and has reported that the assessment rolls are now on file in her office and open to public inspection. NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City of Arden Hills that the proposed assessment rolls now on file and open to public inspection in the office of the Clerk-Administrator are approved and the Clerk-Adminstrator is directed to publish and mail notices that the Council will meet to consider the proposed assessments on September 9, 1985 at the City Hall, 1450 West Highway 96 in the City of Arden Hills, at 7:30 o'clock P.M. which assessment hearings will be held on the following improvements: SS WP ST 84-1 SS WP ST 84-2 SS WP ST 84-3 BE IT FURTHER RESOLVED, that each notice shall state the date, time and place of the meeting, the general nature of each of the improvements, the areas proposed to be assessed, the total costs of the improvements, that the proposed assessment rolls are on file with the Clerk-Administrator, and that written or oral objections thereto by any property owner will be considered. The notices shall be published in the official newspaper of the City at least once, and shall be mailed to the owners of each parcel described in the assessment rolls not less than two weeks prior to the.date of said meeting. For the purpose of such mailed notices, owners of said parcels shall be those shown as such on the records of the County Treasurer. Every property owner whose name does not appear on such records (other than owners of property which is tax-exempt or is taxed on a gross earnings basis) shall be deemed to have waived such mailed notices unless he has requested in writing that the County Treasurer include his name on the records for this purpose.
