ENC: Estimate to reside warming houses with cedar paneling, pricing and material
information for tuff sheds, cost projection spreadsheet, and warming house option
grid.
BACKGROUND
At the May 8, 2006 Regular City Council meeting the warming house comprehensive report was
presented. At that time, staff was directed to bring the report back to a future work session with
additional information and options for discussion. The original report is included. Staff has
researched a few additional options, which are included below.
ADDITIONAL OPTIONS
Hazelnut Park and Freeway Park
I) OPTION A (Optional add on): Replace existing siding with Cedar paneling. This
would be an additional cost from the original report (May 8, 2006).
· Choice I: Cedar tongue and groove siding (not primed) - $571.60
. Choice II: Smartside tongue and groove siding (pre-primed) - $469.60.
. Cost does not include labor.
For a specific breakdown of estimated costs/supplies for this alternative, please see the
attached estimate provided from Operations and Maintenance staff (Attachment 2A-I)

Choice I: $1,691 proposed repairs (original report) plus $571.60 ~ $2,262.60
Choice II: $1,691 proposed repairs (original report) plus $469.60 = $2,160.60
Freeway Park:
Choice I: $1,103 proposed repairs (original report) plus $571.60 ~ $1,674.60
Choice II: $1,103 proposed repairs (original report) plus $469.60 ~ $1,572.60
2) OPTION D (ALTERNATIVE): Bring in Home Depot to construct a TUFF shed.
· These sheds can be ordered in various sizcs and the total cost includes delivery and
construction.
· Home Depot can deliver and construct these buildings in less than a day.
· These buildings do have extra options available.
· Photos, sizc options, and additional options are included (attachment 2A-2).
· Staff would have to make adjustments to the construction. (To name a few: A ceiling
would need to be installed, insulation added throughout the building, interior paneling
added, electrical installed, a heater would need to be added and hooked up)
The total estimated cost for this alternative would depend on the type of TUFF shed and
size desired. Please refer to attachment 2A-2. The construction adjustments and added
costs would have to be determined after the specific building type and size are chosen.
3) OPTION E: Move existing warming house buildings (20 x 28 ft.) from Cummings Park
and Valentine Park to Freeway Park and Hazelnut Park
· Buildings are currently in good shape. Cummings would need to have work done on the
roof.
· Buildings would have to be repaintcd or resided.
· Semple Movcrs gave staff a cost estimatc of $4,000 per building to move to the two
diffcrent sites. A concrete slab (20 x 28 ft.) would have to be put in at each site. If the 0
& M Department does the work, it would cost approximately $2,496, including labor.
The total estimated cost estimate for this option would be a minimum $6,496 per site. The
estimated cost does not figure in existing building tear down (20.4 x 14.6 building size), post
removal and restoration, gate removal and restoration, necessary tree trimming, or
electrical hook-up.

ADDITIONAL ANALYSIS
Councilmember Grant provided staff (attachment 2A-3) with a cost projection spreadsheet for
the original options presented in the first report on May 8, 2006.
Attached is a warming house option grid, which helps layout all of the options and their related
costs (attachment 2A-4).
RECOMMENDATION
After further analysis, staff has the following recommendations:
For Freeway Park and Hazelnut Park, staff recommends Option E: Moving the eXlstmg
structures at Cummings Park and Valentinc Park to replace the old buildings. Minor repairs can
be made and either painting or residing the buildings will make them more aesthetically pleasing
to the eye.
For Valentine Park, staff recommends either discontinuing the staffing of the building and
removing the building or bringing in a portable unit of some kind each season. This site cannot
handle a permanent building with the current park conditions.
Staff has not had the opportunity to present the new recommendations to the Parks, Trails, and
Recreational Committee. However, staff will present the new information at the June 20, 2006
meeting.

BACKGROUND:
The 2005/2006 Ice Skating season officially cnded on Sunday, February]2. Staff was instructed
to prepare a comprehensive look at the warming house and ice rink operations at three sites:
Freeway Park, Hazelnut Park, and Valentinc Park. The warming houses at Cummings Park and
Perry Park are in good condition and the buildings are used year round. At the February work
session, the PTRC prescnted a recommendation within their vision statement to utilize mobile
units at Hazelnut and Freeway Parks.

Freeway Park, Hazelnut Park, and Valentine Park have had previous maintcnance issucs. The
PTRC has looked althe replacement of the three buildings in qucstion at one time or another, but
has put off replacement of those buildings for numerous reasons. (The] 999 CJ.P, ineluded
$20,000 for a replaccment warming housc at Hazelnut Park. The PTRC decided to put off the
rcplacement at that time.) As you arc aware, during our routine pre-season inspection this past
Novcmber (2005), Opcrations and Maintenance staff encountered an issue at the Freeway Park
sitc due to mice infestation. At that time, staff explored several options to get through the
2005/2006 season. The health departmcnt was notified and they dropped off information on
possible health problems relatcd to rodent infestation and also how to clean up the area
appropriately. L01; (ireen from SL Paul - Ramsey County Department of Public Health felt that
if cleaned up properly, the hcalth risk would bc minimal. The information on rodent infestation
is included with this report, (Attachment 7B- J) Time constraints and electrical complications
forced staff to utilizc the building by simply c1caning up and making minor repairs, All three

warming houses at Freeway, Hazelnut, and Valentine Parks have maintenance issues that should
be addressed, Staff has listed each site and the options for the future.
Freewav and Hazelnut Parks
Attendance:
. Freeway Park: Attendance at Freeway Park is strong. The 2005/2006 season was
very mild and afTected the days open and quality of ice, Despite those challenges,
Frceway remains a popular rink. The attendancc was down from 1,133 last year to
6 I 6 this year. The attendance summary is attached for your inf01mation, (Attachment
7B~2) In addition, the City rents the rink out to Bcthel Univcrsity after hours for thcir
intramural broomball program. Those broomball participants arc not includcd in the
attendancc count.
. Hazelnut Park: Attendance at Hazelnut Park continues to be strong, Attendance
was down from J,] 48 last year to 716 this year. As with Freeway Park, the
2005/2006 season was very mild and affected the days open and quality oriee,
Building Condition:
These buildings arc utilized fix approximately three months out of the year. Thcy are closed and
used felr storagc the rest of the year. This has contributcd to pcst infestation and damagcs rclatcd
to that. The buildings are also not aesthetically pleasing. Photos dcpicting the conditions of the
wanDing houses are attached. (Attachmcnt 7B~3) The PTRC has put olT recommendation of
replacement of these buildings for numerous reasons but in particular, because they are only
utilized three months out of thc year. It was detern1ined in past discussions at vmious PTRC
meetings that Hazelnut and Frceway Park would not be good candidates for combination
warming house/picnic structurcs (similar [0 Cummings Park) because the current wanning
houses are not in locations where picnicking would occur. ]n these discussions, the PTRC
voiccd concerns about investing large amounts of money on structures that are only utilized three
months out of the year. The PTRC wanted to look at all possible options. Below are options for
Hazelnut and Freeway parks:
(I) OPTION A: Rcpair cxisting buildings.
A building inspection rep011 is included with this memo. (Attachmcnt 7BA)
The recommended repairs for .Freeway are estimated at $1,691 plus labor
(highest option). The recommended repairs for Hazelnut arc estimated at $1,103
plus labor (highest option).

The estimated annual eost for this option would be $1,349.10 per site plus the
one time cost of electrical relocation of $3,825 for Freeway Park and $1,600 for
Hazelnut Park. \Ve would ineur a $285 fee per site for a 20 yard dumpster for
tear down. Tear down figures do not include labor.

(3) OPTION C: Build a small portah]e building that can be stored olf site during the off
season and brought in during the link season,
This has bcen done for the City of St Michael. The building was built in ] 999 at a
cost 0[$5,000. Mr. Ed Haller, Pubic Works Superintendent for St Michael, referred
to the huilding as an "oversized ice fishing house," Pictures o[ this option arc
attached. (Attachrncnt 7B-8) The building specillcations is below:
. 16 loot wide by 20 foot long, vinyl on the outside and plywood on the inside. It .
has one door and two windows.
. St. Michael Puh]ic Works has a certified carpenter on staff that was responsible
for this project It was constructed during the winter months.
. It has skids, in place of wheels bccause it can hc dragged to the winter location,
approximately 500 teet
. It is only used during ice skating season.
. It has a hcater and one toilet stool. They pay BIFFS, Ine. to hook up a waste
water tank, similar to what cxists in an outdoor toilet
. If they had to build it again, they would make it longer and use wheels instead of
the skids.
The total estimated overall cost for this option is $8,825 for Freeway Pa,.k and
$6,600 at Hazelnut Park, which includes a one time building cost of $5,000 per
site plus a one time cost of $3,825 for electrical relocation at Freeway Park and
$1,600 at Hazelnut Park. 'Ve would incur a $285 one time fee per site for a 20
yard dumpster for tear down. These figures do not factor in building or tear
down labor costs.

. Staff is currently waiting for an estimate on the cost to move the Cummings
and/or Valentine Park buildings to Hazelnut or Freeway.
The lotal estimated eost for this option would be $]9,679.00 per site.

Valentine Park
Attendance:
Attendance at this park has always been low; however, the numbers continue to declinc, The
attcndanee went from 216 users last winter to ] 14 this winter. The mild winters have made
maintaining thc ice difficult at this park_
Building Condition:
The area where the warming house is located f100ds every spring due to the fact that it is at a
lower elevation than Lake Valentine and the ice rink. Evcry ycar after the spring f1ood, the
\vanning house lnust be cleaned, disinfected and rotted wood and insulation removed. This
requires Operations and Maintenance staff to completely clear out the building in order to spray
and clean the inside. The yearly f100ding that occurs has beh>un to cause long tenn maintenance
issucs and has atTccted the building's stmctural integrity.
(l) OPTION A: Tcar down the existing warrning house and do not replaee_
The rink would remain open wilhout a warn1ing bouse. The rink would bc
maintained by the Operations and Maintenance staff. A timer could be installed on
the rink ligbts for automatic turn on and off. Staffing costs for each site are budgeted
at approximately $2,656_29 per rink, This considers wages lor all hours possible
throughout the season and FlCA:

from the building to the pole. Figures for the tear down do not factor in labor
costs.

not include labor) plus a one time electrical relocation fee of $1,423. We would
also incur a one time $285 fee for a 20 yard dumpster. These figures do not
factor in building or tear down labor costs.
4) OPTION D: Renovate Valentine Park to fix the drainage/grading issues.
. 'T'he cun'cnt condition of thc park is a direct cause of the rink quality being poor.
Renovation of the park possibly could alleviate the maintenance issues and
incrcase attendance,

Common Signs of Rodent Infestation
Remember that not all types 01' rodents carry hantavirus. Neither common
house mice 1I0r common rats have been associated with HPS ill humans,
for example. Yet because it can bc tough to tell just what kind 01' rodents
you have, play it safe -- dean up the infestation and rodent-proof your
home or workplace.
Here arc some common signs that you may have a rodent problem.
Rodent Droppings
This is one of the most reliable signs
that you have a rodent problem. You
may find droppings in places where
you store your food or your pet/animal
food, such as in cupboards and drawers
or in bins. Bccause mice like to run in
places that offer them some protection
from predators, you may find
droppings in cupboards or under the
sink, along walls, or on top of wall
studs or beams. Mice will leave droppings near their nests as well (see below).
Storage rooms, sheds, barns, or cabins loaded with boxes, bags, old furniture,
and other objects make an ideal home for rodents, so you may find droppings
there, even inside boxes and other containers.
Workplaces can also makc good rodcnt homes. Warehouses, restaurants, and
the like are obvious placcs to look bccause food may bc plentiful there.
However, rodents can infest officc buildings, too. Once again, look for
droppings in protccted places, such as closets, storage rooms, or inside boxes.
Signs ol'Rodcnt Nests
Rodents tend to build their nests from materials that are soft, fuzzy, or warm.
Among common rodent nest materials are shredded paper, bunches of dry !,'Tass
or small twigs, fablic, and furniture stuffing_ Rodents will nest wherever safety
from enemies can be found close enough to food and water, and thcy prefer

Signs of Rodent "Feeding Stations"
These are semi-hidden spots where rodents eat food they have collected. At
these stations, rodcnts may leave larger-than-normal amounts of
droppings/urine, plus remnants ofa variety of foods (such as nut shells), bits of
plastic or paper, and cockroach carcasses,
You Find Evidence of Gnawing
To get to food, rodents will gnaw on almost anything that Thursday, August 5,
2004eludes such things as wood, paper board, cloth sacks, and materials even
harder than these. Because rodents' teeth grow continuously, they must gnaw to
keep them short. That may hclp to cxplain why chair legs or similar surfaces
show gnawed spots or tooth marks in rodent-infested places.
You Notice an Odd, Stale Smell
In closed-up rooms infested by rodents, you will commonly smell an unusual,
musky odor.
You See a Mouse in Your Honse
Rodents are normally active at night, and generally avoid humans. If you have
rodents, unlcss the infestation is large, you may ncvcr sec one.

Hantavirus pulmonary syndrome (HPS) is a deadly disease transmitted
by infected rodents through urine, droppings, or saliva. Humans can
contract the disease when they breathe in aerosolized virus. Rodent
control in and around the home remains the primary strategy for
preventing hantavirus infection, Through January 5, 2005, a total of 384
cases of hantavirus pulmonary syndrome have been reported in the
United States.

Clean up urine and droppings
Take precautions before and while cleaning rodent-infested areas.
Before cleaning a space, ventilate the area by opening the doors and
windows for at least 30 minutes to diffuse potentially infectious
aerosolized material. Use cross-ventilation and leave the area during the
airing-out period.
When you begin cleaning, it is important that you!:lon6t stir up dust by
sweeping or vacuuming up droppings, urine, or nesting materials. Wear
rubber, latex, vinyl, or nitrile gloves when cleaning urine and droppings.
Spray the urine and droppings with a disinfectant or a rnixture()fbl(lac_hi
ahd water' and let soak 5 minutes. The recommended concentration of
bleach solution is 1 part bleach to 10 parts water. Use a paper towel to
pick up the urine and droppings, and dispose of the waste in the
garbage. After the rodent droppings and urine have been removed,
disinfect items that might have been contaminated by rodents or their
urine and droppings.
Mop floors and clean countertops with disinfectant or bleach solution,
Steam clean or shampoo upholstered furniture and carpets with
evidence of rodent exposure. Wash any bedding and clothing with
laundry detergent in hot water if exposed to rodent urine or droppings.
Lastly, before removing gloves used while cleaning, wash gloved hands
with soap and water or spray a disinfectant or bleach solution on gloves
before taking them off. Wash hands with soap and warm water after
removing gloves.
Clean up dead rodents or nests
Wear rubber, latex, vinyl, or nitrile gloves when cleaning up dead
rodents or nests. Spray the dead rodent or nest and the surrounding

nesting materials or droppings in solution for 5 minutes before wiping up
with a paper towel or rag. Place the dead rodent or nesting materials in
a plastic bag and seal tightly. Place the full bag in a second plastic bag
and seal. Throw the bag into a covered trash can that is regularly
emptied.
Wash gloved hands with soap and water or spray a disinfectant or
bleach solution on gloves before taking them off. Wash hands with soap
and warm water after taking off your gloves.
Clean up cabins, sheds, barns, or other outbuildings
Before attempting to clean cabins. sheds. barns, or other outbuildinqs,!
. Open all doors andwindoWs,for 30 minutes to allow for the diffusion of
potentially infectious aerosolized material. Wear rubber, latex, vinyl, or
nitrile gloves and clean up all rodent urine, droppings, nests, and dead
rodents using disinfectant or bleach and water. Mop floors or spray dirt
floors with a disinfectant or mixture of bleach and water. Clean
countertops, cabinets, and drawers with a disinfectant or a mixture of
bleach and water.
Clean up heavy rodent infestation
Special precautions should be used for cleaning homes or buildings with
hea'L)' rodent infestation. Also, workers who are either hired specifically
to perform a clean-up or asked to do so as part of their work activities
should receive specific training about hantavirus from a health agency.
The special precautions may also apply to vacant dwellings that have
attracted large numbers of rodents and to dwellings and other structures
that have been occupied by persons with confirmed hantavirus infection.
Persons involved in the clean-up should wear coveralls (disposable, if
possible); rubber boots or disposable shoe covers; rubber, latex, vinyl,
or nitrile gloves; protective goggles; and an i'lQjJrojJDaterl:l!>Rlrato_ry
protection device, such as a half-mask air-purifying (or negative-
pressure) respirator with a high-efficiency particulate air (HEPA) filter or
a powered air-purifying respirator (PAPR) with HEPA fillers. Personal
protective gear should be decontaminated upon removal at the end of
the day. All potentially infective waste material (including respirator
filters) from clean-up operations that cannot be burned or deep buried
on site should be double bagged in appropriate plastic bags. The
bagged material should then be labeled as infectious (if it is to be
transported) and disposed of in accordance with local requirements for
infectious waste.

Eliminate possible rodent food sources. Keep food in thick plastic or
metal containers with tight lids. Clean up spilled food right away and
wash dishes and cooking utensils soon after use. Always put pet food
away after use and do not leave pet-food or water bowls out overnight.
Use a thick plastic or metal garbage can with a tight lid. Keep compost
bins 100 feet or more from the house. Keep grains and animal feed in
thick plastic or metal containers with tight lids. In the evening, uneaten
animal feed should be returned to containers with lids.
If storing trash and food waste inside the home, do so in rodent-proof
containers, and frequently clean the containers with soap and water.
Dispose of trash and garbage on a frequent and regular basis, and pick
up or eliminate clutter.
Eliminate possible nesting sites outside the home. Elevate hay,
woodpiles, and garbage cans at least 1 foot off the ground. Move
woodpiles 100 feet or more from the house. Get rid of old trucks, cars,
and old tires that mice and rats could use as homes. Keep grass and
shrubbery within 100 feet of the home well trimmed.

Special Precautions for Homes of Persons with Confirmed
Hantavirus Infection or Buildings with Heavy Rodent Infestations
Special precautions should be used for cleaning homes or buildings with heavy
rodent infestations in areas whcre HPS has bcen reported. If you are altempting
to deal with such an infcstation, it is recommended that you contact the
responsible local, state, or federal public health agency for guidance,
The spccial precautions may also apply to vacant dwellings that havc attracted
numbcrs of rodents while unoccupied and to dwellings and other structurcs that
have bcen occupied by persons with confirmed hantavirus infection.
Workers who are either hired specifically to perfonn the clean-up or asked to
do so as part of their work activities should receive a thorough orientation from
the responsible health agency about hantavirus transmission and should be
trained to perform the required activities safely,

Staff was requested to do a visual inspection of the structural and huilding aspects of the
warming house at Frccway and Hazelnut Park.
Observation
At Freeway Park the following observations were madc.
. No stmctural issues were observed. Roof and floor systems could not adequately be
inspected due to cciling and floor coverings, Recommend reinspection of roof after
ceiling covering is removed.
. Noticed strong smell of what appeared to be a by product of rodent wastc, This was
apparcnt from the ceiling damage/staining that many rodents were living in the attic
spacc, Rodent holes also appeared in the ontside wall bottom plates allowing thc rodents
to cnter the building from the floor area. Also noticed significant damage of thc sonit and
fascia which allows rodents to access the attic space,
. Roofing could not be adequately assessed due to the snow on thc roof. Jim Perron stated
that the roof needed to be replaced,

It should be noted that the abovc recommendations are to address immediate concerns, Thc
buildings are generally in poor condition and will need additional repairs in the near future. Thc
odor issue at Freeway Park may not be resolved with a sealant. Health issues may also be of
concern.

Per your request, I have reviewed the existing conditions at Valentinc Park. The park currently
expcricnces drainage problems due to the minimal difference in elevation between the park and
the ordinary water level of Lake Valentine.
The Local Stormwater Management Plan preparcd by SEH in 200] identifies Valentine Park as
the location of a regional pond. The proposed rcgional pond would serve a drainage area of 58
acres. Thc proposed size of the pond, as rcported in the management plan, is 2A6 acres in
surface arca, or approximately 85% of thc area of the park,
The Parks, Trails and Open Space Plan prepared by the PTRC in 2002 proposed improvemcnts
to Valentine Park. The proposal includes two ponding arcas, storm sewer and overall drainage
improvements, replacement of park and play structures, the parking lot and the construction of a
new trail. Estimated costs wcre listed at $]40,000 lor these improvements,
Due to an increase in construction costs over the last 5 years, a revised estimate should be used
for planning and budgeting purposcs. An estimated cost for pond construction, drainage
improvements (regrading the park), basic landscaping, and parking lot, trail and half-court
basketball construction is about $220,000, including estimated engineermg fees. This cost is
preliminary and does not include park structurc improvements.
A study of the entire drainagc arca is recommend cd prior to improvements at thc park, This
would assist in preventing adjaccnt prope11ies and thc neighborhood overall from cxperiencing
drainage problems as a result of changes made to the park.

BACKGROUND
On May 9, 2006, the Operations and Maintenance Superintendent notified City Hall staff that
one banner and a few brackets along County Road E needed to be replaced, Staff found that 20
banners were purchased on June 30, 2003 for $2,787.67 from Mooney and Company, Inc.
Sixteen of these banners were utilized on County Road E and three were placed at City Hall, We
had one spare, which we have already used. In an attempt to order replacement banners, staff
discovered that Mooney and Company, Inc. has gone out of business. Therefore, in order to
replace our current banners, we will have to utilize a new company and incur an additional art set
up fee for the current design. The art work was done by Derrek Hames and he does have the
capability of reproducing the design for the City.
OPTIONS
Staff is taking this opportunity to ask for City Council input on the topic of banners. Below are
options for the City Council to consider:
1. Keep the current design and remove the banners at City Hall. These extra banners would
be used as spares for County Road E. If and when we need to order more banners for
County Road E, options would be explored at that time.
2. Seek quotes for the current design from a new company and order 2-4 replacement
banners and replacement brackets. This would mean incurring an art set up fee. Our
design would be on file for future replacement orders.
3. Direct staff to explore the possibility of changing the current design, City Council could
consider utilizing seasonal banners or special event banners.
The above options have been provided in ordcr to facilitate a discussion on banners.

Transportation Discussion: Highway 96 and Highway 10 Intersection
BACKGROUND
11 has been quite some time since the City Council discussed the topic of regional transportation.
When the City decided to re-join the I-35W Corridor Coalition, Council indicated that it was
important to try and reach agreement on City positions regarding various transportation topics
and issues. As a starting point, we agreed to talk about the intersection of Highways 10 and 96.
HISTORY
A few years ago there were some discussions about this intersection. In reviewing minutes from
the last five years, there really didn't appear to have been any real in-depth discussion, nor were
any positions formed. Items for consideration included:
. Local access concerns
. Should Highway 10 remain a part of the State's highway system, or become more of a
local street or parkway?
. If Highway 10 remains part of the highway system, should it be a full interchange or
simply an over pass over Highway 96?
Since the last time the Council discussed this topic, we have completed and approved TCAAP
framework Vision. The framework provides a better background for discussion regarding
transportation improvements by laying out a conceptual development (in very general terms).
A few years ago City staff met with MnDOT and Ramsey County staff to discuss transportation
needs as they relate to TCAAP, At that time MnDOT expressed concerns about merging and
safety issues on I-35W, and they desired to limit the nwnber of interchanges, They
recommended limiting the current access at County Road 1. This recommendation led to the
decision to show the north-south TCAAP arterial street on the west side of Rice Creek rather
than the east. We are aware that the Cities of Mounds View and Shoreview have concerns about
that current design and about limited access from County Road 1. Since that discussion a few
years ago, the Medtronic development deal occurred which resulted in a County Road J road
improvement. I don't know how that project affects the plans for County Roads I and H, but that
is something we hope to learn more about on June 19. Ken Haider informed us that with the .
County Road J bridge improvement, there was enough room designed for up to five lanes each
way on I35W under the bridge.
DISCUSSION
Ramsey County Director of Public Works Ken Haider has indicated to City staff that if Highway
10 continues to function in a similar manner to the current, the county position is that there needs
to be grade separation. He also indicated that plans for completing Highway 96 reconstruction
are uncertain due to the lack of MnDOT funding for the State's portion of the project. Whether
the intersection is a full interchange or an overpass depends on several factors, especially land
use.
Staff is scheduled to meet with MnDOT Area Manager Chris Roy on Monday, June 19. We
anticipate getting an update as to MnDOT's current position regarding this intersection and will
be able to update the Council at the Work Session, The most recent discussions with MnDOT
were with the former Area Manager Frank Pafko, who informed us that Highway 10 needs to
function as part ofthe highway system, and needs grade separation. If it doesn't function as part
of the highway system, the costs for the I-35W and 1-694 intersection become cost prohibitive
and significant additional right-of-way acquisition would be necessary.
OUTCOMES
City Council has indicated a desire to try and develop a City position regarding Highways 96 and .
10, Technical staff (i,e. engineering, Ramsey County, and MnDOT) can proceed more easily
with planning if they understand the position of the City, In order to arrive at such a position, it
would be helpful to discuss the City's goals as they relate to this topic.
GOALS
The following are possible goals which mayor not be important to the City as you develop a
position regarding Highways 96 and 10:
1. Maintain access
2. Ensure appropriate screening to minimize noise
3. Landscaping
4. Trail crossings
5. Limit traffic on Highway 10 (is it part ofthe highway system or not?)

Proposed Animal Control Ordinance
Minnesota State Statute 347.50
Overview
Due to recent legal litigation that the City was involved in, City staff has been preparing a
revised animal control ordinance for the City. The proposed ordinance would revise Section 400
of the Arden Hills City Code.
Section 400.04 "Dangerous Dogs" of the proposed ordinance describes in more detail the City's
procedures for dealing with a dangerous dog situation. The proposed ordinance addresses a
dangerous dog situation in the following manner:
1. Animal Control Officcr or law enforcement official is responsible for determining
whether a dog is potentially a dangerous dog or is a dangerous dog.
2. Animal Control Officer or law enforcement officials shall provide the owner with written
notification stating that the dog is potentially dangerous or is deemed dangerous. The
notice shall comply with the requirements stated in Minnesota statutes 347.50 through
347.53.
3. Any dog dcclared dangerous must havc a microchip implanted for identification purposes
within IS days of the date the dog is declared dangerous.
4. A dangerous dog must also be photographed by the Animal Control Officer for
identification purposes.
5. The owner of a dangerous dog may appeal the determination to the City Administrator
within ten days of receiving the written notification. If the owner appeals the decision
within ten days, a hearing shall be held within thirty days after the City's receives the dog
owner's appeal. The City Administrator shall assign a hearing examiner to hear the
appeal. The findings and conclusion of the hcaring shall be made within ten working

days after the hearing and a copy of the written report shall be presented to the dog's .
owner. The decision of the hearing examiner shall be the final decision of the City,
6. Animal control may require a dog declared dangerous to be sterilized within fifteen days
of the date the dog is declared dangerous or the date in which the final decision was made
by the City to declare the dog dangerous, If the property owner refuses to have the dog
sterilized, animal control may have the dog sterilized at the owner's expense. Also,
animal control may inspect the dog to make sure that it has been sterilized.
7. Animal control may retain custody of a dangerous dog pursuant to Minnesota Statute
347.50 and 347.51. Also, the owner of a dog that is declared dangerous must notify
animal control and the City in writing of the dog's death, transfer of its residence outside
of Arden Hills, or its transfer to the City of Arden Hills within thirty days.
The proposed ordinance adopts Minnesota State Statute 347.50 as the City's regulations for
handling a dangerous dog situation, The proposed language change would bring the City into
compliance with Minnesota state statute pertaining to dangerous dogs.
Also, the proposed ordinance also includes language that addresses the feeding of wild animals.
Residents would not be allowed to feed wild animals or mammals using grain, fruit, vegetables,
nuts, salt licks or any other food that attracts wild animals. Bird feed that is placed in a bird
feeding device is excluded from this provision.
Research
City staff has researched a number of animal control ordinances that have been implemented by .
communities throughout the metropolitan area. The following municipal animal control
ordinances were review by City staff in drafting the proposcd ordinance:

· League of Minnesota Cities animal control ordinance guidelines.
City staff incorporated language from the Cities of Shorevicw, Cottage Grove, Roseville, and
Minneapolis animal control ordinance into the proposed ordinance for the City of Arden Hills.
Staff Recommendation
City staff is seeking input from the City Council regarding the proposed animal control
ordinance. City Attorney Jerry Filla has reviewed the proposed ordinance and is comfortable
with the proposed ordinance that was created by City staff.

The City Council of the City of Arden Hills ordains that Section 400 of the Arden Hills
City Code is hereby amended to read as follows:
Chapter 4 Animals and Pets'
400.01 Definitions. The following definitions shall be used in the application and
interpretation of the provisions of this chapter:
1. Animal. Any non-human mammal, reptile, amphibian, or bird.
2.
Animal Control Officer. An individual or employee of a business retained
by the City for purposes of enforcing the provisions of this Chapter; or a
member of the City's law enforcement agency.
3. Animal. Domestic. Animals kept within the home as pets, such as fish,
dogs, cats, household bird, and similar animals.
4. Animal, Non-Domestic. Animals which are kept outside the home for
purposes of food or pleasure such as cattle, hogs, horses, bees, sheep,
goats, chickens, birds, such as falcons and pigeons, and similar animals.
5. Animal, Wild. Any animal which is of a species not usually domesticated
and of a species which, due to size, wild nature or other characteristics,
is dangerous to humans and would ordinarily be confined in a zoo or
found in the wild. The term includes but is not limited to:

(a) Animals and birds, the keeping of which is licensed by the state or .
federal government, such as wolves, raptors, and pheasants.
(b) Eagles, ocelots, jaguars, cougars, weasels, wild ferrets, badgers,
monkeys, chimpanzee, deer, and bison.
(c) Crossbreeds of wild animals and domesticated animals such as the
cross between dogs and coyotes and dogs and wolves.
(d) Any large cat of the family Felidae, such as lions, tigers, jaguars,
leopards, cougars and ocelots, except commonly accepted
domesticated house cats.
(e) Any member of the family Canidae, such as wolves, coyotes,
dingoes, and jackals, except domesticated dogs.
(f) Any poisonous snake such as a rattlesnake, coral snake, water
moccasin, puff adder, or cobra.
(g) Any snake or reptile which by its size, vicious nature or other
characteristic is dangerous to human beings.
(h) Any skunk, raccoon, or fox whether captured in the wild, .
domestically raised, descented or not descented, vaccinated
against rabies or not vaccinated against rabies.
(i) Any bear, ape, gorilla, monkey, or badger.
(j) Any other animal or reptile which is commonly considered wild.
6. At Large. An unattended animal on public property; or an unattended
animal on private property without the consent of the property owner.
7. Cat. Any domesticated feline animal, male or female, whole or
neutered.
8. Dangerous Animal. Any animal that has committed any of the acts set
forth below:
(a) Without provocation, inflicted substantial bodily harm on a human
being on public or private property;

(b) Killed a domestic animal without provocation; or
(c) A potentially dangerous animal which aggressively bites, attacks,
or endangers the safety of humans or domestic animals.
9. Dog. Any canine animal, male or female, whole or neutered.
10. Enclosure. Any structure, except a dwelling, designed to securely
enclose and prevent an animal from escaping therefrom and/or designed
to provide the animal with shelter and protection from the weather.
11. Owner. Any person, firm, or corporation, organization or department
possessing, harboring, keeping, having an interest in or having custody
or control of an animal.
12. Potentially Dangerous Animal. Any animal that has committed any of
the acts set forth below:
(a) When unprovoked, bites a human or domestic animal;
(b) When unprovoked, chases or approaches a person upon the streets,
sidewalks or any other public property in an apparent attitude of
attack; or
(e) Has a known propensity, tendency, or disposition to attack
unprovoked, causing injury or otherwise threatening the safety of
humans or domestic animals.
13. Restrained. On a leash of not more than six (6) feet in length or on a
leash which can be retracted to a length of six (6) feet or less, and in
the custody of a person of sufficient age to adequately control the
animal; in a vehicle; or confined to the owner's property by enclosure or
fencing.
14. Substantial Bodily Harm. Bodily injury which involves a temporary but
substantial disfigurement, or which causes a temporary but substantial
loss or impairment of the function of any bodily member or organ, or
which causes a fracture of any bodily member.
400.02 License Required. The following animal licenses shall be required within the City
of Arden Hills.

(A) Dog/Cat Licenses. All dogs and cats within the City of Arden Hills, except .
as hereinafter provided, shall be licensed.
1. Application. Within thirty (30) days after acquiring possession of
a dog or cat which has not been licensed by the City of Arden
Hills, the owner of the dog or cat shall make application for a dog
or cat license. The application shall be on forms provided by the
City of Arden Hills.
2. Vaccination. The applicant for a dog or cat license shall provide
proof that the animal has been vaccinated with anti-rabies
vaccine certified to be effective by a licensed veterinarian.
3. License Fee. The license fee for each dog or cat must be
submitted with the application. The fee will be established by
City Council Resolution.
4. Duration of License. A license shall be issued for a period of time
not to exceed the expiration date of the rabies vaccination. No
dog or cat license shall be renewed without proof of vaccination.
5.
Issuance of License. Upon completion of the application form,
receipt of the license fee and receipt of the proof of vaccination,
the City Administrator shall cause a dog or cat license to be

6. Receipt and Tags. The City of Arden Hills shall issue a license fee
receipt to the applicant along with a metallic dog or cat license
tag. The applicant shall permanently affix the tag by a metal
fastening device to the collar of the licensed animal in a manner
that allows the tag to be easily observed. If a tag is lost, a
duplicate may be issued by the City of Arden Hills upon
presentation of a receipt showing payment of the initial license
fee and upon payment of an additional fee for each duplicate tag.
7. Change of Address. An applicant who has obtained a dog or cat
license shall notify the City of the applicant's address changes
within the corporate limits of the City within ten (10) days of any
address change.

Counterfeit Tags. No person shall counterfeit or attempt to
counterfeit dog or cat license tags.

9.
Transfer of Tags. No person shall transfer a dog or cat tag from
one dog or cat to another.
10. Exceptions. The following dogs and cats are not required to be
licensed:
(a) Dogs and cats less than six (6) months of age.
(b) Dogs and cats whose owners are temporary visitors within
the City for thirty (30) days or less.
(c) Dogs and cats which are brought into the City for
appearance in an animal show.
(d) Dogs being used by law enforcement officers
(6) Wild Animal Licenses.
(1) General Prohibition. All wild animals except the following are
prohibited within the City of Arden Hills:
(a)
Wild animals brought into the City for entertainment,
exhibition or show purposes by persons keeping wild
animals for a public zoo.

(b) Wild animals which are part of a permanent display
sponsored by a bona fide research institution, a veterinary
hospital, public zoo or other institution.
(c) Nonpoisonous snakes, birds kept indoors, hamsters, mice,
rabbits, gerbils, white rats, guinea pigs, chinchillas, or
lizards and similar small animals capable of being kept in
cages continuously.
(d) Monkeys trained as personal helpers and kept by
handicapped persons.
(e) Raptors owned by licensed Falconers holding valid state
and federal Falconry permits so long as the conditions of
such permits are being satisfied.
(f) Wild animals and birds that are part of the natural habitat
and environment.

(2)
License Application. Applications for a Wild Animal License shall
be submitted on forms provided by the City along with a
Certificate of Insurance which indicates that applicant has
$200,000 of liability coverage on the Wild Animal and which
includes an endorsement indicating that the liability coverage will
not be cancelled without twenty (20) days written notice to the
City of Arden Hills.

(3) Investigation. The Animal Control Officer shall review the
application, conduct such investigation as the Animal Control
Officer deems necessary, and shall prepare a written
recommendation regarding the issuance of a Wild Animal License.
The City Administrator shall within ten (10) days mail a notice to
all property owners within 350 feet of the site on which the Wild
Animal will be kept. The notice shall indicate that the City has
received an application for a Wild Animal License and shall
request comments from such property owners.
(4) Review. The City Council shall review the application, the Animal
Control Officer's recommendations, and the comments from
property owners. The City Council may issue a Wild Animal
License if it determines that the application is in compliance with .
the City's regulations. The City Council may attach any
reasonable conditions to the issuance of a license as it determines
to be necessary in order to protect the health, safety, and
welfare of Arden Hills residents.
(5) Existing Wild Animals. Anyone keeping a Wild Animal in Arden
Hills at the time of the adoption of this regulation shall have
ninety (90) days in which to comply with the provisions of this
regulation or otherwise remove the Wild Animal from the City.
Extensions beyond ninety (90) days may be granted by the City
Council for good cause but in no case shall such extension
permanently exempt a person from the requirements of this
regulation.
400.03 Regulations.
(A) Except as herein provided, the owner of an animal within the City of
Arden Hills shall cause such animal to be confined to the individual's
property by adequate fencing, leash, or enclosure.

(B)
The owner of a female dog or cat in heat shall confine such animal to
the owner's property or any veterinary hospital/clinic, in such manner
that such female dog or cat cannot come into contact with other
animals, except for intentional breeding purposes.
(C) Except in designated off leash areas, the owner of an animal within the
City of Arden Hills shall cause such animal to be restrained at all times
while in a public place including but not limited to school properties,
trails, parks, open space areas, and streets.
(D) The owner of an animal within the City of Arden Hills shall prevent the
animal from becoming a nuisance by barking, baying, crying, or howling
in any manner for at least five (5) continuous minutes or intermittently
for unreasonable lengths of time.
(E) Cleaning up litter:
(1) The owner of an animal shall be responsible for cleaning up any
feces of the animal and disposing of such feces in a sanitary
manner.

(2)
The owner of an animal shall not permit such animal to be on
public property or the private property of another without having
in the owner's immediate possession, a device for the removal of
feces and a proper receptacle located on the property of such
animal owner.
(3) The owner of an animal shall remove feces left by such animal on
public property or the private property of another to a proper
receptacle located on property of the animal owner.
(F) No person shall keep more than three (3) dogs or three (3) cats on
residentially zoned property. The total number of combined licensed
animals per residentially zoned property shall not exceed four (4).
(G) The owner shall confine within a building or a secure enclosure, every
wild animal, dangerous animal, or potentially dangerous animal, and
shall not take such animal out of such building or secure enclosure,
unless such animal is securely muzzled.
(H)
It shall be unlawful for any dog or cat owner to keep or maintain any
dog or cat older than six (6) months of age unless it shall have been

vaccinated with an anti-rabies vaccine certified to be effective by a
licensed veterinarian. No license renewal shall be issued except upon
compliance with this section.
.
(I) A person who uses a dog for security purposes within the City of Arden
Hills shall post a warning notice at the entrance of the premises.
(J) It shall be unlawful for any person to keep or harbor a dangerous animal
or an unlicensed wild animal within the City.
(K) The owner of an animal within the City of Arden Hills shall provide said
animal with sufficient, wholesome food and water; proper shelter and
protection from weather; veterinary care when needed to prevent
suffering; and with humane care and treatment.
400.04 Danllerous DOllS. The provisions of Minnesota Statutes Sections 347.50
through and including 347.56 are hereby adopted as the potentially dangerous and
dangerous dog regulations for the City of Arden Hills. Every provision contained in
the foregoing Minnesota Statutes is hereby adopted and made a part of this
chapter by reference as if fully set forth herein. Where a conflict exists between
the provisions of the City Code and the provisions of Minnesota Statutes Sections .
347.50 through and including 347.56, the latter provisions shall apply.
(A) A City Animal Control Officer of other law enforcement official shall

dangerous dog or dangerous dog.
(B) Upon a determination by the Animal Control Officer or other law
enforcement officials that a dog is potentially dangerous or
dangerous, the City shall provide the owner with notice of the
determination by personally serving the owner or a person of suitable
age at the residence of such owner. The notice shall describe the dog
deemed to be potentially dangerous or dangerous, shall identify the
officer making the determination, and shall inform the owner of the
applicable obligations imposed by Minnesota Statutes Section 347.50
through and including 347.53 and subsection C5 of this section. If
the officer determines the dog to be dangerous, the notice shall also
inform the owner of the owner's right to appeal the determination.
(e) Any dog declared dangerous under this ordinance must have a
microchip implanted for identification purposes within fifteen (15)
days of the date the dog is declared dangerous or the date of a

decision in a hearing held pursuant to this ordinance, whichever is
later. The name of the microchip manufacturer and identification
number of the microchip must be provided to the animal control
officer and the City. If the microchip is not implanted by the owner,
animal control may have the microchip implanted at the owner's
expense. All costs related to the purchase and implementation of the
microchip must be borne by the owner of the dog. Upon request, the
owner of a dangerous dog must make the animal available to animal
control for an inspection to determine that a microchip has been
implanted.
(D)
The owner or custodian of any dog declared dangerous under this
ordinance shall make the dog available to be photographed for
identification by animal control at a time and place specified by
animal control.

(E) An owner may appeal a determination that a dog is dangerous by
filing a written request for a hearing to the City Administrator within
ten (10) days of the owner's receipt of the notice. If a timely appeal
is not filed, the owner of a dangerous dog must comply with the
requirements set forth in this section and Minnesota Statutes Sections
347.50 through and including 347.56. If an owner files a timely
appeal, a hearing shall be held within thirty (30) days after the City's
receipt of the appeal. The City Administrator shall assign a hearing
examiner to hear the apoeaL The hearini! examiner may be a City
employee. provided the employee has not been involved in
determining if the dOl! was potentially dangerous or dangerous.
During the hearing the Minnesota rules of evidence does not need to
be strictly followed and the records of the Animal Control Officer or
law enforcement officer shall be considered without further
foundation. After considering all of the evidence submitted, the
hearing examiner shall make written findings of fact and reach a
conclusion whether the dog is a dangerous dog. The findings and
conclusions shall be made within ten (10) working days after the
hearing and shall be thereafter personally served upon the owner or a
person of suitable age at the residence of such owner. The decision
of the hearing examiner shall be the final decision of the City.

(F) Animal control may require a dog declared dangerous under this
ordinance to be sterilized at the owner's expense within fifteen (15)
days of the date the dog is declared dangerous or the date of a
decision in a hearing held pursuant to this chapter, whichever is

later. If the owner does not have the animal sterilized, animal .
control may have the animal sterilized at the owner's expense. Upon
request, the owner or custodian of a dangerous dog must make the
animal available to animal control for an inspection to determine that
the dog has been sterilized.
(G) Animal control may retain custody of any dog declared dangerous
pursuant to Minnesota Statutes, Section 347.50 until the dog is duly
and property registered as required by Minnesota Statutes, Section
347.51.
(H) The owner of any dog declared dangerous must notify animal control
and the City in writing of the death of the dog; its transfer to
residence outside the City of Arden Hills; or its transfer within the
City of Arden Hills within thirty days of the death or transfer.
400.05 Dangerous Animals. Any animal that has committed any of the acts set forth
below:
(1 )
Without provocation, inflicted substantial bodily harm on a human being
on public or private property;
(2)
Killed a domestic animal without provocation; or
.
(3) A potentially dangerous animal which aggressively bites, attacks, or
endangers the safety of humans or domestic animals.
(A) No person owning or harboring or having the care or custody of a
dangerous animal shall suffer or permit such animal to go
unconfined on the premises of such person. A dangerous animal
is "unconfined" as the term is used in this section if such animal
is not securely confined indoors or confined in a secure enclosure
suitably sized for the animal so confined upon the premises of
said person. An "enclosure" is secure within the meaning of this
section if it is constructed of heave gauge mesh steel, or other
suitable material; consists of a top and sides, with the bottom of
such sides fastened along their perimeter to a slab floor of
concrete or other suitable material; where no slab floor is
provided, the sides must be embedded into the ground no less
than one foot; all access points of the enclosure must be locked
when the animal is confined therein. Animal control may seize an
animal that has been declared dangerous that is unconfined.

(B) No person owning or harboring, or having the care of a dangerous
animal shall suffer or permit such animal to go beyond the
premises of such person unless such animal is securely muzzled
and restrained with a chain not exceeding three (3) feet in
length, and having a tensile strength sufficient to restrain the
animal. Animals which are actively participating in recognized
local, regional or national trials, training or other such sponsored
competition, need not to be muzzled while being transported to
or from during such competitions.
(C) No person shall own or harbor any animal for the purpose of
fighting, or train, torment, badger, bait or use any animal for the
purpose of causing or encouraging said animal to unprovoked
attacks upon human beings or domestic animals.
(D) Any person harboring or owning a dangerous animal that is found
to be in violation of this ordinance shall be subject to 400.13 of
this Code.
400.06 Enforcement. The provisions of Sections 400.01 through 400.14 shall be
enforced by the Animal Control Officer. No person shall, in any manner, interfere
with or hinder an Animal Control Officer in the discharge of their duties.
400.07 Exemptions. The following provisions of this Chapter shall not apply in the
following circumstances:
(A) Unless specified herein, the provisions of this Chapter shall not apply to
animals used or confined at hospitals, clinics, or businesses operated by
licensed veterinarians.
(B) Regulations relating to vaccination requirements shall not apply to any
animal belonging to a nonresident of the City and kept within the City
for no longer than thirty (30) days, provided all such animals shall, at all
times while in the City, be restrained by the owner on the property
which the owner is occupying within the City of Arden Hills.
(C) Regulations relating to dangerous animals and potentially dangerous
animals shall not apply to dogs under the control of a law enforcement
officer.
400.08 Seizure and Removal of Animals. Subject to the provisions of this section,
animals found in violation of this chapter may be seized by the Animal Control
Officer, impounded in a designated animal shelter, and confined therein in a humane

manner for a period of not less than five (5) business days or until claimed by the
animal's owner, whichever occurs first.

(A) Animal Control Officers shall not enter the private dwelling of an
individual for purposes of seizing animals or otherwise enforcing the
provisions of this Chapter without first obtaining a search warrant.
However, an Animal Control Officer is empowered to enter upon a
property adjacent to a private dwelling for purposes of enforcing the
provisions of this Chapter.
(B) Before seizing an animal on private property, the Animal Control Officer
shall make a reasonable attempt, taking into consideration the time of
day and nature of the violation, to notify the owner that the animal is
being seized because it was observed by the Animal Control Officer to
be in violation of the provisions of this Chapter.
(e)
When an animal is seized from the private property of its owner and the
Animal Control Officer has been unable to notify the owner of the
reason for seizing animal, the Animal Control Officer shall leave a
written notice affixed to the dwelling unit, in a conspicuous manner,
which includes the following information;
(1) A description of the animal seized.

(2) Purpose for seizure of the animal.
(3) The time, place and circumstances under which the animal was
seized.
(4) The location, address, telephone number, and contact person
where the animal will be impounded.
(5) A statement indicating that the person claiming the animal will
be required to pay for the fees and costs associated with
impoundment of the animal.
(6) A statement indicating that failure to claim the animal within five
business days will result in the disposition of the animal.
(D) Immediately upon impounding animals, reasonable efforts shall be made
to notify the owner and inform the owner of the animal's confinement
and the procedures for release of the animal to the owner.

(E) An animal which is not redeemed within five (5) business days after
impoundment may be disposed of in any manner provided by law. Any
animal which is not claimed by the owner or sold, shall be euthanized
and disposed of in a sanitary manner by the Animal Control Officer.
(F) The title of all animals seized and held at the animal shelter may be
transferred to the Humane Society after the legal detention period has
expired and the animals have not been claimed by their owners.
(G) Animals taken into custody pursuant to the provisions of Minn. Stat.
343.22 or 343.29 shall be disposed of pursuant to the provisions of Minn.
Stat. 343.235.
400.09 Impoundment Fees. Any animal impounded hereunder may be reclaimed by
the owner of such animal within five (5) business days after such impoundment.
Before the owner shall be permitted to recover possession of the animal, the owner
shall pay the Animal Control Officer all required fees and costs of impoundment.
400.10 Rabies Control.
(A) The Minnesota Health Laws and Regulations are hereby adopted in cases
of rabid animals which have bitten any person or animals suspected of
being rabid.
(B) It shall be the duty of every physician to report to the City the names
and addresses of persons treated or bites inflicted by animals together
with other information helpful in rabies control.
(C) It shall be the duty of every licensed veterinarian to report to the City
his diagnosis of any animal observed by him as a rabies suspect.
(D) Whenever the prevalence of rabies or hydrophobia renders such action
necessary to protect the public health, safety and welfare, the Mayor
shall issue a proclamation ordering every person owning or in possession
of a dog to confine it securely to the premises unless it is muzzled so
that it cannot bite. No person shall violate this proclamation.
400.11 Bitin~ Animals To Be Quarantined. Whenever an animal has bitten a
person, or whenever a known or suspected rabid animal is picked up by the Animal
Control Officer or law enforcement officer, such animal shall be confined for a
minimum of ten (10) days as follows:

(A) Upon proof of a current rabies vaccination, the owner of the animal
may, with the consent of the Animal Control Officer, quarantine the
animal at the owner's residence provided that such animal shall not be
permitted to come in contact with other animals or persons and,
provided further that the animal shall be muzzled and on a leash not to
exceed four (4) feet, and in control of a competent person when taken
from the place of confinement for sanitation purposes.

(B) If no proof of a current rabies vaccination is provided, or if the Animal
Control Officer does not consent to confinement of the animal to the
owner's residence, the animal shall be quarantined at the animal shelter
or a licensed veterinary clinic at the expense of the owner.
(C) A quarantined animal shall not be removed from the place of
confinement without the written permission of the Animal Control
Officer.
(D) A quarantined animal shall be confined in an enclosure constructed of
materials suitable to prevent the animal from escaping. All openings to
the enclosure shall be locked at all times and the animal shall not be
removed from the enclosure unless the animal is muzzled on a leash not e
exceeding four (4) feet in length and in control of a competent person.
400.12 Additional Fee and Proof of Insurance as to Potentially Dan~erous Animals.
The owner of a potentially dangerous animal shall pay an additional annual fee as
determined by Council Resolution and shall provide the City of Arden Hills, annually,
with proof of liability insurance which covers damages that may be caused by such
animal.
400.13 Summary Destruction. Whenever an Animal Control Officer has reasonable
cause to believe that a particular animal represents a clear and immediate danger to
the residents of the City of Arden Hills because it is infected with rabies or because it
is a dangerous animal, the Animal Control Officer, after making reasonable attempts
to impound such animal, may summarily destroy the animal.
400.14 Intentional Feedin~ of Wild Animals
(A) Feedin~ Prohibited. No person shall feed wild animals or small
mammals within the City. Intentional feeding shall mean the provision
of any grain, fruit, vegetables, nuts, salt licks, or any other food that

attracts wild animals. Living food sources such as trees and other live
vegetation shall not be considered food for wild animals.
(B)
Feedinr{ Wild Birds. Bird feed may be placed in bird feeding devices and
structures solely for the purpose of attracting and feeding wild birds.
Bird feeding devices and structures should be placed at a sufficient
height or designed to prevent access by wild animals.
(C)
Exception. This shall not apply to the employees or agents of the City,
County, State, and the Federal government or veterinarians who in the
course of their official duties have wild animals in their custody or under
their management.
The Arden Hills City Council ordains that Section 400 and its subdivisions are hereby
repealed.
Adoption Date: Passed and adopted by the City Council of the City of Arden Hills the
10th day of July, 2006.
Effective Date: This Ordinance shall be effective the day following its publication or
on the day following the publication of an Ordinance Summary approved by the City
Council.

proper enclosure does not include a porch, patio, or any part of
a house, garage, or other structure that would allow the dog to
exit of its own volition, or any house or structure in which
windows are open or in which door or window screens are the only
obstacles that prevent the dog from exiting.
Subd. 5. Owner. )lOwner" means any person, firm,
corporation, organization, or department possessing, harboring,
keeping, having an interest in, or having care, custody, or
control of a dog.
Subd. 6. Substantial bodily harm. 11 Substantial
bodily harm" has the meaning given it under section 609.02,
subdivision 7a.

347.51 Dangerous dogs; registration.

Subdivision 1. Requirement. No person may own a
dangerous dog in this state unless the dog is registered as
provided in this section.

certificate of registration to the owner of a dangerous dog
pursuant to subdivision 2, the county must provide, for posting
on the ownerls property, a copy of a warning symbol to inform
children that there is a dangerous dog on the property. The
design of the warning symbol must be uniform and specified by
the commissioner of public safety, after consultation with
animal control professionals, The commissioner shall provide
the number of copies of the warning symbol requested by each
county and shall charge the county the actual cost of the
warning symbols received.. The county may charge the registrant
a reasonable fee to cover its administrative costs and the cost
of the warning symbol.
Subd. 3. Fee. The county may charge the owner an
annual fee, in addition to any regular dog licensing fees, to
obtain a certificate of registration for a dangerous dog under
this section.
Subd. 3a. Dangerous dog designation review.
Beginning six months after a dog is declared a dangerous dog, an
owner may request annually that the animal control authority
review the designation. The owner must provide evidence that
the dogls behavior has changed due to the dog's age, neutering,
environment, completion of obedience training that includes
modification of aggressive behavior, or other factors. If the

animal control professionals, shall provide by rule for the
design of the tag.
Subd. 8. Local ordinances. A statutory or home rule
~ter city! or a county, may not adopt an ordinance regulating
~erous or potentially dangerous dogs based solely on the
specific breed of the dog. Ordinances inconsistent with this
subdivision are void.
Subd. 9. Contracted services~ A county may contract
with another political subdivision or other person to provide
the services required under sections 347~?O to 347.54.
Notwithstanding any contract entered into under this
subdivision, all fees collected under sections 347.50 to 34'7.54
shall be paid to the county and all certificates of registration
must be issued in the name of the county.

347.515 Microchip identification.

The owner of a dangerous or potentially dangerous dog must
have a microchip implanted in the dog for identification, and
the name of the microchip manufacturer and identification number
of the microchip must be provided to the animal control
authority. If the microchip is not implanted by the owner, it
may be implanted by the animal control authority_ In either
case, all costs related to purchase and implantation of the
microchip must be borne by the dogls owner.

(a) An owner of a dangerous dog shall keep the dog, while
on the owner's property, in a proper enclosure. If the dog is
outside the proper enclosure, the dog must be muzzled and
restrained by a substantial chain or leash and under the
physical restraint of a responsible person. The muzzle must be
made in a manner that will prevent the dog from biting any
person or animal but that will not cause injury to the dog or
interfere with its vision or respiration.
(b) An owner of a dangerous dog must renew the registration
of the dog annually until the dog is deceased. If the dog is
removed from the jurisdiction, it must be registered as a
dangerous dog in its new jurisdiction.
(c) An owner of a dangerous dog must notify the animal
control authority in writing of the death of the dog or its
transfer to a new jurisdiction within 30 days of the death or
transfer, and must, if requested by the animal control
authority, execute an affidavit under oath setting forth either
the circumstances of the dog's death and disposition or the
complete name, address, and telephone number of the person to
whom the dog has been transferred.
(d) An animal control authority may require a dangerous dog
.e sterilized at the owner's expense. If the owner does not
the animal sterilized, the animal control authority may
have the animal sterilized at the owner's expense.
(e) A person who owns ~ dangerous dog and who rents
property from another where the dog will reside must disclose to
the property owner prior to entering the lease agreement and at
the time of any lease renewal that the person owns a dangerous
dog that will reside at the property.
(f) A person who sells a dangerous dog must notify the
purchaser that the animal control authority has identified the
dog as dangerous. The seller must also notify the animal
control authority in writing of the sale and provide the animal
control authority with the new owner's name, address, and
telephone number.

(b) If an owner of a dog is convicted of a crime for which
the dog was originaLLY seized, the court may order that the dog
be confiscated and destroyed in a proper and humane manner, and
that the owner pay the costs incurred in confiscating,
411iining, and destroying the dog.
Subd. 2. Reclaimed. A dangerous dog seized under
subdivision 1 may be reclaimed by the owner of the dog upon
payment of impounding and boarding fees, and presenting proof to
the appropriate animal control authority that the requirements
of sections 347.51 and 347.52 will be met. A dog not reclaimed
under this subdivision within seven days may be disposed of as
provided under section 35.71, subdivision 3, and the owner is
liable to the animal control authority for costs incurred in
confining and disposing of the dog.
Subd. 3. Subsequent offenses; seizure. If a person
has been convicted of a misdemeanor for violating a provision of
section 347.51 or 347.52, and the person is charged with a
subsequent violation relating to the same dog, the dog must be
seized by the animal control authority having jurisdiction. If
the owner is convicted of the crime for which the dog was
seized, the court shall order that the dog be destroyed in a
proper and humane manner and the owner pay the COSL of confining
and destroying the animal. If the person is not convicted of
the crime for which the dog was seized, the owner may reclaim
the dog upon payment to the animal control authority of a fee
for the care and boarding of the dog. If the dog is not
reclaimed by the owner within seven days after the owner has
been notified that the dog may be reclaimed, the dog may be
disposed of as provided under section 35.7l, subdivision 3, and
the owner is liable to the animal control authority for the

2006 PMP Update (Rain Garden Maintenance)
BACKGROUND
. Rain gardens havc becn includcd as a part of the storm water improvements to the 2006 PMP
Ridgewood Neighborhood project. Since the neighborhood is fully developed and also limited
due to rolling topography, we were unable to size the proposed stonn water ponds to traditional
National Urban Runoff Program (NlJRP) standards for treatment of the storn1 water that flows
through them. URS has worked with Rice Creek Watershcd District (RCWD) to provide
additional storm water treatment using other design features, including the proposed rain
gardens.
DISCUSSION
There has been a strong interest expressed by residents and thc RCWD to include upstream
infiltration by the use of infiltration rain gardens. The current design has identified 15 locations
where residents have agreed to rain gardens, which would benefit the function and effectiveness
of the ponds and sewer network. The use of rain gardens does not eliminate the need for a storm
sewer system, but will aid in improving the water quality.

Rain gardens are areas where storm water is captured and allowed to infiltrate illto the ground.
They are shallow (<32", usually <8" for residential) depressions, typically planted with water
absorbing native plants, strategically located to collect, infiltrate, and filtrate rain that falls on
hard surfaces like roofs, driveways, alleys, or streets to minimize negativc impacts of excessive
runoff from these surfaces on lakes and streams. The rain gardens would be constructed to
overflow back into thc strect, to prevent yards and homes from flooding.

Staff requests that Council consider options for the maintenance of these rain gardens. Several
options are described below. Council should keep in mind that future pavement management
projects may also include rain gardens, and a maintenance policy should be established that
could be applied to all projects.
One option is for the City to maintain the rain gardens. Some residents have indicated that since
the rain gardens are a part of the project and are incorporated into the overall water quality
design, they should be maintained by the City. This was also one of the additional requests of the
Arden Hills Island Beach Club.
Another option is to have an informal agreement with property owners. Other cities, such as
Maplewood and Bumsville, have such agreements. These cities have focused heavily on
educating the public on the benefits of rain gardens and the importance of proper maintenance.
To date all of the residellts participating in the rain garden programs have been very cooperative
and have properly maintained the rain gardens. Neither city has experienced a sale of property
with a rain garden and do not know how effective all informal agreement carries over to a new
property owner. Both City Councils have been supportive ofthe rain garden projects completed
to date, and encourage their staffs to continue the program in future projects.

A third option is to prepare a formal maintenance agreement between the city and the property
owner. The document would indicate that the plants would be paid for by the City that a
conservation easement would be placed over the area, and the property owner would be required
to maintain the rain garden. The formality of this option may frighten otherwise interested
residents from agrccing to a rain garden 011 their property.
CONCLUSION
Staff is requesting guidance from Council as to how to proceed with rain garden maintenance.
ADDENDUM
There may be additional new/updated information regarding the 2006 PMP project that will be of
interest to the City Council. A progress report on other matters relating to the project will be
verball y presented at the meeting.
