CITY OF ARDEN HILLS RAMSEY COUNTY RESOLUTION NO. 95-76 RESOLUTION CONCURRING WITH RETROCEDING LEGISLATIVE JURISDICTION OF THE ARMY RESERVE TRAINING CENTER WHEREAS, the 88th RSC currently occupies property which is within the corporate boundaries of the City and which is located in the Northwest Quadrant of the intersection of Lexington Avenue and Highway 96; and WHEREAS, the 88th RSC has formally requested the City to consider a change in jurisdiction of the Army Reserve Site from an exclusive jurisdiction to a concurrent jurisdiction; and WHEREAS, the 88th RSC is conunitted to supporting the public activities of the City; and WHEREAS, the parties desire to establish a longer term and closer working relationship with each other in regards to the use and regulation of the Army Reserve Site; and . WHEREAS, the Army Reserve site is currently included in an R-I Zoning District on the City's Zoning Map and within an area designated as commercial on the City's Comprehensive Plan Land Use map; and WHEREAS, the parties recognize the existing Army Reserve site as a legal, nonconforming use as defined under Section rx of the City's Zoning Ordinance; and WHEREAS, the Army Reserve Site will be designated as a public use under Section II.D.113 of the Arden Hills Zoning Ordinance upon the establishment of a concurrent jurisdiction; and WHEREAS, the parties recognize that should the 88th RSC change the facility and/or site plan for the Army Reserve Site in the future, the 88th RSC will be required to comply with the City's development regulations, including the application for a Special Use Permit; and WHEREAS, the parties have entered into an Memorandum of Agreement (MOA) and will negotiate a long term license/outgrant agreement for use of the facility; and WHEREAS, the City of Arden Hills at its September 25, 1995, Council Meeting, directed City Staff to prepare the appropriate documentation to accept the retrocession request subject to the terms of the MOA and licensing/outgrant agreement. . .. .~. . , . NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, Minnesota that it thereby concurs with retroceding concurrent legislative jurisdiction of the Army Reserve Training Center.
