A RESOLUTION ESTABLISHING DEVELOPMENT DISTRICT NO. 1 AND APPROVING AND ADOPTING THE DEVELOPMENT PROGRAM RELATING THERETO AND CREATING TAX INCREMENT FINANCING DISTRICTS NO. 1 AND NO. 2 AND APPROVING AND ADOPTING TAX INCREMENT FINANCING PLANS RELATING THERETO. BE IT RESOLVED by the City Council (the "Council") of the City of Arden Hills, Minrtesota (the "City"), as follows: Section 1. Recitals. 1.01. It has been proposed that the Council establish Development District No. 1 and approve and adopt a Development Program relating thereto, pursuant to and in accordance with Minnesota Statutes, Sections 469.124 to 469.134, inclusive, as amended and supplemented from time to time. 1.02. It has been further proposed that the Council create Tax Increment Financing Districts No. 1 and No. 2 and approve and adopt Tax Increment Financing Plans relating thereto, pursuant to Minnesota Statutes, Section 469.174 through 469.179, inclusive, as amended and supplemented from time to time. 1.03. The Council has caused to be prepared and has investigated the facts with respect thereto, a Development Program for Development District No. 1 and Tax Increment Financing Plans for Tax Increment Financing Districts No. 1 and No.2. .~ , 1.04. The Council has performed all actions required by law to be performed prior to the establishment of Development District No. 1 and the approval and adoption of the Development Program relating thereto, and to the creation of Tax Increment Financing Districts No. 1 and No. 2 and the approval and adoption of the Tax Increment Financing Plans relating thereto. . 1.05. The Council hereby determines that it is necessary and in the best interests of the City at this time to establish Development District No. 1 and to approve and adopt the Development Program relating thereto and to create Tax Increment Financing Districts No. 1 and No. 2 and to approve and adopt Tax Increment Financing Plans relating thereto. Section 2. Findinqs. 2.01. The Council hereby finds, determines and declares that the assistance to be provided through the adoption and implementation of the Development Program and Tax Increment Financing Plans are necessary to assure development and redevelopment of Development District No.1. 2.02. The Council hereby finds, determines and declares that the Development Program and Tax Increment Financing plans conform to the general plan for the development and redevelopment . of the City as a whole in that they are consistent with the City's comprehensive plan. 2.03. The Council hereby finds, determines and declares that the Development Program and Tax Increment Financing Plans afford maximum opportunity consistent with the sound needs of the City as a whole for the development and redevelopment of Development District No. 1 by private enterprise and it is contemplated that the development and redevelopment thereof will be carried out pursuant to redevelopment contracts with private developers. 2.04. The Council hereby finds, determines and declares that the establishment of Development District No. 1 and the creation of Tax Increment Financing Districts No. 1 and No. 2 and the approval and adoption of the Development Program and Tax Increment Financing Plans relating thereto by the City is intended and, in the judgement of this Council, its effect will be to promote the purposes and objectives specified in this Section 2 and otherwise promote certain public purposes and accomplish certain objectives as specified in the Development Program and Tax Increment Financing Plans. 2 . -~ .' 2.05. The Council hereby finds, determines and declares that proposed Tax Increment Financing Districts No. 1 and No. 2 constitute "tax increment financing districts" as defined in Minnesota statutes, Section 469.174, Subdivision 9, and further Tax Increment Financing District No. 1 constitutes a type of "economic district" and Tax Increment Financing District No. 2 constitutes a type of "redevelopment district" as defined in Minnesota Statutes, Section 469.174, Subdivisions 12 and 10. 2.06. The Council hereby finds, determines and declares that the proposed development or redevelopment in Tax Increment Financing Districts No. 1 and No.2, in the opinion of the Council, would not occur solely through private investment within the reasonably foreseeable future and, therefore, the use of the tax increment financing is deemed necessary. 2.07. The Council hereby finds, determines and declares that the City made the above findings stated in this Section 2 and has set forth the reasons and supporting facts for each determination in the Development Program and Tax Increment Financing Plans, and Exhibits A and B of this Resolution. Section 3. Approval of the Establishment of Development District No. l and the Approval and Adoptio~ of th~ Development PLUqram Relatinq Thereto. . 3.01. The establishment of Development District No.1 and the approval and adoption of the Development Program relating thereto are hereby approved and adopted by the Council of the City of Arden Hills. Section 4. Approval of the Creation of Tax Increment Financinq Districts No. l and No. ~ and the Approval and Adoption of the Tax Increment Financinq Plans Relatinq Thereto. 4.01. The creation of Tax Increment Financing Districts No. 1 and No. 2 of Development District No. 1 and the approval and adoption of the Tax Increment Financing Plans relating thereto are hereby approved and adopted by the Council of the City of Arden Hills. Section 5. Filinq of Plans. 6.01. Upon approval and adoption of the Development Program and Tax Increment Financing Plans (collectively the "Plans"), the Council shall cause said Plans to be filed with the Minnesota Department of Trade and Economic Development. . 3 ^- Adopted by the Council of the City of Arden Hills this 26th day of June, 1989. Finding that Tax Increment Financing District No.1 is an "economic district" as defined in Minnesota Statutes, Section 469.174, Subdivision 12. Tax Increment Financing District No. 1 consists of a parcel of land which qualifies as an economic district under Minnesota Statutes, Section 469.174, Subdivision 12. 2. Finding that the proposed development or redevelopment, in the opinion of the Council, would not occur solely through private investment within the reasonably foreseeable future and, therefore, the use of tax increment financing is deemed necessary. City staff has reviewed the available financing costs for the development including construction of the Round Lake Park and Trail. Due to the high costs of the public improvements, the project would not be financially feasible without the City's assistance. 3. Finding that the Tax Increment Financing Plan conforms to the general plan for the development or redevelopment of the municipality as a whole. The Planning Commission of the City of Arden Hills has reviewed the Tax Increment Financing Plan for Tax Increment Financing District No. 1 and has determined that the Tax Increment Financing Plan for Tax Increment Financing District No. 1 conforms to the comprehensive plan of the City. 4. Finding that the Tax Increment Financing Plan for Tax Increment Financing District No. 1 will afford maximum opportunity, consistent with the sound needs of the City as a whole for the development or redevelopment of Development District No. 1 by private enterprise. The project to be developed (apartments and townhouses) will be located within Tax Increment Financing District No. 1 and will consist of facilities to provide housing for residents of the City and the surrounding area. 5 , EXHIBIT B TO RESOLUTION NO. 89-41 . The reasons and facts supporting the findings for the Tax Increment Financing Plan for Tax Increment Financing District_ No. 2 as required pursuant to Minnesota Statutes, Section 469.175, Subdivision 3, are as follows: 1. Finding that Tax Increment Financing District No.2 is a "redevelopment district" as defined in Minnesota Statutes, Section 469.174, Subdivision 10. Tax Increment Financing District No. 2 consists of a parcel of land which qualifies as a redevelopment district under Minnesota Statutes, Section 469.174, Subdivision 10. 2. Finding that the proposed development or redevelopment, in the opinion of the Council, would not occur solely through private investment within the reasonably foreseeable future and, therefore, the use of tax increment financing is deemed necessary. City staff has reviewed the available financing costs for the development including land acquisition and road and bridge improvements. Due to the high costs of the public improvements, the project would not be financially feasible without the City's . assistance. 3. Finding that the Tax Increment Financing Plan conforms to the general plan for the development or redevelopment of the municipality as a whole. The Planning Commission of the City of Arden Hills has reviewed the Tax Increment Financing Plan for Tax Increment Financing District No. 2 and has determined that the Tax Increment Financing Plan for Tax Increment Financing District No. 2 conforms to the comprehensive plan of the City. 4. Finding that the Tax Increment Financing Plan for Tax Increment Financing District No. 2 will afford maximum opportunity, consistent with the sound needs of the City as a whole for the development or redevelopment of Development District No. 1 by private enterprise. The project to be developed (office, office/showroom, office/warehouse and miscellaneous business space) will be located within Tax Increment Financing District No. 2 and consist of facilities to provide manufacturing and office and will secure additional employment opportunities residents of the City and the surrounding area. will space for 6 .
