CITY OF ARDEN HILLS RAMSEY COUNTY RESOLUTION NO. 95-24 RESOLUTION TRANSFERRING JURISDICTION OVER STOWE AVENUE TO THE CITY OF ARDEN HILLS WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, The 1991 Minnesota Legislature established a Ramsey County Local Government Services Study Conunission to "report on the advantages and disadvantages of sharing, cooperating, reconstructuring, or consolidating..." activities in areas of public service including public works; and The consolidation plan provides for reclassification of roadways and corresponding changes in jurisdiction including the transfer of local and State Aid roadways between the County and municipalities; and Stowe Avenue (County Road 163) from New Brighton Road to Lake Johanna Boulevard located in the City of Arden Hills, is presently under the jurisdiction of Ramsey County as a County Road; and This roadway segment has been determined to serve a local function only; and Revocation of "County Road" status may be accomplished by resolution of the Ramsey County Board of Conunissioners pursuant to Minnesota Laws 163.11; and The City of Arden Hills has concurred that jurisdiction should be changed from Ramsey County to the City of Arden Hills; and The consolidation plan stipulates that Ramsey County shall improve the roadways to acceptable levels prior to transferring jurisdiction over roadway segments from Ramsey County to municipalities, and the Ramsey County Capital rmprovement Program provides funding for these improvements; and The City of Arden Hills desires to reconstruct this segment of Stowe A venue for an estimated cost of $240,000 and fund the reconstruction project with Municipal State Aid Street sources, and an estimated $100,000 from the Ramsey County Roadway Consolidation Fund; , . NOW, THEREFORE, BE IT RESOLVED, By the City Council of the City of Arden Hills, Minnesota: 1. The City of Arden Hills does hereby concur with Ramsey County revoking the "County Road" status of Stowe Avenue between New Brighton Road and Lake Johanna Boulevard, and transferring jurisdiction over the roadway to the City if Arden Hills; 2. That the revocation of Stowe A venue will be effective the first day of the second month following the date the County is in receipt of an adopted resolution from the City of Arden Hills concurring with the County revoking the "County Road" status of Stowe A venue between New Brighton Road and Lake Johanna Boulevard and transferring jurisdiction over the roadway to the City of Arden Hills; 3. That the County will pay to the City as just compensation for this jurisdiction transfer, an estimated $100,000 (the total compensation is calculated from the "County Road" reconstruction Cost Participation Policy, Resolution 9-1272, and adjusted by Pavement Management System [(90 - Condition Rating)lCondition Rating] * 1993 Condition Rating); . 4. That Ramsey County will reimburse the City of Arden Hills an estimated $100,000 upon presentation of billings from the construction contractor for reconstruction of this segment of Stowe Avenue; 5. The Arden Hills Engineer is authorized within the limits of this resolution to take actions necessary to have the identified jurisdiction change executed. The first of which is the turnback of Stowe A venue. As noted at Monday night's City Council meeting, I met with Mr. Tim Mayasich of Ramsey County Public Works on Tuesday, March 14, 1995. As a result of that meeting, the enclosed sample resolution is submitted for your consideration. As indicated in the feasibility study for the reconstruction of Stowe Avenue, Ramsey County has proposed to use Option #2 for the turnback, resulting in the anticipated 100% funding of County eligible funds for that portion of the project. That amount is estimated at approximately $100,000, but may vary slightly based upon bids received and actual construction costs. More importantly, the project can proceed this summer as outlined in that report. The second issue is the County's desire to have maintenance and construction responsibility for Hamline Avenue from Floral Drive to T.H. 96, and West County Road F from Harnline Avenue to Lexington Avenue, turned back to the County from the City of Arden Hills. As it has been proposed to seal coat Hamline A venue, we recommend deleting that portion of the 1995 Street Maintenance project at a potential savings to the City of approximatley $22,000 to $25,000. Finally, upon resolution of these issues, we need to finalize the designation of Municipal State Aid Streets for the City by May 1, 1995. This is typically required prior to March 1; however, the County has provided the MnDOT State Aid office with a list of all proposed turnbacks in the County to delay that reporting date until May 1. .
