Roll Call Present - Mayor Henry J. Crepeau, Jr., Councilmen John Hollenhorst. Stanley Olmen; ~. Gray Henderson, Ronald Herrick. Absent - None. Also Present - Planning Commission Chairman Larry McGough, Clerk Administrator Lorraine Stromquist, Village Attorney Ylncent P. Courtney, Engineers Roger Short, Donald Lund and Donald' Cfirl~tensen, representati~es from McDonald and Associates, Wayne Brown, Henry Bownlk and Leonard Hoff. , Ed Salverda, County CommissIoner, and Deane Anklan and Floyd Snyker, Ramsey County Engineers arrived at abo~t 8:00 p.m. Resolution re Federal, ReVi8nue Sharln!! Mrs. Stromquist reViewed a letter dated January 29, 1911 from the L.M.M. which contained a resolution endorsed by the League favoring federal revenue sharing. Minnesota municipalities were urged to approve the resolution. ' Upon motion by Councilman Hollenhorst, seconded by Councilman Olmen, the attached Resolution of Commitment was approved. MotJon carried unanimously. Copies of the resolution are to be sent to Senator Ashbach, Repre- sentatIve Anderson, Senator Humphrey, Senator Mondale and 4th DIstrict Representative Joseph E. Karth. Tax Abatement. Sewer 12-13 Lift Station Site Letter dated January 29, 191i from Attorney Lynden was reviewed by Attorney Courtney. Upon motion by Councilman Olmen, seconded by Councilman Henderson, an appilcatlon (as attached) for abatement of """'texes for the year,,1911 -and subsequent years .on,.V,lllage owned pr.operty: was approved by the Council. Motion carried unanimously. Request for Contract Cost Adiustment - Sanitary Sewer 12-13 M~~ W. Brown. representing McDonald and Associates, presented a letter, dated January 29, 1971 (attached) which outlined .construction problems on Sanitary Sewer Improvement 12-13. Mr. Brown. s,tated that the job was bid for a winter project but because of delay by the Village in obtaining easements or waIvers of trespass, the contractor was unabJe to put all four labor crews to work as planned; A map listing easement dates and showing lengths":of sewer lines in- volved was presented. Two fact sheets" attached, de~alllng work dates, labor wage rates and deiays caused by sewer line changes. augerlng and easement problems was presented by Mr. Bownik. -. Letter from Contractor to the Village Council of February 25, 1970, In- dicatIng the need for some urgency In obtaInIng easements was reviewed by Mr. Brown. A request was made by Mr. Brown for an additional pay- ment,of $20,34i .51 for increased labor costs, for one month's super- vision fees and for the additional cost~ to the contractor for alIgn- ment changes. Attorney Courtney reviewed the existing contr.act for the project; stating that It was executed by the Council on November 30, 1969. He Informed the contractor th.t no Indication of any urgency in easement matters was given by McDonald and Associates prior to their letter of February 25, 1970. Portions of the contract were read aloud by Attorney Courtney. -1- . . , . .J MINUTES OF SPECIAL COUNCIL MEETING February I, 1911 Page two Mr. Bownlk stated he felt the project could have been completed by April I, 1970 except for easement delays which would have avoided extra cost to the contractor due to the labor strike which started April I, 1970. After Council discussion, the matter was referred to Banister Engineer- ing Company and Attorney Courtney to study figures presented by the contractor and to submit their recommendations to the Council as to what the Village mIght be legally or morally committed. . Reconstruction of Snellln~ Avenue Engineers Anklan and Snyker reviewed the past history of a proposed County Improvement of Snel ling Avenue from Glenarden Road to T. H. 96 and registered their concern that the Village Council den'edapproval of the plans. Mayor Crepeau stated that the Council felt the SnellIng Avenue project should not be started until the State Highway Depart- ment plan for a project from Brooks Avenue to Hamllne Avenue is re- solved. He said that Village officials felt that the basic problem of Snel ling Avenue Is at the Intersection of County Road E and Snelling and that the Village has officially requested Ramsey County to square off the Intersection, Install four-way stop signs and install warnIng lights from the East and South. Engineer Snyker said that the Snelling Avenue project, the Lexington Avenue project and an Improvement between Lexington and Snelling Avenue are all related projects, but that the State proposal re Hamline Avenue to which the Council Is opposed Is not related to this proposal. Mr. Snyker said that State Highway Department procedure requires that the County obtain Village approval for plans the entire length of the proposed project to be eiigible for State turnback funds. WIthout such turnback funds, the project would need to be financed locally. He reminded the Council that the approval Is only on preliminary plan$ and can be changed ~n any number of ways after such preliminary approval. After discussion, the Council asked Engineer Snyker to provide Attorney Courtney with a resolution re the Snel ling Avenue proposal with a report to be made at the Council meeting of February 8, 1971. Lexln~ton Avenue Con~ept Plan Upon motion by Councilman Oimen. seconded by Councilman Hollenhorst, a resolution, as attached, approving the concept plan of a County Improvement to Lexington Avenue from County Road E to Interstate 694 was approved. Motion carried unanimously. Proposed County Improvement to County Road E A concept plan and map for an Improvement of County Road E between Lexington Avenue and: Snel I ing Avenue was reviewed by Engineers Ank'an and Snyker. After discussion, the Council asked that they provide Attorney Courtney with a copy of the proposed resolution. Report to be given by Attorney at Council meeting of February 8, 1971. . Human RI~hts Councilman Herrick reported that the Human Rights Commission is workIng on a study of housing and have under study the Metro Council No. 19 Guidelines. A resolution from the Commission, fol lowing such guide- lines will be submItted to the Council with the request that the Council endorse It. Clerk Administrator was requested to obtain a copy of the Housing 19 Guidelines for the Vi Ilage Counci I. Adlournment The meeting was adjourned at 11:10 p.m. ~S orralne E. Honorable Mayor and Village Council Village or Arden Hills 1450 West Highway 96 Arden Hills, Minnesota He: Concolidated Sanitary Sewer Imp. No. 12 & 13 Proj. No.1 Gentlemen: We are the contractor that has nearly completed the subject project. We have suffered a severe loss on this contract primarily because of our low bidding, however, our low unit prices based on 1969 labor rates were not mistakes but were based on the following facts':, 1. The nature of this job was ideal for winter construction be- cause of the easements and our fiI'lll needed winter work for four or five crews. 2. Conversation with the consulting engineers prior to bidding led uS to believe we could construct all the easene nt :'work in the winter months. 3. Original sewer alignment had a faster progress than some of the changed lines that were wet and rocky conditions 4. We did not anticipate that the CreWS that were 'working would be shut down occassionally with no place to go, sometimes moved off the project and other times Skipping around the project to keep working. Once the project was started we were in constant communication with the consultant engineers both through our men in the field and from our main offce begging for more easements. After having been patient for too long we finally wrote a letter direct to your village on February 25, 1970 asking for help. This was a little late but still action was very slow. On April 1, 1970 we were shut down by the labor strike and at this time had completed only 52% of the project. Taking into consideration the lost time of about three ,weeks for Christmas vacation and cold weather days and using the actual progress of the crews that did work, had we been able to keep fours crews working we would have completed all the easement work and would have completed 84% of the project by this same date. We cO!lllllenced working again on June 1, 1910 after the strike with a 23% labor increase. Because your village had ~ailed to obtain the required easements before March 31, 1970 we had to pay the labor increase on 32% of the project. Crew waiced 3 days for the change to be made. The box work and clamming slowed the progress down 3 days, our progress was 144 ft in 4 days which should have taken 1 dav. Labor, 336.oo/day Equip. 215. 05/day One months time for superintendent.
