A. The City of Arden 1-lills ("Cily") is in the process of�reviewing its regulations regardi.ng the construction of new and the modification of existing electronic changeab(e copy signs, electronic graphic display signs, video disp(ay signs, flashing signs, and multi-vision signs of all sizes in all sign districts. B. As used hercin, "Sign" means any name, identification, description, display, logo, illustration or device which is affixed to, painted, electronically displayed, or rcpresented directly or indirectly upon a building, pole, or other surface or piece or land, and wtiich directs attcntion to an object, product, place, activity, person, iiistilutior�, organi•r.ation or business. C. As used herein, "electronic changeable copy sign" shall be defined �is a sign or portion thereof th.at displ��ys electro�iic, non-pictorial, text inforniation in whicli each alpha�iumcric character, graphic, or symbol is defined by a small number of matrix elemcnts using different combinations of light emitting diodes (I..F;D's), tiber oplics, light bulbs ur other illumination devices within the display area. Electronic change<<ble copy signs include co�nputer pro�nammable, microprocessor controlled electronic displays. Llectronic changcable copy si�ns include projccteci images or messages with these characteristics onto buildings or othcr objects. D. As used herein, an "clectronic graphic display sigii" shall be defined as a sign or portion thereof that displays electronic, static images, static graphics or static pictures, with or without text information, defined by a small nuinber of matrix elements using differcnt combinations of light emitting diodes (LEU's), fiber optics, light bulbs or other illumination devices within the display area where the message change sequence is accoinplished immediately or by means of fade, repixalization or dissolve modes. Electronic graphic display signs include computer programrnablc, microprocessor controlled electronic or digital displays. Electronic graphic display signs include projected images or messages with thcse characteristics onto buildings, billboards, or other objects. E. As used herein, a"video sign" shall be defined as a sign that changcs its message or background in a manner or method of display characterized by motion or pictorial imagery, which may or may not include texl and c�epicts action or a special effect to imitate movcmei�t, the presentation of pictorials or graphi.cs displayed in a progression of Crames which give t}ie illusion of motion, including but not limited to the illusion of moving objects, moving patterns or bands of light, or expanding or contracting shapes, not including electronic changeable copy signs. Vid�o display signs include proje:cied images or messages with these characteristics onto buildings or other �bjects. F. As used herein, a"flashing sign" shall be de{ined as a directly or indirectl�- illutninated sign or portion thereof that exhibits changing light or color e(fect by any mearis, so as to provide interniittent illu►t�ination that changes light intensity in suddcn tr�insitory burst and creatcs the illusion of� intennittent flashing light by streaming graphic bursts showin� movement, or any mode of lighting which resemUles zooining, twinklii�g, or sparkling. G. As used herein, a"multi-vision sign" shall be defined as any sign coinposed in whole or in part of a series of vertical or horizontal slats or cylinders that are capable of being rotated at intervals so that partial rotation of the group of slats or cylinders produces a differesit i�tiage a�id when properly runctioning allows ou a single sign structure the display at any given time one of two or more images. H. The existing Sign Code regarding electronic changeable copy signs, electronic graphic display signs, video display signs, flashing signs, ani� multi-visio�i signs is incotnpatible with City goals and may allow undesirable sign types and sizcs. 1. The City anticipates that tl�ere will be additional submittals for constructing new �r modifying existing electronic c}iangeable cop}� signs, electronic graphic display signs, video display signs, flashirig signs, an�i multi-vision signs in thc City. J. In order to pernlit the City Council to review and eval.uate chariges to the City's current si�� regulations and to preserve the integrity of the plani�ing process, the Arden Hills Cily Council hereby deternlines tfiat a si�*t� moratorium for constructing new or modifying e�:isting electronic changeable copy :;igns, electronic graphic display signs, video display signs, ❑ashit�g signs, anci multi-vision signs is necessary ir� all sign districts. 384.03 Duration of Moratorium. The sign moratorium will comme�lce on the effective date of this ordin.ance and will continue for one ycar thereafter ur�less otherwise terminated or extended by action of the City Council. 2 384.U4 F,nforcement. "I'he C'ity may enforce any provisio�i of this ordinance by mandamus, injunction, or any other appropriate civil rernedy in any court of competent jurisdiction_ 384.05 Separabilitv. Every section, provision, or part of this ordinance is declared separable from every other section, provision or part of this ordinance. If any sectiou, provision, or part of this ordinance is adjudged to be itivalid by a court of competent jurisdiction, such judgment shall not invalidate any other scction, provision, or part of this ordinance. Effective Date. This Ordinance shall be effective the day following its publication or on the day following the publication of an Ordinance Sun.lmary approved by the Arden �-�ills City Council.
