Fairview (intarsection of Crystal and. Fair— view), appeared beiore the Council with a drainage problem. Del,ange recouunended that Village Engineer� Carley, investigate and recommend a solution. DeLenge to take care of notifying Engineer and seeing that a solution is reached. Courtney reported that a peaceful settlement of the Patterson easement matter appears unlikely and recommended that the Council autnorize attorney to prepare a formal rseolution of condemnation to ovtain easement. Kennedy made a motion that the attorney be autriorized to commence condemnation proceedings immediately to obtain this ease�ent, seconded by Crepeau. Motion carried. Courtney sub;2itted re-drafted burnin� ordi7ance. �'�E Council deci3ed to hold it over to tne next regular meeting so they would '_nave a chance to s�udy it. The liquor license applications for Big Ten Tavern, Highway 10 Liquor Store, Inc. and ivIcGuire�s I,iquor, Inc. have been reviewed 'ny the attorneg and returned to Read� with qoted suggestions. Courtney r�ported that all waivers of trespass are aow on file in connaction with se�ver easements presentlg necessary in sewer con— struction. The sewer petitions submitted by residents in Shorewood Hi11s and Valentine Hi11s have been checked by Attorney and all found to be in technically defective form. He also stated that there was no legal point in filing petitions until a syetem was available for residents to hook into, as far as the Improvement Code was coqcerned. `_-ie also requested that any future petitioners get correct form from the Clerk�s Oifice so they would be valid and more readily verified by attorney. • Council instructed Clerk to write residents who circulated petitions to inform tnem that tha petitions, as submitted, are technically defective, the Council is unable to act on petitions until a sewer outlet is available for the area, and that tn.ey' can ob�ain the correct 2 . petition form from tne Clerk when they circulate other petitions. Courtney reported that he did not have the rate section in tize sewer connectiop ordinance written as yet but hoped to be able to submit it to the Council in Ja rnaary with billin(, probably in :�4arcn. The Ordinance for amending Ordinance Number ln, Known as the 9rden • Hills Building Code, To Include Licensiog Provisions for House Sewer Contractors had previously been introduced by title. Kennedy moved that the rules be suspended and ordinance as read be regarded as final readiqg and passed, seconded by De7�ange. I�iotion carried. PUBLIC V�IELFAHE CO'iai�tITT�E; Kennedy reported that he felt it unnecess- ary to take the matter of the Sohn Neskg land along Hibhway #96 , and 300� deep rezoning to the Public '�(elfare Com.-nittee and recommended that ii be set for Public Hearing January 25. Courtney ad- vised that as lon� as sign coniormed with stata law and pertained to business on penperty and, unless protested by Council or residents, it will be satisfactory. . The bill received from M. S. NIergens, grading contractor, for grading b�irst Street was turned over to the Mayor. It was over the legal limit of $�1,000.00 for jobs where advertized bids were not subnitted. J. R. Risgasrd� west eqd of Gramsie Road, complained about the con- dition �f Gramsie ftoad. He asked to have the Couneil authorize rock fill and �rading of road immediatly. Mayor reported blade already ordered to take care of matter next day. PUBLIC ROADS: No report. Y�Ieyor said that DeLange had been on Couqcil since 1951, and he person- nally vranted to thank him £or all of the work he has done for the Village. The Council concurred with the Niayor. Kennedy reported that the Public Welfare Cominittee had reconsidered the application of Texaco to install a station at Countq Road D and Cleveland. Committee approved it with the recommendation that Te�co • provide a cyclone fence along tne lot line and put in a screen plant- ing along tYie north s ide of the ..'���r�-. ������ I m DeLange moved that the Council approve the building permit for this Texaco station provided that they guarantee b� cash deposit the in- stallation of a cycloqe fence alon$ lot line and a screen planting to the north of the station. Cash deposit to be determined by Uuil�- • ing inspector and contractor. Seconded by Kennady. Motion carried. PUBLIC SAPETY: CY'epeau reported that the Chief of Police and Public Safety Department checked P,4ar-Dee�s Inn and Andy�s Place and found them in satis£actory condition for operation in coming year. • • 3 Crepeau submitted applications from Pat Sexton and Vic Pommeranke for tne Justice of Pe�ce vacancy, to the Yiayor. Mayor read a letter from �Irs, iu:ildred Carlson pertaining to the ra- modeling of her lnome into a duplex. I�Iatter referred to Board o£ Appeals. Announcement of regular Council meeting of Japuary 4 was made. The attorney was requested to be present to ewear in new ofFicers. Neet- ing scheduled for 7:00 p.m. A letter from Char'lee Edwards pertaining to sewer, building require- ments, etc. was referred to Kennedy for answer. P4ayor recommended that Council set up meeting after the first of the year for the residents of Arden Hills #1 who are interested in con- necting to the seaer. Clerk reported t:iat the preliminary balance of December 28, 1959 snowed tYie follo�ving in the various funds; General fund -�30,910.67; Fund 1, Playground -��`'491.61; Fund 2, Grant Hoad -�667.22;, and Fund 3, Sewer Construction - �87,455.28. • Crepeau rnoved that the Clerk and Treasurer be authorized to invest Village 1'unds in short term•aecurities until needed for village ob- ligations, seconded by De7.ange. Motion carried. � . / A letter from Banister Engineering Co, was reed concerning the cost of installing 3 phase electric power service for the sewage lift station. Since Northern States Power Company will not make the power available without charge, Banister recommended that the Council pay the �855 as requested. Kennedy moved that the action of the Clerk �e raGified. Seconded by DeLange. Motion passed. Crepeau moved that License Applications for Off-Sale non-intoxicating malt liquor, cigarettes and groceries f'or Kemp�s Grocery be approved subject to approval by the Public Safety' Department and completion of application. Seconded by Kennedq. P�Iotion carried. Crepeau moved that license applications for juke box, soft drinks, cafe� cigarettea� Off- and On�Sale pon-intoxicati�n� malt liquor for Grotto Club� Inc. be approved subject to approval by the Public Safety Department. Seconded by Kennedy, motion passed. Delan�e movad that Cla3ms #20�2 thx�ough #2047 be approved for payment. Seconded by Crapeau, motion carried. Mr. Read reported that he had the liquor license applications for Scnreyer, Inc., Highway 10 Liquor Store, Inc., �14cGuire�s Liquors, Inc. and Wa�on Wn.eel, and that t2e Finance Committee investigation is con- tinuing. Kennedy moved that McGuire�s Liquor�s, Inc. applications for On- and Off-Sale liquor liconses be approved subject to investigation and approval by the Finance Committee and Public Safety Department. Seconded by Crepeau, motio❑ passed. Kennedy moved The VVagon Wheel applications for Off and On Sale In- toxication Liquor be approved subject to approval of the Rzblic Safety Department and the Finance Committee. Secorided by Crepeau, motion passed. Mr. Johnston said that he appreciated the fine cooperation of the Council Schreyer, Inc, has received since they opened for business and pledged their continued cooperation with the Village.
