Attorney Courtney stated that there Is nothing pending before the Council ~ at this tIme. Matter referred to the Clerk to so inform Mr. Allen. FROM THE FLOOR Land Fi I I Complaint Mr. and Mrs. Lawrence McGough, 1666 Johanna Boulevard, "ere present and stated their disapproval of the type of land fi II being dumped on the Arden Hills Sportsman's Club property on the north side of johanna Blvd. Mr. McGough, owner of the McGough Construction Company, informed the Council that this type of fill cannot be dumped In any other Village; they are forced to use a pay dump. He stated in his opInion this con- stitutes a public nuisance as there Is no dirt content and also this ~=~er!al Is being dumped on Mrs. Meyers' property without her consent. Trustee Crepeau, member of the Arden Hills Sportsman's Club, stated that the owners of the property, namely: the Sportsman's Club, Ramsey County and Robert AShbach, had given permission for this fil I and the purpose of this filling Is to enable a road to be built over the swamp to tne Sportsman's property. Attorney Courtney Informed the residents that VI I lage Ordinance No.3 prohibits dumping without the consent of the owner, but if the dumping Is a public nuisance, this would constitute a violation of a State Statute. .. Mayor Nethercut requested Attorney Courtney to check the Ordinances of other Villages and also to review the Arden Hills Ordinance. Mr. and Mrs. Blom, 3197 Shorewood Drive, were present. Mr. Blom ex- pressed his concern about the same fill matter as mentioned above. His concern being that the filling of this swamp would effect the control of the level of Lake Johanna. Mrs. Blom informed the Council that four families on Shorewood DrIve are now haclng water probleM' due to tha hlg~ level of the alke and believes the water level should be controlled. Engineer Don Lund stated that the County does control the level, but did not know at what level Lake Johanna is set. Attorney Courtney stated that he bad ta I ked with Attorney Cope.lend f tom, New Brighton and had one suggested change. Attorney Copeland plans to present the change to the New Brighton Counc II at thel l' meet Ing Tuesdl!iy night, April 12. Matter tabled until next CouncIl meeting. Trustee Crepeau requested Attorney Courtney to submit copies to the Council members as soon as available for study before the next meeting. Attorney Courtney Informed the Council that the old Edgewater~tel porperty owned by Walter Morton is being foreclosed by Mln,n~apo'ls Federal Savings & loan, but the proceedings will not be complete until September. Attorney Courtney was not able to contact Mr. Morton. . Attorney Courtney suggested that the Village proceed with cond~mnatlon If the problem Is serious enough and the cost could be recovered. Trustee BJorndahl confirmed that the condition Is sufficiently ha~ardous to warrant action. R~ferred to Attorney to check again with Minneapolis Feder-al. RelllnQ Water Franchise Proposal Attorney Courtney submitted to the Council members copies of 6. letter dated April 7, 1966, from Attorneys Finley and Finley, representing Mr. Reiling, which answered some of the questions as sumbttted by Attorney Courtney. Mayor Nethercut referred the matter to Attorney Courtney fOr further clarification before referring the matter to the Public Works Comml1'tee. . Cummlnqs Lane Road Improvement Trustee Crepeau moved, seconded by Trustee Bjorndahl, that Clerk Lorrafne StromquIst be the authorIzed representative of the Village to accept and open bids on April 25, 1966, for the Cummings Lane road Improvement project, and to refer same to Englneer Lund for ta~ulatlon; motion carried. ~ County Road F PlaVQround Trustee Bjorndahl requested a meeting be held between the County, Engineer Lund, representation from the Pollee Department and hImself for consIder- ation of the drIveway to the County Road F playground and the problem of the manhole extending above grade. . REPORT OF TRUSTEE HOFFMANN (Absent) Non-Conformlnq Slqns Clerk Lorraine StromquIst read a letter, dated March 14, 1966, from the Board of Appeals which gave their recommendations concerning non-conform- Ing signs In the Village. Clerk Informed the Council that the Planning CommIssion In their letter of AprIl II, 1966, stated that they are In agreement with the recommendations of the Board of Appeals. As recommended by the Board of Appeals, Trustee BJorndahl mbved:seconded by Tru~tae Crepeau, that the sign on the south side of Grey Fox Road advertISing the Industrial park be licensed and that the sIgn located on the north side .of the same road be removed; motion carried. H. Geroux at 134-29th Avenue South, MInneapolis, and 3792-3rd Street N. E., Co~umbla Heights, to determine If this type pf business meets the classIfication of lIght I~dustry as defined. Referred to Clerk to so Inform Mr. Kelley and request that this InspectIon be made before the next PlannIng CommIssIon meeting. Mayor Nethercut requested the CouncIl to stOdy the proposal before recommending a procedure for developIng as requested by the CommIssion. REPORT Of TRUSTEE CREPEAU Speed Control Trustee Crepeau Informed the Council that the Arden HIlls Police Depart- ment wIll comply wIth the request of Captain Nelson, State HIghway Patrol, to cooperate with other villages by attemptIng to curb speeding wIth concentrated use of the radar system. He stated that he would like publIcity on this matter. Junked Cars Mayor Nethercut Informed the Council that he understands that ~t. Anthony .~ Village has a Junked cars ordinance. Trustee Crepeau requested the - Clerk to obtain a copy of thIs. REPORT OF MAYOR NETHERCUT . ReslQnatlon Mayor Nethercut read a I etter of res I gnat! on from Joseph McKeon who was Arden Hills Chairman of the "Splc and Span" campaign sponsored by the .st. Pau I Area Chamber of Commerce. Mr. McKeon stated that a ch.ange In positions does not allow adequate time for t~ls campaign. The Council accepted with regret the resignation and requested recommendations fOr ills replacement. Included In Mr. McKeon's letter were suggestl()n$ tor conducting this year's campaign which recommended the cooperatIon of the Pollee Department; Letter referred to Trustee Crepeau. R. C. L. M.
