Overview
While it is early in the year, it is time to start thinking about the 2004 Budget. In anticipation of
the 2004 Budget, the Management Team has been working on a slightly different process than
we have used previously. Most of the changes in approach are internal allowing department
supervisors and directors more input into the budget process. A spreadsheet outlining the
proposed process and budget calendar is attached for your review.
As indicated in the budget calendar, one of the first steps in the process is to identifY any
significant budget issues for 2004. In addition, at this point in the process staff is hoping to
identify any Council priorities for 2004. For discussion purposes, staff has drafted a list of
factors influencing the 2004 budget, and identified potential opportunities and issues requiring
further evaluation.

SUBJECT: Update on 2003 Celebrating Arden Hills - Beach Barbeque

The purpose of this memo is to update you on the progress of our annual summer event which is
scheduled for June 28, 2003 at Tony Schmidt Park. The event is progressing nicely, As you are
probably aware, the Event Committee has decided to rename the event - Celebrating Arden Hills
- Beach Barbeque! The day will be scheduled from 3:00 p.m. until dusk. This year's event will
look differently then last year's but will be just as exciting! The Event Committee decided to
eliminate the parade and replace it with a catered Barbeque Dinner near the beach. We will be
selling tickets to the dinner for $7.50 for adults and $4.00 for children, Tickets are available at
City Hall. A ticket is not required for the other events in the park. In addition, we will have a
couple of food vendors at the event for those who do not choose to buy a ticket for the barbeque
dinner. Headlining this year's entertainment will be the White Sidewalls Rock-N-Roll Revue
and back by popular demand will be the Prior Lake Water Ski Show and the Shoreview Northern
Lights Variety Band! As always, we will have youth games, caricaturists, face painters,
community booths, a rock climbing wall (we guarantee it will show up this year!), and
FIREWORKS at dusk!!! A complete schedule of events is included with this memo. There are a
couple items for the City Council to discuss:
Ticket Sales - A crucial part of this year's event is the sale ofthe barbeque dinner tickets,
The Committee will be taking an active role in promoting the dinner and with the sale of
tickets. However, we can use all the help we can get. Therefore, the Committee is
asking for the City Council's assistance in selling the tickets. We ask that each
Councilmember take a minimum of 25 tickets and attempt to sell them before the event.
Our goal is to ATLEAST sell 300 tickets but we are hoping for more!
Mavor and City Conncil Involvement - The Committee has some time on stage from
3:00-4:00 p.m. The Committee would like to see a welcome by Mayor Aplikowski and
involvement from the City Council. We are looking for feedback regarding this
possibility.

A. Review request to amend contract to include those properties north of 694 (which are not
currently listed in the contract) and extend the contract through 2008.

At their October 28, 2002 meeting, the Council requested that staff research using money from
the Recycling Enterprise Fund to purchase recycling bins for Arden Hills residents,

E-Z Recycling would also like to revisit their current contract and discuss amending the contract
e to reflect the 694 split and extending their contract to 2008. In 2001 the City passed ordinance

#319 requiring that garbage and recycling haulers split their service days to accommodate the
future garbage and recycling collection needs of Arden Hills. The 694 split translated to ..
recyclable materials being picked up on Wednesday from those properties north of 694, and a W
Tuesday pick-up for those properties south of 694 (the pick-up schedule may differ if the normal
pick-up day falls on a holiday).
E-Z Recycling would also not request any pnce mcrease; however they would request an
extension oftheir contract until 2008.
Recvcline: Bin Update
Subsequent to the October 28th City Council meeting staff consulted with the City's recycling
contractor, E-Z Recycling, to obtain the best price on recycling bins. E-Z Recycling was able to
obtain a bid of $5,50 per recycling bin which would include the City's color of choice (from the
selection available) and have the City's logo hot-stamped on the bins. The bid has been attached
for Council review.
The pricing of $5.50 per bin is based on the City ordering 3,000 bins, approximately the number
of dwelling units in Arden Hills, E-Z Recycling has stated that they could deliver the bins to
residents' homes initially, and then any additional bins or bins for new residents could be picked
up at City Hall or from E-Z Recycling, The bins are available in several colors, the samples that
staffhave been provided with include: Medium Blue, Light Green (Kelly green), Brooks Green,
and Forest Green. It appears that the Brooks Green is the closest to the Arden Hills logo color. _
The bins would include hot-stamping a white stamp of the Arden Hills Logo and text on both ..
long sides of the bins. Several bins could be stored at City Hall (in one of the storage rooms) and
when necessary could be restocked from a larger supply stored at E-Z recycling. These bins
could then be provided to new residents or residents could purchase replacement bins or
additional bins if they so choose.

purchasing their own?).

Staff recommends that Council discuss the following items:
1) Discuss the proposed Agreement for Curbside Recycling Services

Discuss the purchase of3,OOO recycling bins from Tulip Corporation for $5.50 each, a
total of$16,500.00 to come from the Recycling Enterprise Fund (#603).

recycling. I have the collar samples will send you in the mail. The price for the
containers is $5.50 each. This includes shipping the containers to our plant.

AGREEMENT FOR CURBSIDE RECYCLING SERVICES
Agreement made as of , between the City of Arden Hills (hereafter
the City) and E-Z Recycling, Inc., a Minnesota Corporation (hereafter the Contractor).
The City and the Contractor agree as follows:
1, Definitions

NOTE: All boundaries, unless otherwise noted, fall in the center of City
streets such that they include residents in the one-half of the named street.
1,2 'Recyclable Materials" means newsprint and non-glossy paper, cardboard,
glass bottles and jars, mixed aluminum and bimetal beverage containers,
plastic bottles, magazines, box boards, phone books, non-hazardous
completely drained aerosol cans, miscellaneous metals and other materials
as mutually agreed upon by the City and Contractor,

Services to be Perfonned

2.1 The contractor shall collect all recyclable materials on the following days:
North of Interstate 694 Wednesday
South of Interstate 694 Tuesday
When a national holiday falls on a Monday, Tuesday, or Wednesday the
following will be the collection day:
Holiday on Monday pick-up North of 694 will be Thursday
South of 694 will be Wednesday
Holiday on Tuesday pick-up North of694 will be Thursday
South of 694 will be Wednesday
Holiday on Wednesday pick-up North of694 will be Thursday
South of 694 will be Tuesday
The City will provide the Contractor with maps of the City noting areas
for recycling pickups and areas where pickup is not desired and/or
necessary.
2.2 The terms of this agreement shall be from March 1,2003 to Feb.28th, 2008
2.3 The City and the Contractor acknowledge that timely performance of ..
collection services is essential to the success of the recycling program. The .,

work shall be done with forces which are adequate to insure the
satisfactory collection and disposal of said materials at all times and the
failure to perform may be excused only by adverse conditions of weather
and similar hindrances which in other work might be regarded as "act of
providence", In the case of such event, the Contractor will notilY WCCO
Radio and KSTP Radio by 6:00 a.m. to announce postponement and
provide informatiou for a substitute date.
2.4 The Contactor will conduct a phone survey each year. The results of the
survey shall be given to the City Administrator.
3. CoUection
3.1 Recyclable materials shall be prepared as follows:
Magazines. Newsvrint. Mixed Mail: Place in paper bag or recycling container.
Keep separate from cans, glass, and plastic.
Cans. Glass. Plastic Bottles with a neck: Rinse out & place in paper bag or
recycling container. Keep separate from paper items. Plastic items remove
caps and lids and flatten.
Cardboard: Flatten, place in container or bundle with twine, Not to exceed 3ft
X 3ft.
Aerosol Cans: Must be completely drained.
3.2 All recyclable materials placed for collection shall be owned by and the
Responsibility of the occupants or residential properties until they are
handled by the Contractor. Upon handling of the containers and recyclable
materials by the Contractor, the recyclable materials become the property
and responsibility of the Contractor.
3.3 Recyclable materials deemed unacceptable by the Contractor according to
the Preparation procedures in provision 3.1 the Contractor will leave a
notice with the occupant.
3.4 The Contractor's employees shall save for the resident' any containers that
are Marked Save. These containers, once emptied, shall be returned to the
curbside. Any spills will be cleaned up inunediately by the Contractor.
4.
Contractor's EQuiument
4,1 Contractor's vehicles shall be marked with the name of the Contractor.

4.2 The Contractor shall maintain all trucks and equipment in good working
condition. The Contractor's trucks shall be clean and aesthetically
pleasing.
5. Contractor's Operation
5, I The Contractor shall establish and maintain an office with continuous
supervision for accepting complaints and customer calls, The office shall
be in service during the hours of 7:00 a.m. unti15:00 p.m, or until all
routes are completed on all days of collection as specified in this
Agreement. Address and telephone number of such office and any changes
there in shall be given to the City in writing. The address of this office as
for the execution of the contract is 875 North Prior Avenue, St. Paul, MN,
55104
5.2 Complaints on service will be taken and collected by E-Z Recycling, Inc,
The City will notifY the Contractor of any complaints it receives.
5.3 Whenever the City or a resident notifies the Contractor oflocations,
which have not received, scheduled service, the Contractor is required to
service such locations by 3:00 p,m. the day following the missed service.

6. Payment
6,1 The City will compensate the Contractor for the collection of recyclable
materials from residential units as described in Sections 2 and 3, During
this contract, the City will pay the Contractor $2.05 per household,
Household counts to be determined each year on January I",
6,2 The Contractor will submit monthly statements for services rendered as
set forth in Section 7. The City shall make monthly payments within
twenty (20) days upon receipt of the statement.
7. Filinl! of Reports
7.1 The Contractor shall submit an accurate monthly summary of the quantity
and kinds of all recyclable materials collected.

7.2 The Contractor shall provide scale receipts of the recyclable materials
collected.
8.
Insurance
8.1 Prior to commencement of this Agreement, the Contractor shall furnish
the City with certificates of insurance for comprehensive general liability,
automobile liability and property damage insurance, to meet all City
insurance requirements. The policy shall require the Insurance Company
to notifY the City in writing of any cancellation in coverage, at least ten
(10) days prior to cancellation. Any losses to persons or property through
this project shall be the responsibility of the Contractor. The Contractor
agrees to indemnifY the City from any and all liability or loss arising in
any way out of the performance of this contract.
9.
Relationship of Parties
9.1 The parties intend that an independent Contractor-employee relationship
will be created by the contract. The City is interested only in the results to
be achieved, and the conduct and control of the City for any purpose, and
the employees of the Contractor are not entitled to any of the benefits that
the City provides for its employees.

TerminationlExtension
10. I If, in the City's opinion, the Contractor fails to carry out the services
diligently and on schedule, and in a quality manner, the City shall have the
right to terminate the agreement. Priorto termination, the City will give
written notice of intent to terminate. This intent to terminate shall be served
upon the Contractor thirty (30) days prior to termination,
10.2 If, at any time during the term of this contract significant changes to the
program occur (i.e.: use of recycling bins, frequency of pick up, addition of
new collectible materials, etc. . .), the City and the Contractor mutually agree
that the contract will open for negotiation and! or unless negotiated
differently, will terminate at the end of that calendar year.
10.3 If, at the end of the term of this contract, the City and the Contractor

The purpose of the Open Meeting Law1 is to prohibit actions from being taken at
secret meetings where it is impossible for members of the public to become fully
informed as to the reasons for the decision or to detect improper influences; to
protect the right of the public to be informed; and to afford the public an opportunity
to present its views to the decision making body2, Consequently, the Open Meeting
Law is liberally construed by the Courts to protect the public's right of access to the
decision making process3.
The Open Meeting Law unequivocally states that all meetings of a statutory city
council must be open to the public, unless the purpose of the meeting satisfies one of
the following exceptions4:
1. Meetings to discuss confidential data, as defined by the Minnesota Data
Practices Act;
2. Meetings to review charges or allegations against an employee, unless the
employee requests tha~ the meeting be open;
3. Meetings to evaluate employee performance, unless the employee requests
that the meeting be open;

4. Meetings subject to the attorney/client privilege, which has been narrowly
construed in regard to public clients so that it only applies to meetings at
which litigation is discussed; and
5. Meetings to discuss labor negotiation strategy, but only if a majority of the
council votes at a public meeting to conduct such session at a closed meeting,
The Open Meeting Law does not define the terms "meeting" or "open to the public".
Therefore, the Minnesota Supreme Court and the Minnesota Appellate Court have
interpreted those terms.
1. The term "meeting" means a gathering of a quorum or more of the members
of a governing body or a committee of the governing body at which members
discuss, decide or receive information as a group on issues relating to the
official business of the governing body5,

means of correspondence, telephone calls, voice mail or e-mail?

In 1983, the Minnesota Supreme Court stated that the statute did not
apply to letters or telephone conversations between fewer than a
quorum, but in the same opinion the Court stated that "serial meetings
in groups of less than a quorum for the purpose of avoiding public
hearings or fashioning an agreement on an issue may also be found to be
in violation of the statute depending upon the facts of an individual
case". Ten years later, the Minnesota Appellate Court stated that
meetings of less than a quorum may violate the open meeting law if held
to avoid public discussion, to forge a majority view in advance of a
public meeting, or to hide improper influence6,

Open Meeting Law in favor of public access to the decision making
process and upon the Court's indication that violations of the Open
Meeting Law could involve less than a quorum, it is my opinion that the
serialized use of correspondence, telephone calls, voicemails and e-
mails could result in a violation of the Open Meeting Law, This opinion
is shared by the League of Minnesota Cities,

long as the members do not discuss, decide or receive information7.

I. Introduction
These procedures are adopted to comply with the requirements of the Minnesota Data
Practices Act (the "Act"), specifically Minn. Stat. 913.03, Subd. 2 and 13.05, Subd. 5
and 8.
II, Responsible Authority
The person who is the responsible authority for compliance with the Act is the Deputy
Clerk. The responsible authority has designated certain other City employees to assist in
complying with the Act. These designees are listed on attached Exhibit 1.
III. Access to Public Data
All information maintained by the City is public unless there is a specific statutory
designation which gives it a different classification.

The City General Records Retention Schedule lists data series maintained by the City
and their classifications.
A. People Entitled to Access, Any person has the right to inspect and copy public
data. The person also has the right to have an explanation of the meaning of the
data. The person does not need to state his or her name or give the reason for
the request.
B. Form of Request. The request for public data may be verbal or written.
C. Time Limits.
. Requests. Requests will be received and processed only during normal
business hours.
. Response. If copies cannot be made at the time of the request, copies
must be supplied as soon as reasonably possible.
D. Fees, Fees may be charged only if the requesting person asks for a copy or
electronic transmittal of the data. Fees will be charged according to the City's
standard photocopying policy, attached as Exhibit 2, unless significant time is
required, In that case, the fee will include the actual cost of searching for,
retrieving and copying or electronically transmitting the data, The fee may not -
include time necessary to separate public from non-public data. .,

The responsible authority may also charge an additional fee if the copies have
commercial value and are a substantial and discrete portion of a formula,
compilation, program, process, or system developed with significant expenditure
of public funds. This additional fee must relate to the actual development costs of
the information.
IV.
Access to Data on Individuals,
Information about individual people is classified by law as public, private, or confidential.
A list of the private and confidential information maintained by the City is contained in
Appendix A.
A. People Entitled to Access,
}o Public information about an individual may be shown or given to anyone.
}o Private information about an individual may be shown or given to:

The individual, but only once every six months, unless a dispute has arisen or
additional data has been collected.
.
A person who has been given access by the express written consent of the
data subject. This consent must be on the form attached as Exhibit 3, or a
form reasonably similar.
People who are authorized access by the federal, state, or local law or court
order.
People about whom the individual was advised at the time the data was
collected. The identity of those people must be part of the Tennessen
warning described below.
. People within the City staff, the City Council, and outside agents (such as
attorneys) whose work assignments or responsibilities reasonably require
access.
}o Confidential information may not be given to the subject of the data, but may be
shown or given to:
· People who are authorized access by federal, state, or local law or court
order.
· People within the City staff, the City Council, and outside agents (such as
attorneys) whose work assignments or responsibilities reasonably require
access.

8, Form of Request, Any individual may request verbally or in writing if the City has
stored data about that individual and whether the data is classified as public,
private, or confidential.

All requests to see or copy private or confidential information must be in writing.
An Information Disclosure Request, attached as Exhibit 4, must be completed to
document who requests and who receives this information. The responsible
authority or designee must complete the relevant portions of the form, The
responsible authority or designee may waive the use of this form if there is other
documentation of the requesting party's identity, the information requested, and
the City's response.
C. Identification of Requesting Party. The responsible authority or designee must
verify the identity of the requesting party as a person entitled to access. This can
be through personal knowledge, presentation of written identification, comparison
of the data subject's signature on a consent form with the person's signature in
City records, or other reasonable means.
D. Time Limits.
. Requests. Requests will be received and processed only during normal
business hours.
. Response. The response must be immediate, if possible, or within 5 working
days-if an immediate response is not possible. The City may have an
additional 5 working days to respond if it notifies the requesting person that it
cannot comply within 5 days.

E. Fees, Fees may be charged in the same manner as for public information.
F. Summary Data, Summary data is statistical records and reports derived from
data on individuals but which does not identify an individual by name or any other
characteristic that could uniquely identify an individual. Summary data derived
from private or confidential data is public. The responsible authority or designee
will prepare summary data upon request, if the request is in writing and the
requesting party pays for the cost of preparation. The responsible authority or
designee must notify the requesting party about the estimated costs and collect
those costs before preparing or supplying the summary data. This should be
done within 10 days after receiving the request. If the summary data cannot be
prepared within 10 days, the responsible authority must notify the requester of
the anticipated time schedule and the reasons for the delay.
Summary data may be prepared by "blacking out" personal identifiers, cutting out
portions of the records that contain personal identifiers, programming computers
to delete personal identifiers, or other reasonable means.
The responsible authority may ask an outside agency or person to prepare the
summary data if (1) the specific purpose is given in writing, (2) the agency or

person agrees not to disclose the private or confidential data, and (3) the
responsible authority determines that access by this outside agency or person
will not compromise the privacy of the private or confidential data. The
responsible authority may use the form attached as Exhibit 5,
G. Juvenile Records. The following applies to private (not confidential) data about
people under the age of 18.
· Parental Access. In addition to the people listed above who may have
access to private data, a parent may have access to private information about
a juvenile data subject. "Parent" means the parent or guardian of a juvenile
data subject, or individual acting as a parent or guardian in the absence of a
parent or guardian, The parent is presumed to have this right unless the
responsible authority or designee has been given evidence that there is a
state law, court order, or other legally binding document which prohibits this
right. .
. Notice to Juvenile, Before requesting private data from juveniles, city
personnel must notify the juveniles that they may request that the information
not be given to their parent(s), This notice should be in the form attached as
Exhibit 6.

. Denial of Parental Access. The responsible authority or designee may deny
parental access to private data when the juvenile requests this denial and the
responsible authority or designee determines that withholding the data would
be in the best interest of the juvenile. The request from the juvenile must be
in writing stating the reasons for the request. In determining the best interest
of the juvenile, the responsible authority or designee will consider:
. Whether the juvenile is of sufficient age and maturity to explain the
reasons and understand the consequences,
· Whether denying access may protect the juvenile from physical or
emotional harm,
. Whether there is reasonable grounds to support the juvenile's reasons,
and
. Whether the data concerns medical, dental, or other health services
provided under Minnesota Statutes 9 144.341 to 144,347. If so, the data
may be released only if failure to inform the parent would seriously
jeopardize the health of the minor.
The responsible authority or designee may also deny parental access without a
request from the juvenile under Minnesota Statutes 9 144.335.

V. Denial of Access.
e
If the responsible authority or designee determines that the requested data is not
accessible to the requesting party, the responsible authority or designee must
inform the requesting party orally at the time of the request or in writing as soon
after that as possible. The responsible authority or designee must give the specific
legal authority, including statutory section, for withholding the data. The responsible
authority or designee must place an oral denial in writing upon request. This must
also include the specific legal authority for the denial.
VI. Collection of Data on Individuals.
The collection and storage of information about individuals will be limited to that
necessary for the administration and management of programs specifically
authorized by the state legislature, city council, or federal government.
When an individual is asked to supply private or confidential information about the
individual, the City employee requesting the information must give the individual a
Tennessen warning. This waming must contain the following:
. the purpose and intended use of the requested data,
. whether the individual may refuse or is legally required to supply the
requested data,
. any known consequences from supplying or refusing to supply the
information, and
e
. the identity of other persons or entities authorized by state or federal law to
receive the data.
A Tennessen warning is not required when an individual is requested to supply
investigative data to a law enforcement officer.
A Tennessen warning may be on a separate form or may be incorporated into the
form which requests the private or confidential data. See attached Exhibit 7.
VII. Challenge to Data Accuracy,
An individual who is the subject of public or private data may contest the accuracy
or completeness of that data maintained by the City. The individual must notify the
City's responsible authority in writing describing the nature of the disagreement.
Within 30 days, the responsible authority or designee must respond and either (1)
correct the data found to be inaccurate or incomplete and attempt to notify past
recipients of inaccurate or incomplete data, including recipients named by the
individual, or (2) notify the individual that the authority believes the data to be e
correct.

An individual who is dissatisfied with the responsible authority's action may appeal
to the Commissioner of the Minnesota Department of Administration, using the
contested case procedures under Minnesota Statutes Chapter 14. The responsible
authority will correct any data if so ordered by the Commissioner.
VIII. Data Protection.
A, Accuracy and Currency of Data,
All employees will be requested, and given appropriate forms, to provide updated
personal information to the appropriate supervisor, City Clerk, or Finance
Director, which is necessary for tax, insurance, emergency notification, and other
personnel purposes. Other people who provide private or confidential information
will also be encouraged to provide updated information when appropriate.
Department heads should periodically review forms used to collect data on
individuals to delete items that are not necessary and to clarify items that may be
ambiguous.
All records must be disposed of according to the City's records retention
schedule.
B. Data Safeguards,
Private and confidential information will be stored in files or databases which are
not readily accessible to individuals who do not have authorized access and
which will be secured during hours when the offices are closed.
Private and confidential data must be kept only in City offices, except when
necessary for City business.
Only those employees whose job responsibilities require them to have access
will be allowed access to files and records that contain private or confidential
information. These employees will be instructed to:
· not discuss, disclose, or otherwise release private or confidential data
to City employees whose job responsibilities do not require access to
the data,
. not leave private or confidential data where non-authorized individuals
might see it, and
· shred private or confidential data before discarding.
When a contract with an outside party requires access to private or confidential
information the contracting party will be required to use and disseminate the
information consistent with the Act. The City may include in a written contract the
language contained in Exhibit 8.

IX.
Annual Review and the Deputy Clerk.

The Deputy Clerk shall review the data practices and procedures annually for
compliance with the Act and shall complete Appendix B.

SAMPLE CONTRACT PROVISION
Data Practices Comoliance. Contractor will have access to data collected or maintained by
the City to the extent necessary to perform Contractor's obligations under this contract.
Contractor agrees to maintain all data obtained from the City in the same manner as the City is
required under the Minnesota Government Data Practices Act, Minn. Stat. Chap. 13 (the "Act").
