RESOLUTION NO. 87-43
RESOLUTION GRANTING KEM MILLING DIVISION OF DARLING AND COMPANY
A PERMIT FOR CONDUCTING A NONCONFORMING RENDERING
PLANT AND AFFIXING CERTAIN CONDITIONS AS TO
OPERATION THEREOF
WHEREAS, the City, on October 9, 1979, by Resolution No.
79-58, entered into an Agreement with Minneapolis Hide and Tallow Company,
granting said Company a permit for conducting the business of a
nonconforming rendering plant, upon certain conditions, at 619 N.E. 14th
St., Arden Hills, MN and,
WHEREAS, ownership of this facility has been assumed by Kem
Milling Division of Darling and Company (Darling-Delaware), from
Minneapolis Hide and Tallow Company;
WHEREAS, Kem Milling, a division of Darling and Company,
owns and operates a rendering plant located immediately east of Interstate
Highway No. 35-W and north of Interstate Highway No. 694 in the City of
Arden Hills which is a nonconforming use under the City's Zoning Ordinance
(Ordinance No. 99, as amended), and
WHEREAS, said rendering plant has a tendency to emit and
does from time to time emit odors which are offensive to the residential
neighborhood surrounding the grounds of said plant and sewage which may be
deleterious to the New Brighton sanitary sewer system and the Metropolitan
Sewer Disposal System, and
WHEREAS, said odor and waste emissions constitute both a
nuisance and potential health hazard to the public, and
WHEREAS, the City of Arden Hills is responsible for the
general health, welfare, safety and well-being of its citizens, and
WHEREAS, in order to carry out such responsibility, the City
Council of the City of Arden Hills passed Resolution No. 72-98 on December
11, 1972 which required any rendering plant within the City to obtain a
permit in order to conduct such operation and provided that the Council
may impose such regulations in the permit as it deems necessary, and
WHEREAS, the City Council is agreeable to issuing a permit
to Kem Milling, Division of Darling and Company, for the operation of said
rendering plant subject, however, to its compliance with the following
regulations or conditionst
NOW, THEREFORE, BE IT HEREBY RESOLVED, by the Arden Hills
City Council, that Kern Milling, Division of Darling and Company, be
granted a permit to operate a rendering plant at 619 N.E. 14th Street,

Arden Hills, Minnesota, subject to the following regulations and
conditions:
1. All doors and windows of the rendering plant shall be kept closed
during periods of operation so that all rendering plant air will
be processed through a scrubber or burned, except during periods
of loading and unloading when loading doors may be open but these
periods shall be kept to a minimum.
2. Kern Milling shall continue to perform all obligations required of
it by the terms of previous permits issued to it.
3. Any plugging or impairment of the operation of the New Brighton
sanitary or storm sewer system with grease will be considered
prima facia evidence that Sections 28-96 and 28-98 of the Arden
Hills Code, and Section 5-4A of Article V of the Sewage and Waste
Control Rules and Regulations for the Metropolitan Disposal
System have been and are being violated and that the right of
said rendering plant to use the City sewer system is thereby
immediately suspended. The amount of grease discharged into the
City sewer system shall be 100 mg. per liter or less. If the
City sanitary sewer system or a lift station wet well becomes
plugged as a result of the operations of the rendering plant, the
cost of cleaning shall be paid by the rendering plant making use
of that part of the sewer system that has become plugged.

Kem Milling shall be apprised that the City of Arden Hills will
continue to work with the Minnesota Pollution Control Agency and
the Metropolitan Waste Control Commission to assure that all
applicable rules, regulations and codes are being complied with.
5. Not less than two and at the City's discretion, up to four stack
tests shall be made each year and frequent inspections by the
City's health officer or such other officer as is from time to
time appointed by the City Council shall be conducted to assure
the City that Kem Milling is complying with the City's
requirements.
6. The permit shall be subject to the additional terms and
conditions set forth in the Agreement attached hereto and made a
part hereof as Exhibit "A" which Kem Milling shall execute as a
condition precedent to the permit's being in force and effect.
BE IT FURTHER RESOLVED, that the Clerk Administrator be
authorized to issue a permit to Kem Milling which incorporates the
foregoing regulations and conditions and which attaches thereto an
executed copy of Exhibit "A".

BE IT FURTHER RESOLVED, that violation of, or failure to
comply with, any of the foregoing regulations and conditions of the permit
shall be cause for suspension or revocation thereof, and such suspension
or revocation shall be considered by the City Council.
