Administrative Fines Update: As I've written previously, the Sheriffs Depm1ment and the seven
contract cities have been studying the possibility of using Administrative Fines for traffic
violations. Our City Attorney has some concerns about the use of Administrative Fines for
moving violations due to opinions written by the State Auditor and Attorney General. At this
time, three cities have decided against implementing Administrative Fines because of those
existing opinions. A few cities still will discuss it, but it is unlikely to proceed since it will be
onerous for the Sheri1f's Department to enforce and administer for some cities and not others.
Given our City Attorney's concern, 1 am reluctant to recommend the use of these fines for tratTic
violations. However, it is possible that we may want to implement them for other violations. In
addition, the Community Development Department has expressed a desire to look at
Administrative Fines as a tool for Code Enforcement. So, staff will continue to work on this
. topic and bring it to Council when we have a little more inforn1ation and a fin11 recommendation
for your consideration.
We received word after the Council packet was sent out that the closing with Royal Oaks will
take place on Monday morning. Therefore the item on the agenda far the extension of the
closing date will not need action.
Work continues on the preliminary development agreement with CRR. CRR is providing
comments back to Steve Bubul this week. Weare scheduled to meet and review status next
week. Plans for the November 7 and 8 meetings also continue. The dran agenda that was
included in your agenda packet continues to evolve. However, a large focus of the meetings will
be on various technical aspects of the transfer process: FaST, FOSET, RAA. As mentioned in
your packet, we hope to schedule a development tour in the near future, hopefully in November.
We will discuss that further on Monday evening. Tetra Tech is in the process of finalizing a plan
for the additional characterization on the site, which needs to be reviewed by the regulatory
agencIes. Staff has emphasized to CRR the need to finalize the preliminary development
agreement before we can continue to commit City funds. So we will focus our energies on that
effort. Meanwhile, Karen is in daily contact with Gen McJilton (Ryan) as they coordinate all the
various eHarts that are getting underway at this time. I anticipate we may need to tack work
sessions on to regular Council meetings fairly frequently so that we can continue to keep the
Council informed regarding this project.
. I met with a representative of the League of Minnesota Cities Insurance Trust on Thursday. We
are finally getting close to receiving payment of our claim for the fraud case. I have to provide

them with some information and turn in a "Proof of Loss" form, and then the claIm payment will
be processed. I was infOlmed that our expenses are not covered by this policy, only the loss.
However, our expenses were eligible for restitution and were included in the amount ordered by
the judge. I found out today that the probation officer who was assigned to the case is no longer
with the County, so a new officer was assigned. I spoke with him today. He is new to the case,
knew a little about it, but promised to review the file and get back to me with an update on the
status.
The City received a certificate from the Metropolitan Council acknowledging our Livable
Communities Tax Base Revitalization Grant in the amount of $200,000 for soil remediation at
the fonner A TS site. A copy of the certificate is included in this packet.
Karen attended a seminar this week sponsored by the Urban Land Institute and Blue Cross Blue
Shield that addressed "Health Implications of Community Design: The Value of Connected
Communities". The seminar was well-attended by a number of Mayors and City representatives
from the metro area, as well as out-state areas. The speaker, Larry Keeley, President and co-
foundcr of Doblin, Inc., provides consulting services relating to innovation and strategic change.
Attached is a memo providing highlights from the seminar.
Invitations to the EDC luncheon were mailed out earlier this week. We've already receivcd
twelve RSVP's from business people who will be attending the event. .
Preparations for the November 7th general election are in full swing. Schawn and Jackie have
been preparing absentee ballots, voting equipment, and supplies for the November election. The
Public Accuracy Testing of the voting equipment is scheduled for this Friday at 3:00 PM.
City staff recently re-posted the vacant Finance Director position. As of this writing, we have
received six applications for the open position. The application deadline for the Finance Director
position is Friday 10/27.
Public Works Department installed new crosswalk signs in the Cunm1ings Park neighborhood,
and a new security light was installed on the park building at Cummings Park.
We are working on plans for a Committee Summit in November or early December.
The old tower is down at the site near the bus garage.
Reminder - I've e-mailed the form with five questions relating to the annual perfon11ance review
for the Ramsey County Sheriffs department. Please provide your input as I need to rcspond
next week. If you need me to send the fon11 again let me know.
The warming house building has finally been moved from Valcntine Park to Frceway Park. The
electrical work was finished up Thursday and the Public Works staff will be finishing up with .
minor interior repairs into ncxt week. The building looks great at its new location! We should

be set to go for the ice rink season. Thc mini-mobile will move into Valcntine Park in mid-
December.
Staff is researching a situation regarding the removal of a backstop at Arden Oaks Park a few
ycars back. Some residents have recently voiced their displeasure about the removal. S tafT
needs to look into why the backstop was removed and find out the cost to replace in order to
dctcrmine what should be done there. Look far further information in a later update.
Michelle Olson and Jim Perron met Bill Schneider and Jody Yungers out at the Valentine Hills
area last Friday to discuss the potential of a partnership for a Safe Routes to School Grant. They
are determining a preferred route for the grant and will be bringing more information to the City
Council in November.
Just a rcminder that the PTRC is sponsoring a City Buckthom removal day tomorrow at Floral
Park. We will have a continental breakfast at City Hall at 9:30 a.m. and head to Floral from 10-
2. Please wear gloves and dress with work clothes.
Kris attended a Water Resources conference this week. There were infornlational seminars on
Low-Impact Development and other bcst management practices that the City could considcr
incorporating into its projects or even into development standards, especially with TCAAP on
. the horizon.
2006 PMP- restoration work is underway. Weather permitting. thc contractor hopcs to be able to
finish up rcstoration and pave the second lift of asphalt at the end of next week. Residents have
expressed concern that the number of trees being plaIltcd does not make up for the number
removed. We have continued to receive comments about the Siems Court/Lake Johanna
intersection. We have been informed that some of the residents will attend Monday night's
Council meeting to present a petition requesting more attention to both ofthcsc concerns.

SUBJECT: Urban Land Institute Seminar on Implications of Community Design for

. On Wednesday, October 25,2006 I attended a seminar sponsored by the Urban Land Institute
(LJ Ll) and Blue Cross Blue Shield of Minnesota (BCBS) relating to community design for
. .
healthy cities.
The keynote speaker was Larry Keeley, President and Co-Founder of Doblin, Inc. Doblin
specializes in assisting busincsses and organizations with innovation and change. The seminar
was well attended by a number of Mayors, Public Officials, and other community representatives
and staff from throughout the metro area and state. Bill Henry, member of Arden Hills' PTRC
was also in attendance.
Mr. Keeley's (wer-arching message was of the inevitability of change and how to embrace it and
deal with it effecti\'e1y.
Mr. Keeley noted that people tend to make two m(~or errors when faced with change: 1) We
tend to overestimate the amount of change that will occur in the near future; and 2) We
chronically underestimate the amount of change that will occur in the long term. Mr. Keeley
stated that leaders must sense when needs are fundamentally changing and embrace that change
and prepare far it instead of becoming a "victim" of the change.
He also noted that change brings a tremendous amount of anxiety to most people, causing people
to withdraw and tUI11 inward. Change causes a universal strategic condition: 1) An
overwhelming sense of ambiguity, \vhich humans hate; 2) a feeling of complexity, causing
. people to say "it won"t work"; and 3) Volatility, causing a fear of failure and punishment. What
we really need to succeed is: Curiosity, Confidence, and Courage.

Mr. Keeley provided an outline of how to constructively deal with change, either imminent or
potential:
1. Diagnose the Situation
2. Declare Intent
3. Set Conditions
From there_ you author initiatives and foster those initiatives.
Mr. Keeky stated that we have a choice to contribute to our city's health. Wc have a number of
tools to achicve this, for example through zoning regulations (i.e., Seaside, Florida).
Mr. Keeley laid out the six principles of healthy communities:
I. Effort -- sweat equity of citizens (responsibility, collaboration)
2. Purposc - shared activities, progress, focus. a sense of influence
3. Identity -- Defined community, character, authenticity, emergence
4. Organic - Balanced, interdependent, co-constructed, deccntralized
5. Adaptive - flexible, resilient .
6. Freedom ..- Choice, access, fit, empowerment
Mr. Keeley likened these principles to a sandwich, where the "bread" is EITort and Frcedom and
thc "meat" is the Purpose, Identity, Organic, and Adaptive principles. The "bread" is the
characteristics of the peopk in the community; the "meat" is what thc leadcrs need to provide to
the community.
