Backe:round Bethel University is proposing to add 112 net new parking spaces in three locations on their campus (Attachment 3C-3 0 fthe September 5, 2007 Planning Case Report): 1. Twenty-seven spaces along Seminary Drive, which is an internal private road; 2. Forty-nine spaces in the Upper East Lot North; and 3. Thirty-six spaces in the Upper East Lot South; The public hearing notice that was sent to nearby residents stated that 114 parking spaces were proposed to be added in this project. The first version of this parking lot expansion proposal included an unintended encroachment into the 20 foot required setback for parking lots from property lines that are adjacent to a right-of-way. Bethel University has revised the plans to eliminate any setback encroachments, which reduced the new parking stall request by two stalls. The original description of the proj ect, an updated proj ect request letter, and the revised site plans are included as an attachment to this report (Attachment 3C-1 of the September 5, 2007 Planning Case Report). According to the applicant, the additional parking is not meant to facilitate a student or staff expansion. The parking spaces will help ease an existing parking space deficit on the campus. No variances are needed or requested for this application. Findine:s of Fact Staff offers the following fifteen findings of fact for the University Commons for the Planning Commission's consideration: General Findings: 1. The applicant is proposing to expand parking in three locations: a. 27 new stalls along Seminary Drive b. 49 new stalls to the Upper East Lot (north) c. 36 new stalls to the Upper East Lot (south) 2. Parking is a permitted use in the B-1 Zone. 3. The proposed parking expansion was not included on the Master Plan approved in Planning Case 96-026. A conditional use permit amendment and site plan review are required to amend the Master Plan to include the proposed parking lot expansion. 4. The proposed parking expansions meets all setback requirements. 5. The proposed parking expansion does not exceed the lot coverage limits for the campus. On the Conditional Use Permit Amendment/Site Plan Review: 6. The proposed parking expansion is not expected to have any significant impact on traffic or parking conditions since no change in the campus population is expected from this building. 7. The proposed parking expansion will not produce any permanent noise, glare, odors, vibration, smoke, dust, air pollution, heat, liquid, or solid waste. Temporary noise and dust may be created during construction. 8. The parking expansion includes the use of pervious pavers, which may help reduce the storm water impact of the proposed project. 9. The proposed parking expansion is not expected to have any impacts on campus population or density. 10. The park dedication fee is not applicable to this application. 11. The proposed building does not conflict with the City's Comprehensive Plan or the intent of the Zoning Code. On the Landscaping Plan: 12. The parking expansion requires the removal of21 trees for a total of285 caliper inches. 13. The Zoning Code does not have specific landscaping requirements for parking lot expanSIOns. 14. The applicant is proposing to plant 40 new trees for a total of 110 caliper inches. 15. The parking expansion is unlikely to have a significant visual impact from neighboring properties since the nearest property is approximately 300 feet to the east across Highway 51. \\Metro-inet\ardenhillslPlanning\Planning Cases\2007\07-022 Bethel Parking Expansion CUP Amendment and Site Plan Review (PC Approved)\092407 - CC Report - Bethel CUP Amendment and Site Plan Review.doc Page 2 of4 Recommendation The Planning Commission reviewed Planning Case 07-022 and unanimously recommends approval (7-0) of the Conditional Use Permit and Site Plan Review based on the findings of fact and the submitted plans as amended by the following ten conditions: 1. The applicant shall continue to abide by the conditions of all previous permits and revIews. 2. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Plarmer, shall require review and approval by the Plarming Commission. 3. Building Permit Plans shall be submitted to the Building Official a minimum of two (2) weeks before the plarmed start of construction. 4. The applicant shall submit an escrow, bond, or other financial surety acceptable to the City Attorney for 125 percent of the cost of materials and installation of the landscaping plan prior to the City issuing the building permit. The City shall retain the fmancial surety for at least one year after full implementation of the landscaping plan. The fmancial surety shall only be released upon successful inspection of the landscaping by the City Plarmer, which shall only occur during the growing season. 5. A temporary fence shall be placed around the construction area to protect existing trees. The fence shall be subject to City Plarmer inspection and shall be in place prior to the start of any site preparation or the issuance of building permits. The fence shall be maintained until the completion of the project and shall not be removed without City Plarmer approval. 6. Revised plans that are in accordance with the Civil Engineer's memo dated August 28, 2007, shall be submitted to the City prior to the issuance of any permits and the start of any site preparation or tree removal. 7. The applicant shall obtain all necessary permits from the Rice Creek Watershed District, MPCA, and other governmental entities and provide the City with copies of such permits prior to the City issuing any building permits. 8. The applicant shall supply the required number of ADA accessible parking spaces prior to the issuance of the occupancy permit for the University Commons. The location of the accessible stalls shall be subject to Building Official approval. 9. Seminary Drive shall have at least a twenty (20) foot wide clearance in the driving portion of the roadway. 10. The applicant shall provide written approval from the utilities companies prior to the issuance of any building permits or any site preparation to ensure that there is no impact on the gas or power lines. Options 1. Approve the proposal as submitted. 2. Approve the proposal with conditions. 3. Deny the application with reasons for denial. Pursuant to Minnesota State Statutes, the City must act on this request by October 14, 2007 (60 days), unless the city provides the petitioner with written reasons for and additional 60 day review period. Chair Sand opened the floor to Commission questions. Chair Sand inquired about the amount and types of trees that would be removed. Mr. Lehnhoff stated that it would be a total of 21 trees removed trees would be planted. Mr. Lehnhoff stated that they are large and mature combination of deciduous and coniferous trees. He stated there is a restriction for freshmen bringing vehicles. He stated that theyare trying to use space that can't be used for other purposes and are trying to avoid the removal of trees. He stated they have used permeable pavers and it has worked well. Commissioner Modesette inquired if they intend to use pervious surfacing for the proposed lots. Mr. Kunkel stated that it is their intent to use pervious surfacing. Ben Feldman, representative from Anderson, Johnson, and Associates, stated the product used for pervious surfacing is a borgert product. ARDEN HILLS PLANNING COMMISSION - SEPTEMBER 5, 2007 9 Commissioner Zimmerman inquired about the life expectancy for the pavers. Mr. Feldman stated it depends on the maintenance of the system and the pavers are designed to last awhile. He stated that sand should not applied to the system as it will wear down the system. Mr. Kunkel stated that he thinks that they are intended to last 20 to 30 years. Chair Sand inquired how long the pavers have been installed byJpenew dorm. Mr. Kunkel stated that they have been in place for 2 years. Chair Sand inquired about the size of the pavers. Mr. Fel<4nan stated that the pavers are approximately 12 inches square. A. The Baptist General Conference, a non-profit corporation under the laws of the State of Illinois, owns and operates Bethel University, a non-profit institution of higher education ("Permittee"), located on the following real property in the City of Arden Hills, Ramsey County, Minnesota ("Arden Hills"): Those parts of Sections 21, 22, 27 and 28, Township 30, Range 23, lying Westerly and Southerly of the westerly and southerly right-of-way lines of State Trunk Highway No. 51 and Interstate Highway 694 lying northerly of the northerly right-of-way line of the Soo Line Railroad Company and lying northerly and easterly of the northerly and easterly right-of-way lines of State Trunk Highway No 10, except the South y., of the Southeast y., of the Southeast y., of Section 21, Township 30, Range 23, lying east of the easterly line of said Highway No. 10, according to the U.S. Government Survey thereof (herein the "Subject Property"). On the 27th day of August, 2007, Permittee submitted a completed application to Arden Hills requesting that its existing conditional use P13rmit be amended and for a site plan review to allow 27 new parking stalls along Seminary Drive, 49 additional spaces in the Upper East Lot North, and 36 additional spaces in the Upper East Lot South ("Parking Expansion Application") on the Subject Property (See Exhibit A: Layout, Finishing, and Landscaping Plan). C. On the 5th day of September, 2007, the Parking Expansion Application was reviewed at a public hearing by the Arden Hills Planning Commission. The Arden Hills Planning Commission considered the recommendations of the Arden Hills staff, the comments of the public and recommended approval of the Parking Expansion Application subject to certain conditions. 2.0 Approval of Parkina Expansion Application. On the 24th day of September, 2007, the Arden Hills City Council considered the Parking Expansion Application, the recommendations of the Arden Hills Staff and Planning Commission, the effects of the proposed amended conditional use on the health, safety, convenience and general welfare of the owners and occupants of surrounding land and the community as a whole, and determined that the facts and circumstances of this particular case warranted the granting of the amended conditional use permit subject to the following conditions: A. The applicant shall continue to abide by the conditions of all previous permits and reviews. B. The project shall be completed in accordance with the plans submitted as amended by the conditions of approval. Any significant changes to these plans, as determined by the City Planner, shall require review and approval by the Planning Commission and City Council. C. Building Permit Plans shall be submitted to the Building Official a minimum of two (2) weeks before the planned start of construction. D. Maintenance of all utility improvements will be the responsibility of the developer, as the proposed improvements are all within private property. 2 d. On sheet three, the hatch symbols shall be properly identified in the legend (porous pavement is blank). e. On sheet four, the following shall be completed: . The legend lists proposed storm sewer; however, none is shown on the plans. Identify any proposed storm sewer pipe and structures. . Retaining walls greater than four feet in height shall be designed by a certified engineer. . Retaining walls four feet in height and taller will require railings for safety purposes. . Please add to General Note 4 that traffic control devices and signing shall conform to the MMUTCD, including the Field Manual for Temporary Traffic Control Zone Layouts, Latest Edition. f.
