REPORT OF VILLAGE ATTORNEY VINCENT P. COURTNEY Assessment Rates Resolution A Resolution, establishing the recommend~d nEtw rates for Sanitary' Sewer and Water Assessments, was referred to Mr. Robert McNlesh " and Mr. Peter Popovich for thair review prior to Council actloll' on -~he matter. . Calph Claim Attorney Courtney reviewed his letter, dated September 21, 1971, . raportlng that the Calphs haVe released their clli!lm against North~ dale Construction Company. Motion carried unanimously. . Re uest for Street 1m rovement - Gale Circle A ! atter, dated September 24, t 9 I. from 14r. L. J. Kaus. was reviewed by Engineer Lund. After discussion of the matter, the Council advised Mr. Kaus to submit a petition from property owners abutting Gale Circle, if a Vi I rage Street Improvement is desired. Charles Perry Park Impr~~ The Council reviewed and discussed the work in Charles Perry Park which remains undone by Schutz Contracting. Work cannot be started - by Belair Construction Company. under the new project awarded t~em by the Council on September 13, 1971,untlf the work of Schutz Construction Is done, a $5,000 Performance Bond Is held by the Village with the Schutz Agreement. Mayor Crepeau reported that he and Councilman HerriCk met for three hours at the park site with Mr. Schutz and his mother on Saturday, September 25. No satisfactory completion agreement was attained. The Council agreed that they would like to seethe park project completed in accordance with the original Banister plans. \ Mr. Jerome G. Belair. Belair Construction Company, submitted an informal bid of $7,900 to perform the additional necessary grading and filling. A Change Order, prepared by the Village Engineer, would be needed to add'this to the existing contract with Belair Construction Company. After further discussion of the problems involved. the Council instructed Attorney Courtney to inform Mr. Schutz by letter t~at he has been ord~red'off the job. The Attorney was also instructed to notify the bondjng'~ompany of a possible claim by the Village re the project. ~)> Engineer Lund was instructed to establ ish existing grades at the park and to compere them to the proposed grades that ConTractor Schutz agreed to establish and to order some pJctures taken of the site. . Motion was made by Herrick, seconded by Hollenhorst, that the Belair contract be amend'ed to author j ze an add it i on to the park proJect, specifying tr.~t approximately 25,000~c yards of fi II be taken from the SOU7~ section of the project, to the north section. and that the nor~h section be rough graded in accordance with instructions of the Vi II <'Ig,e Engineer, all in accordance with Change Order No. I, as attacheJ; motion carried unanimOUSly. Metro Sewer Bill - 1972 Counc i I man Henderson repoded that the 1972 Metro Sewer B1 II for Arden Hills has been reduced from a proposed $92,679 to 579,959, due to a changed 9~llonage estimate. This gal lonage"change should aid Arden Hills in appealing the 1971 changes. Dutch Elm Disease Matter held over to a future Council meeting, pending research being done by the State of Minnesota and another municipality. REPORT OF MAYOR CREPEAU . The death of former Mayor D. F. Kennedy, on September 25. 1971, was announced by Mayor Crepeau. Mr. Kennedy was the third Mayor of Arden Hills. He served a threeJyear term as Mayor. from 1963 through 1965, and was Village Councilman from 1959 through 1962. The Council asked Mrs. STromquist to write to the Kennedy famll~ expressing Council condolences. . Snelling Avenue Service Road Mayor Crepeau reported a proposed plan of Mr. Hicks, 3590 North Snelling Avenue, to allow residents abutting the service road to do something at the dead-end section of the road. Clerk Administrator to ask them to submit their plans to the Village Planning Commission. Resignation of Maintenance Supervisor Mayor Crepeau read a letter of resignation from Maintenance Super- visor Everett Beecher, resignation to be effective October 15. 1971. Mr. Beecher has accepted the position of Public Works Operations Director with the City of Hopkins. .!' '..," Mayor Crepeau commended Mr. Beecher for his past services. and accepted his offer of help over the transition period. Mr. Beecher was asked to work out a ~chedule with Councilman Olmen. Civil Defense Unit A letter, dated Sepi-ember 9, 1971, from Mounds VlewUigh School Principal Kunze, was read. Mr. Kunze asked that the Shorevlew Civil Defense members be deputized to aid the Arden Hills Pollee Depart- ment to pol ice school activities. Clerk Administrator was asked to obtain the names of the Shorevlew Civil Defense members and supply the Arden Hills Council with the list. Snellin~ Aven4e Service Lana Improvement Mayor Crepeau reported that the residents abutting the service lane had al I agreed to accept a $200.00 assessment for the street Improve- ment, except one resident who owns t lot abutting the street who )s out of town and has been sent a letter request on the matter. . ~etln~ with County Board Re Rainbow HillsYro.iect 14ayor Crepeau reported that he and t4r. Donald Partridge appeared before the Ramsey County Board on September 20, and reviewed plans for Rain- bow Hil Is with them, partlcularlfy as to the ~ralnage and greenereas of the project. Mr. Crepeau said the Board was very receptive and indicated that they felt the project would enhance their green areas and that they commended Arden Hi lis for its cooperation. The County Board agreed -to consider "the area of County Road E2, from Old Snelling to the Baptist building, as part of their Park Development Plan, and also to study the area con"tlguous to Tony Schmidt Park as part of the same plan. These two areas were left off the original plan. HIQhway 51 in Arden Hills Mayor Ci-apeau referred the Counci I to a letter from the Highway . Department to Senator Ashbach. dated February 9, 1971, wh.lch related to speed limits along TH51. Meet I n9.!.: CATV Councilman Hollenhorst agreed to attend, or get a Plannill9 Commission memb-er to attend, a meeting re CATV at the Brooklyn Center City Hall on Wednesday, September 29, 1971 at 7;30 p.m. Metro Sewer Board Mayor Crepeau asked Councilman Henderson to ~ttend a pubitc hearing to be held September 30, 1971, at 8:00. p.m. by the Metro Sewer Board. Hearing to be held at the St. Paul Arts and Science Center. Bethel Col le~e Symposium Mayor Crepeau announced a symposium to be held at the Bethel Campus Wednesday, October 20, 1971 from noon to 8:00 p.m. on: Understanding, Ordering and Improving Suburbia. He asked Counci I members to attend If possible, and asked Clerk Adminis- trator to consider attending. REPORT OF CLERK ADMINISTRATOR LORRAINE STROMQUIST Election Boards Motion was made by Herrick, seconded by He~derson, that the Ele~tlon Boards for the November 2, 1971 Village Election be approved as submitted by Clerk Administrator and attached. Mrs. Stromquist was asked to supply the Committee wIth details of the existing senior citizen program In Roseville. .
