TO: Honorable Mayor and City Council Members Michelle Wolfe, City Administrator Schawn Johnson, Assistant City Administrator~ FROM: SUBJECT: Revisions to the City's Charitable Gambling Ordinance: -Amending Sections 330.02 Subd. 9 and Section 330.02 Subd. II of the Arden Hills City Code Background Recently City staff and City Attorney Jerry Filla reviewed the City's charitable gambling ordinance and noticed that a few changes were needed to bring the ordinance into compliance with State Statutes. The following is an overview of the recommended changes: 1. City staff is recommending that the following language identified in bold be removed from 300.02 Subd 9. of the City's Gambling Code: Local Gambling Tax. The Conncil may, pursuant to state law, impose a local gambling tax on all organizations licensed to conduct lawful gambling within the City. The tax shall be set by the City Council but shall not exceed three (3%) percent of the organization's gross profit from gambling activities within the City. Proceeds of the tax shall only be used for the purpose of regulating all gambling activities within the City, inclnding but not limited to the reimbursement of the City's administrative, legal, and consulting costs. City staff is recommending that the following language be adopted in 300.02 Subd 9. of the City's Gambling Code: Local Gambling Tax. The City may, pursuant to State Law, impose a local gambling tax on all organizations licensed to conduct lawful gambling within the City. The tax shall be set by the City Council, but shall not exceed three percent (3%) of the organization's gross receipts from all lawful gambling, less prizes actually paid out by the organization. Proceeds of the tax shall only be used for the purpose of regulating all gambling activities within the City, including but not limited to, the reimbursement of the City's administrative, legal and consulting costs. 2. All organizations permitted to conduct lawful gambliug within the City shall contribute ten (10%) percent of their uet profits derived from lawful gambling activities within the City to a special fund to be administered by the City Council for lawful purposes. Payments to the fund shall be calculated for quarterly periods ending on the last days of March, June, September and December of each year. Quarterly installment payments shall be submitted together with verifiable supporting documentation, not later than the twentieth day of the month following the end of the quarterly period. City staff is recommending that the following language be adopted in 300.02 Subd II. of the City's Gambling Code: Lawful Gamblin!! Fund. All organizations permitted to conduct lawful gambling within the City shall contribute ten percent (10%) of their net profits derived from lawful gambling conducted at the premises within the City to a special fund to be administered by the City Council for reimbursement of police, fire and public safety related services, equipment and training; and for Charitable Contributions, as defined in Minn. Statutes Section 349.12 Subd. 7.a. Payments to the fund shall be calculated for quarterly periods ending on the last days of March, June, September and December of each year. Quarterly installment payments shall be submitted together with verifiable supporting documentation, not later than the 20th day of the month following the end of the quarterly period. Ordinance #383-Charitable Gambling Ordinance ~ ~~HILLS CITY OF ARDEN HILLS STATE OF MINNESOTA COUNTY OF RAMSEY ORDINANCE NO. 383 AN ORDINANCE RElATING TO GAMBLING The Arden Hills City Council hereby ordains that Section 330.02, Subd. 9 and Section 330.02, Subd. 11 of the Arden Hills City Code are hereby amended to read as follows: Section 330.02 Subd. 9 Local Gamblina Tax. The City may, pursuant to State Law, impose a local gambling tax on all organizations licensed to conduct lawful gambling within the City. Adoption Date: Passed and adopted by the City Council of the City of Arden Hills the 12th day of February, 2007 Effective Date: This Ordinance shall be effective the day following its publication or on the day following the publication of an Ordinance Summary approved by the City Council.
