Council of the Village of Arden Hills
Monday, October 31, 1960

The meeting was called to order by Mayor Robert Ashbach at 8;00 p.m.
Roll Call: Present;- Ashbach, Kennedy, Crepeau, Stromquist
Absent• - Jones
Also attending were Pdr. Vincent Courtttey, Village Council, Mr. Peterson
of the Sannister Engipeering Co. and Mr, Clay Kelley, Buildipg InspectoP.
A request was made by a resident of 1845 Stowe for one or two atreet
lights to be installed on Stowe Ave. between Lske Johanna Blvd. and New
Brighton Hd. Idatter turnad over to Jones. .
Mr. Joe Finley, Attorney i'or Power Tools, Inc. aqd Mr. Bill Florin
appeared to apply for permit to carry on a busineas of a concession type
natura on the parcel of lsnd on the South side of County Road ��En near
T3arkins ➢riving Range. Designe, pictures, and plans of the enterprise
called Fox-GO BY.C�Srtway track were presented. I{ennedy moved to refer
application to Courtney to determine legal questions involved. Crepeau
seconded. Carried.
h1�.,�lan 0. Bessey, 3280 Sandeen Rd. presented pictures and a complaint
that the sewer contractor had not replaced hia property as it was before
the sewer project. A deep ditch left in front of the property creates
a drainage problem. Mr. Peterson of Bannister �ngineering was present
and was asked to bring this complaint to the attention of Contractor
T�ametti.

R7rs. Ed Fyten, 1137 Edgewater, registered a complaint saying the approach
to her home,since the sewer project, was muddy, bumpy, etc. She hoped
it would be resurfaced before winter comes. Mayor Ashbach stated that
some gravel would be put on this fall which would help through the winter
months. By spriqg, he warned it would be bad again but the roads would
be resurfaced in the summer after the earth had had a chance to settle.
Mr. Clyden, 1956 Nounds }1ve, asked if the council had ginen his neighbor,
b4r. Anderson, at 1948 R4ounds Ane. permission to keep horaea. He com-
plaiped about N1x. Anderson�s dog who he says has bitten several people.
He statea that he has to take his daughter to the busline as she is
afraid to go out of the house. This matter was referred to the police
department to cheak.
The public hearing on the ordinance for rezonicy� property from R2 to R1
was opep for discussion. John Nesky was the onbg one appearin�.on this
matter. He opposed the rezoning. Kennedy moved to adopt the ordinance
#58. Crepeau seconded. Carried.
Mt�. Kennedy preaented the proposed Pinal draft of subdivision re�ulations
and said the first reading would be at the Council Meeting two weeks from
tonight.
�dr. Olson complained of the excess char�e and unsatisfactory work done bg
�(Ai.IQQ, one R���-'�'~a contractor necessitating the need for a second to repair the
work a�ain. Bisyor pehbach is to send a letter to the Plumbipg Insp'ector
re�arding repairs and permits.

Mx. Stevenson, 1658 T,ake Johapna Blvd. appealed to the �ouncil a decision
of the Board of 4lppeals, October 15, 1960, who ruled a�ainst his request
• and presented plans for remodeling the building on this land. The Council.
suggested he secure a letter from t�;r. Daniel ?�Vitt, owner o£ property just
east of Mr. Stavensone, saying he will not build on the 20� of property
adjoining &Rr. Strenenson's property line on the east. The matter was
referred to Public 'rM1ielfare Committee.

Improvement #4 - Shorewood Hills - problams were as follows: Quite a bit
of infiltration, culverts alcng County Road F and Fairviaw �ere plug�ed
as were the ones aleng Cr;�stal and Fairvievr.. There should be an extension
of about 30� of culvert east of pairview.
I�ir. Stan Olman, 'School �oard A4ember, reported on the upcoming bo4d issue
of �2�400,000.00 for nevr snhools. This includea �1,100;y^q00:00 addition
to P,iounds Vievu High School. �600,000.�0 each for two future grade schools,
proposed location ara the Gluek Site and the Pa].mer Site on Silver Lake
Road. �100,000.00 for purchase of new sites.

�iTTORNEY'S RiPORT: Mr. Courtney sta�ed that insurance policies #223819
an L been examined and found setisfactory.
Mr. Crepesu moved to table the matter of the advisory ballot re: Water
Facil3ties. Kennedy seconded. Carried.
kTr. Courtney presented for approval three resolutions on condemnation
proceedings. Chennaiuc propertp condemnatioq proceedings hearin� to be
Novamber 17 and the Schmidt property on November 16. Kennedg moned Co
amend Getober 10, 1960 minutes to include condemnation.proceed3n�s on
these two properties. Crepeau seconded. Carried. Persons conaerned
witn condemn�tioq proceedit;os on Improvement '�4 are being advissd by
letter. iiennedy moved to amend minutes of October 10 to include
condemnation proceedings on Improvement #4. Crepeau seconded. Carried.
Mr. Perry, 3670 New Brighton 3�oad registered a complaint against
voluntarily giving an easement to sewer project as it applies to 22
accres of propertg that is E mile from him so it is uselesa as far as
sewer is concerned.
T;r. Courtney asked for a resolution autnorized by Mayor and Clerk to
. negotiate with 50o Lina A. Fi. re�arding the assessment on sewer project.
Kennedy moved to pass this rasoiution�a C�au seconded. Carried.
p question arises as to the status of the residence of Mrs. Lukoeki who
has two families living in a zoned one family dwellin�. This is a
temporary s3tuation as she and husband are v+orking �nd nead the assistance
of the other family to look after their children.

Council requested the attorney write a letter to Nirs. Lukoskie asking
her to terminate thia arrangement by June 15, 1960. .
' A resolution was intbaduced by title re; ordinanee #53, relating to the
A4unicipal San3tary Sewer System, to strike out penalty clause. Kennedy
moved to accept reading. Crepeau seconded. Carried.
Mr. Courtney presented an amendment to ordinance to govern procedure on
amendments to Zoning ordinance. Crepeau moved to accept. Stromquist
secondad. This was referred to Welfare Coa�mittee. ,
Mr. Courtney is to write a letter to
business on the residentially zoned
New Brighton Rd. within 90 days due
around this area.

CL�K'S REPORT: �Irs. Stroarquist presented 3rd quarter reporta from three
quor es a ishments. She reported a complaint had come in from a Mrs.
Capistrant that �1,000.00 was too large a sum for her to pay. She will
be written a letter explaiain� that she will ba notified o£ a hearing
next spring at which time she can regis er this complaint. a��g

Mr. Kennedy moved to approve claima � to �7 for the month of
October. Crepeau seconded. Carried.
Mrs. Stromquist reported three more complaints - one Prom Ivirs. Lund
re: a vacant house on Thom Drive; another from Mrs. Arneson regarding
broken windows in the Grotto Club; the third from a Frances Heiderscheid,
3197 Jensen Ave., regarding a run doavn garage next door to him that he
felt was a fire trap and unsightly. This garage is owned by Orman
Richardson, 1144 �dgewater. The complaints were referred to the Police
Department.

on the S. E. corner for Civil Dafense, etc. Crepeau seconded. Carried.

RESOLUED, that after due consideration this Council dces hereby author-
ize the Mayor and Clerk to execute on behalf of the Uillage of Ard¢n Hi11s
the certain Fipe Line Crossir�g Permit dated September 2d, 1960, between
Miru�apolis, St. Paul & Savlt 5te. Marie Railroad Comparry and the Uillage
of Arden Hills� which Permit authorizes the installation of sanitary sewer
pipe at the Soo Line crossing.
