Roll Call I Present: Mayor Crepeau, Councilmen Olmen, Hol tenhorst, Henderson. ilnd Herrick . Absent: None Also Present: Clerk Administrator Lorraine Stromquist, Treasurer Richard O'Kelly, Attorney Vlncer1t P. Courtney, Engineers Donald Lund and Donald Christoffersen Approval of Minutes The minutes of the Regu I ar Counc II meet I ng of September 27, 1971, were approved as amended. L.W.V. Informational Handpoo~ Mrs. Gloria Kuehn and Mrs. Mary Blomberg, Arden Hills League of Women Voters, showed the Council sample mark-up caples of the new L.W.V. informational Village handbook, stating that it Is expected to be ready the week of October 18. 1,500 copies wi II be distributed to Village residents and business places. C.oples are available for $1.00 per copy. Mrs. Blomberg offered the Village 1,000 caples at $~50 per copy. Atty. Courtney stated that, off hand, he felt the Village could legally buy such copies for their use, If needed. Treasurer O'Kelly stated he was In favor of the Village purchasing such COpies, but felt they should be given away by the Village to persons wanting or needing the Information Instead of sold. Atter diSCUSSion. motion was made by Hollenhorst, seconded by Henderson, that the Village b~y 1,000 copies at $.50 per copy; motion passed unanimously. The booklets bought by the Village are to be distributed from the Administrative office. REPORT OF VILLAGE ATTORNEY VINCENT P. COURTNEY . Belair Construction Company Contract Atty. Courtney reviewed hIs letter, dated October 5, 1971, and the rider he prepared to be added to the contract. Motion was made by Herrick. seconded by Hollenhorst, that the contract and rIder be approved and that it be signed by the Mayor and Clerk Administrator; motion carried unanimously. Red Fox Road Slope Easement Atty. Courtney reviewed his letter, dated October 5, 1971, and recommended Village release of a slope easement on property owned by George Reiling. Motion was made by Olmen, seeonded by Hollenhorst. that the partial release of the easement, as prepared by Atty. Courtney and attached, be approved; motion carried unanimously. Hue Grant Atty. Courtney reviewed his letter of October II, 1971 regarding the. status of the final requlsitioh of the Hue Grant for Water Improvement 66-2 and 66-3. Courtney reported briefly on recent changes In the election laws as they relate to municipal elections and reviewed his letter, dated October II, 1971, regarding an amendment to the liquor ordinance to conform to the state law. SanitarvSewer Improvement 16, ResolutIon No. 71-46 Motion waS made by Ormen, seconded by Hollenhorst, that the assessment 1'01 Is for Sanitary Sewer Improvement 16, as submitted by Engineer Lund, be approved and that the Public Hearing be scheduled for Monday, Nov. a, 1971, at 8:.00 p.m. at the Vlnage Hall, as per Resolution No. 71-46; motion carried unanimously. Road Easement at 3453 Lake Johanna Blvd. . A letter, dated September 29, 1971, from Mr. Bertram Schwartz, was rev I ewed by Engl neer Lun d. Eng i nssrLund reported that the re is no Indication in our records that the easement referred to in Mr. Schwartz' letter is a pUblic easement. It is not possible for the Village to instali barricades on private property. Clerk Admlnlstrator~as as~~d to so advise Mr. Schwartz. REPORT OF TREASURER RICHARD O'KELLY Investments . Mr. O'Kelly referred the Council to the Sept. 30, 1971, Investment, and Cash Balances Report. He reviewed Treasury Bills purchased, .85 they relate to the HUD Account and he briefly reviewed other inve.t- ments held by the Village to date. . I I, 1971 REPORT OF COUNCILMAN JOHN HOLLENHORST - Planning & Zoning CATV Meetinq Mr. Hollenhorst reported on a meetIng he attended relating to CATV. It was sponsored by the Metro Section, L.M.M., with the aim to impress upon muniCipal ities the importance of acting as a single group when granting 'franchises 'for cable television. The group considered establishing a committee to study the matter. Clerk Administrator was asked to write to the Metro Section adviSing them that Arden Hills approves their forming a committee to study the matter In depth. . Deputy Building Inspector Upon the recommendation of Code Enfol"cement Off icer Squl res, motion was made by Hol lenhorst, seconded by Olmen, that Mr. Ernest Kluegel be appointed as Deputy 8uilding Inspector for the Village of Arden Hills and that he be authorl2ed ~o make building Inspections when Mr. Squires Is out of town, and further, that his rate of eompensatlon be $7.50 per hour while ~orking; motion carried unanimously. Case No. 71-34, Liftle Crow Addition The Councl !requested the Planning CommissIon to conduct ~he public hearing for the proposed plat, Little Crow Addl~lon, and set the date of hearing as November 4, 1971. Case No. 71-38, Variance Request - M. Aldrldqe. Motion was made by Hollenhorst, seconded by Herrick, that the Council concur with the recommendations of the Planning Commission and. approve the variance request as .s'ubmitted with Case No. 71-38; motion Carried unanimously. Courtney, reQu~stjng that he prepars a final ordinance draft in accordance with the Planning Commission recommendations. . Case No. 71-9, PrelimInary 5eedlng, Sod~ing, Planting Plan, Bethel Academic 8uildinqs Recommendations of the Planning Commission, dated October 5, 1971, were reported by Counc'iiman Hollenhorst. REPORT OF COUNCILMAN E. GRAY HENDERSON - Finance & MunicIpal Lands and Buildings Bulldinq Additions, Vi lIege Hall and ~1alntenance Bui Idlnq Archt. Tom Horty, Horty Eivlng and Associates, repo~ted detaIls relating to final completion on the buIlding project and discussed final payments requested by EIVlew Construction Co. He explained that the contract with EIVlew provides a one-year guarantee from the date the Certificate of Substantial. Completion was signed (Aug. 12, 1971l.Mr. Horty explained that the items listed below are not yet completed, but EIVle~ Construction Co. is willing to submit a 1~tter guaranteeing completion, if the Village will consent to final contra.ct payment. !!Eflnlshed Items I. Motion carried unanimously. Mayor Crepeau and members of the Counci I commended Mr. Harty for a job well done. Assessments Rate Resolution, Resolution No. 71-47 After discussion, motion was made by Henderson, seconded by Hefrlck, that Resolution No. 71-47 regarding Village polley on assessment rates for sewer and water Improvements be approved, as amended; motion carried unanimOUSly. A section of the recommendations of the Finance Subcommlttee,whlch stated that future land developments be required to have utilities ~lithln such developments pre-planned, approved by the Vi llage Councll, and installed at the COST of the developer was referred to the Ordinance Review Committee. II, 1971" and the changes itemized In Clerk Administrator's memo to the Counc I I, dated October 6, 1971. The Counc i I agreed to the changes as proposed. Motion was made by Henderson, seconded by Herrick, that Resolution No. 71-48, adopting the 1972 budget and tax levy, be approved as amended. Motion carried unanimously. Clerk Adm:lnistretor was asked to wi thho I d cert I f I cat I on to the county for a short perl od of time, pending action by the State Legislature on a neW tax law. Clerk Administrator Stromquist and Accountant Charlotte McNlesh were commended by Councilman Henderson for a Job well done on the 1972 budget. REPORT OF COUNCILMAN STANLEY OLMEN - Public Works . Maintenance Department Councilman Olmen reported that Mr. Wayne Brunette wI II assume Mr. Everett Beecher's duties after October 15, 1971. on a temporary basis, pending a decision by the Council as to how a replacement is to be made. REPORT OF COUNCILMAN RONALD HERRICK - Parks and Recreation. Herrick reported that the Parksa~d Recreation Committee would like to discuss the recreational areas proposed tor Rainbow Hills AdditIon with Devaloper Donald Partridge. They feel that recreational. areas for all Village residents should be provided, as well as those proposed for Rainbow Hills residents. North Suburban Day Care Center Mr. Herrick reported that a representative of the Center Is invited to the next meeting of the Parks and Recreation CommIttee. A recommendation concerning their request for funds will be given to the Council following the meeting. REPORT OF MAYOR CREPEAU - General Government, Public Safety Pakistani Relief Drive - UNICEF . A letter from D. D. organized Pakistani read by the Mayor. Clerk Administrator Michael asking tor a statement of support for an Relief Drive to send money through UNICEF was The Council agreed to the request and asked to inform the group of their support. Bethel COlleqe Symposium The symposium subject will be Understanding, Ordering and Improving Suburbia and will be sponsored by Bethel College and WCCO radio. It will be held from noon to 8:00 p.m., Wednesday, August 20, 1971, at the Bethel Campus. The Council agreed to pay the $10.00 fee for the Village officials who can attend and requested Mrs. Shirley Ludlow, Planning Commission member, to attend, if possible. 1.0.O.F. Open House Mayor Crepeau presented an invitation from the I.O.O.F., St. Paul lodge No.2, to Council members to attend an open house, Sunday, 'ctober 17, at Lake Josephine. REPORT OF CLERK ADMINISTRATOR STROMQUIST Delinquent UtllltvAccounts, Rosolutlon ,No. 71-50 Motion was made by Hollenhorst, seconded by Olmen, that Resolution No. 71-50, certifying delinquent utill~y accounts to the County for Collec- tion, be approved; motion carried unanimoUSly. Federal Census &: Mrs. Stromquist reported briefly on conversations with the Minnesota Highway Department, District Census Bureau, Secretary of State's office, and the Metro CouncIl concerning a new census for Arden Hills. If Arden Hills can obtain a new census and, .if a population count of 5,000 or over can be certified from the Federal Census Bureau to the Secretary of State on or before Oecember 31. 1971, the VIllage of Arden Hills wi II qualify for Highway User Funds for 1972. The Counci I authorized Clerk Administrator Stromquist to write to th~-:--. Oirector of the Census, Washington, D.C., and request cost of a census and other details whiCh are needed to conduct such census.
