BACKGROUND
As a result of the reconfiguration of Red Fox Road and the elimination ofthe TH 51 frontage
road in the 2005 PMP, the City needs to reassign 0.47 miles of Municipal State Aid (MSA)
streets. Staff reviewed the existing street system to identify road segments that are candidates for
MSA streets. Two segments staff identified are Beckman Avenue, from New Brighton Road to
Lake Johanna Boulevard (0.18 miles), and Valentine Avenue, from Valentine Lake Road to Old
Highway 10 (0.23 miles). These streets were selected because they meet the requirements to be
MSA streets, and most closely match the available mileage generated by revoking Red Fox
Road. The MSA Needs Manager has indicated to staff that these reassignments are acceptable
and will be formalized once a City Council resolution is submitted.
DISCUSSION
The State Aid Program was established in 1956 as a part of Minnesota's State constitution. Its
primary goal was to distribute state aids to local roads and bridges so that a balanced highway
system could be established sufficient to serve varied types and volumes of traffic. The funding
for the program, the State's Highway User Tax Distribution Fund (HUTDF), is made up of
license tab fees, vehicle sales tax, and gas tax revenues. 95% of this money is used to fund road
improvements at the state, county and local level. The distribution of this 95% is; 62% for Trunk
Highways, 29% for County State Aid Highways (CSAH), and 9% for Municipal State Aid Street
(MSAS). The remaining 5% ofthe HUTDF is dedicated to the flexible highway account and
township roads and bridges.

In 2007, approximately $1,257.5 million is available for distribution from the HUTDF. Of this
total, only nine percent, or about $107.5 million, is allocated to the MSAS fund.
Any municipality that has a population of 5,000 or over is eligible to receive state aid funds. The
funds are distributed to eligible cities based on two things, population and construction Needs.
To determine the portion ofthe funding that is dependent on construction Needs, each year city
engineers submit information to the State Aid office to document their road, structure, and
railroad crossing funding Needs for their State Aid system.
In order to report the construction Needs for the portion of the City's street system that is MSAS,
the City must identify the individual street segments that comprise their system. A city can
designate up to 20 percent of their county road and local road mileage on their MSAS system.
County roads and County State Aid Highways (CSAH) that have reverted back to the
municipality may be included above the 20 percent mileage limitation. Arden Hills has a total of
30.69 miles of local streets, 20% of which can be designated as MSAS for a total of6.14 miles.
Currently we only have 5.76 miles designated.
In order to designate a street as MSA, it must meet the following selection criteria:
8820.0700 Subp. 3. Municipal state-aid street. A municipal state-aid street may be selected if it:
A. is projected to carry a relatively heavier traffic volume or is functionally classified as
collector or arterial as identified on the urban municipality's functional classification plan;
B. connects the points of major traffic interest, parks, parkways, or recreational areas within an
urban municipality; and
C. provides an integrated street system affording, within practical limits, a state-aid street
network consistent with projected traffic demands.
At the April 16, 2007 City Council Work Session, the City Council asked what projects are
eligible for MSA funds. MSA funds may be used on City projects involving MSA streets, bridge
improvements, as well as CSAH projects to cover the City's portion ofthe cost. Engineering
costs are also eligible up to 25% of the construction cost. MSA funds are also allowed to be used
to fund
1. Lighting of hazardous areas (Ornamental lights may be treated as a landscaping item
see number 7)
2. Traffic control signal (100% eligible)
3. Right- of- way acquisition (100% eligible)
4. Bicycle paths and sidewalks along a CSAH or MSAS route. (100% eligible)
5. Storm sewer. (Percentage of funding is based on benefit to the MSAS route)
6. Pavement-level of participation depends on Average Daily Traffic (ADT). (over 80
ADT then 100%)
7. Landscaping- 5% of total allocation in any given year.
The City Council also asked whether MSA streets that have been reconstructed can be
redesignated. The following excerpt from the Minnesota Rules Chapter 8820 describes the
consequences of revoking streets for which MSA funds have been spent:
8820.0800 Subp. 3. Payback on revoked state-aid routes. If a local unit of government revokes
a state-aid route for which state-aid construction money has been spent, the district state-aid
engineer shall determine the remaining life of the project and compute the value ofthe items that
were financed with state-aid money. This computed value must be subtracted from the next
state-aid contract let by the local unit of government. For this determination, (1) the life of a
construction and reconstruction project is 25 years, (2) the life of a bridge project is 35 years, and
(3) the life of a surfacing or reconditioning project is ten years. Payback is not required ifthe
state-aid construction was a special resurfacing project.

CONCLUSION
50% of our City's MSAS funding is based on construction Needs. MSA mileage that is not
assigned to street segments is not drawing construction Needs. By not having our full mileage
designated to street segments, the City is not receiving all ofthe MSAS funds we are entitled.
The City must make system revisions by May 2007, in order to receive funding for construction
Needs in our MSA allocation. Future revisions can be made to the MSA system as needed.
Therefore, staff recommends that the City Council approve the system revisions identified in the
resolutions.
Staff recommends the following motions:
a. Approval ofresolution revoking Red Fox Road from the MSA system.
b. Approval of resolution establishing Beckman Avenue and Valentine Avenue as MSA
streets.

NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of
Arden Hills that the roads described as follows, to-wit:
Part of MSAS ] 05, Red Fox Road and TH 51 Frontage Road- Dunlap Street North to TH 51
Entrance (0.47 existing miles)
be, and hereby is, revoked as a Municipal State Aid Street of said City, subject to the
approval of the Commissioner of Transportation of the State of Minnesota.
BE IT FURTHER RESOLVED, that the City Administrator is hereby authorized and
directed to forward two certified copies of this resolution to the Commissioner of
Transportation for his consideration.

WHEREAS, it appears to City Council of the City of Arden Hills that the streets
hereinafter described should be designated Municipal State Aid Streets under the provisions
of Minnesota Law.
NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of
Arden Hills that the roads described as follows, to-wit:
Beckman Avenue, New Brighton Road to Lake Johanna Boulevard (0.18 existing miles)
Valentine Avenue, Lake Valentine Road to Old Highway 10 (0.23 existing miles)
be, and hereby are established, located, and designated Municipal State Aid Streets of said
City, subject to the approval of the Commissioner of Transportation of the State of
Minnesota.
BE IT FURTHER RESOLVED, that the City Administrator is hereby authorized and
directed to forward two certified copies ofthis resolution to the Commissioner of
Transportation for his consideration, and that upon his approval of the designation of said
road or portion thereof, that same be constructed, improved and maintained as a Municipal
