RSSOLUTION ARDERING IMPROVEMEPIT, ACCEPTING BID,
AND AUTHORIZING EXECUTION OF THE CONTRACT
WFIEREAS, a resolution of the Arden Hills Council adopted the llth of
November, 1963 fixed a date for a Council hearing on the proposed improvement
of Oak Avenue from its intersection with Lake Johanna Boulevard to the
northerly termination of said Oak Avenne by installation therein of a
sanitary sewer, at an estimated total cost of Fifteen Thousand Five Hundred
Dollars ($15,500.00), and the assessment of the abutting property for all or
a portion of said cost, pursuant to Sections 429.011 to 429.11 of the Minne-
sota Statutes, and
Wf�REAS, ten days published notice of the hearing through two weekly
publications of the required notice was given, and mailed notice was
duly given to all parties entitled to said notice pursuant to law, and
WFffiREAS, the affidavit of publication of said notice and the certificate
of mailing of said notice have been duly filed herein, and
Wf�REAS, all parties desiring to be heard were heard according to 1aw
at the date and time fixed by said notice, to-wit: at the Village Hall at
8:00 o'clock P. M. on November 26, 1963, and
WF�RBAS, by resolution adopted Novemher 11, 1963 the Clerk was directed

to advertise for bids for the performance of said sewer construction, all
pursuant to plans and specifications therefor duly prepared and filed by
Banister Engineering Company, village engineers, on said November 11, 1963,
and
WHEREAS, said advertisement was duly published in the New Brighton
�
Bulletin and in the Construction Bulletin as required by 1aw, and affidavits
of publication therein have been filed with the Clerk, and

Wf�REAS, it appears that Minn.-Kota Excavating Co. is the lowest
responsible bidder for completion of this work in 1963,
NOW THEREFORE� BE IT RESOLVED by the Village Council of Arden Hi11s,
Minnesota;
(1) The aforesaid sewer improvement is hereby ordered as proposed in
the Council resolution adopted November 11, 1963, and pursuant to the plans
and specifications therefor heretofore filed by Banister Engineering Company,
but with the modification that the sewer shall be installed immediately
westerly of and adjacent to the presently-traveled Oak Avenue for approxi-
mately the first four hundred feet thereof extending north from the inter-
section of Oak Avenue and Lake Johanna Boulevard, and thereafter pursuant to
the plans and specifications heretofore filed, and plans and specifications
showing this modification are hereby approved as filed herein,
(2) The Mayor and Clerk are hereby authorized and directed to enter
into the attached contract with Mim-K.ota Excavating Co. of 6332 Lakeland
Avenue North, Minneapolis, Minnesota, inthe name of the Village of Arden
Hills for the i.mprovement of Oak Avenue by installing sanitary sewer therein
from the intersection of Oak Avenue and Lake 7ohanna Boulevard to the north-
erly termi.nation of Oak Avenue, all according to the plans and specifications
as modified and approved by the Village Council and on file in the office of
the Village Clerk. The completion date in said contract of December 31, 1963,
is approved.

successful hidder and the next lowest bidder shall be retained until a
