Backl!round There is currently a drainage pipe that runs near the western side of 321 0 Hamline Ave N, which is located on the nor1h side of Lake Josephine. Unfortunately, the drainage pipe is not centered in the middle of the drainage easement. Despite a number of discussions with Ramsey County and the Rice Creek Watershed District (RCWD), it is not clear why the drainage pipe is not located in the center of the drainage easement. Although the easement was dedicated to the City, the County maintains and operates the drainage pipe. While the easement is the appropriate width for the depth of the pipe, the pipe is not at the center of the easement, which means the easement includes unnecessary portions of the property and may make future maintenance difficult in certain spots along the pipe. The existing twenty foot wide drainage easement extends n0l1hwest from an outlet in Lake Josephine toward the western (side) property line. When the drainage easement meets the western (side) property line, it angles into a more northerly direction that is adjacent and parallel with the western proper1y line. The easement te1111inates at the right-of-way for Hamline Ave N. lfthe drainage easement was corrected to follow the pipe, a small por1ion of the easement would shift very slightly to the west and slightly increase the buildable area at 3210 Hamline Ave N. To make matters somewhat more difficult, the drainage pipe actually goes onto the property to \\Me/ro-illet,II.1'lardcl/lJillsiPlflllllillg\P/alll1il1g Coses12007107-007 Partial Eas['!I1cJjf Vacation (PEND1NG)\040907 _ CC Reparl- Ease/llent Vacalioll.doc Page I of3 the west (3200 Hamline Ave N) about 75 feet from the Ii'ont of the 3210 Hamline Ave N property. However, neither the City nor County has an easement on 3200 Hamline Ave North for the drainage pipe. Since the City does not yet have an easement on 3200 Hamline Ave North, Staff proposed and the applicants agreed to leave a 20 foot wide easement along the western (side) property line in order to access the p0l1ion of the drainage pipe that is located on the subject propel1y. In reality, very little of the drainage easement will move to the west, and the size of the easement will actually increase from 3,318.2 square feet to 3,357.5 square feet. At some point in the future, the City, County, and/or Rice Creek Watershed District may want to obtain an easement for the portion of the pipe on 3200 Hamline Ave N. The realigned easement on 3210 Hamline Ave N will leave enough room for maintenance and replacement for the portion of the pipe on 3210 Hamline Ave N. The discrepancy between the drainage pipe and drainage easement was brought forth because the property owners are preparing plans to redevelop the property, and their proposed redevelopment may encroach a few feet into the eastern side of the existing drainage easement, which would not be pernlitted. However, if the drainage pipe were centered on the drainage easement, the potential redevelopment plans would not encroach into the easement. Although their redevelopments plans are still being prepared, the property owners would like to correct the drainage easement location discrepancy to make it easier to prepare redevelopment plans and to resolve a confusing situation. Despite the potential redevelopment plans for the propel1y, the easement realignment should be considered separately from those plans and evaluated on its own merits. With any vacation, the City Council should consider whether the existing easement alignment has any current or future public use as opposed to the new easement that would follow the true location of the drainage pIpe. Ramsey County Public Works has reviewed the proposal, and they do not have any objections to the proposed casement realignment. Since the easement realignment will not change the function of the pipe, the Rice Creek Watershed District did not have any comments. Although Staff is referring to this application as a drainage easement realignment, the existing easement would actually be vacated entirely and a new easement would be accepted by thc City. The City Attorney reviewed the proposed drainage easement replacement, and the proposed easement legal description on the submitted survey was not sufficicnt. The City Attorney spoke with the applicant's surveyor, and they prepared a revised legal description for the new drainage easement, which is on the Grant of Permanent Easement in Attachment 6A-2. Public Notice Notice was published in the Arden Hills/Shoreview Bulletin two weeks prior to the public hearing and notice was prepared by the City and mailed to residents adjacent to the easement as required by State Statutes. \\Mefro-illcl.IIS\(//,t!cllhills\PlflllllillglPlml1lillg Cascs\200i\OJ-()07 Partial Ea.\'cII1CII/ Vawlioll (PENDING) \040907 - CC Heporl- Easement Vacafion.doc Page 2 of3 Recommendation Since realigning the drainage easement will resolve a discrepancy between the true location of the drainage pipe and the drainage easement, Staff is recommending approval of the drainage easement realignment. The small portions of the drainage easement that will be released to the property owner do not have a public use. Staff recommends approval of Resolution 07-45 for the vacation of the drainage easement in document number 1742652 and the acceptance of a realigned drainage easement at 3210 Hamline Ave North as amended by the following three conditions: 1. The applicant shall submit evidence of title for 3210 Hamline Ave N that is acceptable to the City Attorney before the City records Resolution 07-45. 2. If there is a mortgage, the applicant shall obtain a signed consent to the easement from the mortgagee before the City records Resolution 07-45. 3. The applicants shall sign the Grant ofPernlanent Easement for the realigned easement before the City records Resolution 07-45. Options I. Approve the proposal as submitted. 2. Deny the application with reasons for denial. If the City Council determines that the City has a vested interested in retaining the existing easement alignment, the easement realignment request can be denied by stating the current or future public purpose with the motion for denial. 3. Table for additional information. Deadline for Agencv Actions The City of Arden Hills received the completed application for this request on March 14,2007. Pursuant to Minnesota State Statue, the City must act on this request by May 14,2007 (60 days), unless the city provides the petitioner with written reasons for and additional 60 day review period. The City may, with the consent of the applicant, extend the review period beyond the initial 120 days. WHEREAS, the property owner will provide a replacement easement that is acceptable to the City Attorney and City Engineer along the western side of the property to provide access to the p0l1ion of the drainage pipe that is located on said property from the Hamline Ave N public right-of-way; and, WHEREAS, on the 9110 day of April, 2007, a Public Hearing preceded by published, posted, and mailed notice as required by Minn. Stat. 9412.851 was conducted before the Arden Hills City Council; and WHEREAS, at the conclusion of the Public Hearing, the Arden Hills Council determined that vacating the drainage easement and accepting a realigned drainage easement would be in the public interest. NOW, THEREFORE, BE IT RESOLVED that the Arden l-rills Council hereby vacates the City's interest in that part of the easement as described Doc. No. 1742652 as filed with Ramsey County in the State of Minnesota and accepts a new permanent casement subject to approval of the City Attomey and City Engineer.
