Carried. ec�d� by Cierk stramquie�, rized to inveat a partisl amouxrt ourrmnt expenditurea iaio The meetin� rrsa adjourned at 1Os80 p.m. � er ,orrs ne rom a -i STATE OF MINNESOTA COUNTY OF RAMSEY VILLAGE OF ARDEN HILLS OAK AVENUE STREET � STREET IMEROVEMENT N0, 6 RESOLUTION ORDERIIdG IMEROVEMENT, ACCEPTING BID, AND AUTHORIZING E�CUTION OF THE CONTRACT WFIEREAS, a resolution of the Arden Hills Council adopted November 11, 1963, fi.xed a date for a Council hearing on the proposed improvement of Oak Avenue from the intersection of Oak Avenue on Lake Johanna Boulevard to the northerly termination of Oak Avenue at the cul-de-sac by constructing on Oak Avenue as it presently exists, to the width of thirty feet throughout, a plant-mi.x bituminous-surfaced roadway for the approximate £ifteen hundred foot length of Oak Avenue, at an estimated cost o£ $18,500.00, and the assessment of the abutting property for all or a portion of said cost, pursuant to Sections 429.011 to 429.11 of Minnesota Statutes, and WFIEREAS, ten days puhlished notice of the hearing through two weekly publications of the required notice was given, and mailed notice was duly given to all persons entitled to said notice pursuant to law, and WAEREAS, the affidavit of publication of said notice and the certificate of mailing of said notice have been duly filed herein, and Wi�REAS, a11 parties desiring to be heard were heard according to 1aw at the date and time fixed by said notice, to-wit: at the Village Hall at 8:00 o'clock P.M. on November 26, 1963, and Wf�REAS, by resolution adopted November 11, 1963 the Clerk was directed � to ad�ertise for bids for the performance o£ said street construction, all pursuant to plans and speci£ications therefor duly prepared and filed by Banister Engineering Company, Village Engineers, on said November 11, 1963, and WHEREAS, said advertisement for bids was duly puhlished in the New Brighton Bulletin as required by law, and an affidavit of publication has been filed with the Clerk, and a - 1 - � J i. WHEKLAS, on November 26, 1963 bids were received, opened and tabinlated according to law, and the following bids were received complying with the advertisement: • CONTRACTOR E. J. Pennig Bituminous Surface Treatment Co. J. Craig Co. Bituminous Roadways,Inc. and BID TOTAL $19,389.75 $14,674.45 $15,567.25 $13,676.20 Sdf�REAS, it appears that Bituminons Roadways, Tnc. is the lowest responsible bidder, NOkT TF�REFORE� BE IT RESOLVED by the Village Council of Arden Fti.11s, Minnesota: (1) The aforesaid street improvement is hereby ordered as proposed in the Council resolution adopted November 11, 1963, and puxsuant to plans and specifications therefor heretofore filed by Banister Engineering Company, but with the modification that the street shall be improved only to the width of twenty-four feet. (2) The Mayor and C1erk are hereby authorized and directed to enter into the attached contract with Bituminous Roadways, Inc., in the name of the Village of Arden Hi11s for the improvement of Oak Avenue by installing therein the plant-mi.x bituminous roadway surface from the intersection of Oak Avenue and Lake Johanna Boulevard to the northerly termination of Oak Avenue, all according to the plans and specifications heretofore approved by the Village Council and on file in the office o£ the Village Clerk. � (3) The Clerk is hereby authorized and directed to return forthwith to all bidders the deposits made with their bids, except the depoaits of the successful bidder and the next lowest bidder shall be retained until a contract has been signed.
