SUBJECT: Planning Case #: 07-013 Planned Unit Development Amendment Hood Packaging Corporation (Matthew Hegstrom) 1887 Gateway Boulevard Request Motion to Approve Planning Case 07-013 for a PUD Amendment at 1887 Gateway Boulevard Based on the Findings of Fact and the Submitted Plans as Amended by the Four Conditions in the June 25,2007, Planning Case Report. Back2round Hood Packaging Corporation is located at 1887 Gateway Boulevard in the Gateway Business (GB) Zone on Interstate 35W. Hood Packaging manufactures various types of paper and plastic packaging products and is a conforming use in the GB Zone. The applicant is requesting a Planned Unit Development (PUD) amendment to install two additional 2,000 gallon storage tanks to the southeast side of their building. Each tank is fourteen feet long, five feet four inches tall, and five feet four inches in diameter. The tanks have a double wall construction and sensors to reduce the possibility ofleaks The applicant has submitted a letter explaining the basis for the request; however, in sum, the two tanks would be used to store solvents and waste materials used in their manufacturing process (Attachment 3B-I of the report to the Planning Commission). The stored materials would be transported offsite each month for recycling and returned the site for reuse. According to the applicant, the new storage and recycling system would reduce hazardous chemical disposals by as much as 65 percent. The applicants have a valid license with Ramsey County for handling hazardous materials. Hazardous materials can be handled in the GB Zone with the proper licenses. \lMetro-inet.uslardenhillslPlanninglPlanning Cases\2007\07-013 Hood Packaging PUD Amendment (PC Approval)\062507 - CC Report _ Hood Packaging pun Amendment.doc Page 1 of3 The two new tanks would be installed next to two existing tanks that were permitted in a previous planning case in the year 2000. The tanks are next to the building and approximately 200 feet from the edge of Gateway Boulevard. The fencing around the two existing tanks would be expanded to screen the two new tanks from adjacent properties. The fence is a chain link fence with tan fabric mesh that is similar in color to the building. The fence was part of the approval process for the two existing tanks. A screening wall connected to the building near Gateway Boulevard also helps screen the tanks from Gateway Boulevard, though the wall does not provide a significant amount of screening for the tanks. There will not be any reduction in parking with the additional tanks as all parking is on the other side of the building. Truck traffic may decrease slightly on the site since the tanks will reduce waste collection from twice a month to once a month. The tanks will be built on an existing impervious surface; therefore, no change in impervious coverage will occur with this application. The new recycling system and tanks are not expected produce any noticeable odor or any noise since the system is essentially closed on the outside of the building. Findines of Fact The Planning Commission offers the following eleven findings of fact for review: 1. Hood Packaging Corporation is a conforming use in the Gateway Business Zone. 2. The applicant proposes to add two 2,000 gallon tanks to the southeast side ofthe building. Each tank is fourteen feet long, five feet four inches tall, and five feet four inches in diameter. The tanks are proposed to be double walled and monitored with sensors for leaks. 3. The tanks will be placed on an existing impervious surface and will not encroach on any setbacks. 4. The new recycling and collection system is anticipated to reduce hazardous material disposal by as much as 65 percent. On the Planned Unit Development Amendment Evaluation Criteria: 5. Truck traffic may be reduced slightly because waste material collection will be reduced from twice a month to once a month. Parking will not be impacted since all parking is located on the other side of the building. 6. The two proposed tanks are not expected to alter existing noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid or solid waste, or other nuisance characteristics. 7. The two proposed tanks will not impact drainage on the site. 8. The two proposed tanks will not impact population density on the site. 9. The two new tanks will be screened by an expanded fence from two existing adjacent tanks. The fence matches the color ofthe building and is unlikely to significantly impact the subject property or surrounding properties. The visual impact form Gateway Boulevard is minimal. 10. Park dedication requirements do not apply. The proposal does not conflict with the 1998 Comprehensive Plan. Recommendation The Planning Commission reviewed Planning Case 07-013 and unanimously recommends approval of the PUD Amendment Site Plan Review based on the findings of fact and the submitted plans as amended by the following four conditions: I. The proj ect shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. 2. The two proposed tanks shall meet all applicable Building Code and Fire Code regulations. The applicant shall obtain all required permits prior to installation. 3. The two proposed tanks and connected recycling system shall comply with the odor, noise, and other applicable Minnesota Pollution Control Agency regulations. Failure to comply with these regulations may result in a revocation of the conditional use permit. 4. The proposed fence shall be installed within two weeks of installing the tanks. Options I. Approve the proposal as submitted. 2. Approve the proposal with conditions. 3. Deny the application with reasons for denial. If the City denies the petitioners request, "... it must state in writing the reasons for the denial at the time it denies the request." 4. Table for additional information. Deadline for Al!:encv Actions The City of Arden Hills received the completed application for this request on May 14, 2007. Pursuant to Minnesota State Statutes, the City must act on this request by July 14, 2007 (60 days), unless the city provides the petitioner with written reasons for and additional 60 day review period. The City may, with the consent of the applicant, extend the review period beyond the initial 120 days. PLANNING CASE #07-013 - PLANNED UNIT DEVELOPMENT AMENDMENT; HOOD PACKAGING; 1887 GATEWAY BOULEVARD - PUBLIC HEARING Mr. Lehnhoff stated the applicants have requested a Planned Unit Development Amendment to install two 2,000 gallon storage tanks to the southeast side of the building at 1887 Gateway Boulevard. Staff recommended approval of the Planned Unit Development Amendment subject to the following four conditions: I. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Chair Sand opened the public hearing at 6:39 p.m. and invited anyone for or against the Planning Case to come forward. The applicant explained the recycling system and new technology. He indicated this was both environmentally and cost friendly. Commissioner Thompson arrived at 6:41 p.m. Chair Sand closed the public hearing at 6:44 p.m. Commissioner Zimmerman moved, seconded by Commissioner Larson approval of Planning Case No. 07-013, for a Planned Unit Development Amendment at 1887 Gateway Boulevard based on the findings of fact and the submitted plans as amended by the four conditions in the June 6, 2007, Planning Case report.
