RESOLUTION 99-18
RESOLUTION VACATING A PORTION
OF THE OAK AVENUE RIGHT-OF-WAY
WHEREAS, the City of Arden Hills (the City) reconstructed Oak Avenue in 1996; and
WHEREAS, the City in preparing the plans and specifications for the reconstruction of
Oak Avenue, discovered that the existing roadway was not contained within the existing
right-of-way for Oak Avenue; and
WHEREAS, right-of-way was acquired on the west side of Oak Avenue to
accommodate the alignment; and
WHEREAS, tbe excess right-of-way on the east side of Oak Avenue was not vacated at
the time ofthe alignment; and
WHEREAS, the City has caused a notice of public hearing to be ~ublished in the City's
official newspaper for two (2) consecutive weeks (May 12th & 19t of 1999); and
WHEREAS, the City has notified the affected property owners by mail at least ten (10)
days prior to the public hearing; and
WHEREAS, the request to vacate was reviewed by the Arden Hills Planning
Commission at a public hearing on the 2nd day of June, 1999, and approved by the Arden
Hills City Council on the 14th day of June, 1999; and
NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Arden
Hills, Minnesota, that the City of Arden Hills hereby agrees to the vacation ofthat
portion of the Oak Avenue rigbt-of-way as described on Exhibit A attached hereto.

A Street Vacation of that park of Oak Avenue described as follows:
That part of Oak Avenue as dedicated in Shady Oaks Addition, Ramsey County,
Minnesota which lies easterly ofthe following described line: Commencing at the
Northeast comer of said Lot I; thence westerly on an assumed bearing of North 88
degrees 01 minutes 41 seconds West along the North line of said Lot I a distance of
215.00; thence South 09 degrees 17 minutes 35 seconds East a distance of 1.89 feet to the
West line of said Lot 1 the point of beginning of the line to be described; thence
continuing South 09 degrees 17 minutes 35 seconds East to an intersection with said west
line of Lot I and said line there terminating.

CERTIFICATION
RESOLUTION NO. 99-18
The undersigned, being the duly qualified and acting City Administrator of the City of Arden
Hills, Minnesota, hereby certifies the following:
The foregoing is a true and correct copy of a resolution on file and of official, publicly
available record in the office of the City. Said resolution was duly adopted by the City
Council at a special meeting of the Council held on June 14 ,1999. Said meeting was
duly called, regularly held, open to the public, and held at the place at which meetings of
the Council are regularly held. Councilmember Aplikowski moved the adoption of the
resolution, which motion was seconded by Councilmember Larson ; whereupon
majority vote, said resolution was declared duly passed and adopted.
WITNESS MY HAND AND SEAL OF OFFICE as the City Administrator of the City of Arden
Hills, Minnesota, this 15th day of June, 1999.
