Pursuant to due call and notice thereof a regular meeting
of the Village Council of the Village of Arden Hills, Minnesota,
was duly held in the Village Hall in said Village on Monday,
the 8th day of November, 1971, at 8:00 o'clock p.m.
'!'he following members were present: Mayor Crepeau and
Councilmen Hbllenhorst, Olmen, Henderson, and Barrick.
and the following were absent: None.
Also in attendance were: Mrs. Lorraine Stromquist, Clerk
Administrator; Richard O'Kelly, Treasurer; Don Lund and Don
Christofferson, village consulting engineers; and Peter S.
Popovich, village bond consultant.
'!'he Village Clerk Administrator presented an affidavit
showing publication of notice of hearing on the proposed
assessment for Floral Drive water Improvement No. 71-1 in the
New Brighton Bulletin on October 21, 1971, which affidavit was
examined, found satisfactory, and ordered placed on file. The
Clerk Administrator also exhibited a certificate Mailing Notice
of Hearing to all affected property owners.
'!'he Mayor announced that the meeting was open for the
consideration of objections, if any, to said proposed assessment.

All persons present were then given an opportunity to present
oral objections and all written objections theretofore filed
with the Village Clerk Administrator were presented and con-
sidered, and all such objections were tabulated as follows:

MR. STEPHEN KRANNAK, 1761 Fernwood, Roseville: Asked if
his property included in the improvement is considered commer-

MR. WILLIAM A. FEYEREISEN, 4261 N. HaInline: Asked for the
percentage the assessments will raise of the total cost of the
improvement and how that percentage compares with previous water
assessments in the village. Be thought the 84% assessments were
high in comparison to other water improvements. was informed
that some village owned property had been included in the
assessments.
MR. GEORGE REILING, 3411 Vivian, Shoreview: Pointed out
that he was being assessed 100% for water Dnprovement No. 70-1
and Sanitary Sewer Improvement No. 16 and asked why he should
have to pay for a portion of Water Improvement 71-1 through
general taxes.
MR. ROBERT W. ANDERSON, JR., 1357 Floral Drive: Has been
assessed for 130 feet of frontage but only has 121.83 feet.
He has also been charged 15 feet on HaInline Avenue as a corner
lot. H:>wever, the original corner lot was purchased by the
highway department for right of way. Since the water main on
Hamline is SO or 60 feet away from his property and he doesn't
have access to it, he felt the additional 15 foot assessment
should be eliminated.
MR. WILLIAM A. FEYEREISEN, 4261 N. HaInline (Spoke before):
Asked if the levy limitation provision in the new 1971 Tax Bill
would apply to the general taxes proposed to be levied for this
improvement.
MR. EDWARD THILL, 1474 Floral Drive: Said that he's being
assessed for 110 feet of frontage and at the feasibility
hearing he had been told he would be assessed for 85 feet. It
was explained that he had been told he would be assessed the
average assessment of the platted properties adjacent to him
for running a service line to his property.
MR. ROBERT ANDERSON, JR., 1357 Floral Drive (Spoke before):
Asked how much public property there is in the improvement that
has not been assessed.

Be's being assessed for 195 feet on HaInline but does not think
he should be assessed for 60 feet of street easement.
MRS. PAUL HUSTINGS,4l36 Norma Circle: Asked how long the
assessments would run and if they could pay a portion of it
and have the balance spread on the tax rolls.

The people in his area had petitioned for water at $5 a front
foot which was the front foot assessment figure at that time.
Doesn't believe it's fair that they should now be assessed at
. $8.73 a foot.
MR. EDWARD THILL, 1474 Floral Drive (Spoke before):
Commented on the bad condition of the street.
MRS. PAUL HUSTINGS, 4136 Norma Circle (Spoke before): Her
neighbor, Richard ~ers, 4117 Gale Circle, had asked her to
indicate to the Council that because the street isn't finished
the water to their house will freeze during,the winter. She
asked if they would have to pay for the water if they can't use
it all winter or if the situation could be remedied.
After a discussion of the views presented by the affected
property owners, Councilman Hollenhorst then introduced the
following resolution and moved its adoption:

BE IT RESOLVED by the Village Council of the Village of
Arden Hills, Minnesota, as follows:

1. The amount proper and necessary to be specially assessed
at this time for Floral Drive water Dnprovement No. 71-1 against
every assessable lot, piece or parcel of land affected thereby
has been duly calculated upon the basis of benefits, without
regard to cash valuation, in accordance with the provisions of
Minnesota Statutes, Chapter 429, as amended, and notice has
been duly mailed and publiShed, as required by law, that this
Council would meet to hear, consider and pass upon all objections,
if any, and said proposed assessment has at all times since its
filing been open for pUblic inspection, and an opportunity has
been given to all interested persons to present their objections,
if any, to such proposed assessments.
2. This Council, having heard and considered all objections
so presented, and being fully advised in the premises, finds
that each of the lots, pieces and parcels of land enumerated in
the proposed assessment as amended was and is specially benefited
by the construction of said improvement in not less than the
amount of the assessment set opposite the description of each
such lot, piece and parcel of land, respectively, and such amount
so set out is hereby levied against each of the respective lots,
pieces and parcels of land therein.

3. The proposed assessments as amended are hereby adopted
and confirmed as the proper special assessments for each of said
lots, pieces and parcels of land respectively, and the assess-
ment against each parcel, together with interest at the rate
of 8% per annum accruing on the full amount thereof from time
to time unpaid, shall be a lien concurrent with general taxes
upon such parcel and all thereof. The total amount of each
such assessment shall be payable in equal annual principal
installments extending over a period of twenty (20) years, the
first of said installments, together with interest on the entire
assessment from the date hereof to December 31, 1972, to be
payable with general taxes for the year 1971, collectible in
1972, and one of each of the remaining installments, together
with one year's interest on that and all other unpaid install-
ments, to be payable with general taxes for each consecutive
year thereafter until the entire assessment is paid.
4. Prior to certification of the assessment as amended to
the County Auditor, the owner of any lot, piece or parcel of
land assessed hereby may at any time pay the whole or 50% of
such assessment, with interest to the date of payment, to the
Village Treasurer, but no interest shall be charged if such
payment is made within 30 days after the date of this resolu-
tion.
5. The Village Clerk Administrator shall, as soon as may
be, prepare and transmit to the COunty Auditor a certified
duplicate of the assessment roll, with each installment and
interest on each unpaid assessment set forth separately, to be
extended upon the proper tax lists of the County, and the County
Auditor shall thereafter collect said assessments in the manner
provided by law.

The undersigned Clerk Administrator of the Vi Ilage of Arden
Hills d,oes hereby certify that this Special Use Permit is granted
pursuant to the provisions of Ordinance No. 99 of Arden Hi lis in
accordance with a public hearing duly held by the Planning Commis-

sion on November 4, 1971, and subsequent approval thereof by the
Arden Hi lis Counci I on November 8, 1971.
Permission is accordingly given for construction of a four-
story motel addition to McGuire's restaurant at 1201 West County
Road E in the Vi Ilage of Arden Hi II s upon the parce I of I and des-
cribed as follows, to-wit:
The East 650 feet of the West 900 feet of the
SE ~ of the SE ~, Sec. 27, T. 30, R. 23, South
of Rai Iroad Right-of-Way, Ramsey County.
That portion of the S. t of the SE ~ of the
SE ~ of Sec. 27, 1. 30, R. 23 lying between
the N'ly right-of-Way limits of U. S. Highway
No. 10 and the S'ly right~of-way limits of the
Minneapolis-St. Paul & Saulte Ste Marie Rail-
way Company right-of-way, excepting therefrom
the W' Iy 900 feet thereof.
This permit is issued subject to al I the requirements and
conditions set forth in said Ordinance 99 and subject to the addi-
tional special conditions to-wit:

to three; Highway Department approval be
obtained.
2. Compliance with Engineer Lund's recommenda-
t ions to i nsta II a sump to catch the d i atom-
aceous earth in the backwash swimming pool
water; backwashing to be scheduled during off-
peak waste flow periods.
3. A landscape plan be submitted for approval.
4. The motel be limited to four stories in height.
5. Complete building plans of the four-story struc-
ture be submitted, drawn to scale, for approval.
6. Fire ~~arshal's approval of the four-story
bui Iding plans.
7. Drainage plans be submitted for approval by the
Vi Ilage Engineer.
8. No sign approval is given at this time.
