Backl!round The applicants are proposing to construct a 96 square foot, 8'x12', sunroom on the front side of the existing dwelling facing Lake Johanna Boulevard. The proposed addition would be in line with northern side ofthe existing dwelling; however, the existing structure encroaches approximately 3.2 feet into the northern side yard setback. An existing concrete patio would be removed and the sunroom would be built in the same location, which would result in no net increase in impervious surface for the property. Although the picture submitted by the applicant shows a white metal roof on the sunroom, the applicants have stated that the sunroom roof will be shingled to match the existing roof on the dwelling. The applicant has submitted a letter outlining the reasons for the request, a response to the variance evaluation criteria, and an example picture of how the addition will look with the existing dwelling (Attachment 3B-l of the Planning Commission report). A full survey ofthe property has also been submitted (Attachment 3B-3 of the Planning Commission report). A previous planning case, 01-021, was approved in 2001 for a variance to reconstruct a one car garage into a two garage within the front yard setback. The 10,171 square foot, 50 foot wide lot size is classified as a legal, nonconforming lot within the R-2 Zone. 2. A portion of the current dwelling is nonconforming because it encroaches as much as 3.2 feet into the northern side yard setback. 3. The proposed sunroom addition would be in line with the existing dwelling and would be approximately 1.8 feet from the northern lot line. 4. The proposed addition along with the existing structure would not exceed the impervious limits. 5. The existing single family home and the proposed addition are permitted uses within the R-2 Zone. 6. The existing structure and proposed addition are outside of the 100-year flood plain, wetlands, and easements. 7. The proposed addition itself is a reasonable use within the R-2 Zone as compared to other single family homes in the City. The size of the dwelling and addition are comparable to other structures in the surrounding neighborhood. 8. The proposed addition is unlikely to negatively impact the essential character of the neighborhood or the City. The size and dimensions of other homes along Lake Johanna are similar in character to the subject property, and the addition would be somewhat hidden from Lake Johanna Boulevard by the garage and change in grade from the street to the home. 9. The nonconforming lot size and lot width pose a unique situation that was not created by the land owner. The lot was created prior to the incorporation of the City of Arden Hills and the current land use and subdivision controls. 10. The proposed addition is not based on economic considerations alone. Recommendation The Planning Commission reviewed Planning Case 07-008 and unanimously (7-0) recommends approval of the Variance based on the findings of fact and the submitted plans as amended by the following three conditions: 1. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission. 2. The applicant shall obtain all necessary permits from the Rice Creek Watershed District and any other necessary agencies prior to the City issuing any building permits. 3. The roof of the sunroom shall be shingled to match the roof of the existing dwelling. Approve the proposal with conditions. 3. Deny the application with reasons for denial. If the City denies the petitioners request, "... it must state in writing the reasons for the denial at the time it denies the request." 4. Table for additional information. Deadline for Al!:encv Actions The City of Arden Hills received the completed application for this request on March 14,2007. Pursuant to Minnesota State Statute, the City must act on this request by May 14, 2007 (60 days), unless the City provides the petitioner with written reasons for an additional 60 day review period. The City may with the petitioners' consent extend the review period beyond the 120 days. Staff recommended the following three conditions ifthe Planning Commission moves for approval: I. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission. 2. The applicant shall obtain all necessary permits from the Rice Creek Watershed District and any other necessary agencies prior to the City issuing any building permits. 3. The roof of the sunroom shall be shingled to match the roof ofthe existing dwelling. He indicated he had received an email from Barbara Clark, 3342 Lake Johanna Avenue, in favor of the variance, an email from Steve and Mari Schmidt, 3352 Lake Johanna, and an email from Nancy Hansen, 3368 Lake Johanna Boulevard all in favor of this variance. He stated he had also received one phone call in support. Commissioner Zimmerman stated because the sunroom was being constructed on a slab, this was not habitable space, could not be lived in, or slept in. Chair Sand opened the public hearing at 8:14 p.m. Chair Sand invited anyone for or against the request to come forward and make comment. Commissioner Thompson asked if they had looked at moving it 2-3 feet so the encroachment would not be as great. Bob Teeling, 3346 Lake Johanna Blvd, replied they had looked at moving the structure over, but they would have to restructure the house in order to accommodate moving the sunroom. Chair Sand did not believe this would encroach any further to the street as the property to the south did. He believed this sunroom would be a good addition to the property. He asked if the entire concrete patio would be replaced. Mr. Teeling responded they would replace the entire slap. Chair Sand closed the public hearing at 8:22 p.m. Commissioner Thompson asked if they wanted criteria around the living space. Commissioner Zimmerman noted that was part of the Zoning Code and Building Code. Commissioner Zimmerman moved, seconded by Commissioner Larson to approve Planning Case No. 07-008, for a variance at 3346 Lake Johanna Boulevard based on the findings of fact and the finding the property is unique due to circumstances that were not ARDEN HILLS PLANNING COMMISSION - APRIL 4, 2007 7 created by the landowner based on the submitted plans as amended by the three conditions in Planning Case 07-008.
