B3g Ten Supper Club - Siq� Variance Request
Mr. Jack Welsch from the Big Ten Supper Club was present to expis(n hIs
request for a 15 foot setback so the new slgn will be in Ilne wlth the
exlsting slgns.
Couneflman Crepeau moved, seconded by Councilman Hollenhorst, to atlow
the Big Ten Supper Ciub to place a sign with a 15 foot setback rather
Than the requ0red 25 foot setback; motion carried unanimously.
Mavor B.Iorndahl's Farewell as Mayor
Mayo� BJorndahl expressed his appreciation for the cooperation of all -.-
and especfaily mentioned Attorney Courtney, members of the Council, the
administrative staff, and the pu6BEc; he wished good luck to all. 7he
Council commended Mayor Bjorndahl for a job welt done.
Admintstratlon of Oaths to Newiy Elected Officers
Attorney Courtney administered the oath of office to Justice of the
Peace Douglas Barthany, Councilman Elect Ronald E. He�rick and Mayor
Elect Henry J. Crepeau, Jr. Terms of offfce witi begin Jenuary 2, 1970.

Suburban Zonina Laws Leqlslation
The Counc6l requested Clerk Administrator Lorralne Stromquist to
provide the Councdl with copfes of an article regarding a bill flled in
the Senate whfch would break down suburban zoning to allow the con-
structtoP of apartments and lower cost housing in suburba� areas
throug�'iut the country.

� The Council requested Clerk AdmEnistrator Lorralne Stromqulst to arrite
�- : to the League of Mlnnesota Munic6pa�ities to call to their attention
that tand divislons are not being recorded Bn accordance with

Act and to ask if they plan to take any actlon at the next Leglsiative
session.

authorize Attorney Courtney blanket authorOty to pay $15.OQ for eithisr
water or sewer easements when no damage has been done; motio� carrfed

Engineer Lund read a letter, dated Decem6er 8, 1969, from M9nn-Kota
Excavating Company, 4he co�tractor ior the construction oi Gray Fox
Road, wh9ch requested a t8me extens6on because ot the weather: Engineer
lund reported that the proJect is 90� compEete and recommended approval
of the request.

Mr. Beecher reported that aIB the water mains in Improvement 68-3 are

a break, bwt this has been isolated so these mains wiil be actOve
within a few days. Clerk Adm9nistrator requested to so notify the

tkie i�provements enumerated below, and a contract has been awarded to the lowest
responsible hidder for the furnishing of part or all of the vork and materials re-

liehed in accordance with law, and the desi�nations of the respective improvements
and the presently estimated expense incurred and to be incurred in the making of

It is necessary at this time to borrow the sum of $1,701,000 by the issuance of tem- �
porary improvement bonds purauant to the provisions of rlinneaota Statutes, Section
429.091, Subdivision 3, for the purpose of payin� expenses incurred and estimated to
be incurred in making these improvementa. It has also been determined to be desir-
able in the offering of the bonds for sale to include in the issue additional bonds
in the amount of $34,000, pursuant to the provisions of Minneaota Statutes 1967,
Section 475.56, repreaenting part of the interest contracted to he paid on the bonds.
Bonds in the aggregate amount of $1,735,000 have been duly advertised at public sale
and the highest and best bid received therefor is that of Piper, Jaff ray & Hopwood
, ofMinneapolis, Minnesota ,
and associates named therein, to purchase the bonda at a price of $ 1,707,309.4,0
plus accrued interest on the full principal amoun[ to the date of delivery, and
upon the further terms and conditions set forth in this resolution. The sale of the
bonds in accordance with thia proposal is approved and confirmed, and the *4ayor and
Village Clerk are directed to en[er into a contract for such sale on the part of the
Village. The Treasurer shall retain the check securing the succeasful bid until
delivery of the bonds and payment of ihe purchase price, aad ehall return any other
bidders' checks forthwith.

organized and existing municipal corporation of the County of Ransey, State of
i•linnesota, acicnowledges itself to be indeuted and for value received promises to
pay to bearer the sum of

on the first day of January, 1973, or on an earlier date on which this bond shall
have been duly called for redemption as stated below, and to pay interest thereor.
at the rate of Six and Forty Hundredths per cent (6:'4�) per annum from the
date hereof until said principal sum is paid or until this bond has been duly cailed
for redemption, payable on July 1, 1970, and semiannually thereafter on January 1

This bond is one of a series in tiie ag�re�ate principal amount of
$1,735,000, all of like date and tenor except as to serial number and denomination,
all issued for the purpose of defrayin� expenses incurred and to be incurred in con-
structing necessary local lmprovements heretofore duly ordered to be made in accord-
ance taith the provisions of YLinnesota Statutes, Chapters 429 and 475, in full con-
formity with the Const3tution and laws of the State of rlinnesota thereunto enabling,
and pursuant to resolutions duly adopted by the Village Council. This bond is pay-
able primarily from the Series 3 Temporary Improvement Bond Fund of said Village,
to which fund there have been appropriated the special assessments and taxes to be
levied with respect to [he improvements financed by this series of bonds, after pay-
ment of all expenses of said improvements, and into which fund there are to be paid
the proceeds of definitive improvement bonds which the V311age is required by la��
to issue at or prior to the maturity of this bond for the purpose of providing funds
to pay the principal hereof and interes[ hereon to the exteat that the special
assessments and taxes theretofore collected are not sufficient for the payment
thereof.
This bond is subject to redemption and prepayment a[ the option of the

such redemption the Village will cause notice of the call of this bond for redemp-

3. The bonds iasued hereunder shall be designated Temporary Improvement
Bonds, Series 3, shall be iasued in the aggregate principal a�ount of $1,735,000,
shall be dated January 1, 1970, ahall be numbered serially from 1 to 347, inclu-
sive, and iasued in the denomination of $5000 each, ahall bear interest at the rate
of6.40% per annum, payable ,Iuly 1, 1970, and semiannually thereafter on January 1
and July 1 in each yeary and suall mature on January 1, 1973, but shall be each sub-
ject to redemption and prepayment at the option of the Village on January 1, 1972,
and on any intereat payment date thereafter, at par plus accrued intereat to the
redemption date. Not less than thirty days before the date specified for redemption
of any bonds., the Village Treasurer shall cause notice of the call thereof for re-
demption to be published in a financial newspaper published in a t4innesota city of
the first class or its metropolitan area, anu shall cause such notice to be mailed
to the holdera of the bonds to be redeemed, if known to him, but published notice of
redemption shall be effective without mailing. The Treasurer shall maintain a
record of tne names and addresses of bondholders so far as such infozmation is made
available to hiw by them. The principal of and interest on the bonds shall be pav-
able at the Afnerican National Bank and Trust Company
. inSt. Paul, Minnesota. and the Village shall pay the reasonable
and customary charges of the paying agent.
4. The bonds shall be prepared for execution under the direction of the
Village Clerk and executed on behalf of the Village by the signa[ure of the P9ayor
and counte�signed by the Village Clerk, and the corporate seal of the Village shall
be affixed to each bond, and the appurtenant interest coupons and the certificate to
be printed on the reverse side of each bond; Eollow3ng the text of the legal opinion
rendered thereon, shall be executed and authenticated by the printed, lithographed
or engraved facsimile signatures of the ilayor and Clerk. When the bonds have been
so executed aqd authenticated they shall be dellvered by the Village Treasurer to
the purchaser, upon receipt of the agreed purchase pri•ce, and the Treasurer ahall
deooeit the proceeds of the bonds in a separate and spec2al Series 3 Temporary Im-
provement Bond Eund, which is created and shall be maintained by the Treaeurer
thereafter as a separate bookkeeping account on the Village's official records, un-
til all bonds issued hereunder have been fully paid and redeemed.
5. A Fund has heretofare been created as a separate bookkeeping account
on the Village's official records, for each of the Improvementa listed 1n Section 1
of this resolution. The Treasurer shall transfer from the Series 3 Temporary Im-
provement Bond Fund to the gund of each of the Improvements money in the amount re-
quired, with any balance in such fund, to pay all claims heretofo're allowed by the
Council against such fund; and hereafter the Treasurer shall transfer from said Bond
Fund to the respective Improvement Funds such additional amounts as may be necessary
to pay further claims duly allowed against such funds, for expenses necessarily in-
curred in the making of the respective improvements, in the order 1n which eaid
claima are allowed. '
6. Upon completion of each of said improvements, or prior thereto, the
Council shall do sud perform all acts and things necessary for the final and valid
levy of special assesements upon properties within the respective areas designated
to he assessed therefor, in an aggregate amount equal to the total cost of each im-
provement as finally ascertained, less such portion, if any, as the Council shall
direct to be paid by the levy of ad valorem taxes or the appropriatioa of utility
revenues or other funds, including in such cost, but without limitation, interest
accrued on the teaporary improvement bond proceeds used to finance the improvements,
from the date of such bonds to the date of levy of special asaessments. In the
event that any such assessment shall be at any time held invalid with respect to any
lot or tract of land, due to any error, defect or irregularity in any action or pro-
ceeding taken or to be talcen by the Village or the Council or any of the Village's
officers or employees, in the making of the assessraent or the performance of any
condition precedent thereto, the Village shall do all such further acts and thinga
and shall take all auch further proceedings as shall he required by law to make such
asaeasmente a valid and binding lien upon said property. All collections of apecial

aseesements and taxea levied and revenues approprlated for each improvement prior
to the retirement of said Temporary Improvement Bonds shall be paid into the Fund
of the Improvement and ahall be used, with money received from said Bond Fund and
from any other source appropriated for the purpose, solely to defray e�cpenses of
the Improvement unt11 the same is completed and all costs thereof have been paid;
whereupon such fund may be discontinued, and any money remaining therein, and all
subsequent collections of special assessments and taxes levied aad revenues appro-
priated for the improvement. shall be credited and paid into the Series 3 Temporary
Improvement Bond Fund.
7. At or before the maturity of the Temporary Improve�nt Bonds, Ser.ies
3, the Council shall provide by resolution for the issuance of definitive improve-
ment bonds and ahall isaue, sell and deliver such bonds upon such terms as may be
provided in the mos[ favorable bid then received therefor, within such limitations
as shall then be provided by law, for the putpose of providing money to pay the
principal of and interest on said Temporary Improvement Sonda, so far as the same
cannot be paid out of money then on nand in the Series 3 Temporary Improvement Bond
Fund. Before the issuance oF such definitive bonds, the Council shall by resolu-
tioa determine the cos[ of said improvements which has been paid from the reapec-
tive funds thereof, the amount of money remaining on hand in said improvement funds
and available for transfer to the Series 3 Fund for the payment of said bonds, and
the amount of definitive improvement bonds necessary to be issued to zetire said
Temporary Bonds. In the event that such issuance occurs before the levy of all
special assessments for said improvements, the Council may estimate the amount of
the coat thereof [o be assessed, and the amount of definitive bonds necessary to
be issued. The Council shall also estimate the principal amount remalning unpaid
of the special assessments levied or to be levied for said improvements, and the
interest payeble thereon, and the annual amounts of the collections of any utility
revenues which may be pledged and appropriated for the payment of definitive bonda,
and shall levy upon all taxable property in the Village a direct, annual, irrepeal-
able tax for the years and in the amowts, if any, which will be required, together
with the collections of such remaining special asaessments and interest thereon,
and of any revenues so appropriated, to produce sims not less than 5% in excess of
the principal and interest payments when due upon the definitive improvement bonds,
and shall appropriate all such remainin� special assessments and taxes to the fimd
to be designated for the payment of such definitive improvement bonds and interest
thereon. The proceeds of the definitive improvement bonds shall be simultaneously
credited to the Series 3 Temporary Improvement Bond Fund, to the amount required
so that the bonds herein authorized may be paid from said fund and redeemed and
canceled.
S. Ido tax is presently levied tot the payment of the bonds herein author-
ized, it being estimated that the proceeds of the definitive improvement bonds
herein covenanted aad agreed to be issued, together with special assessmenta to be
levied for said improvements, will provide funds adequate for the payment of said
bonds and interest in full in accordance wi[h Minnesota Statutes, Section 475.§1.
However, the full faith and credit of the Village is hereby pledged for the payment
of the bonds herein authorized, througn the issuance of such definitive bonds, and
ad valoren taxes shall be levied on all taxable property within the V111age, with-
out limitation as to ra[e or amount, to the extent required for the payment of
said definitive bonds and interest thereon.
9. The right is reserved to iasue additional series of Temporary Improve-
ment Boads paya6le from the fund herein created, [o pay any additional costs of the
improvements financed by the bonds herein authorized or of other municipal improve-
ments validly instituted in accordance with Minnesota Statutes, Chapter 429, pro-
vided that the special assessments and taxes to be levied with respect to any such
improvemen[s shall be apptopriated to the Series 3 Temporary Improvement Bond Fund
and accounted for as provided in this resolution.

10. The Village Clerk is directed to file a certified copy of this reso-
lution wlth the County Auditor of namsey County, and to obtain from the County Audi-
tor before the delivery of the bonds herein authorized a certificate that said bonds
have been duly entered upon the County Auditor's register.
11. The offlcers of the Village and the County Auditor of Ramsey County
are authorized and directed to prepare and furnish to the purchasers of the bonds
issued hereunder, and to the attomeys approving the legality of the issuance there-
of, a certified copy of this resolution and of all other proceedings relating to
said bonds, together with such affidavits, certificates and information as may be
reasonably requixed to show the legality azid marketahility of said bonds, as such
information appears from the books and records in their cuytody and control or as
otherwise known to them, and all such certified copies, certificates and affidavita
sha11 be deemed representations of the Village as to the correctness of all state-
ments contained therein.
