RESOLUTION 96-61
RESOLUTION VACATING A SANITARY SEWER EASEMENT
WHEREAS, the City of Arden Hills has been requested to vacate a portion of a 30 foot wide
sanitary sewer easement on a property in the Gateway Business District which is to be developed
pursuant to Planning Case 96-12, said easement being legally described as shown on Attachment
A; and
WHEREAS, the petition to vacate said easement was made by the affected property owners and
the City had caused a notice of public hearing to be published in the City's official newspaper for
two (2) consecutive weeks and the City has notified the affected property owner at least ten (10)
days prior to the public hearing; and
WHEREAS, the request to vacate was reviewed by the Planning Commission at a public hearing
on September 4, 1996 and approved by the City Council on September 30, 1996; and
WHEREAS, the City Council has determined that the identified portion of the easement
currently serves no public purpose,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Arden Hills,
Minnesota agrees to vacate said sanitary sewer easement, subject to the developer/applicant of
Planning Case #96-12 (Welsh Companies) constructing a new manhole at the end ofthe
remaining sanitary sewer line,

ATTACHMENT A
That part Easterly of Highway 35- W of the South 30 acres of the Northwest 1/4 of Section 21,
Township 30, Range 23 except the West 884 thereof and except the following: Beginning at the
point on the South line of said 30 acres, 2033.0 feet East of the Southwest corner thereof; thence
East to the Southeast corner thereof; thence North to the Northeast corner thereof; thence West
along the North line of said 30 acres to a point 1768.0 feet East of the Northwest corner thereof;
thence South 28 degrees 41' East 559,7 feet more or less to the point of beginning, except part
deeded to State of Minnesota in Book "1729" RCR Page 988 and Book "2033" RCR Page 528.
The centerline of said 30 foot perpetual sanitary sewer easement over and across the
aforedescribed tract of land being described as follows: Commencing at the Northeast corner of
the aforedescribed tract ofland; thence run West along the North line of said tract 208.5 feet to
the point of beginning; thence deflect to the left 88 degrees for 275 feet and there terminating.

RESOLUTION NO. 96-64
RESOLUTION ADOPTING AND CONFIRMING SPECIAL
ASSESSMENTS FOR DELINQUENT UTILITIES
WHEREAS, The amount to be specially assessed for DELINOUENT UTILITIES has been
duly calculated in accordance with the provisions of the City Code and Minnesota
Statutes; and
WHEREAS, Notices have been duly mailed as required by law; and
WHEREAS, Said proposed assessments have at all times since their filing been open for public
inspections, and an opportunity has been given to all interested persons to present
objections, if any, to the proposed assessments; and
WHEREAS, There were no oral or written objections received.
I. The amounts so calculated and set forth in said notices are hereby levied against the
respective parcels ofland described therein, and

The proposed assessments are hereby adopted and confirmed as special assessments for
each of said parcels of land and the assessments together with an additional penalty of
eight percent (8%) of the original unpaid amount, inclusive of any previous delinquency
penalty, shall be a lien concurrent with general taxes upon such parcel.
NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Arden Hills,
Minnesota, that the City Administrator be authorized and directed to transmit to the County
Auditor a certified duplicate of the assessment roll to be extended upon the proper tax lists of the
County, and the County Auditor shall collect said special assessments with taxes levied in 1996,
payable in 1997.
