BUSINESS FROM THE FLOOR None. REPORT OF VILLAGE. ATTORNEY VINCENT P, COURTNEY Assessment Rate Revlalon _ Attorney Courtney recommended that asseSSment rates be established by the Counc II by a "Statement of Po II cy", put I n the forlll of a resolution. The Council asked Mr. Courtney to draw up a proposed resolution, based upon the rates recommended by the F'lnance Committee report, dated August 10,1971,; resolution to be submitted to the Cou nc II at the next meetl ng. MOb!le Home OrQlnance Upon motion by Hollenhorst, seconded by Henderson, paragraph 9.2 of Ordinance 147, Mobile Home Parks, was amended In accordance with Mr. Courtney's letter, dated ~eptember 13, 1~71. Ordinance to be amended prior to publication. Motion carried unanimously. Police Squad Car S~ecfflcatlons Mr. Courtney reported that the specifications for a 1972 pollee squad car have his approval end that his letter, dated October 12, 1970, will stili apply to this set of specifications. _ ~C. G. Rein Litigation _ Attorney Courtney reported that a petition for re-argument'of the matter, which was submitted to the Court by Mr. Rein, has been denied, and the case Is apparently closed. The Council commended Mr. Courtney on his successful defense of the case. - . Mrs... Stromquist was asked to.lnform the contractor that If such services ar~ ordered trom the 8anlster firm, that MeDonald and AssocIates are liable for payment of the services ordered. REPORT OF COUNCILMAN JOHN HOLLENHORST " I Case No. 71-25 S ecial Use Permit - McGulres Motel Councilman Hollenhors reported that the lann ng ommlsslon recommends amending the Arden HII Is Zoning Ordinance to permit hotels In R-U Zoning; rezoning of the McGuire's property from G-B to R-B; amending. the ordinance definition of motel. A public hearing on the above matters was scheduled by the Planning Commission for Tuesday, October 5, 1911, at 8:00 p.m. a~ the Village Hall. Case No. 71-26. Special Use Permit for a Planned Unit Development _ Partrid~e Construction Company Councilman Hollenhorst reviewed the Minutes of the Planning Commission Meeting of September 7, 1971, and reported on the Public Hearing held. He stated that the Planning Commission recommends approval of the general concept of the plans for the townhouses and condominiums with_ out giving any specific appr~vals. Mr. Donald Partridge, ~ev~loper, ~nd his architect, Mr. Reuben Johnson, Buetow and Associates, discussed the proposal and answered questions. After further diSCUSSion, motion was made by Hollenhorst, seconded by Olmen, that a conceptional approval, as per attached resolution No.~JI be granted for the c6ndomi~lums and townhouses only, with no specific special use permit to be granted until detailed plans have been sub- mitted to the Arden Hills Planning Commission and to the Village Council; above action to be subject to Village Attorney's review of the mailed legal notices and of the Village Engineer's approval of drainage plans. Motion approved unanimously. Case No. 71-32, Special Use Permit - Fami.l.Y:::t_'iP-!..Fost_er Home. After Council dlscussiCln of the matter, and a revlew.of the recollllllendatlons of the Planning Commls';lon of September 1, l!llI, motion was milCle by Hollenhorst, seconded oy Henderson, that the Special Use Permit for a family-type foster home, at 1377 Cummings Lane, as submitted with Case No. 71-32, be denied tor the fol lowing reasons: I. The buildlnr is not really suitable for occupancy of 10 persons. 2. There Is strong objection of '..II... proposal by the neighbors. 3. These was ~ recent unfortunate foster home .~perience .In this house. 4. Children ~lOuld probably find It difficult to make friends' and the necessity of proving themselves would probably be felt, which Is not what a group home Is trying to establish. Councilman Holfenhorst reviewed the Planning Commission recommendations of September 7, 1971. Motion was made by HolJenhorst, seconded by Olmen, that approval be given for the six-building complex, as per plans submitted wit'l Case No. 71-9, subject to the approval of landscap. plans by the Arden Hi tis Planning Commission. Motion carried unanimouSly. Case No. 71-9, Bethel College Road Access to Old Highway 10. Councilman Nollenhorst referred to the Planning Comm-lsslonMlnutes, dated Sept~mber 7, 1911, and reported that the Planning CommissIon recommends approval of the new road under construction, from Old Highway 10 onto t~e Bethel campus grounds. The road Is shown on an OVer-ail site pla~ submitted to the Village several years ago. Mayor Crepeau reported that the Public Safety Committee recommends approval of the road. -2- . GRAY HENDERSON Mr. Henderson reported a probable reductlon in the Metro Sewer Board bill to Arden HIlls for 1972, from $92,679 to $79,~77. He stated that Arden Hills Is In the process of appealIng both the 197rand.the proposed 1972 charges made by the Sewer Board;: that he Is making some progress with the protest and; wi I I contInue to work on the matter. He reported briefly on a meeting held with St. Paul at which a suburban advisory committee for Sewer DistrIct I was formed. , Use of Villaae Hal I for Group Meetinas After discuSSion of the matter, the Counci I advised Clerk Admlntstrator Stromquist that use of the Village Hall should be granted to local VI I lage groups at such times that It is not scheduled for use by the CounCil, JUstice of the Peace Courts, Village officials or Village committees. Such groups Should be essentIally Arden Hills groups., 'O~ Arden Hills residents. The use should be limited to occasional use, rather than regular use; food and sales to be avoided due to ex~enslve wear and tear on the building and eXCessive Janitorial services. Treasurer O'Kelly recommended that Insurance coverage for such USe be checked. REPORT OF CCUNCILMAN STANLEY OLMEN Sewaae Lift Stations 63 and 64 Mr. Olmen advised the Council that mechanical seals are to.be Installed in 11ft stations #3 and #4 at a cost estimated at $1200 for the two stations. This will leave three older stations built of eoncrete which remain without mechanical seals. Village Vehicle Servicing The Council agreed to the recommendation that Mobile Services, Ine. perform on the site repair services for maintenance department trucks. on a six-month trial basis. Thank You Letter Mayor Crepeau reported that he '1111 I send a "thank you" letter to former Public Works Chairman James Kemper, for his services to the VIllage. ~ntenan~e Department EmQloyee Motion was made by Dlmen. seconded by Hollenhorst, that Steve Ge.ke be hired on a part-time basis from September 13, 1971 through September 28, 1971, for sanitary Sewer flushing work, at a rate of $2.75 per hour. Motion carried unanimously. Village Utility Committee Motion was made by Olme~, seconded by Henderson, that Mr. Roger Rei ling be appointed as a member of the Utility Committee, In accordance with Village Ordinance No. 145. Motion carried unanimously. The other two committee members are Engineer Donald Lund iIInd Code Enforcement Officer 'Lawrence Squires. EPORT OF COUNC I L~lAN RONA LO HERR ICK Charles Perry Park Improvement Motion was. made by Herrick, seconded by Hollenhorst, that the bid for the Charles Perry Park Improvement, In the amount of $77,087.45, be awarded to the Belair Construction Company. Motion was amended by HOllenhorst. seconded by Herrick, that the above bid be awarded to Belair Construction Company. providing the Village of Arden Hills receives, and the Village Attorney approves, a doeument from the BelaIr Construction Company, stating that Arden Hills will not receive a damage claim at a later date, stating that the company was delayed on the project in any way by the Village. Planner for lnQerson Park In accordance with recommdations of the Parks and Recreation Committee, motion was made by Herrick, Seconded by Olmen, that Mr. Dennis Adams be appointed as Planning Consultant for Ingerson Park. Motion carried unanimously. I The preVious plan for the park has been rejected by the Committee, Community One Motion made by Herrick" seconded by HOllenhorst, that Mr. Glenn Beggln be appointed to represent Arden Hills on the Board of Directors of the Community One Youth Program. Motion carried unanimously. Glenpaul Avenue and New Brlqhton Road The drainage problem of New Brighton Road and Glenpaul Avenue was dis- cussed. Mr. Olmen reported that Ashbach Construction Company estimated a cost of $3800.00 to take care of the drainage on the west side of Glenpauf Road. The Council briefly discussed assessment charge polley regarding such improvements and asked Clerk Administrator Stromquist to furnish assessed costs for past street Improvements. Councilman Olmen agreed to ask the PublIc Works Committee to meet with Ramsey County officials to see what the County might provide toward the project. REPORT OF MAYOR CREPEAU Open House The Council agreed to hold an open house on Monday, November a, 1971, to show residents the new addition to the Village Hall and Publ Ie Works Maintenance Building. Details to be publicized later and matled with utility bills. V III age Ha II Supervisor Beecher was asked to again try to obtain cost -estimates from a landscaper for Install ing rock around the Village Hall for drainage purposes.
