Motion to Approve the Final POD Permit for Phase I and 2 of the Traverse Business Center
Based on the Approved Conditions in Planning Case 06-040.

On July 30, 2007, the City Council approved the Final POD for phase I and 2 of the Traverse
Business Center, which is located at the northeast comer of Interstate 35W and 694. When a
Final POD is approved, there are generally two documents that need to be reviewed and
approved by the City Council prior to development: the Final PUD Permit and the Development
Agreement. The Final POD Permit outlines the timeline for the phases of the development, lists
the approved plans, includes certain conditions that cover each phase of the development, and
other conditions that must be completed prior to issuing building permits.
The Development Agreement is a separate document that outlines detailed building, landscaping,
parking plans; specific conditions from the POD approval; and other applicable conditions or
plans for a specific phase of development. The Agreement will also include any required
financial sureties such as a landscaping bond or infrastructure bond. Each of the three phases
will require a Development Agreement; however, phase one and two can be combined into one
Development Agreement if there is demand for both buildings. It is not uncommon for a
development agreement to be reviewed after a POD permit since the complete construction
details may not be finalized until the project is closer to actually beginning construction.
Both the Final POD Permit and the Development Agreement must be approved before any
building permits can be issued. The Development Agreement will come back to the City
Council once the applicant finalizes their building plans for Phase I and 2. lfthe final building

plans are different than the approved plans or do not conform to all ofthe required conditions, a
PUD amendment with Planning Commission and City Council review would be required.
Conditions of Approval
The following 24 conditions were included with the City Council's approval of the Final PUD
for Phase I and 2:
1. The proj ect shall be completed in accordance with the plans submitted as amended by
the conditions of approval. Any significant changes to these plans, as determined by
the City Planner, shall require review and approval by the Planning Commission and
City Council.
2. The applicant shall obtain a building permit within one year of the Final PUD
approval for phase one or the approval shall expire unless extended by the City
Council prior to the approval's expiration date.
3. The applicant shall obtain a building permit within four years of the Final PUD
approval for phase two or the approval shall expire unless extended by the City
Council prior to the approval's expiration date. Phase two shall not be exempt from
changes in the City's regulations that are made one year after the Final PUD approval
for phase one and two. Significant changes to the City's regulations that alter the
design or layout ofthe development shall require Planning Commission and City
Council approval.
4. The applicant shall apply for a Final PUD of phase three within five years of the Final
PUD approval of phase one and two or the Master PUD approval for phase three shall
expire unless extended by the City Council prior to the approval's expiration date.
5. The applicant shall submit an update on the progress of phases one, two, and three to
the City Council by the end of each calendar year starting in 2007.
6. The applicant shall submit a phasing plan for the landscaping to accommodate
landscaping in phases one and two. The phasing plan shall be subject to City Planner
approval. The landscaping plan for phase one shall be capable of creating a finished
look for phase one in the event phase two is not pursued.
7. The applicant shall provide at least 178 overstory trees for phase I and 2.
8. The applicant shall submit a financial surety in the amount of 125 percent ofthe cost
of the landscaping improvement for each phase prior to the issuance of any building
permits for each phase.
9. The applicant shall submit a lighting plan that conforms to the Master PUD design
standards prior to the issuance of any building permits. The lighting plan shall be
subject to City Planner approval.
10. The applicant shall modify the submitted plans to include a pedestrian connection to
the Gateway Boulevard cul-de-sac. The revised plans shall be submitted prior to the
issuance of building permits.
II. The applicant shall re-plat the property prior to the issuance of any building permits.
12. The applicant shall submit a completed preliminary plat application within six months
of the Final PUD approval date unless the deadline is extended by the City Council
prior to the expiration date.

13. The applicant shall pay a park dedication fee that is to be set by the City Council at
the time the fmal plat is approved.
14. The applicant shall obtain approval from the Rice Creek Watershed District and all
other applicable permitting agencies prior to the issuance of any building permits.
Copies of such permits shall be provided to the City.
15. The applicant shall comply with the following requirements from the June 18,2007,
letter from the Lake Johanna Fire Department Fire Marshal:
a. Fire lanes need to be a minimum of 20 feet wide and 13 foot clear in height.
b. Turning radiuses need to accommodate fire apparatus.
c. Verify hydrant locations.
d. Fire department connections (F.D.C.) need to be in an accessible and visible
location on the front side of the buildings.
e. A fire hydrant need to be within 150 feet ofF.D.C.s
16. The applicant shall repair the damaged water main by August 1, 2007, per City
requirements and subject to City inspection unless the date is extended by the
Building Official and Public Works Director.
17. Final grading, drainage, and utility plans shall be subject to approval by the Public
Works Director and City Engineer prior to the issuance of any building permits.
18. The copy area of the monument sign facing the Interstate 694 and 35W intersection
shall not exceed 70 square feet.
19. The proposed monument sign at the southeast comer of Round Lake Road and
Highway 96 shall not exceed fourteen feet in height at the top of the sign structure.
20. The proposed monument sign for the main entrance to the business center at Round
Lake Road and Gateway Boulevard shall not exceed seventeen feet in height at the
top of the sign structure.
21. The applicant shall be responsible for all maintenance related to the monument sign at
the southeast comer of the Highway 96 and Round Lake Road intersection.
22. A developer's agreement shall be prepared by the City Attorney and subject to City
Council approval.
23. The applicant shall conform to all other City regulations.
24. The required number of parking spaces may be reduced subject to demonstration of
proof of parking potential.
Options
1. Approve the PUD Permit as submitted.
2. Approve the PUD with changes.
3. Deny the PUD Permit with reasons for denial. Since the City has already approved the Final
PUD application, there are likely not any grounds to deny the PUD permit unless the permit
is in conflict with the required conditions of approval.
4. Table for additional information. Iftabled, please state what additional information is
needed to continue the review.
The City can generally not impose any new conditions once the Final PUD has been approved.

1.0 Planned Unit Development Permit. This Planned Unit Development (PUD)
Permit is dated the 29th day of October 2007, and is issued by the City of Arden
Hills, a Minnesota statutory city (the "City"), to CMK Arden Holdings, a
Minnesota corporation its successors and assigns ("Applicant") for the planned
unit development of the Traverse Business Center subject to the terms and
conditions contained herein.
2.0 Recitals.
A. Applicant is the fee owner of the following described property situated in
Arden Hills, Ramsey County, Minnesota (Property):
See Exhibit A attached
B. On the 19th day of June, 2007, Applicant submitted a completed
Application for the Final Plan PUD for Phases I and II of the Traverse
Business Center on the Property (the "Application").
C. It is anticipated that the Traverse Business Center will be developed in
three (3) phases. Each Phase of the PUD shall require a separate
Development Agreement which must be approved by the Arden Hills City
Council before the issuance of any Building or Development Permits for
each particular Phase of the Development. Phase I will consist of a
203,400 square foot six (6) story office building and other improvements
as required in the Phase I Development Agreement. Phase II will consist
of a 261,600 square foot eight (8) story office building and other
improvements as required by the Phase II Development Agreement.
Phase III will consist of a 30,000 square foot or less office building and
other improvements as required by the Phase III Development
Agreement.
D. On the 11th day of July, 2007, the Arden Hills Planning Commission
reviewed the Application, the reports and comments of the Arden Hills
staff and consultants, the comments of the Applicant and members of
the public who chose to speak, and, at the conclusion of the meeting,
recommended that the Arden Hills City Council approve the Final Plan
PUD for Phases I and II for the Traverse Business Center subject to
certain conditions.
E. On the 30th day of July, 2007, the Arden Hills City Council reviewed the
Application, the reports and comments of the City's staff and
consultants, the comments of the Applicant and members of the public
who chose to speak, the recommendations of the Planning Commission
had approved the Final Plan PUD of Phases I and II for the Traverse
Business Center subject to the terms and conditions contained herein.
3.0 Terms and Conditions of Permit.
A. The Final Plan PUD for Phases I and II of the Traverse Business Center
Project consists of the following documents, drawings and illustrations
(Final PUD Plans) which are maintained at the City of Arden Hills in
Planning Case file no. 06-040.
1. The Final PUD Project Information Sheets prepared by Chesapeake
Companies and dated June 11, 2007.
2. The Final PUD Project Narrative prepared by Chesapeake
Companies and dated June 11, 2007.
3. The Traverse Business Center-Arden Hills, MN Proposed Plan Unit
Development Designs Standards prepared by Dahlgren, Shardlow
and Urban Inc. and by Pope Architects dated February 2000 and
revised June 2007.
4. The Boundary Topographic Location and Utility Survey for CMK
Arden Holdings consisting of four (4) sheets and prepared by Sunde
Land Surveying, LLC and dated May 22, 2007.
5. The Final PUD Submittal consisting of four (4) sheets (existing
conditions C-1, Land Mitigation Plan C-2, Site Plan C-3, Grading
and Drainage Plan C-4) prepared by Sunde Land Surveying, Inc. and
Pope Associates, Inc. and dated June 11, 2007.
6. The Final PUD Submittal consisting of five (5) sheets (Site Plan- A-
1.1, elevations -A-1.2), site section signage -A-1.3 and A-1.3-2,
and renderings-A-1.4) prepared by Pope Associates, Inc. and dated
June 11, 2007
7. The Final PUD Landscape Plan prepared by INSITES Site Planning
Landscape Architect Inc. and Pope Associates, Inc. dated June 11,
2007.
8. Final PUD Building and Monument Signage statement prepared by
CMK Arden Holdings and dated June 11, 2007

B. Compliance. The Traverse Business Center shall be developed on the
Property in compliance with the Final PUD Plans for Phases I, II, III
except as hereinafter modified.
1. Phasing of Development/Expiration of PUD Permit.
a. On or before July 30, 2008, Applicant shall apply for and
obtain all required Building Permits for Phase I or this PUD
Permit, as it relates to Phases I, II, and III shall expire
unless the Arden Hills City Council approves an extension.
A request for an extension must be submitted to the City
Planner at least forty-five (45) days prior to July 30, 2008,
and shall detail the Applicant's reasons for the extension
request.
b. On or before July 30, 2011, Applicant shall apply for and
obtain all required Building Permits for Phase II or this PUD
Permit, as it relates to Phases II and III, will expire unless
the Arden Hills City Council approves an extension. A
request for an extension must be submitted to the City
Planner at least forty-five (45) days prior to July 30, 2011
and shall detail the Applicant's reasons for the extension
request.
c. Phase III has only received Master PUD Plan approval. On
or before July 30, 2012. Applicant shall obtain Final PUD
Plan approval for Phase III unless the Arden Hills City
Council approves an extension. A request for an extension
must be submitted to the City Planner at least forty-five
(45) days prior to July 30, 2012 and shall detail the
Applicant's reasons for the extension request.
d. Applicant shall submit a progress report regarding the
status of Phases I, II and III to the Arden Hills City Council
at the first regular meeting in the month of December of
each year commencing in December of 2007.
2. Landscaping.
a. The Applicant shall submit a landscaping Phasing Plan for
Phases I and II. The Phasing Plan shall be subject to the
Arden Hills City Planner approval. The Landscaping Plan for
Phase I shall be capable of creating a finished look for
Phase I in the event Phase II is not pursued.
b. The Applicant shall provide at least 178 over story trees for
Phases I and II.

c. Prior to the issuance of Building Permits for a particular
Phase, Applicant shall submit a financial security in the
amount of 125% of the costs of the Landscaping
Improvements.
3. Lighting. The Applicant shall submit a lighting plan that conforms
to the Master PUD's Design Standards prior to the issuance of a
Building Permits. The Lighting Plan shall be subject to the Arden
Hills City Planner's approval.
4. Pedestrian Way. The Applicant shall modify the submitted plan to
include a pedestrian connection to the Gateway Blvd. cul-de-sac.
The revised plan shall be submitted prior to the issuance of
Building Permits for Phase I.
5. Replatting of Property. The Applicant shall replat the Property
prior to the issuance of any Building Permits. The Applicant shall
submit a Preliminary Plat Application on or before January 30,
2008 unless an extension is approved by the Arden Hills City
Council. A request for and extension must be submitted to the
City Planner at least forty-five (45) days prior to January 30, 2008
and shall detail the Applicant's reasons for the extension request.
The Applicant shall pay park dedication fees as established by the
Arden Hills City Council at the time of Final Plat approval for the
replatting of the Property.
C. Amendments. This PUD Permit may be amended as provided in the
City's Zoning Regulations.
