Backl!:round In May 2007, Staff was directed by the Planning Commission and the City Council to examine the current zoning code regarding recreation vehicles. Staff was asked to clarify the definitions used for "recreational vehicle" as well as the methodology for measuring "length" and "height" of R V s. The primary goal of this amendment was to clarify the definitions and build consistency within the RV code. A draft of a revised RV code was proposed in May; however, the project was delayed for additional research. In response to the Council and Planning Commission's request, Staff analyzed the current code and reviewed codes from fifteen other communities in the metropolitan area. Comments and discussion were elicited from other City Staff, including the code enforcement officer and the building official. At each meeting additional questions and concerns were raised. In addition, two public hearings were held at which residents were invited to raise their own questions and concerns, which they did. The Planning Commission unanimously voted to recommend approval of the ordinance at their December 5, 2007 meeting. The City Attorney then examined the ordinance and made minor language changes dealing with redundancy within the document. No policy or regulation changes were made. Through this research process, meetings with the Planning Commission, and discussions with various stakeholders, including the public, staff discovered that there were additional opportunities to improve the ordinance and increase the ease of enforcement. The resulting ordinance is a culmination of that work. Staff feels that the proposed Recreational Vehicle, Utility Trai]er, and Watercraft Outdoor Storage Ordinance is a compromise that balances the needs of residents who own recreational vehicles, the concerns of neighbors, and the ability to effectively enforce the regulations. Options ]. Approve the proposal as submitted. 2. Approve the proposal with changes. 3. Deny the proposal. 4. Table for additional information. If approved, the Zoning Code amendment will not go into effect until it is published in the January 23,2008, edition of the Shoreview Arden Hills Bulletin. Ms. Beekman reported that the RV ordinance has been amended and redrafted. She stated it has been noticed for a public hearing. Chair Sand opened the floor to Commission questions. Commissioner Larson stated there isn't a good copy of the ordinance because of the work session prior to this Planning Commission meeting. Mr. Lehnhoff stated there could be a review of the changes discussed at the work sessIOn. Commissioner Thompson inquired ifthere would be a public hearing before the Council. Mr. Lehnhoff stated there wouldn't be a public hearing, but the Council could choose to open it up to the public. Chair Sand stated the proposed changes have been before the public with the exception of a few changes discussed at the work session. Ms. Beekman stated the changes to the proposed RV ordinance include the following changes: Subdivision 2, letter C, number 2 should state: "The rear yard is fully enclosed by a six foot privacy fence or the R V is substantially screened from adj acent properties as determined by Staff." Subdivision 2, letter C, number 3 should be removed. Subdivision 2, letter H should state: "Alternative locations for storing an RV or watercraft on a property may be permitted by the Zoning Administrator with an administrative land use permit. . ." Subdivision 2, letter H, number 3 should state: "The RV or watercraft shall not be stored forward ofthe principal structure, except as otherwise provided for in subdivision 3." Chair Sand opened the public hearing at 7:44 p.m. Chair Sand invited anyone for or against the application to come forward and make comment. Steve Gericke, ] 840 W. County Road E., stated he is concerned about allowing 3 RVs in adcIition to the allowing 4 cars. He stated he would like a maximum of 4 cars and/or RVs. Ms. Beekman stated the proposed ordinance decreases the amount of additional vehicles allowed. She stated the ordinance clarifies the definitions of R V s and the location of parking the vehicles. She stated it has been policy to have different ordinances for vehicles and RV s. Chair Sand inquired about a situation where four vehicles are parked in the driveway and one RV from a visitor. Ms. Beekman stated it would be allowed under present code. Commissioner Stodola inquired about a requirement to have R V s and vehicles operable. Ms. Beekman stated there is a requirement for them to be operable. Mr. Gericke stated from his residence the neighbor's vehicles are visible at all times. Commissioner Modesette inquired if his circumstance is unique in that all vehicles are stored on one side. Mr. Gericke stated the way his yard is located is that his back yard is the neighbor's side yard. He stated at one time the ordinance only allowed for one RV. Mr. Lehnhoff stated the code was adopted in ]991 and it is possible that there was a limit to one RV prior to that. He stated he was not aware of any changes to the code regarding RVs since it was adopted. Chair Sand stated they are trying to be more precise about where the RVs can be stored. Chuck Mertensetto, 3473 Lake Johanna Blvd., stated he has an easement to get to his house that could be considered a city street. He stated he previously inquired about the screening for RVs. Ms. Beekman read the portion of the proposed ordinance that addresses how the RVs should be screened from the public right of way. She stated the public right of way is owned by the city or county. Mr. Lehnhoff stated easements are different from public right of ways. Commissioner Larson stated with the changes made in the work session the zoning administrator has some discretion about how to screen the R V s. Chair Sand stated Mr. Mertensetto's property arrangement is unique. Mr. Mertensetto stated there is another area where there is an alley providing access to their homes. Ms. Beekman stated the ordinance wouldn't apply to private streets or easements on private property. Chair Sand stated they have received several emails regarding the proposed ordinances changes. Richard Gonzalez, 344] Lake Johanna Blvd., stated he has a few concerns and would like to be able to store a canoe on the long thin beach. He stated it appears that boats need to be stored on trailers and it isn't possible to get a trailer to that portion of the property. Commissioner Larson stated the shore]and ordinance will deal with the beach front. Ms. Beekman stated canoes have been excluded from the RV ordinance. Chair Sand stated the canoe could be stored on the beach front. Mr. Gonzalez stated there isn't 10 feet from the beach front on the lakefront property. Ms. Beekman stated the non-motorized watercraft will be in a separate ordinance. She stated the RV ordinance allows for a land use permit to be granted when the topography doesn't allow for the storage according to the ordinance. Mr. Gonzalez inquired about the requirement to have a principal structure located on the property. Mr. Lehnhoff stated there are a number of properties on Lake Johanna that are one parcel, but are split. He stated a few are two separate parcels. Mr. Lehnhoff stated it is possible to combine the parcels into one parcel through the County. Commissioner Larson inquired if the parcels were combined for tax purposes, if it would satisfy the ordinance. Mr. Lehnhoff stated it would. Chair Sand stated the concern is about the storage ofRVs on vacant lots in the City that don't have principal structures. Mr. Gonzalez inquired about the intent of allowing owners on the lake to have two extra R V s if they have shoreland. Mr. Lehnhoff stated he would view his lot as one shoreland parcel. Commissioner Stodola inquired if it would be possible for Mr. Gonzalez to sell only one of his parcels. Mr. Gonzalez stated it would be theoretically possible. Commissioner Larson stated it is not the intent to penalize people that own lake shore property and Staff could work on specific situations. Mr. Gonzalez stated some ofthe neighbors store RVs for people who don't live on the property. Ms. Beekman stated that is prohibited and would be a violation. Mr. Gonza]ez inquired if it would be possible to allow for the storage of one other RV, not owned by the owner ofthe property, such as a family member's. Commissioner Larson stated it isn't possible to allow property owners to store some people's RVs and not others. Commissioner Zimmerman stated that unless it is reported to the City, then nobody would know whether the RV was owned by the property owner or not. Matt Trites, ]850 Indian Place, stated he is in support of the proposed ordinance. He stated he is the neighbor of Mr. Gericke and they are in compliance with the amount of allowed vehicles and RVs. He stated he would like to have a conditional use permit available for a height in excess of]2 feet. Chair Sand stated at the work session they discussed the height allowed. Ms. Beekman stated the variance process would be available for anyone who wanted a height beyond what the ordinance states. She stated a hardship would need to be shown for the height. Chair Sand stated ] 2 feet high is to the top of the R V without mechanical equipment. Commissioner Zimmerman stated there are State regulations for the height. November 11, 2007 Planning Commission Meeting Minutes PLANNING CASE # 07-025 - ZONING CODE TEXT AMENDMENT FOR RV STORAGE; CITY OF ARDEN HILLS; 1245 WEST HIGHWAY 96- PUBLIC HEARING Mr. Lehnhoff provided background information, stated there was a work session prior to this meeting, and there are remaining items to be worked on. Chair Sand opened the floor to Commission questions. Chair Sand opened the public hearing at 9:40 p.m. Chair Sand invited anyone for or against the application to come forward and make comment. Steve Gericke, ] 840 W. County Road E, stated there has been progress since the last proposal. He stated the definition of an RV shouldn't include boat lifts. Chair Sand stated boat lifts were discussed at the work session. Mr. Gericke inquired about the number ofRVs allowed. Mr. Lehnhoff stated at the work session they discussed separating out the types of R V s by using different defmitions. Commissioner Holewa inquired how many RV's Mr. Gericke would like. Mr. Gericke stated he would like there to be a maximum of one RV. He inquired about the sideyard setbacks from easements. Mr. Lehnhoff stated he would need to look at the specific property. Mr. Gericke stated he would like RVs to be blocked from view. He passed out a picture of the R V s on his neighbor's property. Lisa Abraham, 35]] Siems Court, stated she was confused about which information is the current information. Ms. Beekman stated the website contains the current code and the proposed codes. Ms. Abraham inquired about boat lifts and where they can be placed on the property. She stated ifthey are included, they should consider requiring the removal of the canopies. She stated she is concerned about the ten foot setback. Commissioner Ho]ewa inquired if Ms. Abraham knew where the highwater line is. Ms. Abraham stated it is higher than the shoreline. Ms. Abraham inquired about the difference in storing cars in the driveway and storing a boat. Sam Clark, 3342 Lake Johanna Blvd., stated he is confused about the setbacks. He inquired about the timing of the decision. Ms. Beekman stated it is tentatively on the December agenda. She stated it is possible to set a start date after the ordinance is enacted. Mr. Clark stated he doesn't have ten feet above the highwater mark. Chair Sand said it depends on topography. Matt Trites, 1850 Indian Place, stated that they would like to bring their 34 foot motorhome back to the residence if they could meet the guidelines. Mr. Lehnhoff stated there isn't a process to keep it at their home unless there would be a variance granted to have it on the property. October 3, 2007 Planning Commission Meeting Minutes PLANNING CASE # 07-025 - ZONING CODE TEXT AMENDMENT FOR RV STORAGE; CITY OF ARDEN HILLS. 1245 WEST HIGHWAY 96- PUBLIC HEARING Ms. Beekman submitted a review of the proposed recreational vehicle (RV) zoning code amendment to provide comments, changes and/or a recommendation of approval. She then provided background information and stated that staff recommends approval with input from the Planning Commission on the definitions; RV storage on improved or unimproved surfaces; variance process or CUP process; and minimum RV setbacks. Chair Sand opened the floor to Commission questions. Commissioner Holewa inquired if there would be any screening requirements. Ms. Beekman stated that there aren't any screening requirements. She stated with the conditional use permit process the option to include screening would be available. She stated the majority of communities don't require screening for RVs. She stated staff viewed RVs as being similar to accessory structures, which don't require screening and felt it was simpler to keep it consistent with the setbacks. Commissioner Holewa stated that parking an RV on a piece of property is creating an impervious surface. Ms. Beekman stated that the zoning code doesn't include impervious surfacing. She stated that the code would require that the RV be movable at all times. Mr. Lehnhoff stated that unless a permit was required for parking all R V s it would be difficult to enforce. Commissioner Holewa stated that he would recommend 28 feet in length and 7 feet in height with a maximum of one. Commissioner Thompson inquired about the location of parking RVs on lakeshore properties. Ms. Beekman stated that staff regarded front yards as the portion of the land abutting the public right-of-ways. She stated the code requires a greater setback from the lake to minimize the impact. Commissioner Modesette stated she is concerned that lakeshore property owners would be allowed to store three R V s and three additional watercraft vehicles. Ms. Beekman stated that language is in the current code, but it could be changed in the proposed code. Commissioner Thompson stated the code was written in a way to allow for the possibility of trailers. Chair Sand inquired if the new language for the definition of an RV would include any watercraft, snowmobiles, pull campers, all terrain vehicles, motor homes, travel trailers, tent trailers, special purpose trailer, utility trailer used for hauling, and other similar vehicles resulting in a more inclusive list. Ms. Beekman stated that they were always intended to be included, but weren't. Chair Sand clarified that a boat trailer would be considered an RV. Mr. Lehnhoff stated that it would be considered an R V and if a boat would be on the trailer they would be considered as one. Chair Sand inquired about the direction staff is seeking regarding the impervious surfaces for parking. Ms. Beekman stated that currently residents can park the RVs on the side of their home on the grass, but many of the complaints heard by code enforcement are that the RVs on grass doesn't look nice. She stated the proposed ordinance was written so that RVs would need to be screened or be parked on an impervious surface. Chair Sand stated he is concerned about allowing three additional vehicles to be parked on lakeshore properties. Ms. Beekman stated that is the language in the current code and it was a point of discussion among staff. Commissioner Modesette inquired about temporary parking and storing RVs in the front yard. Ms. Beekman stated that temporary parking would allow the RV to be parked for 72 hours in the front yard to allow for loading, unloading, and cleaning purposes. She stated the ordinance would not allow people to live in the R V s and guests could be granted a permit for parking for a period up to seven days. Mr. Lehnhoff stated the temporary parking and storage language is the same as the current code. Commissioner Modesette inquired about the setbacks for temporary parking. Ms. Beekman stated that it is fifteen from the curb. Commissioner Modesette stated she likes the language stating that R V s need to be parked closer to the property owner's principal structure than to a neighboring principal structure. She inquired if the current CUP that was granted would be affected if the proposed text would be adopted. Mr. Lehnhoff stated a change in the ordinance wouldn't impact the current CUP. Commissioner Modesette stated that the language for parking and storage is used interchangeably. Ms. Beekman stated that they were used together for clarity based on the various types ofRVs. Commissioner Stodola inquired if boats in the water would be counted as an RV and if they would be out of compliance. Ms. Beekman stated that if the boats were on land, they need to meet the ordinance. She stated that if the boats were in the water, it would be under a different section ofthe code. Commissioner Stodola inquired about watercrafts being tied to docks. Chair Sand stated that this code doesn't address watercraft in water or on docks. Commissioner Thompson stated that there will be a large number of people that will be out of compliance for the storage of boats above the high water line. Chair Sand inquired about the docks and boat lifts that aren't pulled above the high water line. He stated that it should be addressed in an ordinance. Ms. Chair Sand stated that docks should be addressed in an ordinance. Beekman stated that docks wouldn't be under this ordinance and wasn't sure which ordinance it would be under. Commissioner Modesette stated that parking the docks and boat lifts are part of the culture of Minnesota. Commissioner Holewa inquired if the language about ownership in the current zoning code is in the proposed code. Ms. Beekman stated that it is not in the proposed code, but it should be included. Mr. Lehnhoff stated that it was missed in the transfer and should have been included. Chair Sand opened the public hearing at 7:43 p.m. Chair Sand invited anyone for or against the application to come forward and make comment. Steve Gericke, 1840 West County Road E., stated that he doesn't think that the size limit should be increased from 24 feet to 28 feet. He suggested they look at other cities and the limits they have. He stated he has a neighbor who has a number of boats and cars parked in the yard that aren't screened and aren't licensed. Chair Sand inquired ifhe has contacted the City to address the issue. Mr. Gericke stated that he has and there doesn't seem to be enforcement of the issue. He stated that the neighbor will come into compliance for a short period of time, but then parks additional things. Chair Sand stated that the purpose of the ordinance is to limit the number ofRVs and clarify what constitutes an RV. He inquired about Gericke's thoughts on the limits of three RVs. Mr. Gericke stated that he thinks one RV is enough. Chuck Mertensotto, 3473 Lake Johanna Blvd., stated he accesses his property through an easement. He stated the neighbors could park an RV in such a way that it would be highly visible from his property. He stated that there should be some enforcement of the ordinance. Chair Sand closed the public hearing at 7:50 p.m. Commissioner Zimmerman stated he would be in favor oftabling the discussion. Commissioner Larson stated he would like staff to inform them about the parameters and rules of the DNR. The Commissioners concurred that at this point they would be in favor of using the variance option. Commissioner Holewa stated he would like to find out more about Mr. Mertensotto's exception due to the shape of his lot. Commissioner Larson stated that there should be discretion for staff to make a determination for odd shape lots and applicants should have the ability to appeal the determination to the Planning Commission. Commissioner Holewa inquired about the violations. Mr. Lehnhoff stated that if a property were in violation it would be turned over as a potential violation to the judicial court. He stated he believes it would be misdemeanor. Commissioner Holewa stated that his understanding is that cll1zens are the violation officers. Mr. Lehnhoff stated they do have a Code Enforcement Officer. Commissioner Stodola stated she thinks the language about RVs being parked closer to the owner's principal structure than the neighbor's should remain in the ordinance. Chair Sand inquired if boats and docks were in the shoreline ordinance or the residential property code. Mr. Lehnhoff stated that the language in the shoreline ordinance is vague and it isn't covered in there. Chair Sand stated that it could be added to the list of zoning codes to be reviewed. He requested that the code enforcement officer look into Mr. Gericke's situation. Commissioner Zimmerman moved, seconded by Commissioner Larson, to table Planning Case #07-025, Zoning Code Text Amendment for RV Storage; City of Arden Hills; 1245 West Highway 96, as proposed in staffs October 3, 2007 Planning Case report. The motion carried unanimously (7-0). Chair Sand stated this Planning Case will be tabled until staff brings it back with answers to the questions asked by the Planning Commission. May 2, 2007 Planning Commission Meeting Minutes RV STORAGE LOCATION INTERPRETATION Mr. Lehnhoff stated Mr. Lunzer of 1795 Chatham Avenue has requested an interpretation of the minimum setbacks for RVs and utility trailers in Section 1325.10 of the Zoning Code. He reviewed the background information on RV storage regulations. He indicated except in the most extreme circumstances, staff would not recommend permitting the storage of RVs forward of the principle structure. Staff recommends dealing with this issue by clarifying the R V regulations. Additional research and discussion will be needed to determine if a 30-foot, 40-foot, or "not closer than the principle structure" is a sufficient front yard setback for RV s. Mr. Lehnhoff noted the Council had remanded back to the Planning Commission the previous planning case regarding the size of an RV. He noted the Commission could either look at this RV storage location issue tonight, or they could take both RV issues at the same time. Commissioner Larson stated he believed the ordinance should be revised and come back to the Planning Commission at a future date. Chair Sand stated at this point Mr. Lunzer was not in violation, so if it was postponed, there would not be any immediate issues. Mr. Lehnhoff stated Mr. Lunzer has been working with staff and he would not be cited at this time. The consensus was that this was open to interpretation and that staff would not issue any citations to Mr. Lunzer as long as the RV was located 30 feet back from the front property line and behind the front side of the dwelling. B. PROPOSED RV ORDINANCE UPDATES Mr. Lehnhoff requested the Commission review the draft RV regulations and provide comments, thoughts, and questions. Commissioner Holewa stated he wanted to address pervious versus impervious surfaces for RV parking. Commissioner Larson stated he wanted to look at the hitch pin issue also. Commissioner Modesette stated she was concerned about the rear setback being five feet. Commissioner Larson stated they should look at measuring the gross length rather than mass length. Commissioner Holewa stated he was not in favor of parking "things" in yards. Chair Sand asked if they might want to hold a workshop to discuss this. Commissioner Holewa noted that would be a good idea. Chair David Sand arrived at 6:00 p.m. 2. AGENDA ITEMS Acting Chair Larson indicated the one item on the agenda is planning case Planning Case 07-025; Zoning Code Text Amendment for RV Storage, and let the record show that there is a quorum in place. Assistant Planner Beekman indicated that because of the concerns that came up at the October 3 Planning Commission Meeting, the item up for discussion was the R V Ordinance. She indicated the memo attempted to answer some of those questions that came up, provide some potential solutions, and to get everyone thinking on what might work and what might not. She also indicated the ordinance attached to the work session memo is basically the same ordinance as from the October 3 meeting with a couple grammatical changes and some language clarification. The ordinance attached to the regular meeting agenda item is the proposed ordinance written in a simplified way and includes some of the changes which have been highlighted. City Planner Lehnhoff stated that if no consensus is reached at the work session or during the actual meeting, it can be tabled to the next meeting. ARDEN HILLS SPECIAL PLANNING COMMISSION ~ 11/7/07 .., 2 3. OPEN DISCUSSION There was discussion regarding the definition of R V s. Mr. Zimmerman feIt it should not include watercraft and that watercrafts and R V s should be treated separately. City Planner Lehnhoff clarified by stating that the definition was meant to encompass boats as well as trailers. Ms. Beekman asked if they wanted to eliminate the watercraft portion in the definition where it states, "RVs shall include any watercraft, snowmobile, pull camper, all-terrain vehicle, etc." Mr. Scherbel indicated there has always been a problem of explaining to residents what is included under recreational vehicle and that most people would not consider a watercraft a recreational vehicle. He felt that maybe they could come up with a term that could encompass all or just do a better job of educating residents on what recreational vehicles include. Commissioner Stodola stated they could say something like trailers, vehicles, and watercraft storage. Chair Sand liked the idea of calling it outdoor storage and that under outdoor storage you could cover watercraft, recreational vehicles, all-terrain vehicles, and trailers. Mr. Lehnhoff stated he liked the idea of outdoor vehicle. He stated that it could encompass all items stored outdoors and then clarify this in the definition. Mr. Zimmerman felt that boatlifts needed to be removed under the definition of watercraft vehicles since they are not mobile and they can't be trailered unless taken apart. Mr. Scherbel commented on the difficulty of moving lifts and felt the intent is to try to clean up the lakeshore as much as possible. He indicated ifit is possible for someone to pull their boaUift 10 feet from shore that they would do that and if they could not they could seek an administrative permit and state the reason why they can't move the lift.. Chair Sand stated that his main concern is the trashy look of some of the shorelines with everybody just throwing everything up on the banks. Mr. Lehnhoff and Ms. Beekman indicated they could address this under the Shoreland Ordinance and that it is not so much a storage issue but a cleanliness issue. Chair Sand agreed that it should be addressed under the Shoreland Ordinance. He indicated the Ordinance should include general shoreline maintenance, cleanliness, appearance, dock storage, and boatlift storage. ~ . ARDEN HILLS SPECIAL PLANNING COMMISSION - 1117/07 3 Ms. Beekman asked if there were any other issues with the watercraft definition or the height and length issue. No other issues were noted. Chair Sand issued concerns about short-term parking with a permit and people connecting up to the utilities. Mr. Scherbel indicated the intent was so that someone could take their RV out of storage from an off site location and bring it back for cleaning and loading purposes. He indicated that parking with a permit does not permit living in the RV. Discussion continued regarding allowing someone to live in an RV for a short period of time with a permit. Chair Sand stated he felt it could be handled through enforcement but thinks that to prohibit it completely would not be right. Ms. Beekman stated that the current code prohibits RVs to be hooked up to sewer in order to discourage anybody from living in RVs for any period of time. The consensus was that this was true. Ms. Beekman stated the ordinance could read, "No RV shall be used for temporary or permanent living, sleeping or housekeeping purposes in the City. They shall not be connected to sewer, water, or other utility for any period of time unless otherwise provided for in Subdivision 3" Mr. Lehnhoff indicated he and Ms. Beekman would work on the language and asked if the consensus is for very short-term parking, so if someone comes for the weekend they would be able to stay in an RV. Chair Sand felt they needed to add language that would allow for hook-up to electrical and water with a permit for up to 7 days. Mr. Lehnhoff indicated the code right now is you can park an R V of any length or height without a permit for 72 hours in your driveway for the purpose ofloading and unloading, but that it cannot be hooked up to any utility. Discussion continued on whether the RV should be owned by the property owner only, or by someone else too. Mr. Scherbel indicated the City does not regulate who owns the vehicles but the number of vehicles in the driveway. Mr. Lehnhoff stated there would have do be a separate public hearing for that. ARDEN HILLS SPECIAL PLANNING COMMISSION - 11/7/07 4 , ,. Commissioner Stodola asked if the owner can also use their RV for short-term guest housing. Ms. Beekman stated that currently they cannot. It currently says that no RV shall be used for temporary or permanent living, sleeping or housekeeping purposes in the City with the exception of what was just added in Subdivision 3, that with a permit you can have someone reside in the RV for up to 7 days. She indicated that for Subdivision 2 the number ofRVs that are allowed to be stored is currently written as 3 and that includes RVs, trailers, and boats on trailers, and not more than one ofthese vehicles can be a self- propelled motorhome, travel trailer, etc. She mentioned these numbers are jnst for recreational vehicles, watercraft and trailers, not for non-lakeshore property, and asked for everyone's input on what the numbers should be. Discussion on the numbers ensued. Mr. Lehnhoff stated that from everyone's response, the average number remained at 3 and staff will move forward with that number. Ms. Beekman provided an update on the height issue because there was a misinterpretation of the existing code and how the City deals with height. Currently the City does not have any limitation on the height of an R V. If the RV is under 7 feet it can be within 5 feet of the property line and if it is over 7 feet it has to be 10 feet from the property line. She stated she did eliminate that from the proposed ordinance because after checking with several RV dealers, 7 feet was unanimously considered to be unreasonable. A standard 28 foot motor home is 12 feet in height and the maximum that is permitted to be highway legal is 13.6 feet in height. She suggests that if height is regulated that it be somewhere between 12 and 13 Yo, feet. She would like to note that it was an error in the first proposed ordinance 4. The motion carried and the meeting adjourned at 6:30 p.m. Attachment B Ordinance 2008-001 January 14, 2008, City Council Meeting CITY OF ARDEN HILLS COUNTY OF RAMSEY STATE OF MINNESOTA ORDINANCE NO. 2008-001 AN ORDINANCE RELATED TO THE OUTDOOR STORAGE OF RECREATIONAL VEHICLES, UTILITY TRAILERS, AND WATERCRAFT The Arden Hills City Council hereby repeals Section 1325.10 and ordains that Section 1305.04 Subd 136 is amended, Section 1305.04 Subd 137, Subd. 138, and Subd, 184 are added, all subsequent subdivisions shall be numbered to reflect these additions, and Section 1325.12 and its subdivisions are added in the Arden Hills City Code to read as follows: 1305.04 Subd. 136 Recreational Vehicles (RVs). Vehicles or trailers for recreational or utilitarian uses that can be driven, towed, or hauled. Including, but is not limited to, motor homes and travel trailers, snowmobiles, pull campers, all terrain vehicles (ATVs), tent trailers, special purpose trailers, utility trailers used for hauling, or other similar vehicle. A recreational vehicle( s) such as an A TV on a trailer shall constitute one recreational vehicle. Subd. 137 Height, Recreational Vehicles and Watercraft. The height of an RV or watercraft shall be measured. from the ground to the highest point of the structure not including antennas and utility/mechanical systems provided they are accessory and take up no more than ten (10) percent of the roof surface area. Subd. 138 Length, Recreational Vehicles and Watercraft. The length of an RV or watercraft shall be measured from end to end including any hitch or motor. For the purposes of measuring length, an RV or watercraft on a trailer will be measured as one vehicle. Subd.184 Watercraft. Motorized water-oriented vehicles and their trailers including, but not limited to, power boats, cruisers, jet skies, fishinglhunting boats, pontoon boats, and any non-motorized craft with greater than a two person capacity. This definition excludes non-motorized one and two person crafts such as canoes, kayaks, and paddle boats. 1325.12 Recreational Vehicle, Utility Trailer and, Watercraft Outdoor Storage. The unregulated outside parking and outside storage of recreational vehicles, utility trailers, and I watercraft within a residential use district is found to create a nuisance, hazard and detrimental influence upon the public health, safety and general welfare of the community by obstructing the view on streets and on private property, bringing noise and odors into residential areas, creating cluttered and otherwise unsightly areas, preventing the full use of residential streets for residential parking, reducing the useable open space of streets and private property and otherwise adversely affecting residential property values and neighborhood maintenance and improvement. 1325.13 Subd.l General Regulations for Recreational Vehicles (RVs) and Watercraft in All Districts. A. Storage in an Enclosed Structure. RVs and Watercraft of any height or length may be kept within an enclosed structure provided the structure conforms to the underlying zoning requirements of the district. B. Attachment to Ground Not Permitted. RVs and Watercraft shall not be permanently affixed to the ground in a manner that would prevent removal. RVs and Watercraft not permitted to be operated on public streets shall be placed on or in a trailer or motor vehicle. C. Use of RVs and Watercraft. No RV or watercraft shall be used for temporary or permanent living, sleeping or housekeeping purposes in the City. R V s and watercraft shall not be connected to sewer, water, or other utility for any period of time, unless otherwise permitted in Subd. 3B of this ordinance. D. Condition While Stored. All RVs and watercraft shall be stored or parked in a secure, safe, orderly, and well-maintained condition that does not inhibit emergency vehicle access to any property, All RVs and watercraft shall be currently licensed and operable at all times while being stored. E. Ownership. Permitted storage shall only be allowed for RVs and watercraft owned by the owner or occupant of the property on which the RV and watercraft are stored. F. No RV or watercraft shall be permitted on a vacant lot without a primary structure unless in conformance with Section 1325.1 I. Subd.2 Permitted RV and Watercraft Storage. Storing RVs and watercraft outdoors is permitted in all residential districts provided that all of the following provisions are met: 2 A. No more than three (3) RV's or watercraft may be stored on a residential lot. No more than one (1) of the three (3) RV's may be a self-propelled motor home, travel trailer, camper, or other similar type ofRV. B. RVs and watercraft shall not be more than twenty-eight (28) feet in length or twelve (12) feet in height. C. One (I) self-propelled motor home, travel trailer, camper, or other similar type of RV that is greater than twenty-eight (28) feet, but not larger than thirty-four (34) feet, in length is permitted in the rear yard of a property provided that all ofthe following criteria are met: 1. The RV meets all setback regulations in this section; 2. The rear yard is fully enclosed by a six foot privacy fence or is substantially screened from adjacent properties as determined by the Zoning Administrator; which may include fencing, vegetation, or both. D. RVs and watercraft shall not be placed within the principal structure side yard setback and shall be at least ten (10) feet from any rear property lines. If both side and rear yards are available for parking or storage, then the location with the least visibility from streets and neighboring property, as determined by the Zoning Administrator, shall be used for such storage. E. On any lot, RV s and watercraft shall not be stored closer to the front property line than the principle structure or attached garage. Additionally, in the case of corner lots the RV shall not be stored closer to the property line than the principle structure or attached garage in the side yard adjacent to the street. F. RVs or watercraft shall not be placed closer to the principle building of an adjoining lot than to the principle building on the lot where it is stored. G. RVs and watercraft stored in the side yard and visible from the public right-of-way shall be screened with a six foot privacy fence or landscaping of similar opacity as determined by the Zoning Administrator, unless they are kept on an improved hard surface. H. Alternative locations for storing an RV or watercraft on a property may be permitted by the Zoning Administrator with an Administrative Land Use Permit for up to one (I) RV or watercraft, when topographic conditions or lot configuration do not allow for the normal location regulations to be met and all of the following criteria are met: 1. The R V or watercraft is at least three feet from the side or rear property line; 3 2. This permit would allow a motor home or other similar vehicle to be connected to water and electricity. 4 Subd. 4 Riparian Residential Lots. A. In addition to RV and watercraft storage permitted by Section 1325.10 Subd 2, the owner or occupant of any riparian lot is permitted to store two (2) additional watercraft. B. RVs shall not be permitted within fifty (50) feet of the Ordinary High Water (OHW) mark of the lake. c. Watercraft shall not be permitted within ten (10) feet ofthe OHW mark of the lake and shall meet the principal structure side setback. If topographical conditions prohibit storing the watercraft at least ten (10) feet from the OHW mark, the Zoning Administrator may grant an administrative permit to allow watercraft storage closer than ten (10) from the OHW mark. The term "Watercraft" has replaced the term "Water-Oriented RV" and the definition now reads: Watercraft. Water-oriented vehicles and their trailers including, but not limited to, power boats, cruisers, jet skies, fishing/hunting boats, pontoon boats, as well as, row boats, sail boats, and other non-motorized craft with greater than two person capacity. This definition excludes non-motorized one and two person crafts such as canoes, kayaks, and paddle boats. In addition to boatlifts, non-motorized one and two person watercraft have been excluded from this definition entirely. These items will be dealt with in the Shoreline Management Code. Number of Permitted RVs and Watercraft Based on the discussion at the November 7'h work session, the number of permitted RVs and watercraft has been set at three; however, of these, only one may be a motor home or other such vehicle. On shoreline properties, the number of additionally permitted watercraft has been reduced to two. This number was reduced because the definition of watercraft no longer includes canoes, kayaks, and paddle boats. Based on this ordinance, the owner of a shoreline lot would be permitted to have up to five R V s, trailers, and watercraft. Only one ofthe RVs could be a motor home or other such vehicle. Height/Length The maximum height of any RV or watercraft has been set at twelve feet. This is the minimum height that can be regulated without functionally prohibiting motor homes and travel trailers within the City. In addition to the 28 foot maximum length, a regulation has been added that would permit one motor home to be kept on property that is between the length of 28 and 34 feet, if certain requirements are met. The new language reads as follows: A. The RV is parked on an improved surface Staff feels that under these circumstances a 34 foot RV would be reasonably screened and the negative impacts on surrounding property owners and the community mitigated. Short-Term Utility Connections The ordinance has been changed to allow, with a permit renewable once during a twelve month period, a motor home or other similar vehicle to be used for temporary living purposes and be connected to water and electrical utilities for a period not to exceed seven days. The vehicle would also be required to be parked in the driveway of the property it is being stored on, at least five feet from any property line, and fifteen feet from the curb. The language of the code would require a City issued permit in order to connect the RV to water and/or electrical utilities and to use the RV for sleeping purposes for any amount of time up to seven days. Administrative Permit Criteria The administrative permit process has been added to the proposed ordinance. The regulation reads as follows: B. Alternative locations for storing an RV or watercraft on a property will be permitted by the Zoning Administrator with an administrative permit for up to one (1) RV or watercraft, when topographic conditions or lot configuration do not allow for the normal location regulations to be met and all of the following criteria are met: 1. Depending on lot configuration, the Zoning Administrator will determine where on the lot is most appropriate for RV or watercraft storage. 2. The RV or watercraft shall not be stored forward of the principal structure This process will allow property owners to be issued a permit to store their RV s and watercraft in alternative locations under specific circumstances. Property owners would not be able to store an RV or watercraft in the front driveway. A proposed RV ordinance was drafted and presented to the Planning Commission at the October 3, 2007, Planning Commission meeting. A work session was held prior to the November 7, 2007, meeting to further discuss specific regulations and concerns raised by the Commissioners at the October 3, 2007, meeting. Some discussion took place and additional questions were raised. At the November 7, 2007 regular Planning Commission Meeting, another public hearing was held and the Planning Commission voted unanimously to again table the R V ordinance. A change to the Zoning Code requires a public hearing before the Planning Commission and approval from 4/5 of the City Council. The Zoning Code change would go into effect upon publication in the official City newspaper. Notice Notice was published in the Shoreview-Arden Hills Bulletin. Staff has received a few e-mails and telephone calls from property owners or occupants in regard to this planning case, in addition to those received at the October 3, 2007 and November 7, 2007 Planning Commission meeting.
