Crepeau, Jr., Councilman Stan Olmen, John Hollenhorst, E. Gray Henderson and Ronald Herrick (1:52 p.m) Absent - None. . Also Present - Ramsey County Engineers Floyd Snyker and Deane Anklan, Clerk Administrator Lorraine Stromquist, Attorney Vincent P. Courtney, Treasurer Worth G. Read, Engineers Donald Lund and Dona1d ChrIstoffersen, Maintenance Supervisor Everett Beecher and Assistant Clerk Dorothy Zehm Approval of Minutes The Minutes of the Regular Council Meeting of January 25, 1971, were approved as submitted. County HI~hway Reconstruction Engineer Floyd Snyker presented plans for the reconstruction of a portion of Snelling Avenue south of County Road E. Old Highway 10 north of County Road E, and County Road E between Snelling and Lexington Avenues. After discussion of the proposed Snelling Avenue-Old Highway 10 re- construction proposal, it was moved by Councilman Hol lenhorst that the Council adopt the resolution, as attached, approving the final reconstruction plans for Snelling Avenue-Old Highway 10, as submit- ted, from Station 204+50 to Station 264+50, with the following ex- ceptions: I. The County construct a chain-link fence to protect the playground ~rea on the southeast corner of Snerflng and County Road E. 2. The two access drives on the west side of Old HIghway, 10, at approximately Station 231, be closed. The motion was seconded by Councilman Olmen. After further discussion, Councilman Henderson moved that the motion be amended to ihc~de an additional exception - to not widen Snelling Avenue south of County Road E, except to provide a right-turn lane , onto County Road E. No second to the amended motion was heard.p . > The original motion passed, Crepeau, Hollenhorst, Herrick and Olmen voting in favor of the motion; Henderson voting in opposition to the motion. It was moved by Counci Iman Henderson that the rest of the County construction plans of Snelling Avenue be rejected until such time as the presentation of the State proposal for an Interchange at Sn'ell ing Avenue and Highway 51 be resolved; seconded by Councilman Herrick. Motion carried unanimOUSly. After review of the proposed reconstruction pians for County Road E, between approximately Snelling Avenue and Lexington Avenue, it was moved by Councilman Hollenhorst that the Council adopt the resolutioni as attached, approving the final plans as submitted; seconded by Councilman Henderson. COURTNEY Personnel Ordinance Amendment - Second Readln9 After Attorney Courtney read the Personnel Ordinance amendment In Its -1- Minutes of Regular Council Meeting February 8, 1971 Page two entirety, Councilman Hol lenhorst moved that the rules be waived on the third reading, and AN ORDINANCE AMENDING ORDINANCE NO. 83,THE PERSONNEL ORDINANCE TO CONFORM THE HOLIDAYS TO STATE LAW, be adopted, as read; seconded by Counci.lman Herrick. MotIon carried unanImously. Calph-Northdale Construction Co~pany Claim Attorney Cou rtney rev I ewed the s-;"atus o-f the Ca I ph-Northda I e Construc- tion Company claim and recommended that the Village continue to withhold the $4500.00, at least ~emporarily, and await action. . The Counci I agreed to the Attorney's recommendation and requested Attorney Courtney to advise the attorneys for Calph and Northdale Construction Company of the Council's action. 1.0.O.F. - S~ecial Use Permit Statu~ ffiOrney Courtney reviewed a letter and affadavit received from the attorney for I.O.O.F., dated January 21, i971, referring the Council to his letter of February I, 1971, In which he Indicates there Is no need for a new applIcation and recommends that a Special Use Permit be prepared. Attorney Courtney and Pianner Richard Shetler were requested to cooperatively prepare a Special Use Permit draft for Council consid- eration on February 22, 1971. Clerk Administrator Stromquist was requested to provide the Council with cop I es of Attorney Courtney's I etter of December 28, 1970. Prel iminary Project Costs Attorney Courtney referred the Council to his letter of February 8, 1911 and recommended that consideration be given to increased Special Use Permit fees to more adequately cover costs involved. Clerk Administrator Stromquist was requested to check into fees charged by other villages. Arden Hills-New Brlqhton Land Trade Status Attorney Courtney advised the Council that the Munlcipai Is waiting for Information from the Highway Department. will "keep in touch" with New Drlghton and the Municipal and advise the Council of the status of the matter. CommIssion He said he Commission Attorney Courtney advised the Council of a $25.00 fee requested by the Municipal Commission, which the Council authorized him to pay. HUD Grant Amended Cont~ct - Attorney Courtney advised the Council that because of a typographical error in the amended contract from HUD, a new contract wi II be submitted. . Audl~ of the Prolect - Counci Iman Henderson moved that Clerk Administrator Stromquist be authorized to notify George M. Hansen Company to conduct the audit of the HUD project and to notify HUD of the Council's ~ction; seconded by Councilman Herrick. Motion carried unanimOUSly. Raymond Wa~ner Plat Councilman Hollenhorst advised the Council that the Planning Commission reviewed the Prel imlnary Plat, and determined that the plat is in order as presented by Mr. Wagner; set the date for Public Hearing on March 2, i971, subject to the opinion of Attorney Courtney. Mr. Courtney's letter, dated February 3, 1911, re the matter was re- viewed. After discussion, Councilman Hol lenhorst moved that the Council grant a variance from the regulations under Section 13, Ordinance 98, waiving the PUblic Hearing requirement and approving the Preliminary and Final Plat, as presented. Motion was seconded by Councilman Olmen and carried unanimOUSly. ~ -h- --...... Feyereisen Easement - Sanitary Sewer Improvement 12-13 Attorney Courtney advised the Council of the status of the Feyerelsen Easement and referred the Councl I to a memo prepared by Attorney Lynden re his recommendations. . After discussion, the Council referred the matter to Councilman Herrick ,In an effort to negotiate a settlement with Mr. Feyereisen. Attorney Courtney recommended that easement settlements be handled individually as damage claims are presented for payment.. The Counci I agreed to the procedure as outlIned. Zonin~ Ordinance Amendment - Second Reading After Attorney Courtney read the Zoning Ordinance Amendment In Its entIrety, it was moved by Councilman Hol lenhorst that the rules be waived on the thIrd reading, and AN ORDINANCE AMENDING ORDINANCE NO. 99, THE ZONING ORDINANCE, AS PREVIOUSLY AMENDED BY ORDINANCE NO. 138, ,BY ADDING AN ACCESSORY USE IN BUSINESS DISTRICTS AND INDUS- TRIAL DISTRICTS, be adopted, as read; seconded by Councilman Henderson. Motion carried unanimOUSly. REPORT OF ENGINEER DONALD LUND 500 Line Spur Track Proposal Engineer Lund reviewed his letter to Attorney Courtney, dated Febru- ary 8,1911, re a meeting he and Councilm~n Hollenhorst andY'mh'a,.,..IlfI"""", attended with 500 Line Railroad Company representatives. , Attorney Courtney was reqeusted to consult with Engineer Lund and Councilmen Hollenhorst and Henderson as he deems necessary, while preparing an agreement to be considered by the 500 Line Railroad and the Village Council, re the proposed Soo Line Spur track. Sewer and Water Improvement No. 10-1 Engineer Lund presented plans for the construction of Sewer and Water lines on County Road F, from Fernwood to Hamline Avenue, suggesting that the property owners be requested to indIcate desired servIce locations. The Council requested that Engineer Lund obtain the service locations from the property owners involved In the improvement. Engineer Lund estimated that the improvement could be completed In approximately 45 days after the bid Is awarded. . Councl'man Herrick moved that Banister Engineering Company prepare the' Advertisement for Bids for publication In the New Brighton Bulletin on February 18 and 25,1971; bIds to be opened on March 5, 1!l71 at 11:00 a.m. at the Village Hall by Engineer Lund and Clerk AdmInIstrator. Stromquist; Council to consider the bids on March 8, 1971; seconded by Councilman Holienhorst. Motion carried unanimOUSly. State Aid Allowance Engineer Lund advised the Council th~t at present all of the Village State Aid allowance, $28,069.00, is for construction; he said hEi has requested that a portion of this amount be transferred for road maintenance. This was agreeable with the Council. McDonald and Associates' Claim Eng I neer Lund adv i sed the Counc il that Eng I neer Roger Short has received the desired information re the McDonald and Associates claim and will report to the Council at the next CouncIl meeting. Villa~e Hall an4 Maintenance Bui Idin~ AddiTions - ConsideraTion of aids Councilman Henderson moved that the Council accept the low bid from EIView Construction Company, in the amount of $15,141.00. that the alternate bid be rejected; authorizing the Architect to prepare the necessary contracts between the Vi Ilage and the Contractor for Attorney Courtney's approval before execution of the contracts by Village officials. The motion was seconded by Councilman Olmen and carried unanimouSly. . REPORT OF COUNCILMAN STAN OLMEN - Public Works No report. REPORT OF COUNCILMAN RONALD HERRICK - Parks and Recreation, Human Rights, Ordinance Review. Human Rights Commission - Housing Resolution Councilman Herrick advised the Counci I thiit"the Human Rights Commis- sion requests Council endorsement of a resolution, as attached, adopting the Metro Council No. 19 Housing Guidelines for the Village of Arden Hills. Clerk Administrator Stromquist stated that she has reqeusted a copy of the Guidelines from the Metro Council for Council review. The Council referred the Guidelines and Resolution to the Planning Commission for study and recommendations to the Council. REPORT OF MAYOR HENRY J. CREPEAU, JR. - General Government and Public Safety. Ramse Count Lea ue of Munlcl alltles - A ointment of Re resentatlve The Counci I members agreed to represent the VII age of Arden Hlils at R.C.L.M. meetings on a rotation basis, one Councilman to attend each meeting. Councilman Olmen agreed to attend the February 17, 1971 meeting and Councilman E. Gray Henderson agreed to attend the March 11, 1971 meeting. Clerk Administrator StromquIst was requested to take care -of getting a volunteer each month. Le~lslative Action Conference Councilman Herrick volunteered to attend the meeting on March 2, 1971. State Informational Systems Legislation Seminar Clerk Administrator Stromquist was a~thorized by the Counci I to aTtend the State Informational Systems Legislation Seminar on February 11, 1971. REPORT OF CLERK ADMINISTRATOR LORRAINE STROMQUIST .
