Minutes of Regular Council Meeting Village of Arden Hills Monday, July 26, 1971, 8:00 p.m. V III age Ha I I Ca I I to Order The meeting was called to order at 8:05 p.m. by Mayor Crepeau. Roll Call Present: Absent: Also Present: Mayor Crepeau, CouncIlmen Olmen and Herrick Councilmen Hollenhorst and Henderson Clerk Administrator Lorraine Stromquis~, Attorney Vincent P. Courtney, Engineers Donald Lund and Donald Christoffersen, Maintenance Supervisor Everett Beecher ~ Approval of Minutes The Minutes of the Regular Council meeting of July 12, 1971, were approved as submitted. Minneapolis Hide and Tallow Co. Mr. Donald Rowberg and Mrs. Roy Ewald of Minneapolis Hide and Tallow Co. again requested that a 9-ton Industrial road be constructed at 14th Street N.E. abutting their property and that the Improvement be assessed against abutting property owners on a front foot basis. Engineer Lund stated the petition asking for the Improvement contained more than 35% of the property owners Involved In the Improvement. The Council decided to consider the Engineer's feasibility report on the project at the Council meeting of August 9, with a possible hearIng date to be set August 31. REPORT OF ATTORNEY VINCENT P. COURTNEY Leaf and Grass Dumping In Low Areas Mr. Courtney clarl fled his June 14, 1971, opinion relating to dumping In the Village, reporting that Section 4, OrdInance 97, makes It un- lawful and prohibits dumping leaves on private property unless a permit Is Issued by the Counc41 in accordance with Ordinance 97. Mr. Courtney further stated that, In his opinIon, the Council has the authority to post property, where It feels dumping and filling to be Inadvisable, with "No Dumping" signs, If they have permls~lon to do so by the property owner. At the request of area residents and the Council, Attorney Courtney agreed to provide his opinion In writing. The Council and several residents of the Arden Hills No.3 area dis- cussed problems relating to grass and leaf dumping In the~wamp area adjoining Lake Johanna. Many of the residents felt that the continued depositing of such material might eventually fIll the swamp area and cause the lake to become polluted. At the suggestion of Mr. Rlehard Hoffmann, Mayor Crepeau asked Mr. Joseph Kahnke to head a study com- mittee to look Into the entire problem of the swamp dumplng,to determine whether or not grass, seaweed and leaf clippings do any harm to the swamp and the adjoining lake. The Committee Is to seek Information from experts In the field. Mr. Kahnke accepted the appointment and named Mr. Hoffmann as his co-chairman. Mayor Crepe~u stated that no dumping will be allowed In Arden H!'ls , unle~~ the existing OrdInance Is changed. In answer to Mr. Hoffmann s statstl objections to "No Dumping" signs posted at the Arden Hills No.3 swamp, Mayor Crepeau stated that the Village would be glad to remove them from there and use them elsewhere In the Village, if the residents of Arden Hills No.3 wIll agree to pol ice 'the ~reathemselves to pro- hibit the dumping In the swamp. ~ourt Decision, C. G. Rein Case , Attorney Courtney reviewed his letter, dated July 21, 1971, reporting that the State Supreme Court Issued Its decision In the C. G. A copy of the decision was given each councilman and a copy filed with the Clerk Administrator. Mr. Courtney further reported that Mr. Rein wi II apparently petition the Court fOr are-hearing. McDonald & Associat~s Contrac!~~s~ment Request A special discussion meeting was set for Thursday, July 29, 1971, at 7: 00 p. m. at the V i I lane 'Ha I I to discuss the above matte r. Attorney Courtney, Engineer Rog~r Short and Council members were a~ked to attend. . McGuire's Enterprises A letter, dated July 23, 1971, from Mr. Joe Lambert and Mr. Paul Pream, McGuire's Enterprises, was read by Attorney Courtney. L. Strom- quist to call Attorney Richard Meyers regarding the request for certain records relating to the corporate transfer from Boccard; Inc. to McGuire's Enterprises, asking that copies of cancelled checks be sent to Arden Hills to verify the amount paid by Truck Crane at the time of the corporate transfer. Appraisal Report, Sanitary Sewer Easement 12-7 An appraisal of Sanitary Sewer Easement 12-7, Sanitary Sewer Improve- ments 12-13, by Joseph L. Bettendorf, dated July 6, 1971, was filed with the Clerk Administrator's records. HUD Grant, Water Improvement 68-2 and 68-3 A letter, dated July 23, 1971, from the Chicago HUD Office asking for additional information with respect to land and right of way costs was referred to Village Engineer Norm Hendrickson, asking that he provide the HUD Office with the Information requested. REPORT OF ENGINEER DONALD LUND-~ ~ ~ x.--. r>'-' . ~f'"1L' MetropOlitan Disposal System Engineer Lund reviewed a 15 page report on Sewage and Rules and Regu'atlons for the Metro Disposal System. Council on the matter will be submitted by Mr. Lund. filed with the Clerk Administrator. Waste Control A letter to the The report was Information to N.S.P.ReQardlrio Planned Construction Projects . .In a letter, dated July 19, 1971, N.S.P. asked that they be notified In advance when Village construction projects are planned, s~chas sanitary sewer, storm sewer, water mains or road grading or surfacl~g. Engineer Lund reported that Banister Engineering Co. has provided this Information to N.S.P.in~advance of all such projects. Clerk Administrator was asked to answer the letter telling them of our practice in the matter. REPORT OF COUNCILMAN E. REPORT OF COUNCILMAN STANLEY OLMEN - Public Works Dedication of Grey Fox Road and D~p Street Mayor Crepeau reported that Roberts Construction Co. and their Attorney, Mr. Daubney, are working on details to enable them to turn Grey Fox Road and Dunlap Street over to the Village. Mr. Roberts 15 In favor of an overlay of the streets as opposed to sealcoatlng them. Engineer Lund stated he felt that the overlay would provide a much better street. L. Stromquist was asked to advise Attorney Courtney to work out legal details with Atty. Daubney. REPORT OF COUNCILMAN RON HERRICK - Parks and Recreation, Human Rights and Ordinance Review Metro Sewer Charqes, 1972 Councilman Henderson attended a recent meeting of the Metro Sewer Board which was scheduled to allow the Board to present proposed changes to -2- , .-',f , Minutes of Regular Council Meeting -3- July 26, 1971 municipal itles for sanitary sewer for 1972, but In his absence, Mr. Herrick reported briefly on the matter, The Sewer Board has estimated an $86,000 to $93,000 charge In 1912 to Arden Hills, leaning to the $93,000. The 1971 charge of $55,000 was opposed by Arden Hills, but to date no usage figures have been provided by the Sewer Board to allow us to present our protest. Reports of Banister Engineering Co. are on file at the Village office for possible use In such protest, which we understand could not yet be made. Clerk Administrator Stromquist was asked to determine the details of how and when Arden Hills can file a protest for the 1971 charges and to let the Metro Sewer Board know that we vehemently object to both the 1971 charges and the proposed 1972 charges. . Parks Maintenance CouncIlman Herrick reviewed the minutes of the Parks and Recreation Committee meeting of July 20, 1971. The Committee again expressed concern about maintenance and grass cutting of Village parks and asked the Council to request Mr. Beecher to present a schedule to the Committee for the regular maintenance of al I parks. Mr. Herrick ~ead a memo addressed to him from Supervisor Beecher, whIch answered certain questions raised by the Committee. Hockey Boards The Council requested that the Parks and Recreation Committee obtain bids for the hockey boards needed. Chas. Perrv Park Plans A meetIng was scheduled for Tuesday morning, July 27, between Engineer Lund and Parks Chairman Glen Beggln to discuss changes the Committee proposes for Chas. Perry Park plans. Plans for the park are to be ready for consideration at the August 9, 1971 Council meeting. REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government and Public Safety 1970 Census Count Mayor Crepeau reported that the Census Bureau has reduced the 1970 census figure for Arden HIlls from 5,628 to 4~75. PrelIminary counts performed by both the Metro Council and the Arden Hills staff Indicated population counts of Qver 5,000 prior to 1979; therefore, Mayor Crepeau asked Clerk Administrator Stromquist to confer with Mr. Robert Nethercut and staff of the Metro Council to obtain background and basis of their earl ier counts. Pertinent Information Is to be compiled by L. Strom- quist for use as a,foundatlon to allow the Council to ~equest a census recount; data to be given to Mayor Crepeau as early as posslbie. A map and letter, dated July 23, 1971, from Mrs. Dorothy Oatman, Metro Council staff, was reviewed by the Village Council. . VIllage Office Move to New Addition Mayor Crepeau reported that the Village office staff obtained an estimate of about $167.00 from a professional moving company to move Village office equipment from the old location to the adJolnl"g "ew addition. The move Is to be made Wednesday. July 28. After discussion, the Council asked Supervisor Beecher and Steve Zehm to move the equip- ment with the assistance of one or two off-duty pollee officers. A dolly Is to be rented for the project. Service Lane. North of Highway 96 Mayor Crepeau reported a call from Mr. Paul Waldoch. Mr. Waldoch stated that he and his wife are in favor of the State Highway Dept.'s proposal for a cul-de-sac at Highway 10 near Highway 96, but they feel they need Ingress and egress to Highway 96. L. Stromquist was asked to call theWaldochs and let them know who to contact at the State Highway Dept. to make their request known. -3- 4 . . . . > . Minutes of Regular Councl I Meeting -4- July 26, 1971 Request for Variance to DOQ Ordinance Mrs. Justine O'Connor was present and discussed her letter to the Council, which asked that she be allowed to breed and raise a limited number of dogs over and above the required limit of two on her residential property at 1970 Stowe Avenue. After discussion of the matter, the Councl I tabled the request to the next meeting and asked the Clerk Administrator to furnish Councilmen Henderson and Hollenhorst with a copy of Mrs. O'Connor's ~etter and to send copies of the current Dog Ordinances to Mrs. O'Connor and to the CouncIl. REPORT OF CLERK ADMINiSTRATOR STROMQUIST Claims Motion was made by R. Herrick, seconded by S. Olmen, that the July claims be approved, as presented. Motion carried unanimously. Minutes of Regular Counc il Meet i ng July 26, 1971 ADDITION TO ENGINEER'S REPORT PatchlnQ and Seal CoatinQ - Bid Tabulation A tabulation, as attached, of bids taken July 26, 1971, for Village street patching and seal coating and for a blacktop project at the Public Works building was presented by Engineer Lund. The bids Wdre referred to the Public Works Committee. Watermain Improvement No. 71-1 - B~~B~atlon Engineer Christofferson presented a tabulation of bids, as attached, taken July 23, 1971. Motion was made by R. Herrick, seconded by S. Olmen, that Resolution No. 71-~~be approved. awardlno the bid for Floral Drive Water Improvement No. 71-1, to the lowest bidder, Dunkley Surfacing Company, Inc., In the amount of $77,812.80; motion carried unanimously. Engineer Lund was Instructed to draw up the project contracts. V. SelvoQ Water Line Extension Request , Engineer Lund presented an Informal report, dated July 26, 1971, showing proposals for furnishing a water line to th~ H. Selvog residence. One proposal showed' a 6" line, wh.ich would serve! the Selvogs, and.eventually the Johnstons. . : ! i . A second proposal Included In the report sh~wed a 12' watermaln running north, parallel to Old Highway 10, which co~ld tie Into the existing water line to Bethel College and the County:Road E2 line, which would give a second source of water to the residents of the Shorewood Hills residents. Such 12" line could also help serve the undeveloped property south of Shorewood Hil Is In the future. Mr. Lund strongly r~commended the Installation of the 12" line. The Council determined to study the matter. ' ,
