STATE OF MINNESOTA RAMSEY COUNTY CITY OF ARDEN HILLS RESOLUTION NO. 99-14 A RESOLUTION REQUESTING APPROVAL OF CHARITABLE GAMBLING PREMISES PERMIT APPLICATION FOR ABW A LADY SLIPPER CHAPTER AT FLAHERTY'S ARDEN BOWL WHEREAS, the City has received a renewal premises permit application from the ABW A Lady Slipper Chapter for Class B charitable gambling activity at Flaherty's Arden Bowl, Inc. located at 1273 West County Road E; and WHEREAS, all City licensing and fee requirements have been met as required by City Ordinance. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Arden Hills, Minnesota: That the City of Arden Hills hereby agrees to approve the premises permit renewal application for ABW A Lady Slipper Chapter for Class B licensed charitable gambling activity to be located at Flaherty's Arden Bowl, Inc., 1273 West County Road E, Arden Hills, Minnesota, for a period from August I, 1999 to July 31, 2001. CERTIFICATION RESOLUTION NO. 99-14 The undersigned, being the duly qualified and acting City Administrator of the City of Arden Hills, Minnesota, hereby certifies the following: The foregoing is a true and correct copy of a resolution on file and of official, publicly available record in the office of the City. Said resolution was duly adopted by the City Council at a regular meeting of the Council held on May 10, 1999. Said meeting was duly called, regularly held, open to the public, and held at the place at which meetings of the Council are regularly held. Councilmember Malone moved the adoption of the resolution, which motion was seconded by Councilmember Aplikowski . A vote being taken on tbe motion, following members of the Council voted in favor of the motion to adopt the resolution: Aplikowski, Larson, Malone, Rem and Probst and the following voted against the same: N/A Whereupon, said resolution was declared duly passed and adopted. The resolution is in full force and effect, and no action has been taken by the Council which would in any way alter or amend the resolution. Illegal Gambling 1. To the best of the lessor's knowledge, the lessor affirms that any and all games or devices located on the premises are not being used, and are not capable of being used, in a manner that violates the prohibitions against illegal gambling in Minnesota Statutes, section 609.75, and the penalties for illegal gampling violations in Minnesota Rules, part 7861.0050, subpart 3. 3. I LESSOR RECORDS MAINTAINED I The lessor shall maintain a record of all money received from the organization, and make the record available to the board and its agents, the commissioners of revenue and public safety and their agents upon demand. The record shall be maintained fora period of 3-1/2 years. . 3. If there is a dispute as to whether any olthese lease provisions have been violated, the lease will remain in effect pending a final determination by the Compliance Review Group (CRG) of the Gambling Control Board. OTHER OBLIGATIONS AND AGREEMENTS - Attachment All obligations and agreements between the organization and the lessor are contained in or attached to this lease.
