CITY OF ARDEN HILLS
RAMSEY COUNTY, MINNESOTA
RESOLUTION NO. 90-11
RESOLUTION VACATING EXCESS RIGHT-OF-WAY
WHEREAS, the City of Arden Hills and the Ramsey County Public
Works Department have determined excess road right-of-way exists
at the southwest corner of County Road E-2 and New Brighton Road;
and
WHEREAS, the excess road right-of-way is beyond what is required
to fulfill the requirements of the Ramsey County Major Street
Plan; and
WHEREAS, pursuant to Ramsey County Resolution No. 89-338, dated
April 11, 1989, the Ramsey County Board of Commissioners vacated
the County's interest in such excess road right-of-way and
released such excess road right-of-way to the City of Arden
Hills; and
WHEREAS, the City of Arden Hills has received a request to vacate
its interest in such excess road right-of-way so that the excess
road right-of-way may be utilized in connection with the
development of a single family residential dwelling; and
WHEREAS, the Arden Hills City Council has determined that it is
not in the public's interest to retain an interest is such excess
road right-of-way.
NOW THEREFORE BE IT FURTHER RESOLVED that the City of Arden Hills
vacates its interest in the excess road right-of-way herein
described as follows:
All that part of New Brighton Road and County Road E-2
contiguous to Lot 3, Rohleder's Home and Garden Acres,
Ramsey County, Minnesota described as follows:
Beginning at the Southeast corner of said lot 3;
thence northerly parallel with the east line of
said plat, 135.00 feet; thence northwesterly
deflecting left 45 degrees 00 minutes 00 seconds
28 feet to the easterly extension of the north
line of said lot 3; thence westerly along said
line 104.00 feet; thence southerly parallel with
the east line of said plat to a curve, said curve
being the northeasterly line of said lot 3; thence
easterly and southerly along said curve to the
point of beginning.

AND BE IT FURTHER RESOLVED that the City Administrator is hereby
authorized and directed to execute a Notice of Completion of
Vacation Proceeding, present it to the Ramsey County Auditor for
entry in the Transfer Record, and then record it in the office of
the Ramsey County Recorder in order to comply with the Vacation
Statute requirements.
Adopted by the Arden Hills Council this 12th day of March, 1990.
