Mr. Kennedy arr3ved at 9:00 p.m. Absant; DAayor Ashbach Also attending; Vincent Courtneg, Village Attorney and Roger 8hort oP Banniater Engineering Co. by Olmen, second by Stromquist, the minutes of the Special Jupe 8t:� and the regular meeting oP June 12 were approved as &tr. LARRY KUEHN, 3199 N. Lexingtop appeared with a�r.oup of neighbors frosn that area asking what the.council was going to do re: the Mythland Club at 3205 N. Lexington. It was their request that the council take action to condemn the buildings. This is the site oP the former Edgewater Motel. However, it has not been operating as a motel for over a year. The F�npi�e Reality is purported to be handling this property. Their attorney ia Pdr. Hi Segall. Our Village Attorpey, Mr. Vincent Courtney, stated that by law the buildings can only be condemned if they are found to be unsafe for humsq habitation. The Council di�ected Mr. Ed Salverda, electrical inspector, to check all electrical wiring of the buildings. Nf�. Courtney stated that a�St. Paul attorney had inquired if thia spot eould be operated as a motel. Mr. Courtney told him it aould be operated as a qon-conforming uae only on the basis that it had been in continued use. � VII3NON SMITH, resident on I$ke Josephi.ne said he had lived in thia area Por 20 yeara. He had seen the motel ip operation for all that time. He further stated that when the building code went idto effect, the motel could operate as such as long as the operation was continuous, opce it ceased the code could revert this Qropertq back to residentisl. He now requests the property be rezoned to residentiel, the little cottages be torn down and every effort be made to make this into a nice neighborhood. �Ift, EDWARD FYTEN stated that about a year ago the owner, a Idr. Nilsson was looking for a buyer and shomed him thraugh ths cabins. They were not fit for habitation. MR. WARREN SILJENBERG, 1200 Edgewater Ave. W. rsised the question of the buildinga being a fire trap. Upon motion by Crepeau, aecond bg Olmen, all nills�e inspectors and the fire marshall are to investi�ate the premises at 3205 Ir'. Lexiqgton and bring in a report to the Council as soon as possible. I�Hotion carried. The residents suggeated that a const�nt surveillance be kept by the aquad k. car. They also wanted to know how long bePore action can be taken on this place apd if the village could ❑ot find reason to file compla iet what recourse wouTd they as residents have. Traffic comas in at all times of the night creating conaiderable disturbance. Mr. Crepeau will ipatruct the 3quad car to atrol this area and assured the residenta that the council will give 100;�cooperation to their whole problem. h�. I�ITH WIISON, 3566 Glen Arden Rd. presented plans and a request for permission to move his home to a new location in the village due to highwaq condemnation o£ hie present property. I�rr. Cley Kelley, building inspector appeared with Mr. Wilson and assured the council that bFr. Wilson's plana tie in v�ith the surroundin� area where he will be moving. Mr. Courtney suggested that the council inatruct Nf�. th'ilson to check with the fire in- spector as to best time to move. I�r.V:ilson agreed to this. �lir. Crepeau,moved, h,rs. Stro�quiat seconded that the council allow the necessary permits to atr. Wilson. Motion carried. MR. JIPd THONIAS, 1655 Valeptine Ave. expressed hia concern with the proposed island to be placed at jupction of Valeptine Court and Valentine Ave. as shown on the mep of the new road improvament. At recent road hearings this island will be directly in front of hia property and will create a nuisance as far as he ie concerned as traffic will come i❑ then back around this island, etc. He has lived at nia preaent address for 10 years and does not feel traffic is such tkiat it warrants blocking the road. IARfiY 1(� , 1645 Valentine Ave. also expressed opposition to this •islsnd and flzr her requeated a storm sewer be put in on Valentine Ave. With roads being left at 24� as they are at present he was advised a storm sewer was not feasible in these plans. Mr. Olmen moved, �rs. Stromquist seconded that a public hearing be held July lOth with written notice to be sent to all residents on Valentine Ave. and Valentine Court to settle this detail of the road improvement program. MR. �'INCEn;T COURTNEY, VIZIAGTS ATTORNEY reported that on �4sy 29 th the Joseph Besch sr�tter w�s appealed to the Supreme Court. The Leslie �ordia matter re: house trailer parking on residential property and also building of connecting structures on a single lot. Clerk has written letter re: house trailer. Attorney has written letter re: copnecting structures. The sewage pro�lem at the Hobert Rydeen residepce, 3294 Ieke Johanna Blvd. still exists. The cesapool of his neighbor �irs. Thompaon overflows. 3he has had it pumped three timea and reftisea to continue to do thie as she is willing to put in the aewer but this ia ell tied up with the Johadna easementa. A csomplaint should be si�ned and referred to the Village Health Officer. Whole matter Peferred to birs. Stromquiat. The purchase of the I�ke Johsnna Fire Department building was again dis- cusaed. The purchase price was to be �4,000.00 with the Village paying .closing ooata. ZILLIOX MATTER; road agreement made Sept. 26, 1960 for one year. Zilliox doesn't want anything done now as he doea not know how his land will be sold or what some future owner v�ill vaant. Ds. Vincent Courtpey recommended that the Sapitary Sewer I�p. #4 awards made by the commissioners not be appealad evep though a couple of thetu are higher than expected but are still reasonable. DeVJitt�s award increased from �1125.00 to �3200..00 Krannak�s award increased from.�2100.00 to �4,000.00. July 5th is the date of expiratiott of appeal. If either DeFJitt should appeal then it ia hir. Courtney's recommeqdation that the appeal. or Ifsannak Council alao �1r. Olmep moved, �r. Kennedy seconded that the Village Attorney be authorized to accept the awards as made by Board of Commnisaionera on Sanitary Sevrer Project #4 except that he be authorized to appeal either or both of the DelYitt or the IU°apnak awards if either or both of them appeal. Motion carried. •JANNA MATTER: Mr. Robert J. Broen, 3324 Lake Johapna Blvd. has iq his possess- ion the Earnest Money Agreement aigned by i�r. Jamma. Mr. Broen ia interested in purchasing the property at the above addresa which is next door to the Jamma property but only if certaiq reviaions are put into the easement. Ae has consulted with the Village �qgineer and the Villsge Attorney and was present at this meeting to present his case. PHr. Qlmen moved, BQrs. Btromquist seconded that the Vil]a ge Attorney be advised to draw up ne� Earnest Nioney Contracts for Jamma and Halstead property,. (it ia the Halstead propertg B�r. Broen wants to purchase) with ravisiona as requeated by Mr. Eroep and furnished by Village Engineer. Theae contracts are to be drawp up and given to �r. Broen to execute only after he (NIr.Broen) gives the Village Attorney the contract he is novr holding with Mr. Jammata signatt:re on it. B�otion carried. GARNET HAI,L 3,�AATTER: re: letter to Mrs. Stromquiat requesting a f3ring range locatio❑ at the Araenal. A firing range is not permitted on Induatrisl property and all of the Arsenal is zoned Industrial. This requeat should go to the Board of �ppeels who could grant a permit. NEL50N MATTER: The demand nom is for �10�000.00 because of losa of two lots and a lot of treea, etc. Thia demand is in excess of apg figures given by appraisera. Mr. Short, Uillage Engineer, xas asked to get figures on sewer conatruction around Nelsopta property befora Council takes action. �BRS. Motion carried. Mr. Olmen moved, Nir. Kennedy seconded that council approve change order #2 for Project #1 on Imp. #2 as presented by Pr;.r. Short, Village Engineer. Motion carried. Mr. Short, Village engineer, Mr. Courtney, Villaga Attorney and John Ryagaerd, property owner in area involved are to meet with Mr. grannak •aqd hia attorneg to discuss the�,..�-9 and the situstioA on the streeta in hia (Mr, Krannak�s) development in Shorawood Hills. Mr. Kennedg moved, �rs. Stromquiat seconded the motion that the Iake Johanna Zmprovement Association be given a fire wo7rks permit for the Fourth of July. %otion carried. Mr. Keanedy moved, Mr. Crepeau seconded the motion tt,at Magor Ashbach�s °Improvement Society" be given a fire works permit for the Fourth of July. Mr. Kennedy etated that he had requesta from various individuals in the community to ti�hten up restrictions on InduatriaZ Zonings. Pursuant to Minnesota Statutes 1957, Chapter 429, as amended, and upon public notice and hearing as therein required, the Village has by resolution ordered the construction of Street Improvements numbered 3,,.4 and 5., It is necessary that improvement bonds be issued under and pursuant to the provisions of Chapter 429, in the amount oi $ 42��G(?4� �or the purpose of paying the cost o3 the improvements, in anticipation of the collection of special assesaments on benefited pro�rties and of taxes to be levied for the share of such cost properly payable by the Vi7lage. 2.
