BUSINESS FROM THE FLOOR Thom Drive Sewer PetPtion Ralph Perry, 3672 New Brighton Road, presented a petition tor sewer from the Thom Drive residents, which inciuded thirteen of the possible nineteen signatures. Mr. Perry informad the councii that the residents who signed the petition were also anxious for the water improvement. Councilman Hollenhorst moved, seconded by Counciiman Crepeau, that E3a�ister Engineering Company be directed to prepare and submit a feasi6ility report for a sewer and water improvement for the New Brighton Road and Thom Drive area; motion carried unanimously.(��a�-��+-�-e--� Councli requested Attorney Courtney to attempt to get cost free ease- ments across three parcels on Nudson Avenue, which tnvolves two owners. Fle felt this shouid be considered as only thrae residents wil! be serviced. James Circle - Street Improvement Request James Johnson, developer of Valentine Lake Piat No, 2, requested the improvement of the James Circle Road in this plat, whlch has been graded and has a small amount of gravel base. After some dfscussfon, the councPl requested Mr. Johnson to confer with EngPneer Lund regarding spectficatto�s and contractors; CEerk Administrator to review the flie for thPs plat regarding road 9mprove- ments. . Red Fox Road UtTlities Inquiry Ciiff Lund, Roberts Constructton sewer on Red Fox Road. Enginear on a mid-summer bid letting for 6e included in the bid. � . ...._ � l�.v J. . .'_ _ Company, inqutred as to the status of Lund stated that the county is pianning the road improvement; utitities wi11 PAou�ds Avenue Improvement Alvin Roesler, 1964 Mounds Avenue, inquired as to the status of the proposed improvement of Mounds Avenue. Mayor BJorndahl intormed him that only one resident respended to the (mprovement notfce sent to the residents. COURTNEY eethel Property Easements - Proposed Water Improvement b8-2 The matfier of obtaining a water easement across the Bethel property by possible condemnation was tabled until the May 26 council meetfng, pe�ding a reply from HUD. Presbyterian Homes - Access Easement Attorney Courtney reported that Presbyterian Homes is reluctant to • give an easement for access to the lift station for mainte�ance pur- poses, but they wtll give the village a Iicense with a cancellatlon clause of 90 days notice. He informed the councPl that if such Iicense is obtained and then such nottce gfven, he would then recommend con- demnation for this easement. Wiillams Easement - W �lerk Administrator Lorraine Stromquist received a letter, dated May 12, 1969, from Attorney Sailand on this matter. Councilman Holle�horst moved approvai of paying Mrs. Emmett 6�illiams, 3355 Lake Johanna Btvd., $500 for a 160 foot easement abutting Lake Johanna al�d; $290 of this amount is compensation for a new iaw�, et cetera; $210 fs to be deducted from the Northern Contracting Company's contract; seconded by Councflman Henderson; motion carried unanimously. Advertisemenfi for Bids - Used Tractor Counciiman Olmen moved that blds for a used tractor wfth a backhoe and front end loader be adverttsed May 15, 1969; authorized Clerk Administrator Lor�a(ne Stromquist to open bids afi 2:00 p.m. on May 26, 1969 and to refer to Supervisor Beecher; seconded by Councllman Hollenhorst; motlon carried unanimously. Pro�fslons ln the advertisement for bids state the equipment is to be avatiabie tor inspection at the village hall parking lot between 2 and 5 p.m, on May 26, 1969 and all bids over $9,500 will be disregarded. Ordinance No. 114 - ProDosed Amendment After council dlscussion regarding sewer rates for Lake Johanna Beach and Harkins driving range, summer utility users, Councflman Nenderson recommended Engtneer Lund figure a 41at rate for sewer based on sewer usage and sugges�ed $50 per season. Council requested Attorney Court�ey fio draft an amendment to the ordinance to provide for these exceptions. Maintenance Department Well Matter Mayor Bjorndahl requested Attorney Court�ey to contact Mr. Grudnoske regardi�g the repair of the weil at the viliage maPntenance buildtng. Industrial Park Landscaping Cltff Lund, Roberts Construction Company, was present and submitted • pictures of the landscaping around some of the buildings in the In- dustrial Park. The council agreed with Counciiman Hoilenhorst's recom- mendation that independent reports be submitted by Village Pianner Car{ Dale and Buiiding inspector Clay Kelley regard'fng the landscape deficPencies in thfs development. Thoso reports are to be submitted to Clerk Administrator Lorratne Stromquist in sufficient time for Mr. Lund to receive a copy and prepare a sfiatement on the matter for the next council meetPng. . Snow Plow Specificatlons Maintenance Supervisor E. Beecher submttted specifications for a snow ptow to Attorney Courtney. Counci�man Olmen moved, seconded by Councfl- man Crepeau, that Attorney Courtney prepare and cause to be published the advertPsement''�for�ra bids for a snow p�ow; bid opening scheduled for June �� 1969 at r�St p.m., and authorized the Clerk Administrafior to open the bids and refer to Supervlsor Beecher; motion carried unanimously. - Z - ,. � Minutes of Regular Council Meet(ng May 12, 1969 Page Three Villaq_e Land Acquisition Council discussed the purchase of 9 acres of land partially aGutting the northern boundary of the vlliage owned Fioral Park. Mayor E3jor�dahl felt the additionai land might be sufficient, if added to Florai Park, to accommodate both the park and a civic center and felt this should be considered. Counciiman Hoilenhorst moved; seconded by Counciiman Henderson that • the land be purchased, with the use to be determined later, subject to Attornoy Courtney's title opinion; motion carried unanimously. REPORT OF ENGINEER DONALD LU�JD Proposed North End Sewer Improvement Engfneer Lund distributed copies ofi a feasibility report including a map regarding installatlon of sewer in the north end area of the viliage, east of tlighway 10, tdotion by Councilman Crepeau, seconded by Council- man O�men to approve the feasibility report; motion carried unanimously. Clerk Administrator Lorraine Stromquist informed the council that a letter of opposition to the improvement dated April 29, 1969, was re- ceived from Mrs. E3ruce C. Todd, 4136 Norma Circte. Councilman Crepeau moved, seconded by Councfiman Henderson,that a publtc hearing be scheduled for June 9, 1969, at 8:00 p.m, in the vtl�age hall for a proposed sewer improvement for the north area of tho village, east of Highway 10; motton carried unantmously. Clerk Administrator to contact Fiscal Agent Peter S. Popovich regarding attendance at this meeting. REPORT OF COUNCILMAN HOLLENHORST - Planning and Zoning Case No. 69-8, Variance Request - Robert �-0anuet Mr. Manuel was present and participated in the discussion with the council regardtng his variance request to construct a two-car carport within 5 feet of his property line. The eoard of Appeals submitted a two vote splft decision on the matter. Councilman floilenhorst felt the granting of this request would not be in keeping with the ordinance as the request is for convenience and not a hardship matter; he believes there is sufficient property available north of the residence for con- structton without a variance. Councii suggested P4r. M11anuel consider constructtng a 6- 8 foot louvered fence in lieu of the carport; this would also require a varlance, but believes it would be more acceptable. if PAr. Manuel chooses to apply for another variance, the councii agreed the 55.00 fee should be trans- ferred from the original request. Councilman Nollenhorst stated that some of the Planning Commission • members have checked the property; others could check it. Clerk Administrator Lorraine Stromquist could fihen poll the members by telephone. Case No. 69-2 Variance Re uest - Richard C. Erfcson As recommended by the Planning Commiss on and the Board of Appeals, Councilman Hollenhorst moved, seconded by Councilman Crepeau, to ap- prove the amended plans for the proposed home of Richard C. Edward Fyten As recommended by the Plannfng Commission and i�he Board of Appeals, Councilman fiollenhorst moved, seconded by Councilman Crepeau, that a variance be granted to the Susset� Company to construct a garage with- out frost footings and I4 teet,6 inches from the property Iine on P4rs. Edward Fyten's property at 1137 Edgewater Avenue; motion carried unanimously. Case No. 69-t0, Theodore Hamm L3rewinq Company • As recommended by the Planning Commission, Councitman Hollenhorst moved, seconded by Councilman Crepeau, approval of the eventual issuance of a building permit to Theodore Hamm Drewinr� Company for their proposed can manufacturin� plant, subject to compliance with the Village of Arden flills building code and zoning requirements; motion carried unanimously. ProDosed Villaqe Street Linhtinq Bob Anderson, member o� the Arden Hills Jaycees, was present. � . Cierk Administrator brlefed the council on the survey submitted to her by the Jaycees, which i�ciuded fihe number of homes contacted by Jaycee members in the area; and also comments from the survey and those taken at the village hall. P4r. Anderson informed 1-he council that three areas have not yet been canvassed, but tfiis will be done within the next two weeks. Mr. McKirinon connected his residence to the municipal xater system wtthout a permii• and also did the actual connecting himself Cthe ordinance specifies th(s is to be done by a licensed plumber). P4atter referred to Cierk Admin(strator to so inform Attorney Courtney to proceed with the prosecution. Mayor Bjorndahl recommended that the viltage try to obtain a statement from Mr. McKinnon stating that any problems vrii-h this line will be P-0r. McKinnon's responslbility. if this situa'rion arises, the village will discontinue water service to this residence until such time as 1'he owner hires a lic�nsed plum6er to do the repair work. REPORT OF PdAYOR BJORNDAHL - Parks and Recreafiion and Human Rights Parks and Recreation Mayor �jorndahl reported that a 7 toot mo�aer has been purchased for $725; this mower is an attachment for the smali tractor. Upon motion by 0lmen, seconded by Councilman Crepeau, two part-time seasonal men, Stephen Zehm at $2.80 per hour and Martin Besi- at �2.65 per hour, effective May I5, 1969, wiil be employed again #his summer. P4otion carried unanimous(y. Playground equipment has been ordered at a cost o# $977. A portion of Charies Perry Fark has beon prepared tor nursery trees, and, with the help of the Jaycees, l,000 seedlinq evergreen trees have been olanted. Charles Perry Park Is to be graded and seeded for active recreation. Ingerson Park (the former Heiman pro- perty) wlll be doveloped with the help of the Josephine Hills Garden Club. REPORT OF CLERK ADMINISIRATOR LORRAINE STROMQUIST . Proposed Arden Hills - New E3riqhton F3oundary Cha�ge A reply to Clerk Administrator's tetter was received from [3ob Schaeffer New E3righton Village PAanager, statfng that the matter will be presented to the New Brighton Councfl on May 13. Councilmen Hollenhorst and Henderson wili represent the Village of Arden Hills. Drainaqe Matter, Kraft - Kubiatowicz Pond Ramsey,County feels it has no responsibiiity for the level of this pond unless the road is attected. The county will send a letter to the viliage, with a copy to P4r. Kubiatowicz�suggesting that he proceed on his ow� to pump the water into Lake Valentine. • Clerk Admtnistrator was requested to check the ordinance regardtng the covering of the fili which was deposited at the south end of thls pond. Variance Request - iEl97 6rant Road Cou�cilman Olmen moved, seconded by Councllman Crepeau, that a variance be granted for a 9 foot front yard setback for 1897 Grant Road, subject to the approval of the Planning Commission and the Board ot Appeals; motion carried unanimousiy. Clerk Administrator informed the council that surrounding homes are set back only 30 feet. By resolution adopted April 28, 1969, the Council has directed Banister Engineering Company to prepare a preliminary report as to the feasibility of a proposed itnprovement lying generally in the area bounded by rIighway 96 on the north= Eaterstate rIighway 694 and County Road "F" on the south; iiighway 51 right-of-way on the east; and old diqhway 10 northerly to its intersection with new riighway 10, and new fiighway 10 from its intersection with old iiighway 10 to Hiyhway 96 on the west, consisting of the conatruction of sanitary sewexs and appurtenancee including lift station and force main. Banister Engineering was also directed to include in the report the estimated cost of the proposed improvement and as to whether such improvement should best be made as propoaed or in connection with some other improve- ment. The fo2lowinq members were presente Bjorndahl, Crepeau, Otmen Hollenhorst, Henderson and the following were absent: None Conncilman Hollenhorst introduced and moved the adoption of the following res�olution: • RESOLUTION ORDERING PREPARATION OF REPORT ON SANITARY SECdER IMPROVEA7ENT NO. 14 WAEREAS, it is proposed to improve that portion of the Village of Arden Hills between Cleveland Avenue and a line 500 feet east of the centerline of New Brighton Road, and between County Road E-2 and the Soo Line Railroad, consisting of the construction of sani- tary sewers, a lift station and force main, and all necessary appur- tenances to provide sanitary sewer service to the properties along Thom Drive and New Brighton Road north of the Soo Line Railroad tracks, together with necessary street restoration where existing street surfaces are damaqed, and to assess the benefited property • for all or a portion of the cost of the improvement pursuant to M.S. 429.011 to 429.111 (Minn. Statutes 1961). Popovich of Peterson & Popovich, village bond consultants. The Clerk Administrator presented an affidavit ahowing publication of notice of re hearing on proposed Consolidated Water Improvement No's. 68-2 and 68-3 in accordance with the reaolution adopted February 2�, 1969, which affidavit was earamined and found to be satisfactory and was directed to 'be � � filed by the Clerk. The Clerk Administrator also exhibited a Certificate of Mailing Notice of Hearing to all affected property owners, which certificate was examined and found to be satisfactory and was directed to be filed by the Clerk. The Nlayor then directed the Clerk to read the description . of the general nature and estl,ma.ted cost of the proposed improvement and the area proposed to be assessed therefor, as stated in the published notice of hearing. After reading of the notice, all persons present were afforded opportunity to be heard, and the names and addresses of the persons appearing and heard by the Council, and the substance of the views presented by them were as followss � � ' MR. EUGENE GAZELKA, 3263 North Snelling: Asked if the proposed location of the water line in the area of the southeast corner of Lake Johanna could be changed so that he and his neighbors could avoid the cost of running the line 700 feet to their homes. It was expla�,ned that it was impossible to obtain easements to run the line as he suggested. Further asked if the line could be run in at an angle rather than along the highway. PAR. ELP��R ISARSEN, 3426 Glen Arden Court: He and some of his neighbors wondered if it was possible to be served by running a water line in their back yards, down the lot line, rather than digging up the boulevards in front. • Mg. ;7ARREN EASTLUND, Attorney at Law, Northwestern Bank Building, i2inneapolis, representing Bethel College and Royal Investment Corporation: Asked for a clarification of the $1 trunk charge. Indicated that his clients own about 250 acres in the improvement area and asked if they would pay the $350 per acre charge and also the $1 trunk charge. P4r. Eastlund pointed out that half of Valentine Lake is incudled in the improvement area and asked if that acreage would be assesaed, Also asked what the formula would be for assessing the library and the school. Asked for a clarification of the acreage and front fo ot charges. If he pays the $350 acreage charge now and later pla ts the property, would the acreage assessments he's paid be credited against the front foot assessment. If not, he felt this would be an inordinately large expense for his clients. Further indicated that at the present time his clients don't need the improvement, don't want it and don't particularly want to pay for it. However, they don't want to stop progress but do want to be treated fairly. �. Asked if any of the street restoration work would be accomplished this summer. RICHARD I�YERS, 1758 Venus Avenue (Spoke before): One hundred percent in favor o£ the improvement, particularly with the following conditions: (1) that 20� of the project be assessed and the federal grant should be applied to assessments over the 20� (2) because of the delay it will cost the affected property owners another 1% interest and over a period of 20 years it will cost these people more than the people who had the project put in last year.
