Pursusnt to due call snd notice thereof, a �gj meeting of

the Council of the Villege of Arden Hills, Miffiesota, was held at the Council Cham-
bers in the Village Hall, 1450 West Highway 96, St. Paul, Minneaota, in said Village,
on the k7th day of September, 1963, at 8:00 o'clock P.M.

The Clerk presented affidavits showin� publication of the notice of sale
of the Sanitary Sewer Improvement Bonds, Series E, in the amount of $93,000 in ac-
cordance with the resolution adopted Avgust 15, i963. 9aid affidavits were examined,
found satisfactory end ordered placed on file.
The Clerk reported that �q� sealed bids ha,d been received pursuant to

BE IT RESOLVED by the Council oP the Village of Arden Hills, Minnesota, as
1. The Village hsa by resolutions adopted by this Council on November 27�
1961 and Jane 4, 1963, after notices and hearings as prescribed by law, ordered the
c�etruction of local improvements pursusut to and in accordance with the provisions
of Minnesota Statutes, Chapter 429, des3gaated as "Sanitary Sewer Improvemeat No. 5"

and "Sanitary Sewer Imprwement No. 6", consisting of the establiahment of eanitary
sewer system.s serving the areas proposed to be asseesed therefor as deacribed in
said resolutions. Contracts heve been duly awarded to the loweat reaponsible bid-
ders, after advertiaement for competitive bida in the me.nner prescribed by law, for
the construction of portions oY said improvemente. The total coat of the improve-
ments is presently eetimated at $93,000, including contracts for conatruction and
a11 other expenses necessarily incurred and to be incurred fram the inception to the
completion of the improvements. It is necessary at this ti� for the Vill�ge to
borrow the awn oY $93,000 to pa,y such coste, by the issuance oF general obligation
improvement bonds pursuant to said Chapter 429. Bonds in this amount have been ad-
vertised and sold at public ee1e, end it is necessary to establish i'1u�da for the
conatruction of said improvements and to provide for the �yment of ssid bonds, and
of any additional bonds necessary to be issued to finance the carnpletion oP the im-
• prove�nts, out of the Saaitary Sewer Improvement Bond Sinking Fund heretofore cre-
ated, and to preseribe the form and terma of the bonds, all in accordsnee with said
Chapter 429 and with Minneeota 3tatutea, Section 475.61, and the co�ract entered
into with the bond purchaser.
2. There are hereby created, and the Villsge Treasurer shall hereaPter
maintain on the books and records of the Village, aeparate and special tUnde desig-
nated as the "Sanitary 3ewer Improvement No. 5 P1�nd" aad the "Saoitary Sewer Im-
provement No. 6 Ehnd", to which Yund� there shall be credlted the entire proceeds of
the sale of the improvement bonds hereitt authorized, and from which there sha11 be
paid a11 expenses incurred and to be incurred in the making of Sanitary $ewer Im-
provements No. 5 ana xo. 6, fYom the inceptioa to the caanpletion thereof, ae euch
expenses are iacurred and allowed. Said fknds shall contimie to be maintained and
shall be credited with the proceede of any bonds subseguently issued for the financ-
ing of said improvements until the cost thereoP is paid in fU).1, including e11 in-
terest to accrue and all principal, if aRy, which shall bec�e due on such bonds
prior to the c�pletion aad acceptance of said improvements. 8aid flands shall also
be credited with all collectlona of the speciel easessments to be levied as herein
provided, prior to the c�gletion of said improvements and the pay�nent of the costs
thereot. Thereafter, said improvement #Lwds ahall be discontinued. The right is
reserved, if a.qy balence of the proceeds of said bonds should then rema.in therein,
to transfer the same to the flwd of ar�y other sanitary sewer improvement subsequetttly
instituted pursusnt to said Chepter 429; but all moneys no�t so transferred, and all
subsequent collections oP seid assessments, shall be pa.id as received lnto the 8ink-
ing Fund described belaw.
3• The Village has by resolution edopted November 3, 1959, created and
agreed to maintain as a separate i7and upon its books and r�corda a 3anitary $eWer
Improvement Bond Sinking Flaad, to be ueed solely for the payment of the principal
and interest on bonds isaued to finance sanitary sewer improveu�nts under the provi-
aions of said Chapter 429. The bonde herein authorized are hereby ordered and dir-
ected to be paid out of said.fUnd on a parity es to both principal and interest with
those heretofore isaued and ma,de payable fro� said fi�nd, and each and all of the pro-
visions of said resolution of November 3, 1959, With rePerence to the administration
of said f�nd and the levy of taxes and specisl assesaments and the pledge oP net
sewer revenues for ita support are hereby conYined and declared. to be covenants and
agreements oY the 9111age of Arden Hilla for the security oY the bonds herein author-
ized.
4. It is contemplated that the special assessments to be leried upon the
areas assessable with respect to Sanitary Sewer Improvements No. 5 and No. 6 xill be
• in the principal amount of approx3mat�ly $93,�, �d said assessments shall be
levied upon such properties in amounte proportionate to and not exceeding the apecial
benefits to be derived by the respective properties fram said improvementa. The 9i1-
lage hereby covenants snd agrees that upon or prior to the completion of said improve-
meate, it will do and perform a11 acts and thinga neceseary for the final end vali$
levy of said specisl assessments; that if any easessment shall be at any time held
invslid, due to any error, de3ect or irregulaxity in sny action or proceeding taken
or to be taken by the Villege or by this Council or by any of the Village's of"Pi.cers
or emplayees, either in the making oP such sesessments or in the performaace of aay
co�ition precedeat thereto, the Village and this Council will forthwith do all such

further acts and take all such flxrther proceedings as may be required by law to make
ssid seseeaments a vslid and bind.ing lien upon said property; that said assessments
shall be payable in twenty (20) equel, consecutive, annual installmenta, the first of
eaid installments to be placed on the tax rolls of the year i963, collectible in the
succeeding year, and that deferred inatallmente of said aseessmenta ehall bear inter-
est at the rate of five per cent (5�+) Per annum. To the first installment shall be
added interest on the entire assessment Yr�n the date of the resolution levyi� the
eame to December 31 of the year in wuich the first installment is payable. To each
aubsequent install�nt when due shall be added intereat for one year oa all unpaid
iastallments. It is estimated that se3d installmettte of principsl and 3nterest wi11
be received in the years and in amounts sufficieat to groduce suma substantially more
than five per cent (5�a} in excess oF the annuel principel and intereat peEymente due
on the bonds heretoPore sold and presently to be issued. The right is reserved, how-
ever, to provide for the psy�nt of a portion of the cost of said improvements by the
levy of ad velorem taxes upon a11 taxable property within the Village, 3n lieu of the
levy oY special assesemente; aud in such event the Village covenants and agrees that
the apecial assessmente will in any esse be levled in amount sufFicieat to pey not
leas than twenty per cent (20�) of the coat of the improvements, and that the taxes
will be levied for the years snd in amounts euch as to produce, together with the
collections oY the special aseessments, and oP the net seFrer reven� appropriated to
the Sinking Fiwd by said resolution of November 3, 1959, eums sufficient to pay the
principal and interest when due on all bonds issued with respect to the improv�eements,
e,nd to provide the five per cent (5�) excess required by Minnesota SLatutes, 6ection
475.61. However, the itil.l faith snd credit of the Village shall be and are hereby
irrevocably pledged for the prompt and ititl pc�yment oY the principal of aod interest
on all bonds issued with respect to San3tary 8ewer Improvements No. 5 and No. 6, and
for the levy and collection of any additional taxes required for such purpose, in
accordance with the provlai�s of said resolution of November 3, 1959•
5. For the purpose of peying the cost oY said 3mprovements, and ia entici-
patiott of the collection of said special asaessments, taxes and net sewer revenues,
the Yillege shall forthwith issue its negotiable general obligation boads to be
designated as Ssaitary 3ever Improvement Bonde, Series E, in ihe aggregate principal
emount of $93,000, date as of October 1, 1963. 3sid bonds shall be in nwnber
and aumbered Yrom 1 to �3 inclusive, each in the denom�ination oi $ 1�, and shall
mature serially on October 1 in the amount of $4,000 in each of the yeaxe 1965 and
1966 end �5,� �a each oP the years 1967 through 1983• The boalds msturing in the
years i974 thro,aeh 1983 ahall be subject to redemption and prepsyment at the opt3on
of the Villege oa October 1, 1968, and sny intereat payment date theresPter at a

of any of said bonds the Village Treasurer ahsll mail notice of the call thereoP to
the bank at which principal and infcerest are then payable and.to the holder, if known,
oY each bond to be prepaid, and said Treasurer eha11 maintain a record of the names
and addresses of the holders of prep�yable boads of said issue so far as said in-
formation is msde available to him, for the purpose of mailing said natices. The

be incurred in the construction of 3mprovements designated as "Sanitary Sewer Im-
provement No. 5" and "Sanitary Sewer Improvement Pio. 6" oi the Villa�e of Arden Hills,
and ie issued pureuant to and in flxll conformity with resalutions duly adopted by the
Villege Council after hearinga as required by law and pursuant to and in Pull conform-
ity with the Conatitution and laws of the State of Minnesota thereunto enabling, in-
cluding Minnesota Statutea, Chapter 429. This bond ia payable primarily fre�n the
Banitary Sewer Improvement Bond Sinkiqg F1�nd of the Village, but the Council is re-
quired to pey tha principal and interest thereoP out of any funds in the treasusy in
the event tha.t the moneys on hand in said fUnd are at any time insuf'ficient to meet
the payment oP ma,turing principal and intereat.
� Bonde of this issue maturing in 1974 through 1983 are each subject to re-
demption and prepayment at the option of the Villege on Oetober 1, 1968, and any
interest payment date thereafter, at a price of par and accrued interest plus a
premium of 2� of the per value of each bond prepsid on or before April 1, 1973, and
without premiwn if prepaid on or after Octpber l, 1973; provided that of the prepay-
able bonds at any time outstsnding, those bearing the highest coupon rate xill be
prepaid first, in inverse arder of their serial nwubere. The Village will mail
natice of the call of any of said bonds for redemption, not lesa than thirty days
prior to the date specified for redemption, to the holder, iP Imrnrn, and to the be,nk

at which principal and interest are then payable. Holders of grepsyable boads de-
siring to receive such notice may register their names and addresses and the serial
nwabers of their bonds with the Village Treaeurer.

shall be affised thereto, and the appurtenant interest coupons shall be erecutec� and

W�REAS, Contracts have been let for Sa;nitaxy Sewer Improvement
No. 6 of the Village of Arden Hills, in the area described in the
legal notice thereof and the resolution thereto, and the contract
price for such improvement is $59.'IOQAO and the other expenses incurred
or to be incurred in the making of said improvernent amount to $23,39Z33
so that the total cost of the improvement will be $83,094.33; and of
this cost the V311age will pay $0.00 as its share of the cost,
NOW, TI�REFORE, be it resolved by the Village Council of the
ViZlage o£ Arden Hills, Minnesota, as Pollowsa
1. The cost of such improvement to be specially asaessed ia Aere-
by declared to be $83,097.33.
2. The Village Clerk, together with the assistance of the
Village Engineer �hall forthwith calculate the proper a�noeust to be
specially assessed for such improvement against every assessab].e lot,
•piece or parcel of land within the dfstrict affected, w3thout regard
to cash valuation, as provided by law, aad she shall file a copy of
sa�h proposed assesmnent in her ofEice for public inspection. The
Village Clerk may arrange for f:he assistance of the Machine Accouating
Division of the County of Ramsey in the preparation of the propoaed
assessmeiat roll.
3. The Village Clerk shall, upon completion of such proposed
assessment, notify the Council thereof for theix further action and
for their aetting of an assessmeat hearing therefor.
