Motion to Approve Ordinance 392 to Amend Sections 900.04 Subd. 1,900.04 Subd. 2, and 900.05 of the Arden Hills City Code Regarding the Minnesota State Building Code. 2. Motion to Approve Publishing a Summary of Ordinance 392 (requires 4/5 vote). Backl!round This past year, the State adopted a new Building Code. The State went from the 2000 International Codes Council (ICe) Codes to the more current 2006 ICC Codes. Even though the City has adopted the Code as amended from time to time, the State recommends readopting the State Building Code due to the change in the numbering of optional code 1306. Option I in 1306 is now part of the code and is no longer available. Prior to the rernoval of this option, cities could exempt certain buildings frorn fire sprinkler requirements. Arden Hills did not adopt the exemption; therefore, this code change does not impact how the code is applied in Arden Hills. Highway 96 Arden Hills, MN 55112 Dear Mayor and City Council, After reviewing Chapter 1306 Special Fire Protection Systems of the 2006 Minnesota State Building Code, it is my recommendation that the City of Arden Hills adopt this code with the following options. Subp. 2. Existing and New Buildings. Automatic sprinkler systems for new buildings, buildings increased in total floor area (including the existing building), or buildings in which the occupancy classification has changed, must be installed and maintained in operational condition within the structure. The requirements of this subpart apply to structures that fall within the occupancy classifications established in part 1306.0030, items A to D. Since the state of Minnesota adopted a new Building Code earlier this year all local municipalities are required to formally re-adopt 1306. The re-adoption of 1306, will allow the same level of sprinkler requirements that we have been able enforce in the past. At the same time it is also my recommendation to re-adopt the 2006 Minnesota State Fire Code. SINCE 1943 ~ ~HlLLS CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA ORDINANCE NO. 392 AN ORDINANCE RELATING TO THE MINNESOTA STATE BUILDING CODE The City Council of the City of Arden Hills ordains that Sections 900.04 Subd. 1, 900.04 Subd. 2, and 900.05 of the Arden Hills City Code are hereby amended to read as follows: 900.04 Buildin'l Code Subd. 1 Codes Adopted bv Reference. The Minnesota State Building Code, as adopted by the Commissioner of Administration, pursuant to Minnesota Statutes Chapter 16B.59 and 16B.75, including all of the amendments, rules and regulations established, adopted or published from time to time by the Minnesota Commissioner of Administration, through the Building Codes and Standards Divisions, is hereby adopted, by reference, and is hereby incorporated as if fully set forth herein. Subd. 2 Application, Administration and Enforcement. The application, administration and enforcement of a building code shall be in accordance with the provisions of the Minnesota State Building Code. The Building Code shall be enforced within the extra territorial limits of the City of Arden Hills, as permitted by Minnesota Statutes Chapter 16B.62 Subd. 1. The Code Enforcement Agency of the City of Arden Hill is called the "Building Department". The building code shall be enforced by a Minnesota certified building official, designated by the City of Arden Hills, to administer the building code. 900.05 Building Code Optional Chapters. The Minnesota State Building Code, established pursuant to Minnesota Statutes 16B.59 to 16B.75 allows the City of Arden Hills to adopt by reference and enforce certain optional chapters of the most current edition of the Minnesota State Building Code. The following optional chapters identified in the most recent addition of the State Building Code are hereby adopted and incorporated as part of the building code for the City of Arden Hills. Chapter 1306, Subpart 2 Existing and new Buildings. Automatic sprinkler systems for new buildings, buildings increased in total floor area (including the existing building) or buildings in which the occupancy classification has changed, must be installed and maintained in operational condition within the structure. The requirements of this subpart apply to structures that fall within the occupancy classifications established in Part 1306.0030, Items A-D. The Arden Hills City Council ordains that Section 900.04 Subd. 1. through and including Section 900.04 Subd. 2. and Section 900.05 are hereby repealed. Adoption Date: Passed and adopted by the City Council of the City of Arden Hills the 10th day of December, 2007. Effective Date: This Ordinance shall be effective the day following its publication or on the day following the publication of an Ordinance Summary approved by the City Council. Stat. 9412.191, Subd. 4, directed that a summary of Ordinance 392 be published. Ordinance 392 is entitled "An Ordinance Relating to the Minnesota State Building Code" The primary purpose of the ordinance amendment is to update the City Code to reflect the numbering change in Chapter 1306 ofthe State Building Code. A full copy of Ordinance 392 is available for inspection by any person during regular business hours at the office ofthe City Administrator, 1245 West Highway 96, Arden Hills, Minnesota 55112.
