RESOLUTION NO. 98-37
The undersigned, being the duly qualified and acting City Administrator of the City of Arden
Hills, Minnesota, hereby certifies the following:
The foregoing is a true and correct copy of a resolution on file and of official, publicly
available record in the office of the City. Said resolution was duly adopted by the City
Council at a regular meeting of the Council held on March 30. , 1998. Said meeting
was duly called, regularly held, open to the public, and held at the place at which
meetings of the Council are regularly held. Councilmember Malone moved the
adoption of the resolution, which motion was seconded by Councilmember Hicks
whereupon majority vote, said resolution was declared duly passed and adopted.

RESOLUTION NO. 98-37
A RESOLUTION ESTABLISHING STOWE AVENUE AS A MUNICIPAL STATE AID
STREET UPON TURN BACK FROM RAMSEY COUNTY
WHEREAS, the 1991 Minnesota Legislature established a Ramsey County Local Government
Services Study Commission to "report on the advantages and disadvantages of sharing,
cooperating, restructuring or consolidating...." activities in the areas of public service including
public works; and
WHEREAS, the consolidation plan provides for reclassification of roadways and corresponding
changes in jurisdiction including the transfer of local and State Aid roadways between the
County and municipalities; and
WHEREAS, Stowe A venue (County Road 163) from Cleveland A venue to New Brighton Road,
located in the City of Arden Hills, is presently under the jurisdiction of Ramsey County as a
County Road; and
. WHEREAS, this roadway segment has been determined to serve a local function only; and
WHEREAS, revocation of "County Road" status may be accomplished by resolution of the
Ramsey County Board of Commissioners pursuant to Minnesota Statutes S 163.11; and
WHEREAS, it appears to the City Council of the City of Arden Hills that the street hereinafter
described upon turn back from Ramsey County should be designated a Municipal State Aid
Street under the provisions of Minnesota Law; and
WHEREAS, the consolidation plan stipulates that Ramsey County shall improve the roadways
to acceptable levels prior to transferring jurisdiction over roadway segments from Ramsey
County to municipalities, and the Ramsey County Capital Improvement Program provides
funding for these improvements; and
WHEREAS, the City of Arden Hills desires to reconstruct this segment of Stowe Avenue for an
estimated cost of$120,000 and fund the reconstruction project with local sources, and an
estimated $50,000 from Capital Improvement Funds for Ramsey County Roadway
Consolidation;

NOW THEREFORE BE IT RESOLVED, by the City Council ofthe City of Arden Hills,
Minnesota:
1. That upon turn back to the City of Arden Hills from Ramsey County the section of
Stowe Avenue, approximately 0.25 mile in length, between Cleveland Avenue
and New Brighton Road be, and hereby is established, located, and designated a
Municipal State Aid Street of said City, subject to the approval of the
Commissioner of Transportation of the State of Minnesota.
2. That the revocation of Stowe Avenue will be effective the date of the award of the
reconstruction contract, and after the Ramsey County Office of Budgeting and
Accounting has encumbered the funds necessary to reimburse the City, and the
County is in receipt of an adopted resolution from the City concurring with the
County revoking the "County Road" status of Stowe Avenue.
3.
That the County will pay to the City as just compensation for this jurisdiction
transfer, an estimated $50,000 (the total compensation is calculated from the
"County Road" reconstruction Cost Participation Policy, Resolution 9-1272, and
adjusted by Pavement Management System [(90-Condition Rating)/Condition
Rating] * 1993 Condition Rating) upon presentation of billings from the
construction contractor for reconstruction of this segment of Stowe Avenue;
4. That Ramsey County will reimburse the City of Arden Hills an estimated $50,000
upon presentation of billings from the construction contractor for the
reconstruction of Stowe Avenue.
BE IT FURTHER RESOLVED, that the City Clerk is hereby authorized and directed to
forward two (2) certified copies of this resolution to the Commissioner of Transportation for his
consideration, and that upon his approval of the designation of said road or portion thereof, that
same be constructed, improved, and maintained as a Municipal State Aid street ofthe City of
Arden Hills, to be numbered and known as Stowe Avenue.
