Mqetlng was called to order by Mayor Nethercut at 8:00 p.m.
Roll Call: Present - Mayor Nethercut, Trustees Crepeau, Hoffmann, Olmen
and SJorndahl.
Absent - None.
Also Present - Attorney Sal land, Engineer Donald Lund,
Administrative Clerk Lorraine Stromquist and
Deputy ~Ierk Florence Honan.

APPROVAL OF MINUTES
The minutes of the Regular Council meeting of September 12, 1966, were ap-
proved as submitted.
PUBLIC HEARING

Attorney Selland Informed the CouncIl that the legal notice had been
published and Interested property owners have been notified. Mayor
~Iethorcut requested comments from the floor. W. Eastland, attorney for
Bethel College (petitioner for the rezoning), and Mr. Nelson, represent-
Ing Phil lips Petroleum Company who Is Interested In constructing the
~tatlon, were both present.
Mr. Eastland displayed a map of the area and stated the Intent of the
Nor~hern Stn~B. Power Company to construct a pOWBr high-line through
the area; that this Is a logical commercial corner and wil I produce
tax base for the Village.
Mr. Nelson showed the proposed development with a two stal I station with
access from County Road E2 which the State has approved; the surrounding
low area will necessItate 10 to 12 thousand dol.lars worth of fill with
bracing of the land. Thls bracing will be of stone construction on a
slope with openings for plantings and screening. He stated that the
property line Is about the same as the adjacent lake shorelln~, but
they wll I not alter this shoreline. The station wIll be the same plan
as the one on 35W and Highway 96.
A resident who lives several houses from the Interchange expressed his
concern about the lights causing this corner to be more confusing, and
Inquired as to the future plans tor the area north of the station to
the treeway.
Nethercut informed him that the Comprehensive Plan proposes Commercial
tor this area.
Mr, Nelson stated that the lighting would be under the canopy with no
alarlng lights; the State agrees that actually a station at such a loca-
tion Is a safety ald.

Mrs. Dcnna Woolfrey, 1811 Venus Avenue, Inquired as to the height of
the sign, and stated her opposition as the sign will be visible from
her window.
Mr. Nelson Informed her that the sIgn will' be 12 feet square, mounted
on a pole not over 25 feet high, In accordance with our Ordinance.
Mayor Nethercut Informed him that the present Ordinance limits the sign
height to 16 feet, but a change Is proposed Increasing height limitation
to 25-feet.
Ralph Perry, 3670 New Brighton Road, Inquired as to the Justification of
another Phillips station since the one located at Falrview and County
Road D, which he thought was fairly new, has been closed for some time.
Mr. Nelson replied that this particular station was built about 1952,
and locations must be changed with the changing traffic pattern.
Mrs. Wool trey asked the hours the station would be open; but she believes
that stations have a tendency to draw teen-age gangs.

Mr. Nelson does not believe the station would be open 24 hours, but
stated that the company does encourage Its stations to remain open as
long as possible, probably from 6-7 a.m. unltl II - 12 p.m. The
company Is not happy when a station becomes a gang hangout and there
have been cases when a change of leasee has been caused by such a
situation, but Hondas, etc. are customers of servIce stations.

Mr. John Hollenhorst. 1822 Venus Avenue, stated that the proposed sIte
Is on the highest spot of land In the area; ~herefore, easIly visible

especially since It will be near the proposed itbrary sIte and many
children will be In the area.
Attorney Eastland stated that the station wIll not be adjacent to the
proposed library site. He also stated that vacant property Is not
good use of land.
Mr. Hal lenhorst believes that other commerelal establishments should
be considered with less traffic. . .
Mr. Nelson Informed that high land Is attractive to servIce companies,
especially corner locations.
In response to an Inquiry from Mr. Nelson, Trustee Hoffmann Informed him
that the N.S.P. C~ Is expected to return to the Planning Commission with
specific plans for the power high-line.
Mr. Nelson stated tha'!" a 135 foot easement fpr this high-I ine will be
over part of the station site. ."

Council Meeting Minutes - September 26, 1966 - continued
Larry McGough stated that the property Is presently zoned residential
and believes It is stili feasible for housing; he noticed that two new
houses, possibly In the 40. to 50 thousand dollar bracket, lire being
built at Highway 694 and Snelling Avenue. He Is not In favor of setting
a precedent. .

Mayor Nethercut felt that thIs area dIffers from the one beIng consIdered
as there Is no access to the freeway at the poInt Mr. McGough mentioned.
Mrs. Boog stated that the lot Is not I arge enough for a res I dence as
theIr home was located on this site before the construction of County
Road E2. The attorney for the Boogs confirmed her statement that If a
diagonal line were drawn, It would not be possible to place a house here.
Mayor Nethercut requested any further questions.
There were no further questions from the floor; Mayor Nethercut then
informed the audience that no action would be taken tonight as the
matter is to be reconsIdered by the Planning Commission. He stated that

Clerk LorraIne StromquIst read a letter, dated September 21. 1966, from
EngIneer Lund regardIng the overflow of draInage water from the dItch
runnIng from Lake JosephIne Into Lake Johanna. which Is causIng erosion
and drIveway damage to the Lambros preperty at 3213 Ridgewood Road.
Engineer Lund stated In his letter that the high weter level of 879.72
recorded In June 1965. and Is expected to Increase to over 880.00 - tae
normal weter elevatIon of Lake Is 877.50. EngIneer Lund suggested that
the VIllage request the opInion of Attorney Courtney as to the VIllage's

Acceptance of Fernwood Avenue
EngIneer Lund reported that Fernwood Avenue (Con1"rol Data Road) has been
I'nspec1"ed by EngIneer LI.benow and the draInage ~ork has now been satis-
factorily comple1"ed accordIng to the plans. Engineer Lund submitted a
letter which stated. Engineer llbenow's recommendation tha1" the Village
aCeep1" 'the road. Tru,stesOlmen moved that the Village accept the dedI-
cation of Fernwood Avenue frolll Control Data Corporation. subject to
At1"orney Courtney's opinion; seconded by Trustee Crepeau; motion carried.

Trustee Crepeau reported with regret that Mr. Cooper. pollee traIned 4 year
old German Shepherd pollee depar1"ment dog, had been fatally Injured by
a hit and run driver Sunday evening. Two Moundsvlew High SChOOl students,
faith Olchefskl, New Qrlghton. and Darlene Vappa. Shorevlew. placed the

Clerk Lorraine Stromquist presented about IZ building permIts as submItted
by Building Inspector Clav Kelley In which fees charged were not In
accordance with the Uniform Building Code as adop1"ed by the Village In
July. She explained that sOllie of these permIts were Issued before the
adop1"lon of the ~te;s"e was requesting approval by the Council for

Trustee Olmen moved that the BuildIng Permit fees Nos. 839-850 es pre-

Trustee Crepeau moved approval of restaurant. cigarette. soft drInks
and juke box licenses to Jacy Johnson. 8351 Groveland Road. to allow
operation of a Cafe at 4760 Highway 8; seconded by Trustee BJorndahl;

of Village Council
Village of Arden Hills, Ramsey County, Minnesota
September 26, 1966
A regular meeting of the Council of the Village of Arden
,4It Hills, Minnesota, was held in the Village Hall on September 26,
1966, at 8:00 o'clock p.m.
The following members were present:
Mayor Nethercut,
Trustees Hoffmann, Crepeau, Olmen and Bjorndahl
and the following 'were absent: None
The Administrative Clerk presented to the Council the
proposed assessment roll for Street Improvement No.7
prepared by her with the assistance of the village consulting
engineers as directed by the Council on September 12, 1966,
and reported that the assessment roll is now on file in her
office and open to public inspection.
Trustee Bjorndahl
then introduced the following
resolution and moved its adoption:

RESOLUTION PROVIDING FOR HEARING ON THE PROPOSED
ASSESSlv'iENT FOR SmEET IMPROVEMENT NO. 7
BE IT RESOLVED by the Council of the Village of Arden Hills
Minnesota, that the proposed assessment roll for Street
Improvement No.7, now on file and open to public
inspection in the office of the Village Administrative Clerk,
is approved, and the Clerk is directed to publish and mail
notice that the Council will meet to consider the proposed
assessmert on October~, 1966 at the Village Hall in the
Village of Arden Hills, at 8:00 o'clock p.m. The notice
shall state the date, time and place of the meeting, the
general nature of said improvement, the area proposed to be
assessed, that the proposed assessment roll is on file with
the Clerk, and that written or oral objections thereto by any
property owner will be considered. It shall be published in the
official newspaper of the village at least once, and shall
be !Dailed,to the owner of each parcel described in the assess-
ment roll, not less than two weeks prior to the date of said
meeting. For the purpose of such mailed notice, owners of said
parcels shall be those shown as such as of September~, 1966
on the records of the County Treasurer. Every property owner
whose name does not appear on such records (other than owners of
property which is tax exempt or is taxed on a gross earnings
basis) shall be deemed to have waived such mailed notice unless
he has requested in writing that the County Treasurer include
his name on the records for this purpose.
The motion for the adoption of the foregoing resolution
was duly seconded by -Irustee Hoffma~

whereupon said resolution was declared duly passed and adopted.
