Minutes for the meeting of APril lOth were epproved as presented. \ N33W BUSIN�SS; Mx'. Lawis W. Lindemer, 658 5nelling Ave. So. appeared before t e Council requesting that an investigation be made of himself for purposes of awarding to him tha transfer of an Off-Sale and On-Sale Liquor License in Arden Hi11s. He presented application forms to the Council. P6r. Crepeau �aoved, Olmen seconded, that the applicatio❑ be referred to the Finance Com- mittee for study and then brin� back a report to tha Council. Motion carried. A7R. JOHN SUI�ZIV�1N, 1429 Skiles Lane presented a petition to the Council signed by 39 residents in the Area o£ Arden Hills �{2 who do not favor perm- anent street impronements in their area such as described in "some ❑ewspaper story„. These people fesl permanent streets should not be put in until the following has taken place: l. Water linea in. � 2. Streets settle properly after excavating for rvater • and sewer linea. 3. Existing land drainage problem is solved. 4. All houses should hook up to sewer. The residents are in favor of oil and sand surfacing onlg at this time. ry WAYQR ASFIBACH x In rebuttal to Prtr. Sullivan's statement th,at there was such a compulsion among governmental officials to spend money� I�ayor Ashbach recalled the advisory public hearinga thmt had taken place £or the express purpose of £inding out what the reaidents wanted as regards street improve- ment. MR. CREPEAU presided at the hearing which included residente of Arden Aills �2 and reported the following: 1. 2. 3. At the end favored oil One person vuanted concrete roeds. Four w�anted 3 ton roads I�ajority of those residents who spoke wanted a bettar road - perhapa a 6 or 7 ton road. of the meeting Mr. Olmen stated that by a show of hands six and sant surfacing - thirty-three favored 6 ton road or better. JSRRY SKII.DUM, 3419 Glenarden Road, said he did not want a super highway in front of his home. Maybe oil and sand surfacin� won't do the job either. • He doesn't know. Page 2 One year later, which was last fall-1960, the same residents came to the �Council begging for sewers. They were informed that if they had the sewer lines installed at that tirne of the year this spring the roads would be very muddy and impassable but they wanted sewars so the sewar project was initisted for their area.. MR. SULLIVAN stated that he was as one of the sewer haarings at that time and agreed that the majoritg of the people crere in favor of the sewar. I � i�,pYOR ASHBACA stated that the Council decided to have preliminary advisorg hearings for the residents of each area in Arden Hills to see if theg wanted st.teet improvemente and what kind. Arden Hi11s #3 has a ton road of widths from 24 ft. to 30 ft. Check on those stireets £or settling, etc..to see if a mistake was made. Sewera originally.had to be put in due to the pressure of the residents who were tired of pumping cesspools and elso due to newspaper publicity. ll+ta;�or Ashbach flzrther stated that^we have had more complaints from Arden Hills �'2 area than any other, why is tnat?n 4Ve can el3minate that area from the road plan if that is what they want and oi1 and sand the streets. only. In answer to the four points raised by N?r.Sullivan in objection to the permanent type roads "as mentioned in the newspaper storg" Ir;aqor Ashbach stated - 1. V�later lines may not be here for 10 or 20 years, should we wait that long for good roads. 2, Settling of the streets after sewer has been installed is not a valid reason. Look at the roads in Arden Hills #3 for example. 3. Drainage goes hand in hand with good roads. 4. Connectiops from each house is pebhaps the most valid reason, ho�ever it has been the experience o£ the villa�e that 85� to 95°� of the residents have put in the sewer by the time a road program ia iqi�iated. ROGEH SHORT of Bannister Engineering Co. agreed with Magor Ashbachts , conclusions. He stated that the settling of the roade is now taking place . and ver5 infrequently will there be any further settling the second year. Most communities proceed with a legal hearing after consulting only with their advisors, engineers, Village Attorney and so on. Here in Arden Hills the Council held adv3sory hearings to �et the residents opinions apd then they went to work with their engineers and consultants to develop a program tne villagers indicated they wanted. • Mr. Short ftzrther stated that due to the type of soil in Arden Hills inadequate roads would always be a problam. DR. WATZ, 1415 Skiles Iane, asked ii the swamp next to his house and N�. Sullivans was connected to the road program. Itilaqor Ashbach stated that since '�hat was on private property and not village propertg the village uras not responsible for drainiqg the propert�. 1 � � \ - MINU2'ES OF REGULAR MEETTtiG, COUNCIL OF VILi,AGE ON' ARDEN HIZIS �.pr.24,1961 Page 3 However, if the residents requested a storm sewer could be installed and the neighbors benefiting by it would be assessed accordingly. • IVT(�YOR ASH$ACH stated that the Highway Dept. plan to obliterate iiamline Ave. by the middle of Sune or July and tneir road program will not be done until. the fall of 1962. prden Iiills has been trying to delaq the highway depart- ment�s action until its ovun road program is finished. JERRY Si�ILDUM inquired as to the cost oi roads in Arden Hills ,�3. Mayor Ashback stated it was $�314.00 per lot. Each lot in tnat area being proport- �onately the same the residants agreed to take ths whole bill and divide it equally among the lot owners. In answer to Mr. Sullivan's question regarding the likelihood of the State Highway Department using village roads, Mayor Ashbach said they probably would not use them at all or onlg on a very rare occasion and then only with �icles that were withip the load limit of the road used. E7�IvIER ISAKSEN, 3426 Glenarden Court brought. up the discussion of the inconsist- oncy of lot sizes in Arden Hills #2 and felt it was not fair to assesathb residents iq this area on lot size. MAYOR ASHEACH stated that the legal public hearing �vould give the residents the opportunity to hear firm bids and then decide what to do. Mr. Isaksen asked when this hearing �vould be. Mr. Roger Short suggested it would be about 30 days. Mr, Isaksen asked how li-�any cho3ces they wo uld 'nave to choose from. Mayor pshbach said bids would be in for two types of roads. Mr. �Sullivan again spoke and said the reaeon for his petition rvas to bring an expression of the views of those residepts unable to attend tne preliminary hearings. Upon questionin� by iviayor Ashbach, Mr.Sullivan could not answer what percentage of Arden Hills #2 residents were represented by his 39 signers. A resident of the area expressed the view that perhaps tney had misunderstood the ^newspaper article". MAYOR ASHI3ACI3 anewered 1u1r. Isaksenfe question regardin� pro-rating of road assessment as follows; 1. A preliminary hearing merely advisory was held. 2. A legal hearing will be held at which tiine bids come in and tne project is initiated if the residents agree. 3. An assessment nearing is held at the end of the project whep all bills are in and at this tiine it is determined 'now to assess the residents. It was D9eyor Ashbach�s opinion at this time that since there is such a variance i❑ lots in Arden Hills #2 the assessment wi11 be on a front foot basie, Mr. Sullivan stated that ne was conv�nced that it was inappropriate to �o any other way than on a front foot basis. MAYOR ASHBELCH asked t�r. SULLIVpN stated thst he could not say what the council should do. The petitioners signed and they knew what theq were signing: He is still not convinced that a road program should be initiated on any of the plans sub- mitted so far. MR. CREPEAU explained that it had been brought out at the preliminary hear- ings tY,at if the roads were bladed, oiled and sanded for six years, the costs would be the same as if a 6 Ton road were done at first and this type road would last at least 10 years. PdAYOR ASHI3ACH stated that neighbors have suggested Skiles I�ne just east of 5nelling should be widened because of the sliding of cars and the dangers created by this when cars turn off of Snelling onto Skiles Lane. Mr. Sullivan agreed.this probablq should be done. MAYOR ASHB,ACH asked i£ it would be reasonable for the Council to go ahead with the bids and the lagal hearing for the road program. NIr. Sullivan stated that it was within the Council�s province to reacli a decision. He may still object but the Council can go ahead and do what they think is best. MR. OI,MEN raised the question of the approximate cost of sanding and oiling of the roads which must also include drainage. Mr. Short stated this cost x� would be approximatelg 60 to 65� of a 6 Ton road. MR. ISAKSEN stated he would go along with the hearings. 141AYOR ASH�ACH suggested that our road costs have gone up and will keep going � up dus to more residepts and the resulting increase 3n traific. A resident inquired about the seaver assessments and if they too are assessed after a public hearing and when this hearing would be. i�r. Short stated that the County Auditor wants the sewer assessment book ready by Oct. 15th, 1961, which means the public hearing must be held by Sept. l, 1961. MR. 3TSVENSON, 1658 Lake Johanna Blvd. again requested eaception to Zoning Ordinance to put an addition to his existing house nearer lot line thaq allowed under existing code. 1vIr. Stevenson presented a letter from Daniel B. Witt, owner of adjacent property approving tne exception. Motion made by Kennedy, seconded by Crepeau that, as �r. Sevenson has now complied with former request from Council, a building permit be approved for the addition. Carried. A request was um de bp i�. A. Fish for a donation to the liounds View recreation association for the Lake Johanna division of the N�ounds View Little Leagua Baseball team. After discussion of the matter, motion by Kennedy, seconded by Crepeau that y�150.00 be donated to the association provided the Village attorney feels that it is a proper expenditure from our Public Vdelfare Budget. Carried. Truatee Kennedy moved, Crepeau seconded the motion that we suspend the rules and $ive second and final reading and approval to the Subdivision Regulation for the Village of Arden Hills. Carried. Clerk will call Rose Tribune as to cost of about 200 extra copies, of tha ordinance in 000klet form. PUBLIC SAFETY: Trustee Crepeau reported he will hold a meeting of his committee.April 25 at 8:00 p.m. MAYOR'S REPOHT: Assistan oubty Hans Prechtel be Carried. T�ayor Ashbach reported a request for our eppointment of an Assessor. Motion by Crepeau, seconded by Stromquist that appointed by Arden Hills ss assistant county assessor. Ptotion by Crepeau, secondad by Kennedy that resolution authorizing Arden Hills Commission for planned Development (as attached) be given approval. Carried. Mayor Ashbach was requested to discuss with Hamsep �ounty officials the possibilitq of the County making Stowe Ave. between I,ake Johaqna Blvd. snd New Brighton Road a County road. A legal hearing on proposed streat improvement programa ie to be held in about 30 days. Crepeau moved, Stromquist seconded the motion that the 39 • residents of Arden Hills #2 on the petition submitted re: roads be sent written ❑otices to attend the coming legal hearing. Carried. CLERK'S REPORT: Upon motion by Stromquist, seconded by Olmeq, license for soft drinks, restaurant and cigaretts were granted the Karis Drive In for a six month period from APril 15, 1961 to Oct. 15, 1961. Carried. Clerk read letter of 4-18-61 i'rom County Engineer re: permit for excavation on County roads - information to be sent to Village Engineer. . Letter of 4-18-61 from County �'ngineer re: curbs, gutters, sidewalks and storm sewers in village was read by Clerk apd to be seqt to Village Engineer. A status report submitted bg Bannister En�ineering Co re; Sewer Improve- ments 2, 3, Ec 4, was submitted by Clerk and filed with records. • A letter from Roger Short of Bannister Engineering Co. of �,pril 11, 1961, re: escrow deposit for street development in Josephine Hills #2 plat was read by Clerk. Clerk to ipform engineer of amount deposited. Letter of ,April 20, 1961 from Ralph Reader of Ind. School Dist. 621 was read. �iotion made by Crepeau, seconded by O7man that building permits be issued for addition to �ounds Vievu High School but fees and inspection be waived becauae of inspection given by various state agencies. Couneil felt that we are not presently ready for noters registration but that a study of it would be advisable. Letter from �ttorney Courtney of gpril 10, 1961, regarding easements 3046- 3049 wae read. Motion made by Crepesu, seconded by Kennedg that easements Nos. 3046, 3047, 30�8 and 3049 be given Counail approval subject to approval by Village engineer, Roger Short. Carried. Motion by Stromquist, seconded by Crepeau approved resolution relating to apportionment of assessments relating to Sanitary Sewer Impr. #2. (as attached) Garried. Motion by Kennedg, seconded by Crepesu that 38-47.from New Brighton Bank and 1065-1072 be approved for payment. Carried.
