Consider a Motion to Approve Planning Case 07,003 for a Planned Unit Development
Amendment at 3717 Lexington Ave South Based on the Findings of Fact and the Submitted
Plans as Amended by the Three Conditions in Planning Case 07-003.

On September 9, 2002, the City Council approved a Planned Unit Development (PUD) to
construct a 90,000 square foot Cub Foods store at 3717 Lexington Avenue in Planning Case 02-
018. The PUD included an approval for 778 square feet of signage (678 square feet for wall
signage and 100 square feet for a monument sign). The signage approved in the PUD has been
installed.
The applicant is now requesting an additional forty (40) square feet of signage for the new "Now
Express Medical Clinic" that is located inside of the store. The proposed sign would be located
near the upper right hand corner of the front of the building. The additional signage requires an
amendment to the Planned Unit Development permit for the property. The clinic is a conforming
use within the B-3 Zone.
Recommendation
The Planning Commission reviewed Planning Case 07-003 and unanimously (6,0) recommends
approval for the PUD Amendment at 3717 Lexington Ave South based on the findings offact
and the submitted plans as amended by the following three conditions:

1. The applicant shall continue to abide by the conditions of approval listed in Conditional
Use Permit #02.018 and any other approved permits.
2. The project shall be completed in accordance with the plans submitted as amended by the
conditions of approval. Any significant changes to these plans, as determined by the
City Planner, shall require review and approval by the Planning Commission.
3. The sign shall not exceed the illumination intensity of the existing signs.
Options
1. Approve the proposal as submitted.
2. Approve the proposal with conditions.
3. Deny the application with reasons for denial. If the City denies the petitioners request, "...it
must state in writing the reasons for the denial at the time it denies the request."
4. Table for additional information.
A motion to deny should include specific findings on why the proposal will have a negative
impact and why those impacts cannot be mitigated.
A POD amendment requires a 4/5 vote for approval.
Deadline for Al!encv Actions
The City of Arden Hills received the completed application for this request on February 14,
2007. Pursuant to Minnesota State Statue, the City must act on this request by April 14, 2007 (60
days), unless the city provides the petitioner with written reasons for and additional 60 day
review period. The City may, with the consent ofthe applicant, extend the review period beyond
the initial 120 days.

Mr. Lehnhoff stated the applicants were requesting a Planned Unit Development (PUD)
Amendment to Planning Case No. 02-018 to add forty square feet of sign age to the front
of the Cub Foods building for the "Now Express Medical Clinic" that is located inside of
the store. Staff recommended approval based on the following conditions:
I. The applicant shall continue to abide by the conditions of approval listed in

Chair Sand opened the public hearing at 7:12 p.m.
Chair Sand invited anyone for or against the request to come forward and make
comment.
James Johnson, 3589 Sunset Road, Brooklyn Park, representing Signs by RSG, stated he
was available for any questions.
Chair Sand asked if it was RSG that prepared the color rendering. Mr. Johnson
responded they had prepared the color rendering.
Chair Sand stated the color rendering was very helpful and asked if the signs would be
backlit similar to the other Cub Food signs. Mr. Johnson responded the letters would be
illuminated.
Commissioner Modesette asked if the sign face was white. Mr. Johnson responded it
was.
Chair Sand closed the public hearing at 7:14 p.m.
Commissioner Larson moved, seconded by Commissioner Modesette to recommend
approval of Planning Case No. 07-003 for a Planned Unit Development Amendment to
add forty square feet of signage to the front of the Cub Foods Building at 3717 Lexington
Avenue North subject to the three conditions as outlined in staffs March 7,2007 report.
The motion carried unanimously (6-0).
