Mr. Richard Wo►d, 381U New Brighton Road, exylained that he was present
at the Public Hearing regardtng Chatham deve'lopment proposal (Special
Use Permit - Case No. 76-4i); expressed concern regerdtng the pro-
posed lot abutting his east property 1tne; requesYed that it no' be
terraced, but sloped to meet the existtng graaa of hi.s'!ot on Idew
Brightoo Road. woid reported that Ban Con agreed to this and the
lot was graded accordingly; lot was suhsequantiy �c�1d snd the naw
owner has r��aoved tha slope, causing an 8' - 10' straiyht drop be-
hind hfs lot, creating a dangerous sttuation as well as erosion

After discussion regardiog the approved Prelimfnary and Flnal Plat

the Butlding Inspector suspend construction on the property, peod-
ing the restoration of the slope or submission of an alternate pian
which will resolve the matter satisfactorily with Mr. Wold.

Lynden referred Council to amended pages of the Briarknoll Davelop-
ment Agreement; noted that Agreement wiii he further amended to
change "letter of credit" to "Performance Bond", p�ae 6, as requested
by the developer.

• Crichton expressed concern that when Colleen Grive is cut 1-hrough to
Hamline Avenue, the deveioper not use Indian Oaks Trail and dames

h7ctdiosh was requested to notify Clty's insurance carrier of City's
efforTs to recover fossas from contractor and to subsequently re-
fmburse insurance company reparding claims paid.

be scheduled on Wednesday, September 13, l978, at the Village Hall
with Rice Creak Watershed District E3oard of Managers, at 7:30 p.m.

1978 Sealcoatinq Profect - Application for Pavment
Christoffersen reterred Councll to his letter of 9,'il/78, report►ng
that ttie project has been completed, recommending that Councfl
accept the project and approve tfnal payment.

1978 Sealcoa` Project aad authorTze payment in the amount o� 519,788.95
to Allied Qlecktop Company, Inc. Motton carriad unanimously.

Chrf s•tottersen reported that the contrartor 6�as agreed to correct
the County Road F Improvement deficte�cies; wili complete repairs
after Karth Lake Estates bituminous Is completed.

Lexington Woods offtce buitding, which modifies the exfierior eleva-
ttons; change is pr�posed because of substantiaf cost differential;

of the window chanqe.

moditied by •hhe change. Crichton expressed concern that the chahge

is lass than minimum r�quired in L-i zones. h1iller concurred
that buildinp may appear s,mailer, but not substantiaiiy; the reduced

Planner t'iiler re�erred Council to his report of 8/31/78, reaardino
thej nroposed library/cafeteria addition to F'ounds View !-�igh School;
noted that the application is for a Specfal Use Permit for the
entlre h!ounds View Hiph School site to bring tt Ento conformity with
reyuirements of the Zonl�g Qrdinance (High School precedes adoption
of the current Zoning Ordlnance). MTller reported that the Planning
Commission recommends approval of the proposed additlon; occupancy
to be contingent upon anapproved landscape plan for the entire
Mounds Yfaw High School property.

View 'rincipal Brungardt described the proposad addition to the
southeast sTde of tha existina "FI Shape" butldin� plan. The
exlsting geodestc structure is to be removed; chanqes are proposed
ovar a 5-yesr period to convert btounds View High School Yo a 4-year
program; foresees no pro�tem in providTnq a landscape plan for
approval prior to occupancy of the cafeteria/library addition (First
Phase).
After discussion, Crichton moved, seconded by Hanson, that Council

Nc. 78-23 (plan dated received 8/16/78); occupancy of thb Phase I

�Ailler explained that the FTnal Plat of Weaver Oak Helahts
