RESOLUTION NO. 88-..1!Q.
A Resolution Vacating a Portion of Utility and Drainage Easements Located
on Lot 9, Block 1, Karth Lake South Addition (1295 Wyncrest Court)
WHEREAS, the owners of Lot 9, Block 1, Karth Lake South Addition (the
"Lot"), the Jacobsens, desire that the CITY OF ARDEN HILLS (the "City")
vacate a portion of the drainage and utility easement which runs over and
across the North 25 feet of the Lot (the "Easement Area") so as to allow them
to construct a garage thereon, and
W-lIEREAS, the City Engineer has advised the Council that he sees no
reasons why the City should not vacate the South 15 feet of the Easement
Area except that part thereof which lies between the Easterly line of the
Easement Area and a line which is 10 feet Westerly thereof and parallel
thereto (the"Garage Strip") and therefore recommends that the City vacate
the Garage Strip, and
WHEREAS, the Rice Creek Watershed District has indicated in a letter
to the City, dated October 7,1988, that it has no authority over the Easement
Area since the easement was not granted to it, and
. WHEREAS, although two weeks' published and posted notice has been
provided in accordance with the requirements of Section 412.851 of
Minnesota Statutes (the "Vacation Statute"), and in addition written notice
has been mailed to property owners owning properties within a 350 foot
radius of the Lot, no one has stated any objections to the vacation of the
Garage Strip either in writing or verbally, and
WHEREAS, it thus appears to be in the public interest to vacate the
Garage Strip,
NOW, THEREFORE, BE rr HEREBY RESOLVED by the City Council of
the City that the Garage Strip be vacated.
BE IT FURTHER RESOLVED, that the Administrator of the City be
authorized and directed to execute a Notice of Completion of Vacation
Proceeding, present it to the Ramsey County Auditor for entry in the
Transfer Record, and then record it in the office of the Ramsey County
Recorder in order to comply with the requirements of the Vacation Statute.
Passed by the City Council of the City this 12th day of December, 1988.

NOTICE OF COMPLETION OF VACATION PROCEEDING
PLEASE TAKE NOTICE that the Arden Hills City Council has
completed the vacation--conducted in accordance with Section 412.851 of
Minnesota Statutes, as amended--of the following described portion of a
drainage and utility easement shown on the plat of KARTH LAKE SOUTH
ADDITION, to-wit:
The South 15 feet of the North 25 feet of Lot 9, Block 1, Karth
Lake South Addition, except that part thereof which lies
between the Easterly boundary line of said Lot 9 and a line 10
feet Westerly thereof and parallel thereto (the "Vacated Strip").
The CITY OF ARDEN HILLS, thus, has vacated its easement rights over
and across the Vacated Strip and has forever hereafter relinquished
ownership, control and possession of the Vacated Strip.

Such vacation was accomplished by the Arden Hills City Council's
adoption on December 12, 1988 of Resolution No. 88-40 ,entitled "A
Resolution Vacating a Portion of Utility and Drainage Easements Located
on Lot 9, Block 1, Karth Lake South Addition (1295 Wyncrest Court)", in
which the Council determined that it was in the public interest to vacate the
Vacated Strip. This Resolution was approved by a vote of at least four-fifths
(4/5ths) of the Council. A public hearing on the vacation was conducted by
the Council on October 24, 1988, commencing at 8:15 o'clock P.M. and
ending at 8:20 o'clock P.M.. pursuant to published notice thereof which
appeared in the legal newspaper of the City, the New Brighton Bulletin, on
October 10, 1988. Said notice was also posted at the City Hall and mailed to
affected property owners on the same date.
In all respects, the requirements of Section 412.851 of Minnesota
Statutes, as amended, have been observed.
