RESOLUTION 98-70
RESOLUTION VACATING A PORTION OF A
DRAINAGE AND UTILITY EASEMENT IN McCLUNG FIRST ADDITION
WHEREAS, the Property Owner (John McClung) of Outlot A of McClung First Addition has
subdivided this parcel as part of Planning Case 98-17; and
WHEREAS, the Developer has requested, as part of Planning Case 98-17, to vacate a portion of
the Drainage and Utility Easement, as described in Exhibit I, which encumbers this property; and
WHEREAS, the petition to vacate said easement was made by the Developer and the City has
caused a notice of public hearing to published in the City's official newspaper (June 17, 1998)
and the City has notified the affected property owner at least ten (10) days prior to the public
hearing; and
WHEREAS, the Planning Commission at its July 1, 1998, regular meeting conducted a public
hearing on the matter and recommended approval of said vacation to facilitate development on
. said property; and
WHEREAS, the City Council at its August 31, 1998, regular meeting approved said vacation to
facilitate development on said property; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills,
Minnesota hereby agrees to the vacation of that part of the drainage and utility easement
described on Exhibit I.

EXHIBIT I
That part of the drainage and utility easement as dedicated on Outlot A, McClung First Addition,
Ramsey County, Minnesota, described as commencing at the southwest comer of Lot 1, Block 2,
said McClung First Addition, thence on an assumed bearing of North along the east line of said
Outlot A, 24.48 feet to the point of beginning of the easement to be described; thence North 82
degrees 45 minutes 39 seconds West 22.77 feet; thence North 48 degrees 10 minutes 47 seconds
West 30.07 feet; thence East 45.00 feet to said line of Outlot A; thence South 22.92 feet to the
point of beginning.
