"' CITY OF ARDEN HILLS RAMSEY COUNTY STATE OF MINNESOTA Councilmember adoption: Keirn introduced the following resolution and moved its RESOLUTION NO. 97-28 RESOLUTION MODIFYING DEVELOPMENT DISTRICT NO.1 AND ADOPTING THE MODIFICATION TO THE DEVELOPMENT PROGRAM THEREFOR; AND MODIFYING TAX INCREMENT FINANCING DISTRICTS NO'S. 1,2 AND 3 WITHIN DEVELOPMENT DISTRICT NO.1 AND ADOPTING RELATED MODIFICATIONS TO THE TAX INCREMENT FINANCING PLANS THEREFOR BE IT RESOLVED by the City Council (the "Council") of the City of Arden Hills, Minnesota (the "City"), as follows: Section 1. Recitals. 1.01 The City has heretofore established Development District No.1, and adopted the Development Program therefor and established Tax Increment Financing Districts No's. 1,2 and 3 and adopted the Tax Increment Financing Plans therefor. There is a proposal to allow for the spending of additional tax increments generated from Tax Increment Financing Districts No's. 1,2 and 3 for other housing and redevelopment related projects in Development District No.1, and to expand the boundaries of Development District No.1, 1.02 The Council has investigated the facts and has caused to be prepared a Modification to the Development Program for Development District No.1; and the Modifications to the Tax Increment Financing Plans for Tax Increment Financing Districts No's, 1,2 and 3; (collectively, the "Modifications") all pursuant to and in accordance with Minnesota Statutes, Sections 469,124 to 469.132, and 469.174 to 469.179, inclusive, as amended (the "Acts"); and 1.03 The City has performed all actions required by law to be performed prior to the adoption and approval of the proposed Modifications, including, but not limited to, notification of Ramsey County and School District No. 621 having taxing jurisdiction over the property in Tax Increment Financing Districts No's. 1,2 and 3, a review of and written comment on the Modifications by the City Planning Commission, and the holding of a public hearing upon published notice as required by law. i tC.r IJCI' ;;:, ' , 'r:' " I," '<' 1, . . . <,' Resolution No. 97-28 Page Two May 27, 1997 Section 2. Findings for Modifications. 2.01 The Council hereby finds that the Modifications are intended and, in the judgment of this Council, the affect of such actions will be, to provide an impetus for development and redevelopment in the public purpose and accomplish certain objectives as specified in the Modifications, which are hereby incorporated herein. 2.02 The Council is modifying the boundaries of Development District No.1 as described in the Modification to the Development Program. The Council is not modifying the boundaries of Tax Increment Financing Districts No's. 1,2 and 3. 2.03 The Council hereby reaffirms the findings previously made that Tax Increment Financing District No. I is an "Economic Development District"; that Tax Increment Financing District No.2 is a "Redevelopment District"; and that Tax Increment Financing District No.3 is a "Housing District"; all as defined in the Acts. 2.04 The Modifications conform in all respects to the requirements ofthe Acts; the Modifications conform to the general plan for the development or redevelopment of the municipality as a whole; the development and redevelopment proposal in the Modifications, in the opinion of the City, would not reasonably be expected to occur solely through private investment within the foreseeable future, and therefore the use oftax increment financing is deemed necessary; the Modifications conform to the general plan for development or redevelopment of the City as a whole; and will help fulfill a need to develop an area of the State which is already built up to provide employment opportunities to improve the tax base and to improve the general economy of the State, and will afford maximum opportunity, consistent with the sound needs for the City as a whole, for the development or redevelopment of the Development District by private enterprise in that the intent is to provide only that public assistance necessary to make the private developments financially feasible, Section 3. Approval of the Modifications: Filinl: 3.01 The Modifications, as presented to the Council on this date, including without limitation the findings and statements of objectives contained therein, are hereby approved, ratified, established, and adopted and shall be placed on file in the office of the City Administrator. Approval of the Modifications does not constitute approval of any project or a Development Agreement with any developer. . . . . . . . Resolution No. 97-28 Page Three May 27,1997 3.02 The staff ofthe City, the City's advisors and legal counsel are authorized and directed to proceed with the implementation of the Modifications and to negotiate, draft, prepare and present to this Council for its consideration all further plans, resolutions, documents and contracts necessary for this purpose. 3.03 The staff of the City are authorized to file the Modifications with the State Department of Revenue. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Aplikowski , and upon a vote being taken thereon, the following voted in favor thereof: Aplikowski, Hicks, Keirn, Malone and Probst and the following voted against the same: N/A PASSED AND ADOPTED BY THE CITY COUNCIL OF TH CITY OF ARDEN HILLS THIS 27TH DAY OF MAY, 1997.
